NOTIFICATION

No. 10066-P/44C-14/2011 Kolkata, the 12th December, 2011.

WHEREAS allegations have been received that corruption I nepotism has taken place since formation of West?engal Housing Infrastructure Development Corporation (WBHIDCO) in procurement, allocation / transfer of land Iapartments situated within the area of the New Town, Kolkata (popularly known as the Rajarhat-New Town area) in thedistricts of North 24-Parganas and South 24-Parganas conducted by the West Bengal Housing Infrastructure Development

A D 'WHEREAS there has been wide-spread public concern about such incident;

AND WHEREAS in view of the gravity of the situation, the Governor is of the opinion that it is necessary to appointa Commission ofInquiry to inquire into and report on the irregularities on the procurement, allocation / transfer ofland /

apartments as aforesaid;

A TD WHEREAS no Commission of Inquiry has been appointed by the Central Government to inquire into the

aforesaid matter ; .

OW, THEREFORE, in exercise of the power conferred by section 3 of the Commissions of Inquiry Act, 1952 (60of 1952), the Governor is pleased hereby to appoint a Commission ofInquiry consisting of Hon'ble Mr. Justice RonojitMitra, retired Judge, I:Iigh Court, Calcutta (hereinafter referred to as the-Commission) to inquire into the aforesaid incidents.

The terms of reference of the Commission shall be as follows:

(c) To review the land acquisition and the additional land acquired but not yet leased for the project and determinethe illegalities involved in the transfer of the acquired land;

(d) To review the status of the resettlement and rehabilitation of the people affected;

(e) To recommend legal action against all those responsible for the illegality in the land procurement, land transfersand land allocation;

(f) To inquire into past allotment of land and apartments of Joint Venture Companies, etc. under the Chairman'sQuota and Special Quota and other discretionary methods, if any;

(g) To inquire whether undue favour has been extended to any individual or group or Joint Venture Companiesof West Bengal Housing Board or co-operatives (industrial or housing) in allotment of land and flat, bothcommercial and residential;

(h) To inquire into the details of fixation' of prices for purchase and sale of land;

(i) To inquire whether there has been any disproportionate increase in sale price in relation to purchase price andacquisition cost;

U) To identify person or persons who has / have been found responsible for irregularities / lapses committed inallotment of land and apartments;' ,

(k) To inquire into any other matter. relevant or incidental to the above questions which the Commission may deemfit and proper. .

The Commission may submit its report embodying the findings and its recommendations thereon to the StateGovernment within a period of3 (three) months from the date of this notification.

The Commission shall formulate its own procedure, select venue or venues of sittings and may give to all concernedsuch notice of the inquiry and all the procedures formulated by it as it may consider necessary and proper.

The Commission may be assisted by such officials and staff as it may require in connection with the inquiry.

The Governor, being further of the opinion that, having regard to the nature of the inquiry to be made and othercircumstances of the case, all the provisions of sub-sections (2) to (5) of section 5 of the Commissions of Inquiry Act,1952 (60 of 1952), should be made applicable to the Commission, is pleased hereby to direct, in exercise of the powersconferred by sub-section (1) of section 5 of the said Act, that all the aforesaid provisions shall apply to the Commission.

The Governor, being also of the opinion that, having regard to the nature of inquiry to be made and other circumstancesof the case, the provisions of section 5AA of the Commissions of Inquiry Act, 1952 (60 of 1952), should be madeapplicable to the Commission, is pleased to direct in exercise of the powers conferred by sub-section (1) of section 5AAof the said Act that all the aforesaid provisions shall apply to the Commission.

WHEREAS, a commission of inquiry under the chairmanship of Hon'ble Justice Ronojit Mitra, Retired Judge,Calcutta High Court had been appointed by the State Government in exercise of the power conferred by Section 3 of theCommissions of Inquiry Act, 1952 (Act 60 of 1952), vide the Home (Political) Department's Notification No. 10066-PI44C-14/20 11 dated 12.12.20 11, to inquire into the incident of corruption / nepotism since formation of West BengalHousing Infrastructure Development Corporation (WBHIDCO) in procurement, allocation / transfer ofland / apartmentssituated within the area of New Town, Kolkata (popularly known as the Rajarhat-New Town area) in the district of North24-Parganas and the said Commission subsequently took its effect with the appointment of Justice Ranendra NarayanRay, retired Judge, Allahabad High Court [hereinafter referred to as the Commission], vide the Home Department'sNotification No. 2063-P/44C-14/20 11 dated 19.03.2012 ;

AND WHEREAS, the term of the Commission needs to be continued further from 09.06.2014 ;

NOW, THEREFORE, the Governor is pleased to extend the term of the Commission with its existing terms andconditions, for a further period of one (l) year with effect from 09.06.2014 or till submission of its report, whichever isearlier.
