Home quarantine............pital beds of tertiary hospitals are required to be keptavailable for more severe cases who may need inten-sive monitoring in a hospital setting.Keeping in view better management of COVID-19patients, the protocol with regard to management ofCOVID-19 patients will be revised and all asympto-matic patients with no co-morbidity and not vulnerableotherwise will be allowed to remain under home quar-antine, if they have a separate room facility at homeand have downloaded the AAROGYA Setu applicationon their phones, the Chief Secretary said. He furthersaid that all such patients will be provided with a pulseoximeter to monitor their oxygen saturation levels andin event of drop in oxygen saturation below 90% theyshall immediately report to hospitals. A poster shallalso be put up outside their home displaying thereinthe quarantine status. Reach out teams constituted bythe Health Department shall monitor health status ofthese patients, Chief Secretary maintained.Chief Secretary expressed that in order to achieve bet-ter compliance amongst the contacts of COVID-19patients, it has been decided that the present practice ofadministrative quarantine of COVID positive contacts,shall be dispensed and the contacts shall be permittedhome quarantine provided they are asymptomatic.However, all contacts shall be sampled and the definedprotocol shall be followed in case of contacts whoreport positive, he observed.Chief Secretary said that keeping in consideration lowpositivity rate amongst the rail and air travellers(0.9%), Home quarantine would be permitted aftersampling for such rail travellers who have a valid con-tactable phone number and have AAROGYA Setuapplication downloaded on their phones. In the eventof any rail traveller turning positive, the standard pro-tocol with regard to management of COVID-19patients will be followed, he added.Chief Secretary further said that Panchayati RajInstitutions can play an important role in controllingspread of COVID-19. He said that a massive campaignfor surveillance involving Panchayati Raj Institutionswill be initiated to help in identify suspect COVID-19cases in rural areas. The PRIs shall be supplied pulseOximeter and contactless thermometer for the purposeand they shall be imparted training for undertakingthis activity, he added.

With the new cases, the tally overall has risen to18390—14457 in Kashmir and 3933 in Jammu.Meanwhile, Eight persons — including four fromSrinagar and one each from Budgam, Kulgam,Kupwara and Pulwama — died due to COVID-19 onSunday, taking the death toll due to the virus in theUnion Territory of J&K to 321.With these deaths, 286 people have lost their lives dueto COVID-19 in 53 days, and 306 people in 67 day inJ&K, where 615 new positive cases were detected onSunday, taking the total number of infected persons to17920.As many as 61 people, including 57 from Kashmir andfour from Jammu, lost their lives due to COVID-19 dur-ing last week.Official sources said that four COVID-19 positivepatients — including a 65-year-old man fromSafakadal, a 60-year-old man from Bemina, a-60-year-old man from Hawal and a 60-year-old man fromBuchpora — died since Sunday evening.They said the victims include a local NationalConference (NC) leader, who died late on Sundayevening at SHMS hospital. “The patient, who was suf-fering from bilateral pneumonia, was tested positivefor COVID-19 on Monday,” they said.They said other three Srinagar residents died at S KInstitute of Medical Sciences (SKIMS) and were suffer-ing from respiratory problems.They said a 70-year-old man, a resident of Behipora inKulgam, was admitted to SKIMS in the wee hours onMonday for respiratory distress. “The patient, whotested positive for COVID-19, died hours after beingadmitted to the hospital,” they said.Another patient, a 65-year-old man, a resident ofChadoors in Budgam, was admitted to SKIMS on July21 for respiratory problem. “The patient, who testedpositive for COVID-19, died at the hospital onMonday,” they said.They said an 85-year-old man, a resident of Samboorain Pulwama, died at SMHS hospital. “The patient, whotested positive for COVID-19, was suffering form respi-ratory problem,” they said.“A 59-year-old man, a resident of Handwara inKupwara, died on Sunday afternoon. “The patient,who had tested positive for COVID-19, was sufferingfrom respiratory distress,” they added.With these fatalities, the death toll due to COVID-19has risen to 18 each in Kupwara and Pulwama.Srinagar is the worst affected district in J&K in terms ofcausalities with 92 deaths, followed by Baramulla with63 deaths. The death toll rose to 23 in Budgam whilethe fatalities stood at 21 in Anantnag. As many as 20people have lost their lives to the disease in Shopian.The number of deaths stands at 27 in Kulgam. Ninepeople have lost their lives in Bandipora. Ganderbaldistrict recorded sixth death due to COVID-19 onFriday.Ten districts of Jammu have reported 23 fatalities while298 people have lost their lived due to COVID-19 in tendistricts of Kashmir.Sixty five people lost their lives between July 13 andJuly 19 due to COVID-19 in J&K. As many as 48patients — including 10 persons from Baramulla, 12from Srinagar, six from Kulgam, three from Anantnag,Kupwara and Budgam, Jammu region, two each fromShopian and Ganderbal, one patient each fromPulwama, Bandipora and a BSF jawan — died due toCOVID-19 between July 6 and July 12.As many as 41 people — including nine from Srinagar,10 from Baramulla, five each from Anantnag, threefrom Kulgam, Budgam and Shopian, two each fromKupwara and Bandipora, one each from Jammu andGanderbal — died due to COVID-19 between June 29and July 5.

The Ropewayfrom Bahu Fort to Mahamaya has 8 cabins and fromMahamaya to Peerkho 14 cabins and the total numberof towers in section one (Peerkho to Mahamaya) andsection 2 (Bahu Fort to Mahamaya) are nine and thecritical components have all been imported.The project will give a boost to the tourism industry ofthe Jammu region and people will spend more time inJammu during their visit to the Vaishno Devi shrine,Amarnath shrine, Patnitop and other tourist destina-tions.The cable car project is aimed at connecting heritagesites across the city and is being set up to connect her-itage sites of Bahu Fort, Badh-e-Bahu Garden andaquarium to Mubarak Mandi Heritage Palace,Mahamaya Temple and Peerkho Temple. In a major boost to tourism sector in Jammu region,Lieutenant Governor, Girish Chandra Murmu todayinaugurated the much-awaited cable car projectbetween Bahu and Mahamaya temples, in the presenceof Sh. Baseer Ahmad Khan, Advisor to the LieutenantGovernor; Sh. Shamsher Singh Manhas, MP; Sh. JugalKishore Sharma, MP; Sh. BVR Subrahmanyam, ChiefSecretary.The Lt Governor and the First Lady Dr. Smita Murmu,took the maiden ride of the cable car after the inaugu-ral function. He hailed the project and hoped that theservice would become a major highlight of Jammu city.On spot directions were issued by the Lt Governor tokeep the service free for general public for first 15 daysof operation. He also called for constructing a gamingzone for kids and keeping special concessional rates forstudents and senior citizens.Managing Director, Cable Car Corporation, Majid KADrabu briefed the Lt Governor about the details aboutthe project. The inaugurated section has been built atthe cost of Rs. 33.65cr and hosts facilities such as restau-rant, walkways, lawns, gender based public conven-iences, park at Mahamaya, ample parking space atBahu, wooden decks etc. The Lt Governor directed theofficers to immediately formulate a SOP for periodicmaintenance of the machinery.Operationalisation of Jammu Ropeway will boost thepilgrimage tourism as it connects the three major tem-ples of Jammu city; the Jamvant Gufa (PeerkhoTemple), Mahamaya Temple and Bahu Fort Templeand will provide recreational facility to Jammuiteswhich was long pending aspiration of people.Among others who graced the inauguration includedMayor JMC, Sh. "The recovery rate is better than most coun-tries and already getting better," he added."The world is praising us because of the efforts of thefoot soldiers. We don't lack awareness," the PrimeMinister said.The country, he said, has taken big strides to set upinfrastructure and now needs to "strengthen demand-supply chains in the block, village and zilla levels"."We want to save each and every Indian," the PrimeMinister said, adding that the country now has morethan 11,000 COVID facilities and more than 11 lakh iso-lation beds."What India did with PPE, masks, test kits, it is a mas-sive success story. At one point, India didn't manufac-ture a single PPE kit. Now it is the world's secondlargest manufacturer. Over 1,200 manufacturers aremaking PPE kits within six months. Ove three lakh N-95 masks are being made in India today. Three lakhventilators can now be produced every year," he said.The new "high throughput" testing centres are locatedat the National Institutes of the Indian Council ofMedical Research at Kolkata, Noida and Mumbai.The Prime Minister said these hi-tech state-of-the-arttesting facilities will boost the testing capacity byalmost 10,000 a day in each of the three cities, which areamong the hotspots of the disease.Mumbai already has the maximum number of coron-avirus cases in the country. The numbers in Kolkata arerapidly rising too. Noida is the big testing centre inwestern Uttar Pradesh.An increase in the number of tests in these areas willlead to early detection and help control the spread ofthe virus.The Prime Minister, however, added that these labswill not be limited to testing for coronavirus. In future,they will also be used for tests for Hepatitis B and C,HIV, Dengue and several other diseases.

were arrested.NIA took up the investigation of the case on 10.02.2020and arrested three more militant associates of thisInfiltration-Transportation module.Searches were conducted at several places in Kashmirvalley and incriminating material including documentsand digital devices were seized.Investigation revealed that apart from their unsuccess-ful attempt in January, 2020, this module had receiveda group of three Pakistani militants in December, 2019after they infiltrated into India from the InternationalBorder in Samba sector and ferried them to SouthKashmir.This module was in touch with Pakistan-based Jaish-e-Mohammad handlers and launch-pad commanderswho used to send the location of freshly infiltrated mil-itants and also share the code-words for receiving themto driver Sameer Ahmad Dar on secure messagingapps.The other three arrested accused viz. Suhaib Manzoor,Zahoor Ahmad Khan and Suhail Javed @ Suhail Lonewere the Over-Ground Workers (OGW’s) of JeM andprovided safe shelter, logistics andcommunicationback-up for the infiltration and transit of the Pakistanimilitants.These OGW’s also purchased ‘phirans’ for the infiltrat-ed militants to make them look like Kashmiris and tohelp them hide their weapons.The arms and ammunition consisting of 2 AK-47 rifles,1 AK-56, 2AK-74’s 1 M4 Carbine, 2 Glock pistols, 3Chinese pistols, 35 grenades, 12 kg high-grade explo-sive, 3 Satellite phones, 6 wireless devices, etc wererecoveredwork due to pandemic and lockdown, some of theemployees who had retired during this period may nothave been provided with PPO.

The officerexplained that the security grid at border as well as inthe hinterland of Jammu & Kashmir were working intandem to defeat the efforts against peace in the unionterritory. “The border grid and the hinterland grid areworking in synergy to foil these designs,” he said.
With Highest...........India had crossed 13 lakhs COVID-19 cases on July 25.Maharashtra has reported 3,75,799 coronavirus cases,the highest among states and Union Territories in thecountry.A total of 2,13,723 cases have been reported from TamilNadu till now, while Delhi has recorded a total of1,30,606 coronavirus cases.According to the Indian Council of Medical Research(ICMR), 5,15,472 samples were tested for coronaviruson Sunday and overall 1,68,06,803 samples have beentested so far.Even though there is a continuous surge in the coron-avirus infections across India, but the COVID-19 CaseFatality Rate (CFR) has now dropped to 2.28% which isone of the lowest in the world."The focused efforts of Centre and State/UT govern-ments on early detection and isolation through aggres-sive testing and efficient clinical management of hospi-talized cases have shown results with continuouslyfalling Case Fatality Rate and improving RecoveryRate," said the Union Ministry of Health and FamilyWelfare.They added, "With effective containment strategy,aggressive testing and standardized clinical manage-ment protocols based on holistic Standard of Careapproach, the Case Fatality Rate has significantlydipped." ndia on Monday (July 27, 2020) reported 30,000 recov-eries per day for the fourth successive day. She said that the issues of food security andfood distribution amongst the poor and disadvan-taged must be addressed with the utmost priority bythe government.“There are so many families in Jammu and Kashmirwho are not getting benefit of any government schemedue to non-bifurcation of their joint ration card. Thegovernment should take a serious note of the situationand should immediately lift a ban on the bifurcation ofration cards so that needy people will take advantageof government schemes which are meant for their wel-fare,” the BDC Chairperson said.The BDC Chairperson mentioned that there are 15Panchayats in Block Dansal and the people, who donot have their ration cards due to obvious reasons, arefeeling the pinch of shortage in essential suppliesamidst COVID-19 crisis.The BDC Chairperson appealed to the Lt Governor tokindly provide the free ration to common masses ingeneral and people belonging to middle class familiesof those who are jobless and are not doing any privatework due to spread of COVID-19 pandemic, in partic-ular.“The only way to ensure every poor (household) getsrations is by universalizing the Public DistributionSystem, she said, adding that the government shouldimmediately lift the ban from bifurcation of rationcards besides issuance of new ration cards. New high-tec hpoly-houses have been constructed bythe Jammu and Kashmir government in Srinagar toboost vegetable cultivation. "These high-tech poly-houses with a cost of Rs 10 lakh have been installedunder the Rashtriya Krishi VikasYojana (RKVY)scheme sponsored by the Central government, withlatest features like humidity control, a fogger system,temperature controller and heating system for harshwinters," Zahoor Ahmad, Agricultural Assistant of theKitchen garden scheme told ANI.He added that the previous poly-house only coveredan area of 1200-1400 square feet while the new onecovers over 2000 square feet. "The new high-tech poly-house covers an area of 2000 square feet and has thelatest agricultural equipment. This system can give usa much higher yield at a better quality. We do notneed to depend on the natural processes to grow ourvegetables. With the new equipment, we can growfresh vegetables at night and even during the off-sea-son," he said.Ghulam Din, a farmer at the facility said that the newsystem would be very beneficial for the people ofJammu and Kashmir. "In Kashmir valley, a very largenumber of people rely on vegetable cultivation fortheir livelihood. The previous poly-houses were veryold and run-down and produced a lot of waste. A veg-etable that would take eight months to cultivate andharvest will now take just two months," he said

In order to increase the forest coverin J&K through people’s participa-tion, the Administrative Council(AC) approved a proposal to plant10 million saplings across J&Kunder ‘Green J&K Driver 2020’ todouble the plantation targetachieved during previous year. Anofficial spokesperson said that theAdministrative Council, which methere under the chairmanship ofLieutenant Governor G C Murmuon Thursday, accorded approval tothe Forest Department’s proposalof organizing an integrated ‘GreenJ&K Drive- 2020’.He said with an aim of planting 100lakh trees covering 15,000 hectaresof degraded forest areas during theyear 2020-21, the drive will seekparticipation from Panchayati RajInstitutions (PRIs), line depart-ments, educational institutions,army, para-military forces, policeand civil society. “The ForestDepartment will provide the requi-site tree saplings. The ForestDepartment will also prepare aproposal for sharing the usufructwith Panchayats,” he said.Additionally, he said the planta-tion drive will help rehabilitate the
degraded forests, enhanceafforestation of suitable areasincluding vacant lands outsideforests, village woodlots, farmlands and fallow lands. “The driveextensively focuses on extendingtree cover outside forests to reducepressure on natural forests for sup-plying minor forest produce,increasing sustainability offorest/tree cover, and optimallyutilizing the mitigation and adap-tation potential of forests in thecontext of climate change andresilient land use; which willinvariably improve the scenicbeauty of Jammu & Kashmir,besides improving the quality and

ing anti-encroachmentdrives and clear all suchareas, particularlyShivalik ranges and Tawibanks, officials said.They said that the LG ispersonally monitoringthe launch of survey andanti-encroachment drivesin Jammu city.So far, the JDA has com-pleted the demarcationprocess in only 33 of 83villages in Jammu. Thetotal land demarcated bythe JDA since 1973 is only2,245 acres out of which330 acres has beenencroached, they said.Similarly, 1,510 acres ofland belonging to the JDAhas been encroached inJammu. Of the total 9,479acres of land, 223 acres isin possession of Jammuwhile 1,111 acres has beenutilised by the JDA while93 acres has been regu-larised, officials said.A total of 3,884 kanals(485 acres) of JDA landhas been retrieved tilldate out of theencroached 12,083 kanals(1510 acres) in Jammu.Around 4,245 cases arepending disposal, theysaid.

Inspector General of Police (IGP), Kashmir range,Vijay Kumar on Sunday said that no one fromSrinagar district was in militant ranks currently afterthe killing of a Lashkar-e-Taiba (LeT) militant IshfaqRashid in an encounter on Saturday in the city out-skirts.Two LeT militants, including a top commander activesince 2018,were killed by security forces in anencounter which ensued after a Cordon and SearchOperation (CASO) was launched at RanbirgrahPanzinara in Srinagar outskirts on Saturday.“After killing of LeT militant Ishfaq Rashid Khan yes-terday, no resident of Srinagar district in terroristranks now,” Mr Kumar said.Khan, a resident of village Sozeith, Srinagar, was oneof top LeT commanders active since 2018 and waswanted in many militancy related cases. Another mil-itant killed in the encounter was identified as AijajBhat, aresident of Pulwama.However, earlier this month, Mr Kumar said Srinagardistrict can’t be militancy free as ultras come to thesummer capital for various reasons, including medicaltreatment.He said security forces are read to meet any eventual-ity and asserted that militants are being neutralizedbefore they could establish abase in the city. “Srinagaris such a city where militants keep coming for medicaltreatment, raising funds, meetings etc. Srinagar cannotbe militancy-free,” Mr Kumar said.The IGP had also given a list of 12 top militants --including four from Hizbul Mujahideen (HM), fourfrom Lashkar-e-Taiba (LeT) and three from Jaish-e-Mohammad (JeM). The teamrecovered 10 kg of brown sugar, arms and ammuni-tion and two vehicles from the possession of theaccused."A huge consignment of warlike stores and narcoticswas apprehended last night at Sadhna Pass at themouth of Tangdhar, Kupwara. Based on specificinputs about smuggling, Army Dogs, aided by detec-tors and scanners, facilitated to locate the concealedand hidden packages from the vehicle. The searchoperation led to the apprehension of three suspectsand the seizure of two vehicles. 1 AK-56, magazineand ammunition, 2 pistols with two magazines andammunition, 20 grenades and approximately 10 kgnarcotics were recovered. vermi compost units .While reviewing Swatch BharatAbhiyan, it was informed that thedistrict has achieved 84 percentcoverage. Regarding IWMP it wasinformed that out of total 70 works14 works have been completedwhile work on 56 is in progress.Under RURBAN Mission, it wasinformed that 27 projects have beencompleted while work on 18 proj-ects is in progress. CJ approves scheme for Internship
and e-Internship in the J&K High

Chief Justice, Jammu and Kashmir High Court, Justice
Gita Mittal, has approved the scheme for Internship
and e-Internship in the J&K High Court.
Responding to the need to put in place a proper
scheme in the High Court of Jammu and Kashmir for
engagement of law students (unpaid), either on a reg-
ular basis and/or e-internships, who may be remotely
located as well, the Chief Justice has conceptualized
this scheme.
Showing utmost concern towards the difficulties
being faced by the law students in seeking opportuni-
ties for internships in offices/ chambers of Judges, law
offices, lawyers chambers etc. and being unable to
observe the practical working of courts and learn
research work during the Covid 19 pandemic, the
scheme has been accorded approval for implementa-
tion by the Chief Justice in the High Court of Jammu
and Kashmir.
Pertinently, prior to the approval of this scheme, there
was no such scheme for engagement of law Interns in
the High Court of J&K.
Under the scheme, the Chief Justice and the Judges of
the High Court of Jammu & Kashmir can permit
internships to law students, either regular or by way
of e-internship.
To be eligible for applying as an Intern, the candidate
must be pursuing LL.B course from a recognized Law
College/ University established by law in India and
should be eligible for enrolment as an Advocate with
the Bar Council of India or State Bar Councils on con-
clusion of the LL.B course and must have a good
working knowledge of computer.
As per the scheme, Law Universities/ College(s) have
been authorized to make recommendation(s) for
internship of a candidate. A candidate can also apply
directly either to the Registrar General or to the Judge
of the High Court through his/her private secretary
with whom the applicant seeks to intern.
The scheme further envisages that the Law Intern will
be issued an experience certificate by the Registrar
General on successful completion of internship with
the approval of the Judge with whom the intern was
attached.
Pertinently, Law internships are established pro-
grams’ in courts all over the world including several
high courts in India. Internships are fixed term per-
missions granted to law students to attend and
observe court proceedings, read files of cases, under-
take legal research on points assigned to them and any
other law related activity.
With the approval of the scheme, the law students
studying in various colleges/universities/law Schools
and other institutions shall get an opportunity to fur-
ther hone their legal skills and understand both
breadth and depth of legal knowledge.

In this moment of celebration, at
least, let us keep aside the fact that it
took an order of the Supreme Court
for the Indian Army to ensure perma-
nent commissions for women. The
decision to grant such commissions to
Short Service Commission officers in
the 10 streams they presently serve is
certainly a step towards greater
empowerment and meets, in part, a
longstanding demand for gender equal-
ity. Permanent commissions will be
offered in the Army Air Defence (AAD),
Signals, Engineers, Army Aviation,
Electronics and Mechanical Engineers
(EME), Army Service Corps (ASC),
Army Ordnance Corps (AOC), and
Intelligence Corps in addition to the
existing streams of Judge and Advocate
General (JAG) and the Army
Educational Corps (AEC). Unlike the
British Gorkhas though who are poised
to recruit women in infantry roles,
India will keep its women soldiers away
from combat roles, in terms of the
Supreme Court order passed last
February. The battle to allow women
enhanced roles in the Army has been a
long one. Governments over the years
have shied away from commitment, for
the most part opting for occasion- driv-
en tokenism as in 2016 when the then
Defence Minister had told the Ficci
ladies’ organisation that the govern-
ment might consider an allwomen bat-
talion to circumvent logistical problems
such as separate accommodation et al.
Of course, no such battalion was raised
nor is one on the anvil and of course by
citing logistics – and not mindsets – as
the reason for the dithering, the
Minister had conveniently fudged facts.
For left to themselves, the Army and the
bureaucracy would have preferred to
keep women on as mere show soldiers,
to be used in largely ceremonial roles.
This week’s decision arrests that trend,
but only very partially.

The nation commemoratesKargil Vijay Diwas everyyear on July 26 to recount the
sacrifice and martyrdom of ourarmed forces that brought laurelsto the nation by defeating a deceit-ful and untrustworthy neighbourof ours during the Kargil War of1999. It is celebrated to honour thesacrifices of our brave soldiers,who laid down their lives on thelofty heights of Kargil on the front-lines to secure an unparalleled vic-tory in the annals of military histo-ry. The war, fought mainly in theuncompromising climate of theupper Himalayas, saw the rawcourage of Indian soldiers assault-ing uphill, unmindful of enemyfire and dislodging them after atough hand-to-hand fight. Theyregained our lost territory whichthe enemy forces had occupiedsurreptitiously, throwing to windthe unsigned convention betweenthe two armies of maintaining sta-tus quo in the traditional gapsalong the Line of Control (LoC).But for the raw courage and auda-cious bravery of our soldiers andyoung officers, history wouldhave been different as theunscrupulous enemy had succeed-ed in taking us by surprise. Sadlyenough, what happened in Kargilis being replicated, albeit on amuch larger scale, across thetrans- Himalayan region inEastern Ladakh along the Line ofActual Control (LAC).We were surprised then and wehave been surprised now.Intelligence, Surveillance andReconnaissance (ISR ) remain ourmajor weakness. Since the warwas limited and the LoC wasmuch smaller in length, thoughthere were shortages, the crunchwas not felt. The amassing ofBofors guns and ammunitionplayed a crucial role in enablinginfantry assaults. The Indian AirForce (IAF), too, played a majorrole though it was not equipped tofight at those heights with therestriction of not crossing the LoC.India also successfully called thenuclear bluff of Pakistan. A deter-mined political leadership made acritical difference. The higher mil-itary leadership and higher direc-tion of war left many questions tobe answered which were subse-quently addressed by the KargilReview Committee (KRC) butunfortunately no heads rolled.Our true homage to the martyrswould be to say with certainty andauthority that their sacrificeswould not go waste and a Kargil-like situation will not be repeated.While we can say with confidencethat Kargil 2.0 will not happenagain but while achieving thatcapability, did we ignore our otherneighbour? While we consideredPakistan as a threat, we continuedto treat China as a challenge. Ourpolitical leadership was convincedabout averting a conflict withChina through political and diplo-matic outreach. Despite the alarmraised by the Army and otherservices, the political hierarchywas overconfident of their capa-bility to handle China. LikePakistan, China, too, proved to betreacherous and lulled our leader-ship into being friendly because itneeded the Indian market to
become an economic superpower.China all the while wanted to bethe sole power in Asia but ourleadership failed to read theChinese mind correctly as it didwith Pakistan at the time of Kargil.While AB Vajpayee had taken abus ride to Lahore in search ofpeace, its scheming Army ChiefPervez Musharraf was planningthe Kargil incursions.Like any developing nation with alarge segment of the populationbelow the poverty line, we alsoface the dilemma of butter versusbarrel of the gun. EveryGovernment had to tread a verycautious path while allocatingresources for defence forces. Evenduring Kargil, General Malik, thethen chief, had said that “myArmy will fight with whatever wehave.” Immediately after Kargil,unmanned aerial vehicles (UAVs)and other surveillance equipmentwere added to the inventory.However, post-Kargil, because ofthe Bofors scandal, all majordefence contracts were put onhold. As a result, the country’sarmed forces began to suffer notonly obsolescence but shortages inspares, affecting the battle-readi-ness of equipment.However, the trend was reversedpost-2014 and big ticket purchaseswere made for enhancing the com-bat efficiency of the forces.Delegation and enhancement offinancial powers was also done toenable the armed forces to meettheir immediate and critical needs.Today, our armed forces are well-equipped with latest platforms,smart munitions, UAVs, missilesand so on. We have definitelymade a qualitative jump butnumerically we are still short offighting a sustained two-frontwar. Also criticality still exists inour Air Defence and the infantryweapon systems. The Navy andIAF also have critical gaps whichneed to be filled. Depending onthe quality of security we need, apercentage of the GDP (not below3.5) has to be earmarked for thedefence budget.Unlike 1999, when we had justbecome a nuclear power, today weboast of our triad capability withICBM capability. However, inview of the looming threat, wemust review our policy of “NoFirst Use.” India has alwaysbelieved in honouring varioustreaties and agreements but bothour neighbours have shown scantrespect for them while threateningus on the LoC/LAC. In the case ofKargil, the plan was made as earlyas during the Zia regime. Weshould have known about it.Thereafter, Pakistan began a proxywar against us. Just prior to KargilWar, it began regular shelling ofthe national highway, linkingKashmir and Ladakh. Ourresponses were mainly defensiveand ad-hoc. Pro-active and puni-tive responses were absent due tothe fear of an escalation. Pakistantook advantage of it, ignored theunderstanding about “traditionalgaps” and presented us a faitaccompli in the form of Kargilincursions.It is the same with China. Despitesalami-slicing, we continued toappease it. Even after Doklam, wefailed to wake up. The net result isthe multi-point, well- planned
incursions in eastern Ladakh witha definite aim of holding out andnot vacating. Our planners wouldhave known that our claim ofAksai Chin and Gilgit Baltistanwill definitely raise hackles inChina because both are very criti-cal to Chinese President XiJinping’s pet project of the Beltand Road Initiative (BRI).However, our planners, includingthe military, failed to take any pre-ventive and precautionary meas-ures to thwart the Chinese threat.Once again we are reacting.Worried about escalation, we didnot even exercise the option ofquid pro quo. Now it may be toolate though the LAC is quite vastand the enemy has many vulnera-bilities. The possibility of collusionbetween China and Pakistan can-not be ruled out completely,though Islamabad does not havethe capability to launch such anoffensive for the time being.Where we were holding the entirefrontage with a brigade then, nowwe have a full infantry divisionwith well-sited and hardeneddefences along the entire length ofthe LoC. Similarly, compared to1962, our defences in easternLadakh are very strongly heldwith adequate reserves and a well-developed road and track net-work. The Kargil experience hasshown us that a ratio of 1:9 or 1:12is needed in these heights tolaunch offensive operations.ISR was a weakness then andremains so even today. Though alot of structural changes havetaken place like the DefenceIntelligence Agency (DIA),National Technical ResearchOrganisation (NTRO), DefenceImage Processing and AnalysisCentre (DIPAC), yet the optimalhas not been achieved. The prob-lem does not lie in the assets but intimely processing and dissemina-tion. The permanent office of theNational Security Advisor (NSA)is meant to look into this vitalaspect of national security man-agement but the desired level ofintegration has not taken place.We also need to enhance the capa-bility of operational and tacticalintelligence. In such a terrain, withunpredictable and harsh weather,a multi-mode, multi-layered, all-weather, 24x7 surveillance grid isneeded. We also need to developcapability to monitor the move-ment of Chinese troops and for-mations to the plateau or towardsthe LAC from the XinjiangMilitary District. Mountains doimpose certain restrictions but weneed to invest more in therequired means. Lack of jointnesswas a major lesson from Kargil.Here I would like to quote thefirst-hand experience of the thenColonel General Staff of 8Mountain Division, which wasmoved from the Valley to dislodgethe intruders. “Ever since the infa-mous huff between the then Armyand IAF chiefs in the initial stagesof the operations, the Army andAir Force never operated in uni-son. In the first week of June, theIAF recommenced OperationSafed Sagar as we were inOperation Vijay. Two standaloneoperations in a small mountainousarea, where the IAF had neveroperated earlier.

Centre tells SCSolicitor General Tushar Mehta, representing theCentre, made the submission that the detention willnot be extended. To this, senior advocate DushyantDave, on behalf of Qayoom, said the bar associationpresident’s fundamental rights were being violatedwith this “illegal detention”.Dave and counsel Vrinda Grover contended thatQayoom should be released now especially since theCentre has decided not to extend his detention order.The Supreme Court bench then asked Mehta to con-sider releasing him on bail for the rest of the detentionperiod.The top court said that it was trying to figure out a“workable arrangement”. “The government may havesome apprehensions to release him due to theapproaching date,” the court said. “Are you willing torelease him if he doesn’t go there [Jammu andKashmir] till the seventh, agrees to stay in Delhi andnot release any statements?”Following this, the proceedings were adjourned tillJuly 29.The Centre on Monday informed the Supreme Courtthat the detention order of Jammu and Kashmir BarAssociation President Mian Abdul Qayoom will notbe extended when it ends on August 6, reported Barand Bench. Qayoom was among several peopledetained when the Centre revoked the erstwhilestate’s special status and split the region into theUnion Territories of Jammu and Kashmir, and Ladakhin August.The bench of Justices Sanjay Kishan Paul, Ajay Rastogiand Aniruddha Bose took up Qayoom’s petitionagainst his detention.Qayoom’s plea also said that the High Court hadagreed that the grounds for the lawyer’s detentionwere “somewhat clumsy”, yet it upheld the detention.Detentions under the Public Safety ActMany Kashmiri politicians were also detained underthe Act when India revoked the special status ofJammu and Kashmir. Former Chief Minister OmarAbdullah was released from detention on March 24.After his release, Abdullah demanded the release ofother Kashmiri politicians, including former ChiefMinister Mehbooba Mufti. Abdullah’s release ordercame less than a week after the Supreme Court askedthe Centre to clarify on its intention to release himfrom detention.The administration had released Abdullah’s father onMarch 13. Farooq Abdullah was detained at his resi-dence in Gupkar Road in Srinagar.Peoples Democratic Party chief and former ChiefMinister Mehbooba Mufti still remains in detention.On June 8, the Supreme Court sought a response fromthe Centre and the Jammu and Kashmir administra-tion on a plea by Congress leader Saifuddin Soz’s wife,challenging his house arrest since August 5.The administration, however, released PeoplesDemocratic Party leader Naeem Akhtar on June 18.The previous day, the administration releasedNational Conference leader and former minister AliMohammad Sagar, after the High Court set aside hisdetention.

As the revocation ofJammu and Kashmir’sspecial status is set tocomplete one year onAugust 5, former ChiefMinister FarooqAbdullah on Sundaycalled for restoration ofits statehood and hopedthe Supreme Courtwould render justice bystriking down the repealof Article 370 provisions.In his first media inter-view after the abrogationof Article 370 of theConstitution that endedthe erstwhile state’s spe-cial status, Abdullah, 82,told PTI that his partywould continue to con-test the changes throughall democratic means.These changes were a“betrayal” of the trustreposed by the people ofJammu and Kashmirwhen the State acceded tothe Union of India, hesaid.The Centre had abrogat-ed the special status onAugust 5 last year, sayingArticle 370 had stalledthe development ofJammu and Kashmir,prevented proper educa-tion, health care andgrowth of industriesbesides not helping incurbing terrorism.The National Conference(NC), of which Abdullahis the President, has
mounted a legal chal-lenge in the SupremeCourt to the abrogationof Article 370 and carvingout of two union territo-ries of Jammu andKashmir, and Ladakhfrom the erstwhile state.The legislation passed byParliament and the sub-sequent orders issued bythe President were“unconstitutional”, it hassubmitted in the apexcourt which has set up afive-member bench tohear the matter.“As a political party it isbut natural that we willkeep the people informedabout what we are doingto get justice. We are veryclear that we do notaccept the changes forcedon us and will continue tooppose them,” said theveteran leader who wasarrested hours beforeArticle 370 provisionswere scrapped on August5 and spent over sevenmonths in detention.Abdullah, who hasserved three terms as theborder state’s chief minis-ter, said, “We will fightfor our rights, campaignfor our rights withindemocratic means. Wehave never used guns, wehave never used methodswhich are not constitu-tional. We are a demo-cratic mainstream partyand will use all demo-
cratic means at our dis-posal.”Describing the changes as“vishwasghat” (betrayalof trust) reposed by peo-ple of Jammu andKashmir at the time ofaccession, he said, “Thetrust we had reposed inDelhi has come tonought.”“There is a loss of trustand Delhi has to rebuildthe trust. That trust willcome only when thestatehood is restored andother changes arereversed. That has to bedone,” Abdullah, a sit-ting member of LokSabha, said.“What happened isunfortunate. They(Centre) said J and K willprogress once this thing(Article 370) is removed,militancy will disappear.I would like to ask thosepeople, has militancy dis-appeared? It hasincreased rather thandecreased. Any develop-ment? Zero development.Whatever we had wehave lost even that,” hesaid.Explaining his party’sdecision to move theSupreme Court,Abdullah said, “We areseeking justice from thehighest court of the landbecause of our faith in thejudiciary. We are hopefulthat justice will be ren-

relaxation of the restric-tions on Internet services,including 4G services,would be carried out atpresent”.The special committeecomprises the UnionHome Secretary,Department ofT e l e c o m m u n i c a t i o n sSecretary and the ChiefSecretary of J&K.On May 11, the J&Kadministration hadsought the dismissal of aplea by the Foundationfor Media Professionalsat the Supreme Court bypointing out that high-speed internet would
enable the spread of fakenews/ rumours, andtransfer of heavy audio/video files, which couldbe used by terror outfitsfor incitement as also inplanning attacks.To another question onthe J&K InformationDepartment’s MediaPolicy 2020, whichempowers the DIPR(Department ofInformation and PublicRelations) to examinemedia content for fakenews, plagiarism andunethical or anti-nationalactivities, Lt GovernorMurmu said, “I will
check this, this is notrequired. There are rele-vant IPC/ CrPC andother laws for this.”The policy, implementedby the InformationDepartment on May 15,2020, said, “DIPR shallexamine the content ofthe print, electronic andother forms of media forfake news, plagiarism,unethical or anti-nationalactivities.” Any individ-ual or group indulging inthis shall be de-empan-elled, it said.The Lieutenant Governorsaid that the DIPR didnot have the capacity to
decide whether a news is“anti-national.”“This obviously, only theagencies can check. Wecan delete this also (fromthe revised media policy).They (DIPR) only have todo the checks requiredfor accreditation, but notfacts… if there is such asituation, they will get itchecked from agencies.What is ‘anti-national’ isa parameter of law… theSupreme Court has givenjudgements on this fromtime to time… Again,agencies or police willhave to do (look intothis),” he said

died today late evening due to illness.
The news of sudden death of Justice Mehta has come
as a shock to legal fraternity and as a big loss to the Bar
and the Bench.
Justice Sanjay Gupta, 59, is survived by his wife and
one son and one daughter.
Justice Sanjay Kumar Gupta was Born on 24.11.1961,
did matriculation from Oriental Academy, Jammu in
1976, did B.Sc with full medical subjects from G.G.M
Science College, Jammu in 1982, did L.L.B. from
University of Jammu. Enrolled as Advocate in Bar
Council of Delhi in 1986, joined Jammu bar in the
Chamber of S.S Lehar (Senior Advocate) and practised
in all fields including criminal, civil, revenue , MACT
etc in subordinate courts and before High Court. Was
selected as direct recruit in higher judicial service as
District and Sessions Judge on 22.01.2004 and was
posted as Additional District and Sessions Judge
Doda, served as District and Sessions Judge in various
courts at Jammu, including 1st additional, 2nd addi-
tional ,3rd additional ,additional District and Sessions
judge and Principal District and Sessions Judge
Jammu. Also remained posted as 3rd and 4th addi-
tional District and sessions Judge Srinagar ,Judicial
member special tribunal, J&K at Jammu. One man for-
est tribunal Jammu and Kashmir, Principal District
