Message from the Chair

Welcome to the 2008 PIUG NE Conference and happy Sukkot.

First an apology. When I scheduled the meeting in 2007, I forgot to check for holidays. I will check for the 2009 conference.

This year there are three new records—the number of sponsors (20), the amount of money that Zhifu Shu raised, and the days of workshops. Last year ThomsonReuters requested a workshop day of their own. I could not accommodate them last year but agreed to try it in 2008. If it works out, we shall go to four days.

The conference is successful because of the people who generously donate their time and effort. A meeting takes a lot of planning and hard work. A huge thank you to everyone who made this meeting the success it is.

For this year and last, part of the program focused on hot topics. Last year was KSR; this year, it is mentoring, certification and qualifications of patent searchers. The first time it happened the topic was database standardiza-tion. Most of the time, the program is an amalgam of topics that depends on the presentation abstracts submitted. Usually, the program is split into practical information and legal/theoretical.

Generally, I am willing to accommodate special requests when I can. There have been two requests in the last two years. The exhibit room was moved from around the corner to adjacent to the meeting room. Instead of frozen kosher meals, last year they were freshly prepared. Via email, someone wanted to know if the exhibit room was open only on the day of the conference or open on the training days as well. My question to the sponsors: Would you want the exhibit room open on additional days? If so, which days? It would mean higher rates at all sponsor-ship levels. To meeting attendees, would you visit the exhibit room if it were open on workshop days (Monday, Wednesday, Thursday)?

Certification, Licensure and Legal Liability for Patent Information Professionals: A Primer

Abstract

On Tuesday, 05 August, 2008 I posted an inquiry to the PIUG discussion email list soliciting comments regarding requirements for becoming a professional patent searcher, especially as they pertain to certification, licensure and legal liability. This inquiry sprouted from my curiosity as a patents librarian desiring to learn about substantive differences in qualifications, liabilities, and practices between patent librarians and professional patent searchers. My inquiry garnered many responses on the topic from a variety of perspectives. My presentation will outline and summarize those responses, while reflecting on the original intent of my inquiry from the perspective of an aca-demic librarian and a representative of the Patents and Trademarks Depository Library Program (PTDLP).

Biography

Martin Wallace, a science and engineering librarian at the University of Maine in Orono, is the Patents and Trade-marks Depository Library Program (PTDLP) representative for the state of Maine. In 2007 he was the recipient of the PIUG Brian Stockdale Memorial Award. Martin is a currently a member of the Training Working Group of the PIUG Education and Training Task Force (PETT).

Biographies

Lucy Akers (Bristol-Meyers Squibb)

Lucy Akers is a U.S. patent agent with a degree in Chemistry. She worked for five years as an independent patent information consultant and has held corporate positions with Shell, ExxonMobil and Nerac, in management, advi-sory or individual contributor roles. She is currently a senior patent analyst with Bristol-Myers Squibb. For several years, Lucy has trained and has evaluated new patent information specialists in the WON/GO Institute course (certified by the Dutch government). This is a program that has celebrated the certification of more than 100 patent information specialists from various countries in Europe, Asia and Africa.

Cynthia S. Barcelon Yang (Bristol-Meyers Squibb)

Cynthia S. Barcelon Yang, the current PIUG Chair, works as the Director of Patent Analysis Group at Bristol-Myers Squibb (BMS). Prior to joining BMS in 2001, Cynthia had been employed at DuPont for over 20 years, initially as a research chemist and later as information scientist, group leader, project manager, patent searcher, and team leader in the Patent Information Services group at DuPont Pharmaceutical subsidiary. Cynthia obtained her M.S. degree in Chemistry from Marquette University and a M.S. degree in Information and Library Science from Drexel Uni-versity. She is a member of the American Chemical Society (ACS) and the BMS delegate to Patent Documentation Group (PDG). Cynthia recently joined the IPI Award Selection Board.

Edlyn Simmons (Procter & Gamble)

Edlyn S. Simmons is the winner of the 2005 International Patent Information Award. She is a founding member of PIUG, past Chair, and current Director-at-Large. She serves as Principal Information Scientist in the Infolytics department at The Procter & Gamble Company in Cincinnati, Ohio. She has B.S. and M.S. degrees in chemistry, and is a registered U.S. patent agent. Edlyn serves on the ACS Joint Board-Council Committee on Patents and Related Matters, the World Patent Information Editorial Advisory Board, and the IPI Award Selection Board. She has been a member of the faculty of the PERI course on Patent Information for Pharma/Biotech, serving as Course Director since 1995. She is the winner of the 2005 International Patent Information Award.

The PIUG Wiki – A New Medium for PIUG Collaboration and Discussion

Abstract

The new PIUG Wiki is designed to further the PIUG mission “to support, assist, improve and enhance the success of patent information professionals through leadership, education, communication, advocacy and networking.” It is also a Web 2.0 development. According to the Wikipedia entry, “Web 2.0 is a living term describing chang-ing trends in the use of World Wide Web technology and web design that aims to enhance creativity, information sharing, collaboration and functionality of the web. Web 2.0 concepts have led to the development and evolution of web-based communities and hosted services, such as social-networking sites, video sharing sites, wikis, blogs, and folksonomies.”

The PIUG Wiki has information sharing, social networking, and discussion forum functionality. It is expected to complement the current PIUG website, which will be reserved for generally static and official content, and the current PIUG Discussion List. The primary PIUG Wiki space is open to all patent information professionals worldwide through a simple signup procedure. Some content and features are limited to current PIUG members. For example, only PIUG members are able to create and maintain “Personal Spaces” that allow members to share information about themselves. These personal spaces are accessible to all wiki registrants and are analogous to profiles posted on LinkedIn and other social networking sites. The PIUG Board of Directors and PIUG committees, task forces, and teams will have private Wiki spaces open to their members only. Each Wiki space will have one or more discussion forums to eliminate the need for sending mass email to participants. Wiki spaces and forums have many powerful features including easy content creation and editing, easy application of links to other Wiki and web content, submission of collaborative comments to any entry, optional attachment of documents with check-out/checkin control, and complete user control over whether the user is notified by email of new contributions (“watches”). Forums are fully integrated within the Wiki and are open or closed in parallel with the wiki space in which they are hosted. Forum entries have clear topic thread format, full email push of new or edited content to all who are “watching” the forum, and no of out-of-office messages. The Wiki discussion forum may be viewed in time as superior to the email discussion list due to these advantageous features.

This presentation will introduce the Wiki and cover basic usage, including creating, viewing and watching Wiki content. Current development issues will be highlighted to stimulate discussion, encourage active community usage, and promote providing input towards further Wiki features improvement.

Biography

Tom formed Wolff Information Consulting LLC in 2006. Tom works as a patent information specialist and technical advisor on a contract basis. He has been PIUG webmaster for two years and chairs the PIUG Electronic Communi-cation Committee. Tom has a PhD from Stanford University in bioinorganic chemistry, B.S. from the Massachusetts Institute of Technology and is a registered patent agent.

The Facts on Legal Status - Who, What, Where, When & Why

Abstract

Following and understanding the various types of legal status as pertains to patents and applications is a daunting task. With various patenting offices around the world using differing legal status designations and codes, it is no wonder that today’s patent searcher can be overwhelmed in this area. This talk looks at where to find international patent legal status data and what it all means.

Biography

Jim Brown joined FIZ Karlsruhe, Inc. in 2008 after working at IFI Patent Intelligence for 23 years. At IFI, Jim started as a chemical patent indexer, and then moved on to chemical patent indexing training and chemical patent searching. He was also a special indexing project manager and technical representative. His current duties at FIZ Karlsruhe Inc. include customer trainings, authoring workshop manuals and presentations, and representing FIZ at conferences and exhibits. Jim has a Bachelor’s degree in Chemistry from the University of Delaware.

Updates on US Patent Law, Rules, and Practice

Abstract

Rick will provide an update on important U.S. patent law, including the appeal in Tafas v. Dudas, recently pro-posed and promulgated changes in USPTO patent rules, and provide a vision where U.S. patent law and practice are heading in the years to come.

Biography

Rick graduated from the University of Rochester with degrees in Physics and Mathematics, and he received a Ph.D. in Physics from Rutgers University in 1986. After working in R & D for the U.S. Army, Rick was hired by the law firm of Oblon, Spivak McClelland, Maier and Neustadt, PC, and began law school at George Washington University in 1990. From 1990 untill 2002, Rick worked his way up to partner and deputy head of the Oblon firm’s interference section. In 2002, Rick left Oblon and founded Neifeld IP Law, PC, where he has been ever since.

Rick is also a former chair of the Interference Committee of the AIPLA. He is widely published on patent law issues many of which appear on his firm’s web site, www.Neifeld.com. He also administers the popular-amongst-interference -practitioners “patentinterference” yahoo group list. He is also a co-founder of the www.patentval-uepredictor.com patent valuation service.

Rick is admitted to practice before the United States Patent and Trademark Office, the Virginia State Courts, the United States Court of Appeals for the Fourth Circuit, the United States District Court for the District of Columbia, and the Court of Appeals for the Federal Circuit.

Rick’s firm focuses on patent and trademark prosecution in the USPTO and abroad.

Locating Patent Information About the Newest High Technology: A Case Study of Nanotechnology Patents

Abstract

New technology is always difficult to find because the means of identifying anything new is problematic. There is no general agreement of naming conventions, and the usual coding systems lag behind the leading edge, all of this making it difficult to search for new concepts. This is especially significant in patent searching because, by definition, inventions become patents because they identify novel technology. This session will look at some of the problems with identifying new concepts found in patents and also how these concepts are treated by the various sources of patent information with an inclination on how to find more information. A case study on nanotechnol-ogy will be presented as this takes many forms and covers the areas of mechanical, chemical, and electrical pat-ents.

Biography

Ron has been conducting technical literature searches via online, batch and manual systems for over thirty years, specializing in patent information. As Director of Intellectual Property Segment at Dialog, he has worked with patent attorneys, examiners, students, researchers and patent searchers at top firms, offices and companies around the world and has presented many sessions and written many papers on search techniques. He has been at Dialog for twenty-seven years and has also held searching positions at different research companies. He co-authored a NISO standard on search languages which was then adopted into the equivalent European standard. He holds a BS in Chemistry, an MS in Computer Science and Information Systems, and a JD with a Certificate in Patent Law. He was a patent agent for several years and is now a patent attorney and is a member of several professional organizations including AIPLA, ABA, PIUG and is thirty-four-year member of the American Chemical Society.

Why IP is Important and What an IP Attorney Looks for in a “Good Search”

Abstract

Mr. Woodbridge’s presentation will focus on patent information gathering from the perspective of a patent attor-ney. What is it the attorney really needs? How can it be packaged to help the attorney the most? What other types of information can be provided for the attorney beyond the traditional novelty and infringement investigations? Mr. Woodbridge will draw upon his experience as a former US Patent Examiner and a registered patent attorney who has written and prosecuted hundreds patents to provide some useful insights into the unique information needs and opportunities in the rapidly changing patent field.

Richard C. Woodbridge is a partner in the Princeton Office of Fox Rothschild LLP a 435 attorney law firm with 14 offices in the United States. He graduated with a degree in Electrical Engineering from Princeton University in 1965 and a JD from George Washington University Law School in 1971. His specialty is computer, software and communications patent law as well a US and International trademarks.

PIUG General Information

The Patent Information Users Group (PIUG) was established in 1988. The objective of the group was to create a forum to discuss issues and concerns relevant to the patent searcher community. Also, PIUG promotes the importance of intel-lectual property, especially patent publications, and most specifically, the computerized patent databases. Since 1988, PIUG has worked with intellectual property database producers and vendors to maintain and to improve the quality of their product from the customer, or user, perspective.

From a modest sixteen original members, PIUG presently has over 634 active members from 30 countries. PIUG pro-duces a newsletter and has a formal annual meeting, usually held in May. For the past several years the meeting has been a multi-day event with presentations from experts in the fields of patent searching and patent law and also pre-sentations by personnel from patent granting authorities. Workshops on the days before and after the plenary sessions provide opportunities for meeting delegates to further develop their patent research and analysis skills. The meeting also showcases patent database providers, giving attendees a firsthand look at new search tools and enhancements in the databases themselves. A newsletter is published at least two times a year and contains member articles, search tips and information on patent database vendor and producer developments. In addition, PIUG supports a Discussion List which serves as a forum for discussion among patent search professionals worldwide.

Membership Information

As of April 2008, PIUG has 642 members, including nearly 300 patent information professionals who do patent search-ing for a corporation, about 100 patent information consultants, over 80 patent information professionals who do patent searching for law firms, and more than 20 searchers based in academic institutions. PIUG members are employed in performing patentability, freedom to practice, and validity patent searches for Fortune 500 / multinational companies, leading universities and major IP law firms. In recent years, PIUG members have also engaged in patent information analysis as a strategic innovation tool. We have a very active discussion list with over 1300 subscribers world-wide and produce a newsletter twice a year. The PIUG newsletter contains members’ articles, salary survey results, search tips, meeting trip reports, and information on patent database vendor and producer developments. Currently, the one-year membership fee for PIUG, Inc. is $US 40.00 ($US 20.00 for students/retired/unemployed).
