Key objective: the RTAP

The Regional Transport Action Plan

► The Project supports the beneficiary countries with the implementation of RTAP actions on aviation namely:

► action 14 on the opening of the aviation market and

► actions 15 and 16 on making air transport safer and secure

► The Project also supports the RTAP in establishing the EuroMediterranean Common Aviation Area (EMCAA) a long-term strategic objective in relation to extending the EU's Common Aviation Area to all its Neighbours.


Key objective : the Roadmap

The Roadmap

► The Road Map was adopted by the Aviation Working Group at its 6th meeting, on 24th November 2009

► The Road Map is made up of 60 high level objectives

► For all these objectives the Road Map defines a planning for gradual implementation

► The detailed contents of the Project supports the Road Map


The expectations from the Project :

Specific results to be achieved per domains

► Market: further promotion of liberalization of the air transport market and the gradual removal of competition distortive measures;

► ATM: Enhancing the participation of the beneficiaries into the Single European Sky initiative (notably Functional Airspace Blocks initiatives); support the current regional initiatives (AEFMP) and participation of the beneficiaries and cooperate with Eurocontrol to ensure the proper implementation of the three pan-European functions;

► Safety: for those countries that are not participating in the EASA managed MASC initiative, a further promotion of the EU safety acquis and standards;

► Security: Enhancing security awareness and implementation of effective measures to ensure this;

► Environmental protection: among the actors involved with air transport to stimulate awareness to the environmental issues.

► Approach in steps

► In most domains activities will be performed in steps: typically a workshop would lauch an activity and an action plan will be put together; missions of assistance follow; one or more events would be organised thereafter for improvement and progress towards completion of the objective

► Living document

► The Work Plan is a living document updated on a regular basis (as a minimum every six months) to account for facts finding, progress actually achieved and changes to priorities.

► Conplementary orientation

► The Project was directed by end-2013 to shift focus on requests made on a case by case basis by beneficiary countries

► 9 countries - Syria excluded throughout the duration of the Project for political reasons and Libya included in February 2012

► Budget of 2M€ first allocated across domains, then continuously monitored:

Safety(0.3 M), Security (0.2 M), ATM (0.8 M), Market Access (0.3 M), Environment (0.2 M), Regional Visibility (0.2 M)

► 69 technical assistance activities carried out:

20 regional activities, including 4 AWG meetings

49 bilateral activities

► Over 500 persons participated to the activities

► 24 experts involved

► Around 1350 days of work performed

► Cooperation with key stakeholders: EASA, ECTL, Blue Med, AEFMP

Market Access: high level objective

► A further promotion of liberalization of the air transport market and the gradual removal of competition distortive measures.


Market Access: detailed objectives

► Reinforcement or establishment of an independent economic regulator in the field of air transport and a regulatory framework to handle competition issues.

► Ensuring that each partner country converges with EU principles established in Regulation EC 1008/2008 so that air carriers operating in the EMCAA are subject to equivalent financing requirements and similar conditions related to the granting / withdrawal of operating licenses.

► Reinforcement or establishment of an independent regulator and an accompanying regulatory framework for Passenger protection.

► Airport operations and ground handling:

To promote the opening-up of the ground-handling sector in the beneficiary countries in view of allowing self-handling of the airlines and the possibility for airlines to choose between several third-party handlers;

to promote the implementation of an airport charges scheme based on the principles of transparency, non-discrimination, consultation of the stakeholders and cost-relatedness.


Market Access: independent regulator

► To that effect a high level workshop presented:

► the general framework of competition law in EU about: Abuse of dominant position, antitrust,

State aids to firms in difficulties,

State financing at airports,

State start-up aid to airlines,

► and subject matters for the economic regulator: Air carriers licensing, Passengers protection, Ground handling, Airport charges schemes

► And participants commented the impact assessments carried out in those countries where competition is in place, with the case of Morocco as an example

► Results: Participants received an overview of the comprehensive material governing competition law, and a framework for subsequent EuroMed Aviation activities


Market Access: Passengers’ protection

► To that effect ad-hoc missions took place about

► The promotion of the ratification of the Montreal convention

► The adoption of legislation similar to :

► (EU) 261/2004 on passengers rights

► (EU) 1008 / 2008 on price transparency

► (EU) 1107/2006 on the rights of disabled persons and persons with reduced mobility when travelling by air

► Results

When the legislation and a dedicated service / unit will be in place it is expected that passengers will receive adequate compensation and assistance; there will be no discrimination between persons; straightforward rules on carrier liability will apply; non-compliant carriers will be exposed to sanctions that are efficient, proportionate and dissuasive.


Market Access: ground handling

► To that effect a high level workshop presented:

► A high level analysis of the impact of adopting 96/67 (or successor) performed when the Directive was put in place

► The rationale for a revision of the Directive, contents of the draft revision and shift from a Directive to a Regulation

► Views, experience and expectations of European stakeholders:

Air France: the expectations of a based carrier; the case of self- handling

Aviapartner: the expectations of a supplier

Toulouse airport: the expectations of the airport managing body

Detailed presentations by beneficiary countries participants

► Further to the workshop participants were requested to perform a detailed gap analysis based on a common matrix; the Project offered follow-on assistance for convergence based on specific situations.

Security: high level objective

► Enhancing security awareness and implementation of effective measures to ensure this


Security: Detailed objectives

► Harmonization of the regulations and national programmes

► To be reflected under the National Civil Aviation Security Programme, the National Civil Aviation Security Quality Control Programme and Training Programme with regulator separated from the entity that implements the security measures.

► Activity 3b: Passengers and baggage screening

► Measures equivalent to EC requirements in this matter should be implemented as they are more detailed as the applicable ICAO Annex 17 SARP.

► For each of the two topics the project should organise a workshop at regional or subregional level and in addition technical expert missions in those beneficiary countries where this is deemed necessary – as defined in the different national action plans developed under EuroMed Aviation I.


Harmonisation & separate regulator

► To that effect a high level workshop:

supported the implementation of the action plans regarding the harmonization of national legislation and national security programs of Beneficiary countries with EU regulations and requirements and strengthening of the enforcement powers of the appropriate authority.

Found out that main requests concentrate on “Security Equipment”, “Cargo” and “Assistance on organizational separation of the appropriate authority”.

Made it possible for the experts to put together then maintain over site specific missions a description on a country basis of identified differences and guide for assistance activities proposed by Beneficiaries countries to foster convergence.

► Thereafter ad-hoc missions took place


Pax & baggage screening; other areas of

interest

► Missions ran on an ad-hoc basis with beneficiary countries: Algeria, Egypt and Lebanon. In selecting the countries due consideration was also given to the status of the twinning programme, to avoid any risk of overlap.

► Algeria: the purpose of assistance was twofold:

calibrating the capacity, resources and enforcement powers of the authority

extension of the certification of acc3 (air carrier cargo third country)/ra3 (regulated agent third country) / kc3 (known consignor third country)

► Egypt: assistance was designed to enhance: National Security & Security Quality Control Programme standards on Recruitment, Training and Certification for Screeners, Instructors and

Security Managers standards and licensing for cargo, ACC·3, airport and in-flight supplies facilities standards on practical training for screeners

► Lebanon: Out of a comprehensive support programme circumstances dictated to concentrate efforts on developping the Airport Security Programme

Safety: high level objective

► For those countries that are not participating in the EASA managed MASC initiative, a further promotion of the EU safety acquis and standards.

► Those countries were at that time: Algeria, Egypt and Palestine

Note: MASC is a dedicated EU project set-up with EASA (2M€) parallel to EuroMed Aviation on aviation safety and specifically for those partners that expressed at that time a wish to collaborate intensively with the EU on aviation safety.


Safety: Detailed objectives for non-MASC

countries

► To assist the Mediterranean partners in aligning their ramp inspection regime with the common European procedures as established under the EC SAFA programme;

► To ensure a smooth and efficient implementation of the "Third Country Operator" authorisation as established by Regulation(EC) 216/2008;

► The other road map objectives and actions identified in the national actions plans notably an enhanced focus on the establishment of an independent safety regulator and harmonisation of certification rules applicable to aeronautical products and staff.


Safety: Actions performed under the

Workplan

► From the very beginning however EuroMed and MASC cooperated to provide joint support to all beneficiary countries. This took the form of seven workshops, giving maximum value for money and contributing to an « EMCAA spirit ».

► Five workshops ran by EuroMed: SAF 204-02 - Workshop - New European Regulation on Air Operations SAF 204-01 - Workshop - New European Regulation on Aircrew SAF 204-03 - Workshops on the requirements for Continuing Airworthiness SAF 201-02 - SAFA Training SAF 204-05 - Part 147 and Part 66 Training

► ►Two workshops ran by MASC: SAF 204-04 - Part 145 Training - Theory and practical OJT SAF 204-06 - Part M Training - Theory and practical OJT

► This gave beneficiaries inter alia a comprehensive view over the full compendium of EU legislation on continuous airworthiness and the new « AIR OPS » regulation.


Safety: Other actions performed

► End 2013 EC signed an agreement with EASA such that EASA would take care of “non-MASC” countries.

► Lybia Further to a request from EC, and although an activity whose scope is close to

an audit does not fall within the remits of the Project, the Project volunteered to assess the core capabilities of the Libyan Civil Aviation Authority (7 to 11 February 2014).

Experts performed within tight timing limits and under the stress of a demanding security environment and diplomatic warnings.

► Israel

Further to a discussions with the Civil Aviation Authority of Israel (CAAI) and although Israel is not a non-MASC country the Project assisted CAAI across 2014 in producing its State Safety Programme (SSP), with support from EASA through:
