    Information about this guide

    This guide will help you to complete the form Work Visa Application (INZ 1015). It will give you informationabout coming to New Zealand to work and help you tounderstand the requirements you need to meet if youwant to work in New Zealand.

    You should read this guide before completing theapplication form. The guide gives you information about:

    how to decide which visa you need to apply forwhat evidence you need to provide with yourapplication formwhat to do if you want to later apply for residence inNew Zealand.

    Do you need a visa to work in New Zealand?

    You do not need a work visa to work in New Zealand if one ofthe following applies to you.

    You are a New Zealand citizen.You hold a New Zealand residence class visa.You hold a special temporary (diplomatic, consular orofficial) visa.

    You hold a military visa.You are intending to undertake work in New Zealand that isnot considered to be employment (see What work is notconsidered to be employment? on page 2).

    If you are the holder of a current Australian permanentresidence visa or a current Australian resident return visa, youdo not need a visa to travel to New Zealand. You must applyfor a resident visa on arrival. You will do this by completing anarrival card on the aircraft/ship on your way to New Zealand.

    GENERAL INFORMATION

    What is a visa and what does it allow?

    A work visa allows you to work in New Zealand fora limited amount of time.

    You can apply for a work visa before travelling toNew Zealand. A work visa granted offshore willallow you to travel to the New Zealand border.When you arrive, an immigration officer will checkthat you meet all the conditions of your visa to begranted entry permission to work in New Zealand.

    You can also apply for a work visa once youare already in New Zealand. Whether you applyonshore or offshore, your work visa may includetravel conditions allowing a single entry (validfor one journey) or multiple entry (valid for morethan one journey).

    A work visa may be endorsed in your passport ormay be granted electronically, in which case youneed to have and keep a printed copy.

    What is on a work visa?

    A work visa will state the expiry date of your visa,the expiry date of your travel conditions (if youhave any), and the conditions of your visa. Theconditions may include:

    the type of employment

    the employers namewhere in New Zealand you can work.

    What is employment?

    Employment includes self-employment and meansany activity undertaken for gain or reward,except for those activities described below underWhat work is not considered to be employment?

    Gain or reward includes any payment or benefitthat can be valued in terms of money, such asboard and lodging, goods (eg food or clothing)and services (eg transport). This applies whether

    the payment or benefit for the activity isprovided by a New Zealand citizen or residenceclass visa holder or an overseas resident.

    Employment in New Zealand includes employmenton board any vessel within New Zealandsterritorial sea or any vessel registered inNew Zealand operating within New Zealandsexclusive economic zone. If a research vesseloperating within New Zealands territorial seais not registered in New Zealand, it must haveformal consent from the New Zealand Ministry of

    Foreign Affairs and Trade before undertaking anyresearch.

    Commercial sexual services

    No person who holds a temporary visa (including awork visa) or limited visa may provide commercialsexual services, or operate or invest in a businesswhich provides commercial sexual services.

    What work is not considered to beemployment?

    There are some kinds of work that we do notconsider to be employment under immigrationinstructions. You may undertake these activitieswhile holding a visitor visa. You will only have toget a work visa if there is a time limit on the

    activity you are engaged in, and you need to be inNew Zealand for a longer period.

    These are the activities that we do not considerto be employment.

    Representation on an official trade missionrecognised by the New Zealand Government.Employment as a sales representative of anoverseas company in New Zealand for a period orperiods no longer than a total of three months inany calendar year.Activity in New Zealand as an overseas buyer ofNew Zealand goods or services for a period orperiods no longer than a total of three months

    in any calendar year.Official business in the service of anygovernment, or of any inter-governmental orinternational organisation that is entitled toany privileges and immunities under theDiplomatic Privileges and Immunities Act 1968.Business consultations or negotiations inNew Zealand on establishing, expanding, orwinding up any business enterprise inNew Zealand, or carrying on any business inNew Zealand, involving the authorisedrepresentatives of any overseas company, bodyor person for a period or periods no longer thana total of three months in any calendar year.Study or training under a scholarship or otheraward recognised by the Minister of Immigration.

    Who can you include in yourapplication?

    You cannot include anyone else on your applicationform. If your partner, your children, your parent/ legal guardian, or anyone else will accompany youto New Zealand, they must apply separately for thetype of visa they need.

    Part-time work

    If you are a visitor or student in New Zealand andwish to work part time, you may apply for a variation

    of conditions. You will need to complete the form Application for a Variation of Conditions or aVariation of Travel Conditions (INZ 1020) .

    How long can you stay and work inNew Zealand?

    Some work instructions specify the durationthat visas can be granted for, others are linkedto the duration of your offer of employment. Ifno maximum stay is specified in the informationon specific instructions (see pages 4 - 10), workvisas can be granted for a maximum stay ofthree years. The exception to this is visas forhighly skilled people granted under EssentialSkills Instructions, which can be for a maximumduration of five years (see page 5).

    If your work visa is nearing expiry, you can applyfor a further visa. There is no limit on the numberof further visas you may obtain, however therequirements of the instructions that youapply under must continue to be met. For someinstructions (such as Essential Skills WorkInstructions), this will include a labour marketcheck to find out whether any New Zealandcitizens or residence class visa holders havebecome available to take up the position for

    which you are applying for a work visa.

    How much does a work visa cost?

    Our New Zealand branches do not accept cash.Most of our branches outside New Zealand donot accept cash.

    What rules must employers meet?

    All employers who want to employ foreignworkers or students to work in New Zealandmust comply with relevant employment andimmigration law. Generally, this includes:

    paying employees no less than the appropriateadult or youth minimum wage or othercontracted industry standard

    meeting holiday and special leave requirementsor other minimum statutory criteria, egoccupational safety and health obligationsonly employing people who have authority to

    work in New Zealand.Under some instructions, the rules may beslightly different.

    An employer may not employ a person whoholds a temporary visa or limited visa to providecommercial sexual services.

    Will you be eligible for publicly-funded health care in New Zealand?

    The Ministry of Health determines eligibility forpublicly-funded health care in New Zealand. To

    see if you are eligible visit the Ministry of Healthwebsite www.health.govt.nz/eligibility.

    People covered by New Zealands reciprocalhealth agreements with Australia and theUnited Kingdom are entitled to publicly-fundedhealth care for immediately necessary medicaltreatment only.

    If you seek health care when you are in New Zealandyou should carry your passport so that healthproviders can check whether you are eligiblefor publicly-funded health care. We stronglyrecommend that you arrange comprehensivehealth insurance for your stay in New Zealand.

    Importing your car, boat, and/orhousehold items

    You may be able to bring your car, boat, and/orhousehold items to New Zealand free of Customscharges. For detailed information on restrictions,and to find out if you must pay Customs charges,see the New Zealand Customs Service websitewww.customs.govt.nz.     VisaView

    It is an offence to employ a person who is notentitled to work in New Zealand. One way foremployers to avoid committing this offence isto check a persons entitlement to work withImmigration New Zealands online VisaView system.The sharing of information through VisaView isauthorised by legislation.

    their studies and get practical experiencesuitable to their qualification. See page 7.

    Specific Purpose or Event Instructions allowpeople to come to New Zealand to work at a

    specific purpose or event for a particular period.See page 8.

    Horticulture and Viticulture Seasonal WorkStream includes a number of special instructionsrelated to horticulture and viticulture seasonalwork (planting, maintaining, harvesting, or packingcrops). You cannot apply for a visa under theseinstructions using the Work Visa Application . Formore information about these instructions, seewww.immigration.govt.nz/work.

    Religious Worker Instructions facilitate the entryof religious workers to provide New Zealandcommunities the opportunity to practise,

    maintain and advance their religious beliefs. Seepage 9.

    Crew of Foreign Chartered Fishing VesselsInstructions provide for the grant of work visasto foreign crew on foreign chartered fishingvessels. See page 9.

    Students and Trainees Instructions facilitate theentry of certain overseas students and traineesto gain practical work experience in New Zealandas part of their studies. See page 9.

    Silver Fern Practical Experience Instructionsprovide for the grant of work visas to young,highly-skilled people from overseas who hold aSilver Fern Job Search visa (or a first Silver FernPractical Experience work visa) and have foundskilled employment in New Zealand. See page 10.

    Free Trade Agreement special work instructions facilitate the entry of nationals of certain countrieswho are qualified and experienced in specificoccupations and who have a genuine New Zealand

    job offer in that occupation. See page 10.

    Requirements for all visas basedon employment

    If you are applying for a work visa based ona job offer in New Zealand, you must providedetails of your employment, including an offer ofemployment in writing. All offers of employmentmust contain:

    the name, address, telephone and/or faxnumber of the employer, andthe name and address of the person to whomthe job is offered, anda full job description.

    If you believe that an employer has been giventhe wrong entitlement information via VisaViewyou may contact the Immigration ContactCentre (0508 558 855) to request correction ofthat information.

    Interim visas

    If you are currently in New Zealand, hold a validtemporary visa and have an application for afurther work visa being considered by INZ, youmay be eligible for an interim visa. We will make adecision on whether to grant you an interim visaclose to the day your current visa expires and willinform you by email or letter. You cannot apply foran interim visa, and there are no fees or forms forinterim visas.

    There is no guarantee that you will be grantedan interim visa and if you are the conditions(including whether or not you can work) willdepend on the type of visa you hold and the typeof application you have made. Interim visas donot have travel conditions and are valid for amaximum of six months or until a decision is madeon your application whichever is earlier.

    WHAT DIFFERENTINSTR CTIONS CAN OAPPL NDER?Essential Skills Work Instructions allow peopleto work temporarily in New Zealand, in areaswhere we need people to fill shortages whereNew Zealanders are not available. See page 5.

    Work to Residence Instructions allow peoplewhose skills and talents we want to work inNew Zealand, and provide them with a way to getresidence in New Zealand. See page 6.

    Partnership Instructions allow the partnersof New Zealand citizens or residents, and thepartners of people who hold work or student visasto work temporarily in New Zealand. You shoulduse the form Partnership-Based Temporary Visa Application (INZ 1198) to make an applicationfor a partnership visa. The Partnership-BasedTemporary Visa Guide (INZ 1199) contains moreinformation about the requirements and evidencefor a partnership visa.

    Study to Work Instructions include GraduateJob Search Work Visa Instructions, and allowoverseas students who have completed aqualification in New Zealand to work here after

    The job description must include all of the following.

    Job title or designation.Address of the place of employment if differentfrom employers address.Type of work, duties and responsibilities involved.Details of pay and conditions of employment.Any qualifications, experience or training required.Confirmation of whether or not registration inNew Zealand is required.Duration of the job.How long the offer of employment is open.

    If you are applying for an Essential Skills workvisa, Graduate Work Experience visa, Silver FernPractical Experience visa, Work to Residence LongTerm Skill Shortage List visa or a Specific Purposeor Event work visa which requires a job offer, you

    must submit a completed Employer Supplementary Form (INZ 1113) from your employer, with yourapplication. This will contain all of the informationabout your employment described above.

    Employers can find more detailed information onrequirements they must meet in our ImmigrationGuide for Employers in New Zealand (INZ 1031) .

    You must also provide evidence that you arequalified by training or work experience to dothe job you have been offered. This evidence canbe provided in the form of original or certifiedcopies of your qualifications and/or writtenconfirmation of your work experience from

    previous employers.If the job requires registration by law inNew Zealand, you must also show evidence thatyou have met, or are able to meet registrationrequirements.

    In New Zealand registration is required by law inorder to undertake employment as:

    Architect Barrister or solicitor

    Cadastral (land title)surveyor

    Chiropractor

    Clinical dental technician Clinical dental therapist

    Dental hygienist Dental technician

    Dental therapist Dentist

    Dietitian Dispensing optician

    Electrical service technician Electrician

    Enrolled nurse Line mechanic

    Medical laboratoryscientist/technologist

    Medical laboratorytechnician

    Medical practitioner Medical radiationtechnologist

    Nurses and midwives Occupational therapist

    Optometrist Osteopath

    Pharmacist Physiotherapist

    Plumber, gasfitter, ordrainlayer

    Podiatrist

    Psychologist Real estate agent

    Teacher Veterinarian

    If you intend to work in one of these occupationsin New Zealand you must provide evidence youcan meet the relevant registration requirementsbefore we will grant a work visa.

    Dental or medical professionals who holdconfirmation in writing from the New ZealandDental or Medical Councils that they meetNew Zealand registration requirementssubject only to attending an interview with arepresentative of the Council immediately afterarrival may be granted work visas.

    Essential Skills work visarequirements

    We may give you a work visa under Essential SkillsInstructions if you have a job offer for which youare suitably qualified and experienced, and:

    your job offer is in an occupation that is on theImmediate Skill Shortage List (ISSL) or theLong Term Skill Shortage List (LTSSL), and youmeet the requirements for that occupation, oryour job offer is from an employer who has acurrent approval in principle from us for yourrecruitment, orwe are satisfied there are no suitableNew Zealanders available, or no New Zealandersreadily able to be trained to do the job.

    Your employer may need to show that the rate of payyou have been offered is not less than the marketrate for New Zealand workers in that occupation.

    www.immigration.govt.nz/essentialskills.Essential Skills Work Instructions differentiatebetween occupations on the basis of skilllevel. Skill level is determined according tothe Australian and New Zealand StandardClassification of Occupations (ANZSCO).

    The skill levels in ANZSCO range from 1 (highskilled) to 5 (low skilled). If your occupation iswithin ANZSCO Skill Level 1 we may give you afive-year work visa, provided your job offer is forat least five years and your annual salary is atleast NZ$55,000. We can only give you a five-yearvisa under these instructions once, although

    you may reapply for a further visa for a shorterduration (up to three years).

    If your application is successful and your occupationis within ANZSCO Skill Level 4 or 5 the maximumduration of your visa is one year.

    Minimum income threshold requirementfor dependent childrenIf you want to bring your dependent children withyou as visitors or students, you must show thatyou meet a minimum income threshold to ensureyou can support yourself and your dependantswhen in New Zealand. The minimum incomethreshold is NZ$35,019 gross per year.

    You will need to provide evidence that you meetthe minimum income threshold with your childsvisitor visa or student visa application. Acceptableevidence includes original or certified copies of a

    job offer with salary or wages equal to or higherthan the minimum income threshold.

    If you and your partner both hold an EssentialSkills work visa, both of your wages or salariesmay be taken into account when determining ifthe minimum income requirement is met.

    Note : if the minimum income requirement is notmet your childs visitor or student visa applicationmay be declined.

    Note : self-employment does not meet theobjectives of Essential Skills work instructions.If you wish to obtain a work visa based on self-employment, you should apply for a long termbusiness visa. For more information see theLong-Term Business Visa Application (INZ 1058) and the Long-Term Business Visa Guide (INZ 1059) .

    Work to Residence visarequirements

    There are four different options for you if you areapplying under Work to Residence Instructions.

    Talent (Accredited Employers) WorkInstructions for people with a job offer froman employer who we have accredited.Talent (Arts, Culture and Sports) WorkInstructions for people with exceptionaltalent in their field of art, culture or sport.Long Term Skill Shortage List Work Instructions for people working in an occupation on ourLong Term Skill Shortage List (LTSSL).Long-Term Business Visa Instructions. For moreinformation, and to apply under theseinstructions, see the Long-Term Business Visa Application (INZ 1058) , and the Long-TermBusiness Visa Guide (INZ 1059) .

    If you are successful in applying under Talent(Accredited Employers) Work Instructions, Talent(Arts, Culture and Sports) Work Instructions, orLong Term Skill Shortage List Work Instructions,we will grant you a multiple entry work visacurrent for 30 months.

    Accredited Employer work visaYou may be eligible for an Accredited Employer workvisa if you are aged 55 years or under and havean offer of employment in New Zealand from an

    accredited employer and a minimum base salary ofNZ$55,000 per annum. In addition to the generalrequirements for offers of employment (seepage 4), your offer of employment must be:

    for employment in New Zealand in theemployers core area of business activity, wherethe employer will have direct responsibility foryour outputfor a period of at least 24 monthsfor full-time employment, (that is, it amountsto, on average, at least 30 hours per week)current at the time we assess your application,and at the time we grant a visa, and

    for a position with a minimum base salary ofNZ$55,000 per annum.

    Arts, Culture and Sports work visaYou may be eligible under these instructions ifyou are aged 55 years or under.

    You must show us that you have exceptionaltalent in a declared field of art, culture or sport.We will want to see evidence that:

    you have an international reputation and

    record of excellence in your declared field, andyou are still prominent in that field, andyour presence in New Zealand will enhance thequality of New Zealands accomplishments andparticipation in that field of art, culture or sport.

    Also, you must be supported by a New Zealandorganisation of national repute in your declared field.A New Zealand organisation of national repute is:

    a New Zealand organisation that has anationally-recognised record of excellence in afield of art, culture or sport, ora New Zealand organisation that has a nationally-recognised record of excellence in fosteringexceptional talent in a field of art, culture or sport.

    You must also have a sponsor. The sponsor mayeither be the organisation supporting yourapplication or an individual. For details of therequirements for sponsorship under theseinstructions, see our form Talent (Arts, Cultureand Sports) Sponsorship Form (INZ 1091) .

    Long Term Skill Shortage List work visaYou may be eligible under these instructions ifyou have an offer of employment in New Zealandin an occupation that is included on the LongTerm Skill Shortage List (LTSSL) that meets thespecifications for that occupation. For detailsof the requirements your offer of employmentmust meet, see Completing Section I: Work toResidence Instructions.

    You must be suitably qualified by training and/orexperience to undertake your offer of employment,and you must meet any specific requirements setout in the LTSSL. To see the LTSSL, see our websitewww.immigration.govt.nz/ltssl.

    You must also have met, or be able to meet,any of the necessary New Zealand registrationrequirements if these are required to take up theoffer. For details of registration requirements,

    see Completing Section F: Job offer.When you later apply for residence, you must beaged 55 or under to be eligible.

    How do I qualify for residence underWork to Residence Instructions?If your application for a work visa under Work toResidence Instructions is successful, then, afteryou have held a work visa for 24 months, you maybe eligible for a residence class visa. You will haveto meet normal residence requirements, such as

    health and character requirements, as well asmeeting the requirements for the instructionsyou applied under. When you lodge the residenceapplication, you must be in New Zealand.

    Accredited Employers Work Instructions

    You may be eligible for residence if you have beenemployed in New Zealand throughout a period ofat least 24 months by any accredited employer,or any other employer you obtained our approvalto work for.

    You must have employment in New Zealand witha minimum base salary of at least NZ$55,000per annum. (The minimum salary requirementsare different for people whose work visa underthese instructions was made before 28 July 2008.See our Self-Assessment Guide for Residence inNew Zealand (INZ 1003) ).

    Arts, Culture and Sports Work Instructions

    You may be eligible for residence if you have beenactively engaged in your declared field of art,culture or sport. You must still be prominent inthat field of art, culture or sport, and you must besupported by an organisation of national repute inyour declared field. You must also have a sponsor.The sponsor may either be the organisationsupporting your application or an individual.

    You must not, since the grant of your visaunder these instructions, have applied for, orbeen granted, welfare assistance under theNew Zealand Social Security Act 1964.

    Long Term Skill Shortage List Work Instructions

    You may be eligible for residence if you areaged 55 years or under and have employment inNew Zealand with a minimum base salary of atleast NZ$45,000 per annum that is either:

    in the same occupation that enabled you toobtain a work visa under these instructions, orin an occupation on the LTSSL current at thetime you apply for residence.

    Study to Work visa requirementsStudy to work visas include the Graduate JobSearch visa and the Graduate Work Experiencevisa. Both are open to former students who havecompleted their studies in New Zealand.

    Graduate Job Search visaYou may be eligible for a Graduate Job Search visaif you have successfully completed a qualificationin New Zealand that would qualify for points under

    the Skilled Migrant Category. You may apply fora Graduate Job Search work visa for a maximumof 12 months. You must apply for the work visano later than three months after the end date ofyour student visa for that qualification.

    You must also show that you have at leastNZ$4200 to support yourself while you are lookingfor work. Acceptable evidence of funds includes:

    photocopies of travellers chequesbank draftsletters of credit, andbank statements in your name showing aminimum of two months transactions andcurrent balance.

    Graduate Work Experience visaYou may be eligible for a Graduate WorkExperience visa if you have successfullycompleted a qualification in New Zealand thatwould qualify for points under the Skilled MigrantCategory and you have a job offer which isrelevant to that qualification.

    You may apply for a work visa for a maximum oftwo years to get practical experience suitable toyour qualification. You may apply for a work visafor a maximum of three years if you are workingtowards getting membership or registrationfrom a New Zealand professional association,which requires more than two years of relevantpractical work experience. You must apply for the

    work visa no later than three months after theend date of your student visa for that course orqualification, or be the holder of a Graduate JobSearch work visa.

    Specific Purpose or Event visarequirements

    You may be eligible for a work visa under theseinstructions if you are coming to New Zealandfor a specific purpose or event for a particularperiod. You must have demonstrated skills,attributes or expertise in areas relevant to

    that specific purpose or event that are likelyto benefit New Zealand. Your employmentin New Zealand must not be likely to harmemployment opportunities for New Zealanders.

    If you are required to provide an offer ofemployment, you will also need to submit acompleted Employer Supplementary Form (INZ 1113) .

    The following people may be approved to come toNew Zealand for a specific purpose or event.

    Senior or specialist business people on short-term secondments. You must have an offer of

    employment either in a substantial New Zealandcompany or a New Zealand subsidiary of anoverseas company.

    People seconded to New Zealand as an intra-

    corporate transferee . You must be taking up aposition in a multi-national company as a chiefexecutive or senior staff member or specialiststaff member.

    People wishing to undertake business activitiesin New Zealand for a period exceeding threemonths in one year . You must be able to satisfyan immigration officer that you have genuinereasons for a longer stay, and documentedevidence of these reasons will be required.

    Other . You must be able to show that you

    need to come to New Zealand for someother specific purpose or event and that thecircumstances justify the grant of a work visaunder these instructions.

    Religious Worker visa requirements

    You may apply for a work visa if you are beingsponsored by a registered charity whose primarypurpose is advancing religion. The religious workyou undertake must be recognised by INZ asdirectly serving the religious objectives of thesponsoring organisation.

    A work visa under Religious Worker instructionsmay be granted for a period of up to two years towork with the same sponsoring organisation.

    For details on the evidence you must provide seethe Work Visa Application (INZ 1015) .

    The organisation sponsoring your application fora work visa must be a charity registered with theCharities Commission:

    whose purpose is advancing religion, andwho will cover your costs for accommodationand maintenance while in New Zealand, andrepatriation.

    The sponsoring organisation must complete aSponsorship Form for Religious Workers (INZ 1190)and include:

    a copy of their Charities Commissionregistration certificate, andevidence of their financial ability to sponsor youfor the duration of your visa, anda copy of an employment agreement and/ordescription of the religious work you will undertake.

    Crew of Foreign Chartered FishingVessels visa requirements

    You may apply for a work visa with evidenceyou hold a contract to work on a vessel inNew Zealand. The normal maximum stay istwo years. For several crew travelling together aGroup Visa Application for Visitors to New Zealand(INZ 1021)may be used. Your New Zealand agentwill need to contact the local INZ office, andobtain approval for your entry before you travelto New Zealand.

    Student and Trainee visarequirements

    There are three groups of people who may beapproved to come to New Zealand under Studentand Trainee Instructions.

    Medical or dental trainees wishing to fulfil acompulsory training requirement by undertakingpractical training in New Zealand

    You must:

    be appropriately qualified and experienced, andhave a letter of acceptance from aNew Zealand hospital, andmeet funds requirements, andnot hold a student or visitor visa.

    Students wishing to fulfil a course requirement

    If you want to fulfil a course requirementby undertaking practical work experience inNew Zealand that is directly related to yourcourse of study, you must:

    be studying in your home country or lawfully inany other country (excluding New Zealand), andhave the support of your education provider, andmeet funds requirements, andhave an offer of work from a New Zealandeducation provider or employer.

    Jockeys aged 16 or over wishing to undertake anapprenticeship in New Zealand

    You must have:

    an offer of employment from a New Zealandtrainer, anda guarantee of maintenance andaccommodation from New ZealandThoroughbred Racing Incorporated, anda guarantee of repatriation from yourNew Zealand trainer should you not continuethe apprenticeship.

    Exchange schemes visarequirements

    You may apply for a work visa to come and workin New Zealand as part of an exchange scheme.These may be:

    government-to-government schemes, such asworking holiday schemes (see the TheInternational/Humanitarian Stream, below), orother exchange schemes we have formallyapproved.

    Silver Fern Practical Experiencevisa requirements

    You may apply for a work visa if you hold a SilverFern Job Search visa or a Silver Fern PracticalExperience work visa, and have an offer of skilledemployment in New Zealand which is current for aperiod of at least 12 months.

    We may grant you a work visa for the durationof your offer of employment, up to a maximumof two years. Any subsequent Silver FernPractical Experience work visa will be granted to

    a maximum of two years from the grant of thefirst Silver Fern Practical Experience work visa.

    Skilled employment for the purpose of theseinstructions is employment that would beassessed as skilled under the Skilled MigrantCategory residence instructions. For details ofskilled employment, see instructions SM7.10 orthe Application for Residence Guide (INZ 1105 ).

    The International/HumanitarianStream

    The International/Humanitarian Stream allowsyoung people from other countries to work inNew Zealand under working holiday schemes. Do notuse the Work Visa Application (INZ 1015) if you wantto apply under a working holiday scheme. Use theform Working Holiday Scheme Work Visa Application(INZ 1085), or you may be able to apply online. Seeour website www.immigration.govt.nz/whs.

    Other categories in the International/ Humanitarian Stream allow New Zealand to meetits international and humanitarian obligations tothe following groups of people:

    Free trade agreement special work visarequirementsChina Special Work Instructions and ChinaSkilled Workers Instructions . These instructionsallow limited numbers of Chinese nationalswho are qualified and experienced in certainoccupations, and who have a genuine New Zealand

    job offer in that occupation to be granted a workvisa. You must also meet normal requirementsrelating to health and character.

    To apply you must complete the form Work Visa Application for China Skilled Work Instructions (INZ 1158) .

    Philippines,Vietnam and Indonesia special workinstructions : these instructions allow limitednumbers of workers from the Philippines, Vietnamand Indonesia, who are qualified and experiencedin specific occupations, to come to New Zealandto work for up to three years, depending on thelength of the job offer.

    If you are granted a work visa for less thanthree years, you may apply for a further visa forthe balance of the period, as long as you stillmeet all the requirements of these instructions.

    If you are granted a visa under these instructionsand later wish to return here, you will need to remainoutside of New Zealand for at least three yearsbefore you can apply under these instructions again.

    Philippines Special Work Instructions : farmmanagers and engineering professionals applyingfor a work visa must be resident in the Philippinesand apply through the Manila branch of INZ;registered nurses may apply from any countrythrough their nearest INZ branch.

    Vietnam Special Work Instructions : Vietnamesechefs and engineering professionals applying fora work visa must be resident in Vietnam and applythrough the Ho Chi Minh branch of INZ.

    Indonesia Special Work Instructions : Indonesian

    chefs, Halal slaughterers and Bahasa Indonesiateachers aides applying for a work visa mustbe resident in Indonesia and apply through theJakarta branch of INZ.

    As well as meeting health and characterrequirements, you must have a New Zealand joboffer. The job offer must be for genuine, sustainableand full-time employment for up to three years.You must provide evidence that you have thequalification and/or experience required for that job,and you must meet any other requirements, for oneof the occupations in the table on page 11.

    G IDE TO COMPLETING THE APPLICATION FORMTo apply for a work visa, you must complete and sign the form Work Visa Application (INZ 1015) andsend it to us with the application fee, and all the documents we need to assess your application.

    If you do not include everything we need, we will not process your application and will return it to you.

    Translations of documentsIf you provide a translation, it must:

    be in English; andbe accompanied by the original document or a certified copy; andnot be made by you, any of your family members or or an immigration adviser assisting with yourapplication; andbe certified as a correct translation made by a person familiar with both languages and competentin translation work; andbe on the official letterhead of the translation business (if applicable); andhave the stamp or signature of the translator or translation business; and

    be paid for by you.Translations may be prepared by:

    the Translation Service of the New Zealand Department of Internal Affairs; orreputable people within the community who are known to translate documents accurately; orembassies or high commissions (if the translation is endorsed with the appropriate embassy orhigh commission seal); orany other private or official translation business.

    Completing Section A Personal details

    Passport photographsYou must attach two passport-size photographs to the form at the section indicated. Thephotographs must be original, and taken within the last six months. The size of the photographs shouldbe about 45 mm by 35 mm. The photographs should be in good quality colour (not black and white).

    A3 Other names you are known by or have ever been known by

    This includes your birth name, your name from marriage or from adoption, or your English name.

    A7 Passport details

    The passport details must be those of the passport or travel document you will use to travel toand from New Zealand.

    You must send your passport or travel document with your application. It must be valid to atleast three months past the date you plan to leave New Zealand.

    A9 Partnership status

    You have the following options for your partnership status:married/in civil union (a civil union is a legally recognised union of a couple of the same oropposite sex, with rights similar to those of marriage)single (not currently married or in a partnership or civil union)partner (this includes being in a de facto partnership)separated (this includes being separated from a civil union)engagedwidoweddivorced (this includes having a dissolved civil union).

    Completing Section B Contact details

    B5 An adviser can be any person who assists you with your application. It could be a lawyer,immigration adviser, translator, friend or family member.

    Completing Section C our health

    C5 If you intend to give birth in New Zealand please indicate how the cost of maternity healthservices will be paid for and provide the relevant evidence.

    If you are pregnant and intending to give birth in New Zealand we need to be sure that you havea bona fide reason for being in New Zealand. We also need to ensure that you are either eligiblefor publicly-funded maternity health services or able to meet the costs of maternity healthservices (evidence of at least NZ$9,000 is required) through personal funds or sponsorship.

    To find out if you are eligible for publicly-funded maternity services, you may check your eligibilitythrough the Ministry of Health at www.health.govt.nz which provides comprehensive informationon eligibility for publicly-funded health and disability services. Alternatively you may be able to

    establish whether you are eligible by checking our leaflet Health Requirements (INZ 1121) . Youshould attach evidence that you meet the criteria to be eligible for publicly-funded maternityservices if the evidence is not already available to us (for example evidence of partnership oryour partners eligibility for publicly-funded health services).

    If you are not eligible for publicly-funded maternity health services you will need to provideevidence that you have sufficient funds to pay for the cost of maternity health services.

    Acceptable evidence of your funds includes:bank statements in your namebank draftsrecognised credit cards with sufficient credit available, andtravellers cheques.

    You must not send cash or original evidence of funds. Funds to cover the cost of maternityhealth services must be additional to the funds you hold to support yourself in New Zealand andto purchase an outward ticket.

    Alternatively you may provide evidence of sponsorship which meets our sponsorshiprequirements. Your sponsor must complete the Sponsorship Form for Temporary Entry (INZ 1025) .

    Medical certificates

    You may need to provide us with a medical certificate and chest X-ray certificate to show that youmeet our acceptable standard of health. What you must provide depends on:

    whether you have recently sent a medical certificate or chest X-ray certificate with anotherapplicationhow long you intend to stay in New Zealandwhat countries you have previously lived in or visited.

    If you are already in New Zealand, and you are applying for a further visa, you need to include thetime you have already spent in New Zealand, as well as the time you intend to study here, to decidewhether or not you need to complete a medical certificate or chest X-ray certificate.

    Example You have been in New Zealand on a visitor or student or work visa or other temporary visafor eleven months, and you wish to apply for a work visa for six months. This will mean astay in New Zealand of more than 12 months in total.

    C6 Will you be in New Zealand for more than six months in total?

    You are not required to provide a medical certificate or chest X-ray certificate if you will be inNew Zealand for less than six months.

    C7 How long do you intend to stay in New Zealand? If you are in New Zealand, this includes time youhave already spent here.

    If you will be in New Zealand for between six and 12 months and are from, or have spent more

    than three months visiting, a place outside the list of countries, areas and territories with a lowincidence of tuberculosis (TB) (see the table below), you must provide a Chest X-ray Certificate(INZ 1096) which is no more than three months old, unless the exception rules for a chest X-raycertificate apply (see notes below).

    If you will be in New Zealand for more than 12 months , you must provide a General MedicalCertificate (INZ 1007) and Chest X-ray Certificate (INZ 1096) which are no more than threemonths old, unless the exception rules for a medical certificate and chest X-ray certificateapply (see notes below).

    Example 3 You hold a British passport and you live in the United Kingdom, which is on the list above.

    However, in the last five years, you spent five weeks in Thailand and eight weeks inFiji. Thailand and Fiji are not on the list above, and you have spent a total of at leastthree months in a place which is not on the list above.

    You must complete a Chest X-ray Certificate (INZ 1096).

    Notes:Exception rules for a medical certificate

    If you are a person who is required to provide a medical certificate, you do not need to provideone if you have provided a General Medical Certificate (INZ 1007) which was issued less than 36months ago with a previous visa application; and

    Exception rules for a chest X-ray certificate

    If you are a person who is required to provide a chest X-ray certificate you do not need toprovide one if you have provided a Chest X-ray Certificate (INZ 1096) which was issued less than36 months ago with a previous visa application; and

    your health has not deteriorated since then; andyou have not been requested in writing by an immigration officer to provide a certificate; andyou have not spent six consecutive months since your last certificate was issued, in a country,area or territory not listed as having a low incidence of TB.

    Chest X-ray certificate for pregnant applicants

    If you are pregnant you do not need to provide a chest X-ray certificate. If you are a person whowould ordinarily be required to provide one, you will only be granted a visa valid for three monthsafter the date that you are due to give birth, unless you have provided a chest X-ray certificateissued within the last 36 months with a previous application. Where a visa is only granted for threemonths after the date you are due to give birth, you will need to provide a chest X-ray certificatewith an application for a further visa if you wish to remain in New Zealand.

    Where can I get my medical and chest X-ray certificates completed?

    In most countries we require the medical examinations to be carried out by one of a selectedpanel of medical practitioners or institutions. The details of these countries and the names andaddresses of the approved panels are listed on our website.

    I have been recognised as having refugee or protection status in New Zealand and am eligible toapply for a permanent resident visa. What medical certificates do I need to provide?

    You are not required to provide a medical certificate or a chest X-ray certificate with a workvisa application.

    Completing Section D our character

    d3 Have you been excluded (refused entry) from any country?

    You should tick yes if you have had a visa application declined by any country, or if you have been

    refused entry to a country at the border.

    Police certificates you must provide

    You may need to provide us with police certificates to show that you are of good character and donot pose a potential security risk. At the time of lodgement your police certificate must not be morethan six months old from date of issue. Police certificates that are older than six months from thedate of issue at lodgement of any application will NOT be accepted.

    d4 If you are applying for a work to residence visa under the accredited employer, long term skillsshortage list or arts, sport and culture instructions, you must provide police certificates.

    If you are applying for any other type of visa and you intend to stay in New Zealand for24 months or longer, you must provide a police certificate from your country of citizenship

    and any country you have lived in for five years or more since your turned 17. The only exceptionto this is if you have provided police certificates with a previous visa application, and thatcertificate was issued less than 24 months ago when you lodge your current visa application, orif you are younger than 17. If you are under 17 you do not need to provide police certificates.

    ANZSCO is the Australian and New Zealand Standard Classification of Occupations. MostNew Zealand occupations are listed on the ANZSCO, with a six-digit occupation code and a skilllevel. For more information see www.immigration.govt.nz/anzsco.

    Assessing your application: bona fides

    When we assess your application and the information you provide, we ensure that it meets all therequirements of the visa you are applying for. This includes the requirement to be bona fide, whichmeans you intend a genuine temporary stay to work.

    When we assess if you are a bona fide worker, we consider all of the information that we have. Forexample, we will consider:

    your personal circumstances, such as: your family ties in your home country and New Zealand;

    personal, financial, employment or other commitments in your home country and New Zealand; any circumstances that might mean you may not want to return to your home country when any

    visa expires,

    information that we have about previous applications, such as whether you have previouslyoverstayed or breached visa conditions.whether you have dependants who are unlawfully in New Zealand.your ability to leave or be deported from New Zealand to your country of citizenship.

    INZ will consider all of the information you provide in support of your application but is not obliged toask you for more. So, with evidence that you meet the particular requirements for the type of visayou are applying for, you should provide any evidence that you think demonstrates that you are a bonafide applicant.
