PHYSICIAN ADVISORY COMMITTEE
I.
INTRODUCTION
This is the 2010 annual report of the Physician Advisory Committee, an advisory body to
the Oklahoma Workers’ Compensation Court statutorily created by section 201.1 of Title 85 of
the Oklahoma Statutes. This report identifies the progress and activities of the committee during
calendar year 2010.
Current members of the committee are LeRoy E. Young, D.O., Chairman, Robert L.
Remondino, Vice Chairman, Jeff A. Fox, M.D., David Garrett, D.P.M., William R. Gillock, M.D.,
Duane G. Koehler, D.O., Scott A. Mitchell, D.O., John A. Munneke, M.D., and C. Keith Muse,
D.C.. A current membership list, including medical specialty, appointing authority and
congressional district represented, is included in the appendices to this report. Staff support for
the committee is provided by the Oklahoma Workers’ Compensation Court as provided in 85
O.S., Section 201.1(F).
II.
STATUTORY DUTIES
The statutory duties of the Physician Advisory Committee are set forth in 85 O.S. §201.1, a copy
of which is included in the appendices. These duties include:
• assisting and advising the Administrator of the Workers' Compensation Court
regarding utilization review and the medical practices of health care providers,
• making recommendations for acceptable deviations from the American Medical
Association's "Guides to the Evaluation of Permanent Impairment" and for
alternative methods of evaluating permanent impairment,
• adopting treatment guidelines and protocols for treatment of injuries to the hand,
wrist, back, knee, neck and shoulder and utilization controls for all treatments,
• adopting guidelines for the prescription and dispensing of controlled substances,
• providing general recommendations to the judges of the Workers' Compensation
Court regarding issues of injury causation and apportionment, and
• conducting educational seminars and assisting the judges of the Workers'
Compensation Court in accessing medical information.

III. 2010 ACTIVITIES
The primary focus of the Physician Advisory Committee during 2010 was the continued
development of guidelines and protocols for the treatment of injuries pursuant to the legislature’s
statutory direction. The Committee continued to review nationally accepted treatment guidelines
and protocols in the treatment areas mandated by the legislature, including the American Pain
Society’s report on Pain Management, Medicare’s study on Epidural Injections, and the North
American Spine Society’s Guidelines on Cervical Radiculopathy. The Committee also reviewed
the American College of Occupational and Environmental Medicine’s Guide to High-Value
Physician Services in Workers’ Compensation.
The Committee heard several presentations over different topics related to workers’
compensation during the year. Mr. Edminsten, an Oklahoma Bureau of Narcotics and Dangerous
Drugs Agent, presented information on diversion and fraud as related to prescription drug crimes.
Ms. Susan Rogers, General Counsel of the Bureau of Narcotics, presented information on the
Prescription Monitoring Program for Oklahoma. Ms. Tish Sommer, Workers’ Compensation
Court Special Counsel, reported on workers’ compensation related legislation of interest to the
Committee.
The Committee completed development of one treatment guideline during 2010.
Following a public hearing, the Committee adopted Treatment Guidelines for Continuing Medical
Maintenance for Scheduled Drugs, which are pending review and approval by the Workers’
Compensation Court Administrator.
The treatment guidelines developed by the committee and adopted as provided by law are
intended to prevent over-utilization by outlining a standard course of treatment for a workers’
compensation injury. The guidelines also are intended to promote optimum recovery and return
to work, while containing workers’ compensation costs. The Committee continues to work
toward the development of additional guidelines.
In October 2010, Chairman LeRoy Young, D.O., and Committee Member William
Gillock, M.D., participated in the Oklahoma Bar Association’s educational program entitled
Workers’ Compensation: New Directions. They discussed Committee activities, legislative
changes impacting the Committee, and the Committee’s efforts regarding development of
continuing medical maintenance treatment guidelines.
IV. PUBLIC MEETINGS & HEARINGS
The Committee held four (4) public meetings, one (1) special meeting, and two (2) public
hearings in 2010. A copy of the agendas and minutes for each of the meetings is in the appendices
to this report.
Regular meetings of the Committee for calendar year 2011 are scheduled on January 14,
2011, April 15, 2011, July 15, 2011, and October 14, 2011. The meetings are scheduled for 2:00
p.m. in the second floor En Banc Courtroom at the Workers’ Compensation Court, 1915 N. Stiles
Avenue, Oklahoma City, Oklahoma.

V. CONCLUSION
The Physician Advisory Committee is pleased to submit this report. We hope our efforts
help enhance meaningful review of medical issues affecting our state’s workers’ compensation
system.

A. 1. There is hereby created a Physician Advisory Committee comprised of nine (9) members
to be appointed as follows:
a. the Governor shall appoint three members, one of whom shall be licensed in this
state as a doctor of medicine and surgery, one of whom shall be engaged in the
practice of family medicine in a rural community of the state, and one of whom
shall be an osteopathic physician,
b. the President Pro Tempore of the Senate shall appoint three members, one of
whom shall be licensed in this state as a doctor of medicine and surgery, one of
whom shall be licensed in this state either as a doctor of medicine or a doctor of
osteopathy and shall be engaged in the practice of occupational medicine, and
one of whom shall be licensed in this state as a podiatric physician,
c. the Speaker of the House of Representatives shall appoint three members, one of
whom shall be licensed in this state as an osteopathic physician, one of whom
shall be licensed in this state either as a doctor of medicine or a doctor of
osteopathy, and one of whom shall be licensed in this state as a chiropractic
physician.
2. a. To fill the positions for which the term of office expires on January 1, 1996, the
Governor shall appoint a resident of the Fifth Congressional District, the President Pro
Tempore of the Senate shall appoint a resident of the First Congressional District and the
Speaker of the House of Representatives shall appoint a resident of the Second
Congressional District.
b. To fill the positions for which the term of office expires on January 1, 1997, the
Governor shall appoint a resident of the Sixth Congressional District, the
President Pro Tempore of the Senate shall appoint a resident of the Third
Congressional District and the Speaker of the House of Representatives shall
appoint a resident of the Fourth Congressional District.
c. To fill the positions for which the term of office expires on January 1, 1998, the
Governor, the President Pro Tempore of the Senate and the Speaker of the
House of Representatives shall appoint residents of the state at large.
d. Thereafter, appointments shall be made from the Congressional District
numbered the same as the district from which the original appointment was
made pursuant to this paragraph, if a Congressional District so numbered exists.
When congressional districts are redrawn, each member appointed prior to July
1 of the year in which such modification becomes effective shall complete the
current term of office and appointments made after July 1 of the year in which
such modification becomes effective shall be based on the redrawn districts. Appointments that were to be made from a numbered Congressional District
which no longer exists shall be appointed from the state at large.

e. Effective July 1, 2005, all members of the Physicians Advisory Committee shall
be subject to reappointment regardless of their appointment date, with any new
appointee to serve out the remainder of the unexpired term of the committee
member so replaced.
B. The Committee shall:
1. Assist and advise the Administrator of the Workers' Compensation Court regarding
utilization review as it relates to the medical practice and treatment of work-related
injuries. Such utilization review shall include a review of reasonable and necessary
treatment; abusive practices; needless treatments, testing, or procedures; or a pattern of
billing in excess of or in violation of the Schedule of Medical Fees. The Physician
Advisory Committee shall review and make findings and recommendations to the
Administrator of the Workers' Compensation Court with respect to charges of
inappropriate or unnecessary treatment or procedures, abusive practices, or excessive
billing disclosed through utilization review. The guidelines shall be designed to assist providers by offering an analytical framework for the evaluation and treatment of injured
workers.
The Workers’ Compensation Court shall be bound by the findings and recommendations
of the Physician Advisory Committee in regard to reasonable and necessary medical treatment, duration of treatment, continuing medical maintenance, and development of a
formulary for the use of prescription medicines, unless there is clear and convincing
evidence to the contrary. Any order for medical care not consistent with findings and
recommendations of the Physician Advisory Committee shall contain specific findings to
support the deviation from said findings and recommendations;
2. Assist the Administrator of the Workers' Compensation Court in reviewing medical
practices of health care providers, including evaluations of permanent impairment
provided by health care providers, as provided for in Section 201 of this title. The
Committee shall review and make findings and recommendations to the Administrator
with respect to charges of abusive practices by health care providers providing medical
services or evaluations of permanent impairment through the workers' compensation
system;
3. After public hearing, review and make recommendations for acceptable deviations from
the American Medical Association's "Guides to the Evaluation of Permanent Impairment"
using appropriate and scientifically valid data. Those recommendations may be adopted,
in part or in whole, by the Administrator to be used as provided for in paragraph 11 of
Section 3 and Section 22 of this title;
4. After public hearing, review and make recommendations for an alternative method or
system to evaluate permanent impairment that shall be used in place of or in combination
with the American Medical Association's "Guides to the Evaluation of Permanent
Impairment". Appropriate and scientific data shall be considered. The alternative method
or system to evaluate permanent impairment may be adopted, in part or in whole, by the
Administrator to be used as provided for in paragraph 11 of Section 3 and Section 22 of this title. Revisions, deviations and alternatives to the American Medical Association's
"Guides to the Evaluation of Permanent Impairment" shall become effective as provided
in paragraph 11 of Section 3 and Section 22 of this title;
5. After public hearing, adopt treatment guidelines and protocols for treatment of injuries,
including, but not limited to, injuries to the hand, wrist, back, knee, neck and shoulder
and utilization controls for all treatments, including, but not limited to, x-ray and imaging

technology for diagnostic purposes, for adoption by the Administrator. Treatment
guidelines and protocols shall be based upon nationally accepted practice standards and
shall indicate when surgery is indicated and the appropriate surgical procedure for the
condition. Compliance with treatment guidelines shall be mandatory and an employer or
insurer for an employer shall not be required to pay for treatment which is not in
compliance with the guidelines, unless prior authorization is received. If an employer or insurer for an employer refuses to give such prior authorization, the employee may
request the case be reviewed by an independent medical examiner pursuant to the
provisions of subsection B of Section 17 of this title. Provided, however, if the employer
and employee are unable to agree on the appointment of an independent medical
examiner for prior authorization purposes, the Court shall randomly select an independent
medical examiner within seven (7) days of receipt of a written request by the employee.
The independent medical examiner shall review the medical records of the employee,
examine the employee, or both, as necessary to render an opinion as to whether prior
authorization should be given. If prior authorization is granted, the employer shall pay the
costs of the independent medical examiner subject to limits established by the
Administrator. If prior authorization is denied, the employee shall pay the costs of the
independent medical examiner subject to the limits established by the Administrator;
6. After public hearing, adopt guidelines for the prescription and dispensing of any
controlled substance included in Schedule II of the Uniform Controlled Dangerous
Substances Act;
7. Review utilization on cases or of providers when requested by any employer, injured
employee or insurer. The Committee may issue a public or private censure to any
provider for utilization which is excessive or inadequate, or recommend the Court order
treatment within the treatment guidelines;
8. Provide general recommendations to the judges of the Workers' Compensation Court on
the issues of injury causation and apportionment;
9. Conduct educational seminars for the judges of the Workers' Compensation Court,
employers, employees, and other interested parties;
10. Assist the judges of the Workers' Compensation Court in accessing medical information
from scientific literature; and
11. Report its progress annually to the Governor, the President Pro Tempore of the Senate,
and the Speaker of the House of Representatives.
C. The term of office for initial appointees shall expire March 1, 1994. Thereafter, successors in
office shall serve as follows:
1. The term of office for three positions, one each appointed by the Governor, the President
Pro Tempore of the Senate and the Speaker of the House of Representatives, shall expire
on January 1, 1996;
2. The term of office for three positions, one each appointed by the Governor, the President
Pro Tempore of the Senate and the Speaker of the House of Representatives, shall expire
on January 1, 1997;
3. The term of office for three positions, one each appointed by the Governor, the President
Pro Tempore of the Senate and the Speaker of the House of Representatives, shall expire
on January 1, 1998;

4. Thereafter, successors in office shall be appointed for a three-year term. Members shall
be eligible to succeed themselves in office; and
5. Any person appointed to fill a vacancy shall be appointed for the unexpired portion of the
term.
D. Members of the Physician Advisory Committee shall receive no compensation for serving on the
Committee but shall be reimbursed by the Workers' Compensation Court for their necessary travel
expenses incurred in the performance of their duties in accordance with the State Travel
Reimbursement Act.
E. Meetings of the Physician Advisory Committee shall be called by the Administrator but held at
least quarterly. The presence of a simple majority of the members constitutes a quorum. No action
shall be taken by the Physician Advisory Committee without the affirmative vote of at least a
simple majority of the members.
F. The Administrator shall provide office supplies and personnel of the Workers' Compensation
Court to assist the Committee in the performance of its duties.
G. Upon written request, the State Insurance Commissioner, CompSource Oklahoma, and every
approved self-insured employer in Oklahoma shall provide the Committee with data necessary to
the performance of its duties.
H. Any health care provider acting in good faith and within the scope of the provider's duties as a member of the Physician Advisory Committee shall be immune from civil liability for making any
report or other information available to the judges of the Workers' Compensation Court or to the
Administrator of the Workers' Compensation Court or for assisting in the origination,
investigation, or preparation of the report or other information so provided.

Call to Order: The meeting was called to order by the chairman, Dr. LeRoy
E. Young, on January 15, 2010 at 2:00 PM. The Secretary of State’s Office
had been notified of the meeting and the agenda was posted at the Workers’
Compensation Court’s Oklahoma City location, 1915 N. Stiles Avenue.
Roll call and determination of quorum: All members were present except
for Dr. Scott A. Mitchell who was unable to attend. A quorum was noted.
Announcements and Introductions: There were no announcements or
introductions.
Discussion and possible action concerning minutes for the October 9, 2009
regular meeting of the Physician Advisory Committee: A motion was made
and seconded to approve the minutes of the October 9, 2009 meeting. The
motion was approved by a unanimous vote of those present.
Subcommittee report by Drs. Gillock and Munneke regarding continuing
medical maintenance provided workers’ compensation claimants and
discussion and possible action regarding same: New treatment guidelines
for continuing medical maintenance, particularly in relation to prescribing
narcotics, were discussed at length. The idea of a periodic review by the Court
of all pain management cases also was discussed. The subcommittee was asked
to work in more detail on the Treatment Guidelines, and to report to the
Committee at a special meeting in six weeks time.
Discussion regarding the December 2009 NCCI research brief on narcotics
in workers’ compensation: The Committee was asked to review the brief,
especially as related to Treatment Guidelines. The Committee also discussed a
new recommendation to send all drug screenings to a medical review officer.
Discussion regarding the American Pain Society Guidelines: The
Committee was given copies of news releases concerning the updated American
Pain Society Guidelines concerning interventional procedures and opioid

Discussion and possible action concerning minutes for the January 15,
2010 regular meeting of the Physician Advisory Committee: A motion was
made and seconded to approve the minutes of the January 15, 2010 meeting.
The motion was approved by a unanimous vote of those present.
Subcommittee update by Drs. Gillock and Munneke on draft treatment
guidelines for continuing medical maintenance provided workers’
compensation claimants, and discussion and possible action regarding
same: The draft treatment guidelines for continuing medical maintenance were
discussed at length, especially concerning urine drug screens and chain of
custody requirements.
A motion to delete paragraph 3c in its entirety and substitute the wording,
“Urine Drug Screens must be done per PAC guidelines with a chain of
custody,” and to renumber subsequent paragraphs was made and seconded.
The motion was passed by unanimous vote of all members present.
A motion was made and seconded to change the language of paragraph 3d to,
“Must utilize the Oklahoma Prescription Monitoring Program (PMP) Drug

Opening Remarks by the Chairman of the Physician Advisory Committee:
Dr. Young welcomed everyone attending the public hearing and thanked them
in advance for their participation. Dr. Young announced that the public hearing
was intended to permit public input regarding revisions, if any, to the Physician
Advisory Committee's proposed Continuing Medical Maintenance Treatment
Guidelines.
Receive public comments and/or proposals, including views or arguments,
orally or in writing, regarding revisions, if any to the Committee’s
proposed Continuing Medical Maintenance Treatment Guidelines: The
Committee heard comments from the public in attendance. Dr. Young
summarized PCI’s comments (attached), mentioned additional comments
received verbally, and responded to questions of the committee by those in
attendance about the proposed guidelines. The majority of the comments
concerned clarification to the language of the guidelines. Dr. Koehler
suggested it might be helpful to include an appendix with the DEA regulations
concerning prescribing narcotics in the guidelines. Dr. Young requested
additional comments from those in attendance and there were none.

Dr. Young advised that the comments would be taken into consideration, and

Roll call and determination of quorum: Drs Jeff Fox, Scott Mitchell and
Keith Muse were absent. All other members were present. A quorum was
noted.
Announcements and Introductions: There were no announcements or

Discussion and possible action concerning minutes for the February 26,
2010 special meeting of the Physician Advisory Committee: A motion was
made and seconded to approve the minutes of the February 26, 2010 meeting.
The motion was approved by a unanimous vote of those present.
Discussion and possible action regarding proposed Continuing Medical
Maintenance Treatment Guidelines: After receiving input from the Public
Hearing, it was recommended to continue to work on the draft. A motion was
made and seconded to form a subcommittee including people outside the
Committee to continue work on the draft. This motion was approved by a
unanimous vote of those present. A Public Hearing will be held on July 23,
2010 for consideration of the revised draft, and the revised draft will be
released to the public in advance of that date.
Discussion and possible action regarding approval of the 2009 Annual
Report of the Physician Advisory Committee: A motion was made and
seconded to approve the 2009 Annual Report of the Physician Advisory
Committee. The motion was approved by a unanimous vote of those present.

Update on access to American Pain Society Guidelines: Dr. Mitchell will review the articles in
question to determine if any changes to the Committee’s guidelines need to be made in relation to the
American Pain Society Guideline changes.
Discussion and possible action regarding enacted legislation pertaining to the Physician
Advisory Committee: Tish Sommer summarized some of the changes pertaining to the Physician
Advisory Committee in the recently passed HB 2650, which goes into effect August 27, 2010.
Possible issues the Physician Advisory Committee should look at in light of these changes will be
further investigated.

MINUTES OF THE REGULAR MEETING OF THE PHYSICIAN
ADVISORY COMMITTEE HELD ON FRIDAY, OCTOBER 8, 2010 AT
THE WORKERS’ COMPENSATION COURT IN OKLAHOMA CITY,
OKLAHOMA.
Present: Drs. LeRoy E. Young, Robert Remondino, Jeff Fox, William R.
Gillock, Reed Burk, Duane Koehler, and John Munneke
Others Present: Workers’ Compensation Court Judges Kent Eldridge and John
McCormick; Laura Robinson, Court Research Analyst. Erin Sexton from
Medtronic, Bruce Outland and Don Holmes from CompSource, and Joe Biscone
were also present.
Call to Order: The meeting was called to order by the chairman, Dr. LeRoy E.
Young, at 2:10 PM. The Secretary of State’s Office had been notified of the
meeting and the agenda was posted at the Workers’ Compensation Court’s
Oklahoma City and Tulsa locations, and online on the Workers’ Compensation
Court’s website.
Roll call and determination of quorum: Drs. Scott Mitchell and Keith Muse
were absent. All other members were present. A quorum was noted.
Announcements and Introductions: Members of the public attending the
meeting were recognized by the chairman and introduced themselves.
Discussion and possible action concerning minutes for the July 23, 2010
meeting of the Physician Advisory Committee: A motion was made and
seconded to approve the minutes of the July 23, 2010 meeting. The motion was
approved by a unanimous vote of those present.
Discussion and possible action concerning minutes for the July 23, 2010
public hearing of the Physician Advisory Committee: A motion was made
and seconded to approve the minutes of the July 23, 2010 public hearing. The
motion was approved by a unanimous vote of those present.
Discussion and possible action regarding the American Pain Society report
on Pain Management: A subcommittee of Drs. Munneke, Mitchell, and
Anthony, and Ross Pope was formed to review the guidelines and prepare
recommendations regarding further action.
Discussion and possible action regarding Medicare’s study on Epidural
Injections: A subcommittee of Drs. Munneke, Mitchell, and Anthony, and
Ross Pope was formed to review epidural injection methods and prepare
recommendations regarding further action.

Discussion and possible action regarding the North American Spine Society’s Guidelines on
Cervical Radiculopathy: A subcommittee of Drs. Remondino, Gillock, Koehler and Muse was
formed to review and prepare recommendations regarding further action.
Discussion and possible action regarding the American Pain Society’s report on Back Pain: A
subcommittee of Drs. Remondino, Gillock, Koehler and Muse was formed to review and prepare
recommendations regarding further action.
Discussion and possible action regarding ACOEM’s Guide to High-Value Physician Services in
Workers’ Compensation: This guide is for informational purposes at this time. However, it might
require action in the future, given the participants in the study.
Discussion and possible action regarding recent Oklahoma law revision involving duration of
treatment: Given the language of HB 2650, the Committee will look into duration of treatment for
their guidelines. Drs. Fox, Burk and Munneke will look into upper extremity and lower extremity
guidelines, while Drs. Remondino, Gillock, Koehler, and Muse will look into the guidelines concerning
the spine.
Discussion and possible action regarding recent Oklahoma law revision involving prescription
medication formulary development: The Committee discussed the possibility of adopting a drug
formulary already produced by the state. This idea will be further investigated before the next meeting.
Update on the Committee’s Continuing Medical Maintenance Treatment Guidelines: At this
time, the Committee is still waiting on final approval of the guidelines by the Court.
Discussion and possible action regarding proposed scheduling of regular meetings for the year
2011 as follows: January 7, April 8, July 8, and October 14, to begin at 2:00 pm on each date:
The proposed schedule for the 2011 PAC meetings was changed to January 14, April 15, July 15, and
October 14 and agreed upon by the members.
Adjournment: A motion was made and seconded to adjourn the meeting. The motion was approved
by unanimous vote of those present and the meeting was adjourned at 3:08 PM.
