FINDING: CONSISTENCY - The project, as described in Condition No . 1 and as conditioned,conforms to the policies, requirements, and standards of the Monterey County Genera lPlan, Del Monte Forest Land Use Plan (LUP), Monterey County Zoning Ordinance (Titl e20) Part 1, and Monterey County Zoning Ordinance (Title 20) Part 5 (Coasta lImplementation Plan for the Del Monte Forest), which designates this area as appropriat efor development .

EVIDENCE : (a)

The text, policies, and regulations in the above referenced documents have bee nevaluated during the course of review of applications . As proposed andconditioned, no conflicts were found to exist . No other communications werereceived during the course of review of the project indicating any inconsistencie swith the text, policies, and regulations in these documents .

(b)

The property is located at 1516 Riata Road (Assessor's Parcel Number 008-351-033-000), Pebble Beach Sub-Planning Area, Del Monte Forest Land Use Plan ,Coastal Zone . The parcel is zoned Low Density Residential, 1 .5 units per acre,with a Design Control District Overlay ("LDR/1 .5-D"), which allows theconstruction of additions with a Coastal Administrative Permit . Therefore, theproperty is suitable for the proposed development .

(c)

The project planner conducted site inspections on August 13, 2008, and January 8 ,2009, to verify that the project on the subject parcel confoiins to the plans liste dabove.

(d)

Pescadero Watershed : The project site is located within the Pescadero Watershed ,which limits structural coverage to 5,000 square feet and impervious coverage t o4,000 square feet (Section 20 .147.030, CIP, Part 5) . The project, as proposed,

will not increase the existing structural coverage of 5,000 square feet . Theproposed addition will be located above the existing garage .Public Access . See Finding No. 6 .Scenic and Visual Resources : The property is located in the area identified on th eDel Monte Forest Land Use Plan (LUP) Visual Resources Map (Figure 2C of theLUP) as visible from the Point Lobos State Reserve . The policies of the DelMonte Forest LUP direct that placement and design of new development no tinjure the visual integrity of the area . Staff conducted site visits on August 13 ,2008, and January 8, 2009, to assess the potential viewshed impacts of the projec tfrom the Point Lobos State Reserve. Based on the site visit, the existing an dproposed structures are not and will not be visible from Point Lobos due to existin gtree screening .Del Monte Forest LUAC : The project was referred to the Del Monte Forest LandUse Advisory Committee (LUAC) for review . Based on the LUAC Procedur eguidelines adopted by the Monterey County Board of Supervisors per ResolutionNo. 08-338, this application did warrant referral to the LUAC because it involve da Design Approval subject to review by the Zoning Administrator . The DelMonte Forest LUAC unanimously recommended approval at a public meetin gheld on January 8, 2009 .Cultural Resources : The project includes a Coastal Development Permit to allowdevelopment within a 750 foot cultural resources buffer zone. County recordsidentify the project site is within an area of high sensitivity for prehistoric culturalresources . However, the requirement for a preliminary archaeological report wa swaived for this project pursuant to the Coastal Implementation Plan for the DelMonte Forest, Section 20 .147 .080.B .5, because a previous report (LIB030200 )was prepared for the site by a qualified archaeologist which included the currentsite within the scope of the survey . The report concluded that there is no surfaceevidence of potentially significant archaeological resources . Also, the structuraladdition is a second story that will result in minimal ground disturbance outside o fthe existing footprint. The potential for inadvertent impacts to cultural resourcesis limited and will be controlled by the use of project conditions (Condition No .3) .The application, project plans, and related support materials submitted by theproject applicant to the Monterey County RMA - Planning Department for theproposed development found in Project File PLN080372 .

FINDING: SITE SUITABILITY - The site is physically suitable for the use proposed .EVIDENCE : (a)

The project has been reviewed for site suitability by the following departmentsand agencies : RMA - Planning Department, Pebble Beach Community Service s(Fire Protection) District, Public Works, Environmental Health Division, and theWater Resources Agency . There has been no indication from thesedepartments/agencies that the site is not suitable for the proposed development .Recommended conditions have been incorporated.

FINDING: CEQA (Exempt) - The project is categorically exempt from environmental review an dno unusual circumstances were identified to exist for the proposed project .

EVIDENCE : (a)

California Environmental Quality Act (CEQA) Guidelines Section 15301 (e )categorically exempts additions to existing structures provided the addition wil lnot result in an increase of more than 50 percent of the floor area of the structure sbefore the addition, or 2,500 square feet, whichever is less .

(b)

No adverse environmental effects were identified during staff review of th edevelopment application during site visits on August 13, 2008, and January 8 ,2009 .

(c)

FINDING: NO

VIOLATIONS - The subject property currently has a violation (CE090008), whic his related to the implementation of construction work prior to the issuance of the require ddiscretionary and ministerial permits . The proposed project and the associated Combine dDevelopment Permit is required to bring the property into compliance with all rules an dregulations pertaining to zoning uses, subdivision, and any other applicable provisions o fthe County's zoning ordinance. Zoning violation abatement costs, if any, have been paid.

EVIDENCE : (a)

Zoning violations on the subject property (Assessor's Parcel Number 008-351 -033-000) relate to the construction of a 820 square foot addition prior to th eissuance of the required discretionary and ministerial permits . Correctivemeasures, fines, and enforcement fees have been colleted . No further codeenforcement actions have been deemed necessary .

(b)

Building and Planning staff reviewed the conditions of the site on January 7 and 8 ,2009, and determined that necessary corrective measures can be achieved a sproposed by the application and that no additional corrective measures ar enecessary to bring the property into compliance with all applicable regulations .

(c)

Review of Planning Department and Building Services Department records b ystaff has concluded that no other code violations exist on the subject property .

FINDING: HEALTH AND SAFETY - The establishment, maintenance, or operation of the projectapplied for will not under the circumstances of this particular case be detrimental to th ehealth, safety, peace, morals, comfort, and general welfare of persons residing or workin gin the neighborhood of such proposed use, or be detrimental or injurious to property an dimprovements in the neighborhood or to the general welfare of the County .

The proposed project is in confonnity with the publi caccess policies of Chapter 5 of the Del Monte Forest LUP, and Section 20 .147.130 of th eMonterey County Zoning Ordinance (Part 5 - Coastal Implementation Plan) .
