He welcomed guests and asked everyone to introduce themselves. With 17/19 voting members present, a quorum was confirmed and official business would be conducted. Lee moved to accept the agenda as written and start the meeting; Tom seconded (von Borstel / Chastain). All in favor. Approval of 2017 Meeting Minutes Next, Warren moved to approve the 2017 Board meeting minutes as written; Brian seconded (Dole / Parker). All in favor. OSU College of Agricultural Sciences report Dr. Dan Arp, Dean of the College, began his report by thanking the OSU Foundation for providing such a welcoming space for the meeting, including convenient parking for non-campus members and visitors. He also thanked Oregon Seed Certification and Seed Lab staff for the service they provide to the industry, all of the OSU Extension faculty for the myriad of ways they support Oregon’s seed industry, and finally the growers, contractors, breeders who make the industry strong, especially those who commit time to be on the advisory committees, and bring Oregon seed to the world. The College of Ag continues to do fairly well financially, able to provide education and support for all 220 agricultural commodities grown throughout the state. It is the first year in a biennial cycle; in the last cycle, the College ended up a little bit short of what was needed to fund programs. Things are looking strong so far and there are a few key positions that will be filled soon. OSU Extension Service report Sam Angima provided a written report for the meeting despite being absent; Dean Arp gave a brief summary on his behalf. intendtorefill8moreincludingtwofortheWillametteValleyinfieldcrops,andastatelevelentomologist.ExtensionhiredanewstatewidePesticideSafetyEducationProgramCoordinator,whohasimmediatelybeguntogetallfieldfacultyuptodateonPesticideApplicator’slicenses.ThereisalsoanefforttoformworkinggroupsofExtensionspecialistsacrosscommoditiestoincreaseinteractionandcollaborationacrosscroptypesandspecialties.OSUDepartmentofCropandSoilSciencereportDr.NollerreportedthatOSUExtensionisundergoingareorganizationinto6districtstoalignbetterwithOregoncounties.Thereare5candidatesinterviewingfortwoFieldCropsAgronomistpositionsincentralWillametteValley.OtheractiverecruitmentsincludeanAssistantProfessorofWeedScienceinCorvallis,anExtensionFieldCropsAgronomistinMalheurcounty,anAgronomistinKlamath,andpendingnegotiationswithRyanGraebnerforanExtensionCerealsposition.TheDepartmentsuccessfullyhiredanewSeedCertificationManagerinJanuary,AndrewAltishin,andanewProfessorofPracticeinGeneralAgriculture,GordonJones,locatedinCentralPointatSOREC.Thereisanewdepartmentalwebsite,foundathttp://cropandsoil.oregonstate.edu;thehopeisthatitcanbeasourceofthemostupdatedinformation,andthroughwhichvisitorscanleavefeedbackaboutanyoftheseongoingrecruitments.Dr.MaziarKandelousresignedfromhisSoilWaterQualitySpecialistpositionattheendofDecember;DeanArphasalsoannouncedhisretirementattheendofJune.AnationalsearchisunderwaytoreplacetheDean,andDr.NollerwelcomesfeedbackoncandidatesastheyareannouncedaroundlateApril.OregonStateUniversitycelebratesitsSesquicentennial(150th)anniversarythisyear;anewbrandhasbeenreleasedandthroughouttheyearthecelebrationwillfocusonthedifferentaspectsoftheSeaandLandGrantstatus.OSUHorticultureDepartmentreportDr.BillBraunworthhighlightedtheimportanceofOSU’sLandGrantstatus;assuchitisvitaltoprovideoutreachouttothestudents,growers,andcommunitiesweservetorepresentthemandtheirinterestsinameaningfulwaythroughteaching,doingresearch,andextension.Thesethreefunctions,whenmixedtogetherincreativewaysmakesOSUmorerelevantandaccessibletothepublic.TheHorticultureDepartmentwasabletohelpcontributetothismissionandbackfillapositionthatwascriticaltoreachingstudents.eCampusisgrowingintheHorticultureDepartment;alargechunkoftherevenuefromeCampusisabletofilterbackintotheon-campusgraduatestudentcommunity,summersalariesforfaculty,andothersupportforprograms.AnothersourceofincomeisthedevelopmentandprotectionofOSUplantvarieties,anareathatisgrowingandcontinuingtotakeshapeintheCollege.Severalpositionshavebeenfilledoverthelastyear,particularly,criticalresearchandextensionpositionsrelatedtotreefruits,pollinators,andothers.RecommendationsfromAdvisoryCommitteesPotatoAdvisoryCommitteeJeffMcMorranprovidedabriefsummaryofthePACmeetinginJanuary.AlthoughtherearenoactionitemsfortheBoard,hementionedthreeitemsthatwerediscussed:Achangeinthewintergrowoutprogramfromplantingdirectlyintothesoil,toplantingintraysreceivedaunanimous,positiveresponsefromgrowers.ThisyearOSCSmovedvirustestingfromtheIdaholabtotheOSUSeedLabwithpositiveresults.ThereisongoingdiscussionofchangingtotheFieldYear(FY)gradingsystemtoalignwithotherstates;ifIdaholegislaturedecidestoswitchtothatsystem,itislikelythatOregonwillfollowsuitnextyear.

GrassandLegumeAdvisoryCommitteeBrianParkerbeganthediscussionbyreadingfromGrassandLegumeAdvisoryCommittee(GLAC)meetingminutes,andsubsequentcombinedGLAC/SCACsubcommitteemeetingminutes.Item1:RequestmadebyvarietyownerstohaveaccesstoCertificationrecords.FollowingsignificantdiscussionattheGLACandSCACmeetingsinDecember,asubcommitteewasformedtofurtherinvestigatethedetailsofthisrequest.OncethemembersofthegrouphadmetanddiscussedtheissuewithindustryorganizationsincludingOregonSeedAssociation,OregonGrassSeedBargainingAssociation,andtheTurfgrassBreedersAssociation,thesubcommitteemembersmetandcreatedaprimaryandbackupsecondarymotion;thenheldavotethroughemail.TheGLACupheldmotion#1andbroughtitforwardhere;theSCACdidnotsupporteithermotion(seeAttachment1).Immediately,thequestionwasposed,“Whatcausesthisissueatthistime?”

VirginiaLehmanofferedherexperiencewithaPVPTitleVprotectedvariety;whensherequestedproductioninformationabouthervarietyfromSeedCertification,shewasdeniedandhadtoseekthatinformationthroughunofficialchannels.AsanownerofaPVP,apersonisrequiredtodoeverythingintheirpowertoprotecttheirvarietyorbesubjecttolosingit;shearguesanimportantpieceofthatisknowingwhereandhowmuchseedisbeingproduced.

MattHerbreadthroughthetwomotionsmadeattheOSAmeeting:thefirstbeingarequesttoSeedCertificationtomakevarietyproductioninformationavailabletovarietyowners,licenseesandcontractorsasspecifiedontheVOD(VarietyOwnershipDeclaration),andthatinformationbeidenticaltotheinformationcurrentlyavailabletothepublicconcerningpublicvarietygrowers,fieldnumberandacresonaperfieldbasis;thesecondbeingarequesttoSeedCertificationtoworkwithOSAandTBAtoexploreawaytomakeinspectionreportsandseedanalysisreportsavailabletovarietyowners,licenseesandcontractorsasspecifiedontheVOD.

Next,someoneasked,“Ifbasedonthecurrentpublicvarietymodel,wouldprivatevarietyownershipalsobeavailabletoeveryonethen?”Mattcounteredthatwouldnotbetheintentandthereremainseveralquestionsastohowthiscanbedone.Brianpointedoutthatentitiesthathaveverylittlerightorreasontohavethiskindofinformation(warehousesforexample)doinfact,havemoreaccessthanwhatavarietyownerorbreederhas.Itmakessensetomakeitavailabletothem.

DonFloydthenpresentedalegalletterofopinion,championedbyDanWeaverofSmithSeedServices(seeAttachment2).Inittheauthorstates,“OSUhasnovalidlegalbasistorefusetodisclosetovarietyownerproductioninformationandseedtests,”andpositsthat“iftheproductiondataisnotsuppliedtothevarietyowner,thenthismayresultintheseedbeingsoldasVNStoathirdparty,inanefforttoevadehonoringavalidproductioncontractwithavarietyowner…”.ItgoesontorequestthatOSCSmodifytheVODtoinclude“authorizationofthereleaseof‘productiondata’,”andthereleaseof“allseedtestreports.”

TerryBurrpointedoutthatnearlyalwaysthegrowersarecontractingwithlicenseesanditisraretocontractwiththevarietyownerdirectly.

DaveGorackespokeonbehalfofseverallocalgrowersandexpressedconcernthatthereseemtobenoprotectionsforthegrowerinthisdiscussion.Heexpressedconcernthatwhencontractingwithaseedcompanytheunderstandingisthatthecontractisbetweengrowerandthatcompany,trustingthatinformationisnotsharedwithapotentiallyunknownthirdparty.Additionally,thereareseparateanddistinctcontractsbetweentheownerandseeddealerthatarenotbeingaddressedhere.MikeMcCarthymentionedtheissueofexcessK31beingshippedoutofOregonatthehighestrateeverbeforeseen,suggestingthatseedisbeinginappropriatelymarketed;hearguedthatsituationslikethiscanbemonitoredifvarietyownersaregiventherightstoproductioninformation.

BeckyBergeroftheOregonGrassSeedBargainingAssociationreportedthatOGSBAboardmemberswereallinfavorofowneraccesstovarietyproductioninformation.Shereadfromaletterontheirbehalfinsupportofthemotion(seeAttachment3).Shealsopointedoutthatthisisalreadycommonpracticeinotherstates.

TomChastainspokeupandreadaletteronbehalfofBobZemetrainfavorofthemotion(seeAttachment4).Heofferedhisownopinion,bringingthediscussionbacktotheenduser,theconsumer.Theultimatepointofcertificationistoverifythatwhatthebuyerpurchasesisasintended,andwithnogenetictestsavailabletoprovepurity,theentiresystemreliesontrust.

JenniferKlingvoicedsupportforincreasedtransparencywithinthesystemandforthemotion.

SagarSathuvalliurgedanymotiontobefurthervettedbyOSULegalastotheprivacyprotectionbroughtupbythisissue;ultimatelythegoalbeingtoensureprotectionoftherightsofallpartiesandpreventownershipissues.

RachelHankinsmentionedthattherearetwowaysavarietyentersintotheOSCSprogram,eitherbyPVPorthroughtheAOSCAVarietyReviewBoard.AOSCAdoesnottakeintoconsiderationownershiprights;abouthalfofthevarietiescurrentlyintheCertificationprogramusedthelatter.

LorenBehrmanpresentedaletterinsupportofthemotionasagrowerofbothgrassseedandcerealgrains(seeAttachment5).

Brianputforwardthemotionfromthesubcommitteeaswritten:ThecommitteesrequestthatSeedCertificationmakevarietyproductioninformationavailabletovarietyowners,licenseesandcontractorsasspecifiedontheVarietyOwnershipDeclaration.Thisinformationistoincludevarietyname,growernames,fieldnumbers,acres,andgeneration.Tomseconded(Parker/Chastain).Discussioncontinuedfurther.

Someoneasked,“WhatwasthemaindiscussionagainstthemotionintheSeedConditionersAdvisorygroup?”Warrenrelayedhesitancytoreleaseprivateinformation;thesecontractsarebetweenthebreederandcontractorandSeedCertificationshouldremainaneutralpartyastheyworkwithgrowersandcontractors.

SagarstatedthatownersshouldbeabletorequestinfofromOSCSdirectly.Someinformationcanbereceivedusing“cc’s”onseedlabtests.Contractorshavemuchofthisinformationalready;whyaren’tBreedersgettingthatinformationfromthem?

ChristyMcCarthypassedoutacopyoftheOSCSVOD(seeAttachment6),andpointedoutthatwhenaBreedermakesarequestforinformation,itisprovidedasasummary.

OregonSeedAssociationPhillreportedthatrecentlyOSAmembershadmettodiscusstheBreeder’sAccesstoCertificationrecordsissuediscussedearlierinthemeeting.HealsonotedthatthedayisapproachingwhenOSAmembersplantodoameet-and-greetwithOregonLegislatorsatthecapitolinSalem.OSUSeedServices–SeedCertification,SeedLaboratory,andFoundationSeedDanintroducedAndrewAltishinasthenewOSCSManagerasofFebruary1,2018.AndywashiredasaSeedCertificationSpecialistin2013andhashadanintegralroleingrassseed,cerealgrains,sunflower,andseveralotherCertificationprograms.Inhisnewrole,AndywillcontributetothemissionsoftheCollegeofAgriculturalSciencesandtheOregonExtensionServicebyservingasliaisonbetweentheseedindustry,theOregonSeedCertificationService,andOSUSeedServices.In2017,OSCScertified236,660acres,adecreaseof4%.Thisincludes84croptypesand1,238varieties,andworkingwith706growers,364warehouses,and416contractors.SeedLabhashiredanon-campusgrouptocreateiPadapplicationsthatwillallowelectronicdataentryintothedatabase.Theintentistoreduceerrorsanddouble-enteringofdata;theyhopeitwillbeinplacebythisspring.ThelabwillalsobeundergoinganISTAAuditinMarch;thisisroutinelydoneeverythreeyears.SeedServicesiscurrentlyworkingwiththeInternationalSeedTestingAssociationtoperformavalidationstudyonaPCRtesttodistinguishbetweenPerennialandAnnualRyegrasses.OldBusinessDr.NollermentionedthatHouseBill4089maycurrentlybeupforavotewithinthenextcoupleweeks.ItdirectlychargesOregonSeedCertificationwithcertifyingIndustrialHemp,andallowsforgrowthofthecropingreenhouses,thereforepermittingmultiplecropswithintheyear.SeedTestingwouldbehandledbytheODASeedTestingandRegulatorylab,astherearenumerous“regulatoryhoops”tojumpthrough.Attheendofthemeeting,LeevonBorstelpresentedBarrySchrumpfwithaCertificateofRecognitionforhisdedicatedworktoOSCSandtotheCerealsAdvisoryCommittee,specifically.Barrygraciouslyacceptedandofferedhissincerethanksandappreciationtothegroupforbeingwonderfulcolleagues.AdjournmentWarrenmotionedtoadjournthemeeting;Brianseconded(Dole/Parker).Allinfavor.Themeetingadjournedat3:30pm.MinutespreparedbyMaryBeuthinAlladvisorycommitteemeetingminutesandsupplementarymaterialsareavailableonlineattheOSUSeedCertificationOnlineServiceswebsite(http://seedcert.oregonstate.edu),orbyrequest.

MikeMcCarthyhandedoutaversionoftheOSAmotions(seeappendixformotions)thatwerevotedonbyOregonGrassSeedBargainingAssociation(OGSBA)(seeappendixformotion).

AfterdiscussionofwhichmotiontobringforwardtotheCommittees,BrianParkeracknowledgedthataresponsewasneededtotheoriginalmotion,andifitwasfoundtonotbeacceptable,anewmotionneededtobecraftedtosendtotheCommitteesandeventuallytheBoard.

ColinaskedMikeCoontoreportonthegrower'sopinionofthedraftedmotion.MikeC.saidthathevisitedwithanumberofdifferentgrowersandsomedealersandthatitwasaunanimousopinionthatthisisnotthegrower'sbusinesstobeinvolvedinthedealer/breederrelationship.Growersconsiderthistobetheirprivateinformationandthatiswhereitneedstoend.

ColinacknowledgedthattherewasalotoftimeandenergyputintotheseproposalsbyVirginiaLehmanandMikeM.,andexpressedconcernabouttheshorttimeframebetweenthemotioninDecemberandtheFebruaryboardmeeting.HefeltthereneededtobealongerconversationaboutthiswiththeOregonSeedIndustry.DougPicklesvoicedhisagreementandstatedthatweneedanoverallsolution,notaband-aid.
