Below are some real life examples of accidents in the workplace. Think about the roles and responsibilities of an employer and employee under the Health and Safety at Work Act 1974 and try to determine which is at fault for each case.

1. A worker fractured their ankle in a food factory when water vapour froze inside and on the outside edge of a freezer. Seals on the door did not shut fully or seal and the floor was uneven and worn. The company had ignored previous employees' pleas and Health and Safety Inspectors recommendations to improve working conditions.

2. An employee operating a carpet-beaming machine became entangled in accessible revolving machinery causing serious injuries. The guarding on the machine was not fixed or interlocked and the trip wire was not in the correct position.

3. A driver visiting a quarry and landfill site was fatally electrocuted when the grab on his lorry contacted an overhead powerline. The site was poorly laid out with inadequate signage and barriers.

The quarry owner/occupier/operator failed to cooperate with the investigation. Gathering the evidence to support the defended cases therefore presented major difficulties. Close working between the HSE, Customs and Excise, local planning authority, Environment Agency, County Council and solicitor agents was needed to identify the duty holders and make sure the legal proceedings moved forward successfully.
