The Indian legislature has enacted the Sexual Harassment of Women at Workplace (Prevenon, Prohibion and Redressal) Act, 2013 w.e.f. 23.04.2013. This Act aims at protecon against sexual harassment of women at workplace, to provide mechanism for prevenon and Redressal of complaints, and to safeguard a woman's right to live with dignity, right to pracce any profession or to carry on any occupaon, trade or business and a right to a safe environment free from sexual harassment. This write-up aims to familiarize us with a few of the important definions and provisions contained in the act that are there to empower and benefit us.

The Act states very clearly in Secon 3 that ̀ No woman shall be subjected to sexual harassment at any workplace'

This gives right to some important quesons which are addressed by the Act, namely,

1. What is sexual harassment?2. What is a ̀ workplace'?3. Who is an ̀ Aggrieved Woman'?4. What are the remedies available to an ̀ aggrieved woman'?

As per the Act, “sexual harassment” includes any one or more of the following unwelcome acts or behavior (whether directly or by implicaon) namely:-

i. Physical contract and advances; orii. a demand or request for sexual favours; oriii. making sexually colored remarks; or iv. showing pornography; orv. any other unwelcome physical, verbal or non-verbal conduct of sexual nature;

It is important to note that sexual harassment is not just physical harassment of unwelcome contact and advances. Anything at work that places the working woman at disadvantage compared to other male employees in her official career just because she is a woman and which is discriminatory and unwelcome to her, can be termed as sexual harassment. `Incidental Harassment' is a form of sexual harassment which includes- (i) promise of preferenal treatment (ii) threat of detrimental treatment (iii) threat about her present or future employment status; or (iv) interferes with her work or creang an inmidang or offensive or hosle work environment for her; or (v) humiliang treatment likely to affect her health or safety. The important point in all of the above is that the Act is ̀ unwelcome' to the woman. Some examples of harassment include Denial of payment or official approval in the absence of sexual favors; Pornographic pictures/messages displayed on desks or sent by email; Remarks made about personal appearance and dress; Colored jokes shared in the office that make others present feel uncomfortable.

Any woman, of any age, whether she is employed or not, who alleges that she has been sexually harassed is an `aggrieved woman' under the Act who has a legal right to demand recourse under the Act for the same. Even our domesc help/ maids who work in our houses are covered under the Act. Their Workplace is the house that they are working in, and we as their employer have a legal duty to provide a safe working environment for them which is not hosle.

The other important aspect of Secon 3 (quoted above) is the use of the word `any workplace'. The definion of

`workplace' under the act is very exhausve and covers almost all establishments and offices including all private

companies and private ventures; all departments, organizaons, undertakings, establishments enterprises,

instuons, offices, branches or units with backing by the Government or a local authority or co-operave society. It

includes hospitals and nursing homes, sports instutes, gym, training grounds and other related places, and very

44

importantly, it also includes any place visited by the employee arising out of or during the course of

employment including transportaon provided by the employer for undertaking such journey.

Therefore, the responsibility of your organizaon does not end at the office. It extends to all the places

you have to visit in the course of duty/ on an official tour. Also, you, being a woman, are protected at

ANY workplace, and not just your own office and organizaon. So for example- if you got to a hospital,

which is a workplace under the Act, the hospital has a duty to provide you with a safe environment.

LODGING A COMPLAINT

Under Secon 4 of the Act, All administrave units, offices or workplace, employing 10 or more than 10

workers have to constute an Internal Complaints Commiee (ICC) of minimum 4 members, which

shall be presided by a senior woman employee of the company and shall consist of people who are

known to fight for the cause of women. For places employing less than 10, a Local Complaints

Commiee (LCC) shall be set up at the District level, which can be approached.

Any aggrieved woman can make a complaint to the ICC or LCC within three months from the date of

incident. The first step aer instung a complaint is Conciliaon. The ICC/LCC will try to facilitate

conciliaon between the pares and try to reach a selement. There is no monetary compensaon in a

selement. However, if no selement can be arrived at, or if the selement is violated, an inquiry will

be instuted to look into the maer as per the applicable service rules. If there are no service rules for

the same then complaint will be forwarded for inquiry to the Police. Both sides will be given equal

opportunity to be heard and make submissions. However, giving of false evidence will be punishable.

During the pendency of inquiry, if deemed fit, the aggrieved woman may be recommended for transfer

to another unit, leave for 3 months or any other relief.

RELIEF:

The inquiry has to be completed in 90 days and any acon thereupon must be taken within 60 days from

date of compleon. If the allegaon of sexual harassment is proved to be true, appropriate acon as per

the Service rules of the Employer may be taken. Addionally, any sum as deemed fit may be deducted

from the harassers salary/wages to be paid as compensaon to the aggrieved woman or her legal heirs.

It is pernent to note that if, however, it is determined that the complaint had been made falsely, or with

malicious intent, the complainant will also be liable to punishment as per the service rules.

Therefore, we must read our Service rules and ensure that adequate provisions for the safety of women

are included therein. Moreover, while it is important for us to be aware of our rights, it is equally

important to be aware of our duty under the Act of not misusing the law. This is just a board overview of

the Act, the whole Act is available on the website of Ministry of Women and Child Development, Govt.,

of India at hp:/wcd.nic.in/wcdact/womenactsex.pdf.
