Editor’s Note to the 2012 Edition
Lawmakers made a number of changes to notice-by-newspaper requirementsduring the 2011 and 2012 legislative sessions. Over the past two sessions, the Arizonalegislature added four new notice requirements and eliminated two existing publication
duties.
The four new notice requirements pertain to an eclectic assortment ofgovernmental activities. First, legislators adopted guidelines for residential rentalinspection programs, which require counties to publish notice of certain public hearingsin a local newspaper of general circulation two weeks before the hearing. Second, thelaw now requires the board of directors of a road enhancement district to publish noticeof any changes to the district in a newspaper of general circulation within the district.Third, in the context of county and municipal bond proposals, deadlines for thesubmission of arguments for and against the bond propositions must be timely publishedin a newspaper of general circulation in the political subdivision. Finally, lawmakers
imposed a publication requirement on sanitation districts proposing the adoption orextension of a development moratorium.
During these past two sessions, lawmakers ended two notice-by-newspaperrequirements. Newspaper publication is no longer required in the context of renewalenergy incentive districts and the sale of unclaimed property.
Given the public’s continued reliance on newspapers for credible informationabout government affairs, one struggles to discern a rational basis for the legislature’selimination of notice-by-newspaper requirements, or to understand why requirementswere added in some areas and subtracted from others. Still, new publicationrequirements came at a rate of two-to-one during the legislature’s 2011-2012 sessions,and the public is all the better served for it.

Editor’s Note to the 2010 Edition
Lawmakers made three primary changes to notice-by-newspaper requirementsduring the 2010 legislative session. First, counties, cities and towns are now required to publish a summary of estimates of revenues and expenses, together with the library
addresses and websites where a complete copy of estimates may be found. The summaryshall be published once a week for at least two consecutive weeks after the estimates areadopted in the official newspaper of the county, city or town. A.R.S. § 42-17103.Second, in the context of tax liens, the county sheriff must now publish a notice of sale ofseized property in a newspaper of general circulation where personal service isimpossible because the owner or owner’s address is unknown. A.R.S. § 42-19111.Third, Arizona no longer requires a limited liability partnership to file an affidavitevidencing proof of publication of the statement of qualification. A.R.S. § 29-1103.

INTRODUCTION TO THE 2009 EDITION
In the three years since Notice by Newspaper was last updated, one thing iscertain. The internet has changed the way we do business. And that includesgovernment.
For decades, Arizona law required county boards of supervisors to publish theminutes of their meetings in newspapers. In fact, 25 years ago, the ANA won a case inthe Arizona Supreme Court to enforce the statutory duty of the Maricopa County Boardof Supervisors to publish the full minutes of its proceedings in a newspaper. In 2008,however, the legislature amended the laws to relieve county boards of this duty, requiringthem instead – along with cities and towns with populations over 2,500 – to post theinformation on their internet websites. Similarly, the law was amended to give schooldistricts the choice of whether to publish their annual financial reports in a newspaper or post them on the web.
Fortunately, the vast majority of Arizona’s new “public notice” laws still require publication by newspaper. Over the past three years, Arizona enacted roughly 30 newlaws substantively affecting publication requirements, and resisted attempts by some todilute the role of newspapers. From a city’s hearing on a proposed “regional attractiondistrict” to a county’s intent to establish a “renewable energy incentive district,” thesenew laws mandate notice by newspaper publication. From annual budgets of fire districtsto bids to construct flood protection facilities, the subjects of these newspaper noticestatutes are many and varied. Applicable to the government and private sector, theselaws continue to reflect the importance and vitality of notice by newspapers.

INTRODUCTION TO THE 2006 EDITION
Twenty years have passed since the Arizona Newspapers Associations publishedits first “revised” edition of Notice by Newspaper in 1986. When the ANA last updatedthis compendium of Arizona statutes requiring publication of “notices” by newspapers in
1998, we discovered that the number of laws relating to this subject had nearly doubled.As this 2006 edition goes to press, one is struck not only by the great number of Arizonalaws on point, but also by the abiding role of newspapers in providing official notice ofactivities, large and small, to our communities.
From amending the Arizona Constitution to establishing drainage districts, thelaw looks to newspapers to publish notice. The continuing vitality of newspapers toinform the public of important events is especially noteworthy in the internet age.Although the World Wide Web has become a familiar marketplace to the public and private sectors over the last decade, lawmakers continue to recognize the special role ofnewspapers in satisfying one bedrock aspect of due process -- namely, providing “notice”
to the general public of hearings and other happenings that could affect our rights.
As before, this edition is divided in two major parts -- one, reflecting all statutesthat require government bodies to publish notice in newspapers; the other, showing allstate laws that compel individuals or private parties to publish notice of some activity orevent in the paper. Within each of these two principal sections, the statutes are arranged by subject matter, and each statutory excerpt is introduced by an italicized, generaldescription or summary of the statute.
We apologize for the surfeit of “legalese” in these statutory excerpts. Ideally, ourlaws would be written so the average citizen could understand them without resort to
counsel. To help publishers understand the context of Arizona’s “notice by newspaper”laws, we have erred on the side of including the exact (and often challenging) language ofthe law in these statutory references.

INTRODUCTION
More than a dozen years have passed since the Arizona Newspapers Associationlast published a compendium of Arizona statutes requiring the publication of “notices” bynewspapers. When the ANA issued its revised edition of Notice by Newspaper in 1986,less than 400 Arizona statutes found their way into the compendium. In this currentedition of Notice by Newspaper , nearly twice as many Arizona laws relating to notice-by-newspaper publication are included.
Given the large number of statutes contained in this collection, we have tried tomake the information as accessible to the reader as possible. In general, this edition of Notice by Newspaper is divided in two parts – one for all statutes requiring governmentbodies to publish notice in newspapers, the other for all state laws compelling individualsor private parties to publish “notice” of some activity or event in the paper. Within eachof these two major sections, all statutes are subdivided by subject matter, and we haveintroduced each statutory excerpt by an italicized, general description or summary of thestatute. In view of its general importance, we have provided an introductory section –applicable to both government and non-governmental entities alike – setting forth thegeneral notice-by-newspaper statutes in Arizona.
“Historically,” as the Arizona Supreme Court has observed, “this state has alwaysfavored open government and an informed citizenry.” Arizona Newspapers Associationv. Superior Court , 694 P.2d 1174, 1178, 143 Ariz. 560, 564 (Ariz. Sup. Ct. 1985). As the ANA decision made clear, the state’s notice statutes provide an important means ofensuring “public access to information about the business of . . . government.” Id . Forthis reason, we have prepared this collection of state newspaper notice laws in the beliefthat the information will do more than simply act as a potential revenue source fornewspapers. Beyond revenues, this compendium of notice statutes should provide ameans of holding government accountable for the publication of vital information incompliance with Arizona law.
The success of this project is attributable in no small part to Blake DeWitt, the1998 President of the Arizona Newspapers Association, and to John F. Fearing, theANA’s Executive Director.
