Dear Sir,

In this connection we are to say as under:

1. The subject Mining Lease of Iron Ore was granted in the name of SardarFauza Singh on 01.05.1972 for 30 years. Thereafter, the said lease wastransferred vide Government Order No.3864lM dated L4.O7.1983 and gotexecuted on 09.08. 1983.

2. There are no authenticated production documents since 01.05. 1972 of theproduction carried out by previous lessee.

3. Subsequently, we submitted a letter to the District Mining Officer, Chaibasato make available the production records since 01.05.1972 to 31.03.1985and certification of production from 0 1 .04. 198 5 to 3 1 .03. 1993 to submitbefore you as mining activity was started by us since 01.04.1985.

figure from L993-94 to Sept' 20L4 & from 2OL1 to 2OL6-L7 in separate twoletters which were earlier submitted before you vide our Letter no.AKI 78 / L7 -I8 dated 18. 1 O.2Ol7 which was submitted to rcply of ADSgenerated on 12.IO.2OI7 .

That, the complaint is officer of JSPCB and is the Regional Oflicer

Jharkhand State Pollution Control Board, Jamshedpur and he is public

within the meaning of section 21 of Indian Penal Code as per section 21

Environment (Protection) Act, 1 986'

That vide letter no. G-2357 Ranchi dated 15-12-2012 0f Jharkhand state

Pollution Conffol Board (JSPC Board), the complainant has beon authorized to file

this complaint by the competent authority under the provision of the Environment

(Protection) Act, 1986 and he is competent to do so'

Noamundi, District- West Singhbhum and has its lease known as lWs Balaji Iron

Ore Mines within the jurisdiction of this Hon'ble Court.

That, the Jharkhand State Pollution Control Eoard has received raising and

dispatch figures of different Iron and Manganese ore mines for the period 2005-06

to 2011-12 from Assistant Mining Officpr, Chaibasa, vide letter No.-917 (M)'

dated-15.05.2012.

That, the above unit was granted Environmental Clearance for expansion of the

mining project for enhancement of production of Iron Ore 39,000 tonnes

it is clear that the unit has made production of iron ore 6000 TpA, 20a0 TpA inthe year 2009-10 & 2010'11 respectively for which the unit has not obtainedenvironmental clearance from MoEF, Gofi. of India.
