Effect ive January 1, 2012
• Each driver and all passengers must wear aproperly fastened safety belt.
• Children under the age of eight years must be secured in an appropriate child restraint system,more commonly called a child safety seat. Childsafety seats include infant seats, convertibleseats (rear-facing for infants and forward-facingfor toddlers) and booster seats that are used with the vehicle lap and shoulder belt system.
• Children weighing more than 40 pounds, may betransported in the back seat of a motor vehiclewhile wearing only a lap belt if the back seat isnot equipped with a lap and shoulder belt system.
• The parent or legal guardian of a child under theage of eight years is responsible for providing achild safety seat or booster seat to anyone whotransports his or her child.
• A violation of this act is a petty offense punish-able by a fine of $75. A person charged with a violation of this act shall not be convicted if theperson produces in court satisfactory evidence of possession of an approved child restraint sys-tem and proof of completion of an instructionalcourse on the installation of a child restraint sys-tem. A second or subsequent violation of this Actis a petty offense punishable by a fine of $200and cannot be waived.
