Please accept this correspondence in follow-up to our transmittal dated July 30, 2014 regarding consideration for escalated enforcement action in the above referenced matter. More importantly,

please accept this as our written confirmation that the proposed measures taken for remedy and correction of the apparent violation have been successfully accomplished and decommissioning as required in accordance with 10 CFR 30.36 (et seq.) is complete.

Summary of Events

On August 12, 2014 a visual inspection of the site and measurements for the existence of removable surface contamination was conducted by David Rhoe, Consultant for the purpose of completion of the Radiation Safety Close Out Survey along with recommendations for transporting and shipping the 55 gallon metal drum containing the stored materials. Due to

concern for the integrity of the existing container an 85 gallon steel over pack drum was purchased from RAC Enterprises, LLC and delivered to Mr. Rhoe.

On August 13, 2014, Mr. Rhoe returned to the site with the results of the Radiation Safety Close Out Survey and the existing drum was placed in the over pack container and sealed for shipment using locked-in-place security closures and transported by Mr. Rhoe and Kelvin A. Massey to the FEDEX airport facility for shipment.

Upon completion of form UN2910 by Mr. Rhoe and acceptance by the FEDEX agent, the container was shipped international priority freight to R. M. Wester and Associates, Inc., 215 Indacom Drive, St. Peters, MO 63376, via Airway Bill# 8021 5485 7340.

Per online FED EX tracking information, the container was delivered and accepted by Joseph Koch on behalf of the recipient at 9:11AM on August 14, 2014.

Confirmation of receipt and acceptance is provided in the attached letter dated August 15, 2014 from the Joseph D. Koch, PhD, RPID on behalf of the recipient.

Finally, after telephone conversations with your agency regarding the above, NRC form 314 Certificate of Disposition of Materials has been completed and included among the attachments.
