• Mathias Schindler• Joined Wikipedia in 2003• Co-Founder of Wikimedia Germany in 2004• Working at the German National Library in

2008• Full time employee at Wikimedia since 2009

German Federal Archives

• State agency operating under legal mandate• Legal deposit for state owned/created material

after being no longer actively used in adminstration

• ~10 million images, a smaller part being already available in digital form

• Had started www.bild.bundesarchiv.de in 2007, which prompted us (=Wikimedia Germany) to initiate contact

Negotiation

• Negotiations took about 12 months• Critical points were licensing and image size• Requirements: Free License, allowing anyone

to use and distribute and modify the content• Including commercial usage• Without time or space restriction

The Agreement

• Partnership in making 100.000 images available under Creative Commons cc-by-sa

• Images were reduced to 800pixel on their larger side (we practically negotiated for every single pixel)

• Building a structure to match authority file records from the Archive, the German National Library and Wikipedia

• Reporting of corrections being found

Victim of its success

• Requests to the Federal Archive increased 200%• No additional staff for handling the requests at

the institution• Additional revenue had to be given to Treasury• Lots and lots of image usage without proper

compliance to the terms of the Creative Commons license (outside Wikimedia Commons)

Policy recommendation

• Images created by public institutions /administration should be released with no or little restrictions, we favour the PD-GOV concept

• In the meantime, cc-by-sa licensing terms are acceptable, image size restriction should be avoided

• A special focus should be given to meta-data in all formats
