What was your primary reason for joining theGreensboro Builders Association?

Your answer may vary depending on your business and the problemsthat possibly keep you up at night. And your reasons today may differfrom when you initially joined. But I would wager that none of usjoined to have a relationship with the organization, but instead tobuild business relationships with other members. Yes, the lobbying,education and information are important too, but the connections andrelationships we make with other businesses are what many of usvalue the most.

In the best and the most challenging of times, our business relationshipsmake us stronger. We learn from each other, share news, or even better,referrals and leads. We expose each other to different perspectives andideas – in turn, which help us make wiser business decisions. The adviceand support we get from others can be invaluable to our businessgrowth.

We all know that people like to do business with people they know.Relationships are one of the most powerful benefits of GBA membership,but it’s a benefit that not all our members receive. Why? Because itrequires involvement and participation, even if just for an hour here andthere.

Become Active & Engaged Members

The time commitment doesn’t have to be major…however therehas to be some level of commitment to build and grow yourGBA network. Attending membership meetings, council orcommittee meetings, educational programs and/or special eventssponsored by the Association are natural ways to get involved.Networking occurs at every GBA function.

I encourage you to find an area that interests you as a starting point.Chances are we have a council or committee that might be addressingissues you want to learn more about…from remodeling…to greenbuilding…to building codes…to technology. Or maybe you enjoygolf and/or skeet shooting…we have tournaments for both this springthat provide opportunities to meet other members while having somefun outside the office.

Utilize the GBA website, Member NEWS emails, and our Facebookpage to stay abreast of upcoming events and activities. Our nextmembership meeting is the Southern Ideal Home Show PreviewNight on March 22. This is a great opportunity to begin expandingon your business network and it’s free for you, your employees andinvited guests.

Our connections and relationships with other members is the realstrength of the Greensboro Builders Association. NCHBA Introduces NEW MemberRebate Program

NCHBA has introduced a new Member Rebate Programfor Builder & Remodeler members…regardless of sizeand volume…a program that is designed to help youincrease your bottom line. At TREBIC’s annual meeting in January, we heardfrom an expert panel on Guilford County PropertyTax Revaluation. Panelists included Guilford CountyTax Assessor Ben Chavis; Debbie Winters, partner inColvin Sutton Winters & Associates Appraisers andnewly appointed member of Guilford County Boardof Equalization & Review; Brian Pearce, attorneywith Nexsen Pruet who has litigated tax assessmentmatters; and Jeff Deal, a past member of GuilfordCounty Board of Equalization & Review. Here’swhat we learned:

Under NC Statute, counties must revalue real propertyat least every 8 years, and 2012 is Guilford County’syear. The Tax Department’s 13 certified Real PropertyAppraisers have assessed its 164,000 residentialparcels and 44,000 non-residential parcels and plansto mail notices of the new assessed values in earlyMarch. In an effort to do as accurate job as possible,they used an array of state-of-the-art technologicaltools and performed detailed analysisof 2500 neighborhoods (v. the usual300). Still, due to the state of thereal estate market, appeals activity isexpected to be heavy and the 2012tax base will probably not be fullysettled out until the fall.

By law, properties must be assessedat Market Value, meaning the mostlikely price that the property wouldsell for recognizing current use aswell as its potential use, with a willingbuyer and a willing seller, both fully informed andneither under any pressure to buy or sell. Whileassessed value typically starts at 100% of market valuein a revaluation year, it generally drops over thecourse of the next 8 years as market values rise. Forinstance, assessed value of Guilford County propertieswas only 80% of market value right before the lastrevaluation. But because of the current recession,2011 assessed values were actually 3.7% higher onaverage than market value. This gap, however, is notnearly as wide as in some parts of the country thatexperienced dramatic real estate “bubbles”. So theTax Director predicts only minimal sticker shock forowners, with no extreme value fluctuations. But it ispossible that overall, assessed value may be downfrom the 2004 assessed value, so the Revenue NeutralProperty Tax Rate may increase.

APPEALING YOUR ASSESSMENT

The revaluation notices will include a form to use ifowners disagree with assessed value. Answers toquestions can be found on the department’s FAQwebsite, by emailing [email protected], orby calling 641-4814.

Valid reasons to appeal include that assessed valueexceeds actual market value; assessed value is not anequitable assessment with comparable properties; ora factual mistake has been made (e.g. inaccuratesquare footage). While it may be tempting tocomplain, you won’t get an adjustment based oninability to pay, the amount of the increase, the factthat assessed value is higher than the constructioncost or insurance value or that it is just too high.

The first avenue for appealing a “new” value is tocontact the Guilford County Tax Department directly

and ask for an informal meeting. Thetax department is already notifyingthe citizens it speaks to that it wouldrather be contacted by e-mail or regularmail than by phone. If you dochoose e-mail or regular mail, besure to follow up if you don’t get aprompt reply. Many appeals areresolved at this staff level.

If the informal process does notwork, a property owner can file awritten notice of appeal with the

Guilford County Board of Equalization & Review(BER), which must be filed “before the BER adjournsfor the year”, a date that has not yet been announcedby the Tax Department. The hearing before the BERwill be informal, meaning the testimony is not swornand the rules of evidence do not apply. But, theproperty owner should attend and be prepared toargue the case, showing evidence that the assessmentdoes not accurately reflect fair market value.

If the BER does not satisfy you, the next step is toappeal to the NC Property Tax Commission, whichmust be postmarked by a US Post Office (your officepostage meter doesn’t count) within 30 days after theBER notice is mailed to the property owner, or onthe day the Property Tax Commission actuallyreceives the notice if it is not post marked by the

USPS. If the notice of appeal is not received withinthe required time period, it may be automaticallydismissed. If the notice of appeal is received ontime, the Property Tax Commission will provide aform AV14 (Request for Hearing), which must bereturned to the Property Tax Commission within 30days of its mailing. The form AV14 can only becompleted by the property owner or an attorneylicensed in North Carolina.

Once the form AV14 is filed, it is typical that therewill be a lengthy delay before the matter is actuallyset for hearing. A party can ask the Property TaxCommission staff to arrange and informally mediatean informal meeting with the local tax department.When the matter goes to hearing, the hearing will bequasi-judicial, meaning testimony will be sworn andthe North Carolina Rules of Evidence will apply.

If the property owner does not get the relief theysought from the Property Tax Commission, theproperty owner then has a right to appeal to theNorth Carolina Court of Appeals. This appeal mustbe filed within 30 days of entry of the final decisionby the Property Tax Commission.

All in all, a property owner can appeal a propertytax valuation through several levels in an effort toget a fair value assessed to their property. However,throughout the process, the property owner shouldkeep in mind they must present meaningful andcompetent evidence to support their case and mustcomply with the time frames and rules discussed inthis article in order to ensure they have a chance tobe successful in getting the value they seek.
