What is Hazing?
• Hazing activities are defined as (but not limited to): Any action taken or situation created, intentionally, whether on or off fraternity premises or during fraternity functions, to produce mental or physical discomfort, embarrassment, harassment, or ridicule. Such activities may include but are not limited to the following: use of alcoholic beverages; paddling in any form; branding; creation of excessive fatigue, physical or psychological shocks; quests; treasure hunts; scavenger hunts, road trips; or any other such activities carried on in the name of the fraternity; wearing of public apparel which is conspicuous and not normally in good taste; engaging in public stunts and buffoonery; morally degrading or humiliating games and activities; and any other activities which are not consistent with fraternal law, ritual or policy or the regulations and policies of the educational institution and local, state and federal laws.

“Hazing” refers to any activity expected of
someone joining a group (or to maintain full status
in a group) that humiliates, degrades or risks
emotional and/or physical harm, regardless of the person's willingness to
participate.

• § 268H. Hazing students prohibited
(a) Haze defined. -- In this section "haze" means doing any act or causing any situation which recklessly or intentionally subjects a student to the risk of serious bodily injury for the purpose of initiation into a student organization of a school, college, or university.
(b) Violation constitutes misdemeanor; penalty. -- A person who hazes a student so as to cause serious bodily injury to the student at any school, college, or university is guilty of a misdemeanor and, on conviction, is subject to a fine of not more than $500, or imprisonment for not more than 6 months, or both.
(c) Consent of student not defense. -- The implied or expressed consent of a student to hazing may not be a defense under this section.

• *2 On July 18, 1996, Reeves instructed Edwards to round up the other five pledges and meet him in a park dressed in jeans, a white t-shirt, and black gym shoes. Reeves also told Edwards that each person was to bring $50 and give it to Reeves. When they met, Reeves punched Hawkins in the chest for wearing black boots instead of black gym shoes and hit Edwards because he was in charge of organizing the group. The six men then repeated an oath, and Reeves told them that they had become official pledges.

• The following day, Edwards went to Terry's apartment where Terry told Edwards that he suspected that they were being asked to do things that were not right. Terry than called his brother Patrick Terry (“Patrick”) who was a student at DePauw University and helped establish the undergraduate local chapter of Kappa Alpha Psi Fraternity at DePauw in 1993. Patrick informed Terry that pledging was illegal, that they must be going through an underground pledge process, that the only way to become a valid member was through the Intake Process, and that participation in any pledging activity would likely bar their chances of getting initiated. The six pledges then met and Terry explained what his brother had told him. Later that night, the six met Reeves behind the NIU nursing building. Terry informed Reeves that he was no longer going to continue in the pledge process and asked for his $50 back, which Reeves refused to return. Hawkins then told Reeves that he had some questions, but Reeves refused to answer any questions and said that whoever wanted to continue in the process was to meet behind the NIU engineering building. In addition to Terry, Hawkins and another pledge decided no longer to participate in the process. Edwards and two others decided to continue and met Reeves behind the engineering building. Edwards then raised concerns about what Terry's brother had said about the pledge process, and Reeves responded by labeling Terry's brother a liar and proceeded to paddle the three remaining pledges on the buttocks.

• Edwards claims that the next time he was in Reeves apartment, somebody put out a cigarette in Edwards' hand. The three pledges also traveled to other college towns and were paddled on the buttocks or face. Terry stated that after he quit the pledge process he saw Edwards with what appeared to be a black eye and a swollen lip. On August 14, 1996, Edwards and the two remaining pledges signed a lease with Reeves, Bland, and Williams and began living off campus together.

• On about August 20, 1996, Edwards was driving his girlfriend's car between DeKalb and Aurora, Illinois, and stopped on the interstate. A state trooper stopped to see if he needed assistance. The following day, Edwards went to the emergency room at Kishwaukee Hospital in DeKalb. Edwards told the emergency room physician that he had been involved in a car accident and hit his head against the side window and the steering wheel. The doctor determined that he had a small contusion on his skull. Edwards followed up at the NIU Health Clinic the next day because he noticed blood in his urine. An ultrasound of his kidneys revealed no evidence of damage or trauma to his kidneys, and Edwards experienced no further discoloration of his urine.

• *3 Some time during August 1996, Edwards called the National Organization in Philadelphia. The person at the National Office informed Edwards that the pledging process had been outlawed and that Edwards should contact either Larry McKenzie (“McKenzie”) who is head of the North Central Province, or Reginald Motley. By this time, Edwards was upset because he had been told that he was going to be made a member by a particular date, but that date had come and gone without his becoming a member of Epsilon Omicron.

• Fraternity member was convicted in the Circuit Court, Somerset County, Daniel M. Long, J., of hazing. Member appealed.
• THIEME, Judge.• This case arises from four criminal informations filed in the
Circuit Court for Somerset County on June 18, 1998, charging appellant Jon-Mikael McKenzie and his co-defendant Vaughn E. Green FN1 with **69 second degree assault, hazing, and reckless endangerment. In the first, McKenzie was charged with three offenses against Marques Polk; in the second, the named victim was Dwayne Motley. In the third and fourth, Green was charged in connection with offenses against the two named victims.

• McKenzie was a member of the Kappa Alpha Psi Fraternity at the University of Maryland Eastern Shore (UMES). The faculty advisor of this fraternity had informed McKenzie that the hazing of pledges was not permitted, and McKenzie had agreed in writing that he would not engage in hazing.

• Nevertheless, at an unofficial meeting of pledges on February 8, 1998, fraternity leaders told Marquez Polk and Dwayne Motley that they would be beaten as part of their initiation into the fraternity. If they did not agree to be hazed, they would not enjoy full membership privileges. Over the course of the next two months, the men were struck, spanked, slapped, kicked, paddled, and caned “enumerable times.” So severe were the beatings that the canes and paddles used often broke on the pledges, and the two named victims were rendered bloody on several occasions. McKenzie, among others, inflicted the beatings.

• As a result of the beatings, both Polk and Motley eventually were hospitalized, presenting two main medical conditions: i) subcutaneous bleeding in the buttocks, and ii) gangrene in the tissue of the buttocks. Without medical intervention, both conditions are potentially fatal. Both men underwent surgery, *130 during which physicians excised large amounts of tissue and performed skin grafts.

1. Establish the chain of command– Chapter Polaris (or next senior chapter officer) take charge– Undergraduate Chapters: Immediately consult your Chapter Advisor (financial
member of neighboring alumni chapter)2. Seal and Control the Area
– Only chapter officers, advisors, and university officials should enter and leave until instructed otherwise by authorities
