5) DISCUSSION/RECOMMENDATION: Request by Sara & Jesse LaCrosse,

2442 School Ln, for the following; a) Rezone from Rural Residential to Neighborhood Business

b) Conditional Use for a single family home and accessory buildingFor parcel SU -317- 1. Located on the north side of School Ln about 1/ 2 mile west ofRiverside Dr.

Staff Report:

The applicant would like to open a small hair salon in/at her home. This would

be located in the existing accessory garage rather than the home. As such it isnot considered an " in home" business by our definition. This would be anallowable use in Neighborhood Business. The existing single family homewould be allowed by conditional use approval. A second accessory garage willbe constructed for personal use.

The comp plan does not specifically show this lot as a futurecommercial/mixed use but it is 1/ 2 mile to the east and there is business just

one lot further to the west. Staff believes this meets the intent of the compplan and would not believe any modification to that plan would be required.

Planning & Zoning Commission Minutes, 02/ 08/ 17

This property is located in an area not scheduled to receive sewer or water. Allservices would remain private.

The accessory building has been looked at by an architect and they will beproviding the proper plans for the conversion to a business use. BrownCounty, I believe, has also been contacted about the septic system. The existing building does not meet the exterior finish requirements of thecode but as an existing building staff would not require that unless an additionwas to be considered. The building currently matches the home. A monumentsign would be allowed for this zoning. This will require 2 separate motions.

Discussion points:

Does not plan on expanding.

Wants to be the only one doing hair. Wants to be on site because of their children.

Made more sense than driving into Green Bay.

Motion by Yaggie to recommend approval of a rezone of SU -317- 1, 2442 SchoolLn from Rural Residential to Neighborhood Business, second by Ward, motioncarried 6- 0.

Motion by Thomson to recommend approval of a conditional use to allow a singlefamily home in Neighborhood Business along with an accessory building to alsobe reviewed by Design Review Committee. Add any conditions you feel arenecessary, second by Magray, motion carried 6- 0.

6) DISCUSSION/RECOMMENDATION: Request by WMJR Family LLC & Chambers Land & Trust for preliminary plat approval for Chambers Hill Farm

Addition, as prepared by Soletski Surveying. Parcels SU -627, SU -628, SU -629, SU -630, SU -631, SU -632, SU -647, SU -657-2, & SU -657. Located on the east

side of Velp Ave. south of Wood 1n, & north of Ranchu Rd. Zoned Residential

Sewer.

Staff Report:

70 proposed lots with one of those, far east on plat, left for future condo typeuse. Staff believes the applicant should consider gaining the conditional use

approval for this prior to or along with the final plat. Approvals will be easierbefore the subdivision is built up. As long as the count and type of units areapproved, a final site plan could always come back at a later date. The street names are being considered by the Suamico Historical PreservationCommission at their Feb.

meeting. Any recommendation will be broughtforward to the P & Z Commission.

It has been questioned as to whether a second access point should be providedat time of construction. The approved ADP does show 2 additional access

points, one to Velp and one to Mulligan Way. To require either one of these atthis time would add a substantial cost to the project as the second Velp accesswould down near White Pine.

All of the lots would be served by public water & sewer.

Planning & Zoning Commission Minutes, 02/ 08/ 17

Road design is being reviewed by Public Works & Utility and Health & Safety. A trail is being considered along the sanitary sewer easementThe Developer does have the option of declaring up to 7 Duplex lots, per ourcode. I do not believe they are interesting in that at this time. Lot 108 appears to have an existing home on the property. Staff would like tosee that shown on the plat or as an attachment verifying all set -backs are met. There is also a structure that appears to be on lot 110. This likely belongs to anadjacent property owner. That will need to be removed. I don' t believe codewould allow it to be relocated to that property today. There are some lot line issues from previous land divisions that staff will need

to discuss with the surveyor to hopefully address. These do not affect thecurrent plat as drawn, but should be corrected.

The stormwater is being designed/reviewed by a Village consultant. The plat includes one outlot. It does not appear that any stormwater will bewith -in this lot as it is showing as all wetlands. The ownership of this lotneeds to be determined.

Discussion points:

Does not plan any duplexes.

Randy Matuszak, 2386 Ranchu Rd; question regarding the traffic coming out andonto Velp Ave. Would like the village to get ahead of the traffic issues on VelpAve. Will there be a roundabout on White Pine?

Steve Kubacki: at some point in time there will be a roundabout there. We need

to figure out where to get the dollars to do it. A total reconstruction of VelpAvenue is anticipated no later than 2027. In 2017, they are planning on an overlayand expanding certain areas while adding a five foot shoulder.

Motion by Yaggie to recommend approval of the preliminary plat of ChambersHill Farms 1 st addition with the following conditions; 1. Approval of the stormwater plan by the Village Board2. Review and approval of the road design by the Village Board3. Final design/ approval/need for the construction of a trail with -in the

subdivision.

4. Determination of ownership of outlot 1. S. Approval of a signed Developers agreement

6. Verification of the lot line issues/ questions that exist with this plat and

previous CSM' s

7. Payment of the parkland dedication fees of approximately $20,7008. Meet the requirements of all other applicable ordinances, regulations and

reviewing agencies,

9. Note that the developer has declined the option for duplex lots,

Background

The plat has changed a bit from your initial review in January. Less roads/cul-de- sacs.

This is a 14 lot plat being brought forward as a joint effort between 2 propertyowners. One existing home with outbuildings will remain on lot 10. The plat is in an area that is to remain rural in the Comp plan, thus requiring aminimum lot size of 2 acres or a PDD. The plat does meet the requirements for lot

sizes with a PDD. Staff has not seen the criteria the developers are proposing forthe PDD. We hope to have that to you for the meeting for yourreview/consideration.

The plat does include wetlands which should not impact any building sites andalso floodplain which is only a general " A" zone, not a studied area. With thegrades that exist, a formal flood study will likely not be required. This will onlyimpact lots 9 & 10. With 10 already built on, they would not see any impact fromthis. Lot 9 may have a few issues with flood insurance because a study was notcompleted. This would not be something that staff would likely have an issuewith, but may cause a few extra steps for a home owner with their financialinstitution. A note shall be included on the plat noting the lots that may require ashoreland permit from Suamico

The Historical Preservation Commission did look at the road names and

suggested that the cul-de- sac be considered for ;

o Sawmill Ct

o Grist Mill Ct

o Beaver Trail

They did like the main " Trappers Bend" name. This is only advisory to the Board. The building set -back is required to be 45ft. The plat shows 40ft. A note should be added to the plat restricting access to School LN, Cty HWY Bfor lots 1 - 4 & lot 14.

Stoimwater will be reviewed at a later date.

Fiscal Impact

Parkland Dedication fees of $3, 900 will be due at signing of the final plat. 13 new lots at300 each.

Suggested Motion

To recommend approval of the Preliminary Plat of Trappers Bend with a PlannedDevelopment overlay with the following conditions;

1. Correction of the building set -back to 45ft2. A note on lots 1- 4 & 14 restricting access to School Ln, County Hwy B3. A note included on the plat noting the lots that may require a shoreland permit

from Suamico

4. Review and approval of the stormwater plan by the Village5. Approval of a Developers agreement

6. Payment of the $ 3, 900 Parkland Dedication fee

7. Approval of the PDD restrictions

8. Meet the requirements of all other applicable ordinances, regulations and

reviewing agencies
