As provided in WIA [section 129 (c) (2) (D)] and [20 CFR §664470], work experiences may be paid or unpaid; (b) work experience workplaces may be in the private, for-profit sector, the non-profit sector, or the public sector.

Service Providers currently under contract with Workforce Connections and receiving WIA Title I formula funds shall follow this policy. Service Providers may establish written internal procedures that meet the requirements of this policy. This policy applies to all Workforce Connections' Service Providers providing WIA Title I funds services to Youth.

Policy: Workforce Connections has established that successful implementation of work experiences and summer Youth employment opportunities will be appropriate when the need for such activities has been identified in the Individual Service Strategy- (ISS) wherein the participant's interests, abilities, and needs have been also identified. Therefore, the following guidelines are designed to assist Workforce Connections' Service Providers in the planning and execution of a work experience (WEX) program activity. The guidelines will also assist in meeting local regulations which require that, to be permissible, costs incurred in the WEX program activity must be necessary, reasonable, and allowable.

I. General provisions for Work Experience (WEX)

A. Work experience is a planned, structured learning experience that takes place in a worksite for a limited period of time that is solely based upon identified needs of the youth program participant. A WEX worksite may be in the private for-profit sector, the non-profit sector, or the public sector. Work experiences may be subsidized and unsubsidized. [20 CFR §664.460]

1. Work experiences are designed to enable youth participants to gain exposure to the working world requirements.

2. Work experiences are appropriate and desirable activities for many youth participants throughout the program year.

3. Work experiences should help youth participants acquire the personal attributes, knowledge, and skills needed to obtain a job and advance in employment.

4. Work experiences main purpose is to provide the youth participant with the opportunities for career exploration and skill development and is not to benefit the employer.

5. In addition, other elements and strategies are provided to serve the needs and goals of the youth participant such as: a) Instruction in employability skills or generic workplace skills; b) Exposure to various aspects of an industry; c) Progressively more complex tasks; d) Internships and job shadowing; e) The integration of basic academic skills into work activities; f) Supported work, work adjustment, and other transition activities; g) Entrepreneurship; h) Service learning; i) Unpaid community service; and j) Other elements designed to achieve the goals of work experience.

Note: 1. The on-the-job training is not an appropriate work experience activity for younger youth participants (14-17). Local program operators may choose, however, to use this service strategy for eligible older youth (18-21) when appropriate and based on the needs identified by the objective assessment and as documented in the ISS.

B. Work Experience Wages: WEX program participants shall be paid an hourly wage for hours worked, and shall be compensated at the same rates as trainees or employees who are similarly situated in similar occupations by the same employer and who have similar training, experience, and skills, and such rates shall be in accordance with applicable law, but in no event less than the higher of the rate specified in section 6(a)(1) of the Fair Labor Standards Act of1938 (FLSA) (29 U.S.C. 206 (a) (1)) or the applicable State or local minimum wage law, [PL 105-220 Sec. 181 (a) (1) (A)]; [20 CFR §667.272].

1. The U.S. Department of Labor's Wage and Hour Division (WHD) has developed the six ( 6) factors below to evaluate whether a worker is a trainee or an employee for purposes of the FLSA:

a) The training, even though it includes actual operation of the facilities of the employer, is similar to what would be given in a vocational school or academic educational instruction;

b) The training is for the benefit of the trainees;

c) The trainees do not displace regular employees, but work under their close observation;

d) The employer that provides the training derives no immediate advantage from the activities of the trainees, and on occasion the employer's operations may actually be impeded;

e) The trainees are not necessarily entitled to a job at the conclusion of the training period; and

t) The employer and the trainees understand that the trainees are not entitled to wages for the time spent in training.

2. If all of the factors listed above are met, the worker is a "trainee", an employment relationship does not exist under the FLSA, and the FLSA's minimum wage and overtime provisions do not apply to the worker. Because the FLSA's definition of "employee" is broad, the excluded category of "trainee" is necessarily quite narrow. Moreover, the fact that an employer labels a worker as a trainee and the worker's activities as training, and/ or a State unemployment compensation program develops what it calls a training program and describes the unemployed workers who participate as trainees, does not make the worker a trainee for the purpose of the FLSA unless the six (6) factors are met. C. Unemployment Insurance (UI) Benefits:

A youth participant receiving work training, such as a funded WIA Title I work experience activity, is not to be considered an employed individual for the purpose of being able to qualify for unemployment insurance benefits, even though they might be on a regular payroll, receiving wages, and are considered employed under FLSA. Therefore, a youth participant placed in a WEX, then filing for unemployment insurance, will not be eligible on the basis of the work experience. Nevertheless, work experience wages are counted as earnings when a youth participant is currently on a UI claim. This income has the potential to affect the amount and duration of the UI claim on the basis of the work experience.

D. Work Experiences are provided under a worksite agreement in the private for-profit sector, the non-profit sector, or the public sector. Prior to entering into an agreement an assessment must be conducted to ensure that the employer and/ or worksite meets the minimum standards and can properly provide adequate training to Youth participants.

1. The employer/worksite assessment must include at a minimum: Compliance: a) Federal, State and local regulations b) Fair Labor Standards Act of 1938 c) Non-discrimination and Equal opportunity provisions of the Workforce

Investment Act (WIA) and its regulations [PL 105-220 sec. 188] d) Americans with Disability Act e) Health and safety standards t) Worksite summary and profile

2. Safety and Child Labor Laws/Work Permits The Worksite: a) General worksite safety is to be monitored by the youth service provider. Any

identified issue(s) must be immediately reported to WCs' Youth oversight staff. b) Non-Discrimination and Equal Opportunity: WIA Sec. 188 prohibits

discrimination on the grounds of race, color, religion, sex, national origin, age, disability, political affiliation or belief. An organization that agrees to be worksite and host a work experience for a Youth participant should be aware of obligations imposed by WIA law, and must ensure compliance.

c) Worksite must ensure, when applicable, that they will adhere to Child Labor Laws and OSHA compliance.

d) Any worksite accident must be reported immediately by the Youth program participant to their worksite supervisor and to WIA staff, Service Providers must implement written and very specific procedures to ensure that all reporting is properly done and in a timely accurate manner.

e) Service Providers must maintain worker's compensation insurance for each Youth participant placed in a work experience program and are not allowed to provide this program element unless worker's compensation insurance is in place.

t) Service Providers must ensure that work permits (youth 14 - 17) are in place. A copy of the work permit must become part of the program participant's file.

g) Worksite needs to have a clear understanding and expectation of the skills needs, interests, and attitudes/habits that the Youth participant may exhibit.

h) Effort shall be made to place Youth participants at a worksite that matches the Youth participant interest and abilities.

i) The worksite must provide general liability insurance coverage. j) Worksite must ensure that Youth pa1ticipants mav not be involved in religious

sectarian instructions or activities while participation on a work experience. k) Worksite must ensure that Youth pa1ticipants may not be involved in political

activities of any form while participation on a work exverience. ~

E. Duration of Work Experience and Hours Limitation:

Addendum-1 Continuation

1. The total maximum number of hours for each subsidized work experience must not exceed 320 hours.

2. Subsidized work experiences during the school year for in-school Youth and for all Youth who have not yet attained their GED or High School Diploma must not exceed six ( 6) hours per day and total 20 hours per week.

3. Participant youth shall not be placed in more than two (2) subsidized work experiences during the WIA program year.

4. Work experience must be limited to a period of time that is reasonable in duration. The length of the work experience assignment is to be based on the needs of the Youth participant and actual purpose of placing the Youth participant in a WEX. These elements must be addressed on the participant's ISS.

5. Neither overtime nor overtime pay is allowed. As previously indicated Child Labor Laws must be observed when scheduling work hours for youth participants under 18 years of age.

6. In the event there might be an exception, a written notice/request must be submitted to WC oversight staff. Source support documentation must be attached, if applicable, as well as proper justification.

II. Work Experience The Worksite Agreement:

A. The purpose of the worksite agreement is to establish a formal working relationship with a worksite, to specify the responsibilities of each party to the agreement, and to provide a successful, enriching work experience for Youth program participants. A properly signed and dated original of the worksite agreement must become part of the program participant's file.

B. The worksite agreement must be fully executed and will not be considered valid unless it is properly signed and dated by both the employer and the Service Provider authorized representative(s).

C. Service Provider and program participant shall mutually review and determine the feasibility of utilizing a work experience activity. The activity must focus on the development of appropriate work habits and work ethics to include an understanding of employer/employee relationship. The work experience must focus on career exploration, skill development, and/or skills needed to obtain a job. The worksite agreement shall reflect these elements in alignment with the Youth participant objective assessment and ~- ~

D. General provisions for the work experience worksite agreement: Prior to the Youth participant commencing the work experience program a worksite agreement must be in place. The agreement must include the following provisions:

IV. Summer Work Experience - Prerequisites.

As part of the ten program elements offered to Youth participants, a WEX is not intended as a stand-alone program activity and must be tied to an objective in the Individual Service Strategy (ISS). Summer work experiences must provide direct linkages to academic and occupational learning. Workforce Connections has established guidelines for in-school and out-of-school Youth participants.

In-School Youth Participant must be enrolled and attending summer school, if determined credit deficient. If Youth participant drops out of school, WEX immediately terminates.

General Terms and Conditions

I. PURPOSE OF WEX AGREEMENT. The purpose of this agreement is to establish the general terms and conditions under which [Service Provider Name] may refer to [Youth Name], identified eligible WIA Title I Youth program participant, to enable him/her to take part in the work experience program as the term is defined under the Workforce Investment Act (WIA).

II. WORK EXPERIENCE (WEX) DEFINED. As written in [20 CFR §664460] (a) work experiences are planned, structured learning experiences that take place in a workplace for a limited period of time. As provided in [WIA section 129 (c) (2) (D)] and [20 CFR §664.470] work experiences may be paid and unpaid; (b) Work experiences workplaces may be in the private, for-profit sector; the non-profit sector; or the public sector.

III. STATEMENT OF WEX. The worksite agrees to: 1) provide a WEX orientation to the WIA participant(s) as related to the worksite policies, job safety, and WEX expectation; 2) ensure that the work policies and WEX expectations for WIA Youth participant(s) must be the same as for non-WIA workers at the worksite; 3) provide highly qualified supervision to WIA Youth participant(s) at all times; 4) designate an alternative supervisory authority; 5) provide all necessary equipment, supplies and/ or materials and shall provide sufficient duties to enable the WIA Youth participant(s) to carry out work assignments; 6) conduct evaluations for the WIA Youth participant(s) as established by the WIA Service Provider; 7) maintain accurate record of each WIA Youth participant's time and attendance (including start and stop times and total hours worked) as established by WIA Service Provider; 8) make all records related to WIA Youth participant(s) available for inspection upon reasonable notice request form WIA Service Provider or such other entity identified under WIA Title I as having fiscal or programmatic responsibility for the work experience, and such records shall be retained for no less than three (3) years, WC PolicyYTH-040-05; 9) ensure that duties/assignments at the worksite correspond to those described on this agreement as specified by WIA Service Provider; 10) report immediately to WIA Service Provider any issue/concern involving the WIA Youth participant(s) termination of work experience.

IV. WORKSITE ASSURANCES. A. NON-DISCRIMINATION AND EQUAL OPPORTUNITY: WIA Sec. 188 prohibits

discrimination on the grounds of race, color, religion, sex, national origin, age, disability, political affiliation or belief. An organization that agrees to be a worksite and host a work experience for a Youth participant should be aware of obligations imposed by WIA law, and must ensure compliance.

B. GRIEVANCE PROCEDURE: The worksite will use its own written grievance procedures to resolve non-WIA related problems that may arise between worksite and the Youth participant(s). All WIAprogram-related grievances that may arise between the worksite and the Youth participant(s) will be resolved in accordance to WC Policy GEN-050-01, Equal Opportunity and Grievance Process.

C. WORKERS' COMPENSATION. Worksite must provide workers' compensation insurance at worksite's sole cost and expense. Neither the worksite not its carrier shall be entitled to recover any costs, settlements, or expenses of workers' compensation claims arising out of this agreement. Worksite shall provide evidence of this insurance coverage to Service Provider /Workforce Connections upon request.

D. WORKSITE CERTIFIES that it will immediately report to WIA Service provider any work related injury or incident involving the WIA Youth participant(s) under this agreement.

E. GENERAL LIABILITY INSURANCE - Worksite must provide comprehensive general liability insurance protection to Youth participant(s), and, if the participant(s) will operate a motor vehicle as part of his/her responsibility, worksite must provide comprehensive vehicle liability insurance as well.

F. ACCESS - Any entity identified under WIA Title I as having fiscal or programmatic responsibility for a work experience established under this agreement (including but not limited to the Federal, State and local governments, and Workforce Connections' staff) may have access to the worksite and to the Youth participant(s) to assure that progress and quality of WEX are in compliance with the terms of this agreement.

G. WORKSITE MUST ensure that Youth participants are not involved in religious sectarian instructions or activities while participation on the work experience under this agreement.

H. WORKSITE MUST ENSURE that youth participants will not be involved in political activities of any form while participating in this work experience and under this agreement.

I. WORKSITE CERTIFIES that it will comply with all, Federal, State and local laws and ordinances. The worksite assures that they have not violated any of the following within the last three (3) years: a) anti-discrimination statutes; b) labor and employment laws; c) environmental laws; d) health and safety laws [29 CFR Part 37].

J. WORKSITE CERTIFIES that any or all worksite personnel involved in the work experience under this agreement will not provide transportation to WIA Youth participant(s) in a privately owned vehicle.

K. WORKSITE CERTIFIES that the WEX Youth participant(s) will not displace any regular employee of employer, and certifies that no person was displaced as a result of relocation of the current business in the previous 120 days of signing this agreement.

L. WORKSITE AGREES to indemnify and hold harmless the WIA Service Provider for and against any damage(s) or liability arising out of reliance upon misrepresentation of documentation.

M. WORKSITE AGREES to protect, indemnify and hold WIA Service Provider, its officers, employees and agents harmless from and against any and all claims, demands, damages, losses, expenses, suits, actions, decrees, judgments, awards, attorney fees and court costs which our organization, its officers, employees, or agents may suffer or which may be sought against, or are recovered or obtainable from by reason of, or as a consequence of any act or omission, negligent or otherwise, of the worksite, its officers, employees or agents, including the participant under control and supervision and acting under the direction of the worksite agency, in the performance of any of the services that form the subject matter of this agreement.

N. WORKSITE CERTIFIES that it will not receive any type of compensation for participation and/ or provision of the work experience to WIA Youth participant(s ).

O. MODIFICATION AND TERMINATIONS - This AGREEEMENT is subject to modification or termination due to actions taken by the Federal, State, or local government that result in a frustration of AGREEMENT purpose. Such actions include, but are not limited to withdrawal of WIA funding by the United States Congress.

P. EITHER PARTY for any reason upon ten (10) working days written notice to the other may terminate this AGREEMENT.

V. WIA Title I - YOUTH SERVICE PROVIDER ASSURANCES A. NON-DISCRIMINATION AND EQUAL OPPORTUNITY: WIA Sec. 188 prohibits

discrimination on the grounds of race, color, religion, sex, national origin, age, disability, political affiliation or belief. WIA Youth Service Provider must be in compliance with WC Policy YTH-040-06, Equal Opportunity, and must provide continuing notice that they do not discriminate on any prohibited grounds.

B. GRIEVANCE PROCEDURE: WIA Youth Service Provider will use its own written grievance procedures, WC Policy GEN-050-01, to resolve any WIA program related grievances that may arise between the worksite and the Youth participant(s) will be resolved in accordance to WC Policy GEN-050-01, Equal Opportunity and Grievance process.

C. WORKERS' COMPENSATION: WIA Youth Service Provider certifies that it will provide workers' compensation insurance to Youth program participant(s). WIA Youth Service Provider shall provide evidence of this insurance coverage to Workforce Connections upon request.

D. GENERAL LIABILITY INSURANCE: WIA Youth Service Provider certifies that it will provide comprehensive general liability insurance protection to Youth participant(s). WIA Youth Service Provider shall provide evidence of this insurance coverage to Workforce Connections upon request.

E. WIA YOUTH SERVICE PROVIDER CERTIFIES that any or all personnel involved in the work experience under this agreement will not provide transportation to WIA Youth participant(s) in a privately owned vehicle.

F. ACCESS: Any entity identified under WIA Title I as having fiscal or programmatic responsibility for a work experience established under this agreement (including but not limited to the Federal, State and local governments, and Workforce Connections' staff) may have access to the worksite and to the Youth participant(s) to assure that progress and quality of WEX are in compliance with the terms of this agreement.

G. WIA YOUTH SERVICE PROVIDER CERTIFIES that: 1) WILL CLOSELY MONITOR the work experience program activity as well as the Youth participant's progress; 2) WILL ASSIST worksite with conducting evaluation of the Youth participant; 3) WILL SUPPLY the worksite with required forms, procedures for maintaining WEX participant(s) records and instructions of required reporting information; 4) WILL PROVIDE supportive services as may be required by each WEX participant, if applicable and allowable; 5) WILL ASSIST worksite with WIA staff in the resolution of work experience issues, personal issues, performance issues that may affect the overall accomplishment of the WEX; 6) WILL CLOSELY supervise that accurate time and attendance records will be kept by the worksite and that all related WEX documents will become part of the Youth participant's file; 7) WILL ENSURE that Youth participant will not work at the worksite under WEX past the end date stated on this agreement; 8) SHALL PAY a wage to Youth participant only when participating in this work experience. The wage to be paid will be the current minimum wage; the intent is to provide work experience and exposure to the world of work. WIA Youth participant will be only paid for actual WEX hours; no pay will be given for lunch breaks, holidays or absences. Overtime is not allowed; 9) WILL ENSURE that the worksite is in compliance with safety guidelines and applicable Federal, State and local laws; 10) WILL ENSURE that WEX participant time cards will be processed accurately and in a timely manner; 11) EITHER PARTY for, any reason, upon ten (10) working days' written notice to the other, may terminate this agreement.
