PUBLIC NOTICE CITY OF BELMOND, IOWA ORDINANCE NO. 453 An ordinance establishing the Belmond Downtown Arcade Self-Supported Municipal Improvement District pursuant to the provisions of Chapter 386, Code of Iowa, and providing for the establishment of funds and the levy of annual taxes in connection therewith WHEREAS, the City of Belmond (the “City”), in the County of Wright, State of Iowa, is authorized by Chapter 386, Code of Iowa (the “Act”), to create a self-supported municipal improvement district, as defined in the Act, in the City, to provide for the opera- tion of such district, to provide for improve- ments or self-liquidating improvements, as defined in the Act, for such district, and to levy taxes as are authorized by the Act with respect to such district; and WHEREAS, there was filed with the City Clerk on the 02nd day of March, 2020, a peti- tion requesting that the City Council establish a self-supported municipal improvement dis- trict (the “Proposed District”) in accordance with the Act, to establish an operation fund with respect to the Proposed District and in ac- cordance with the Act and to levy an annual tax for such fund in accordance with the Act; and WHEREAS, the petition was in all ways in complete compliance with the provisions of the Act; and WHEREAS, upon receipt of such petition, the City Council did refer such petition to the City Plan and Zoning Commission in accor- dance with the Act, with instructions to such commission to prepare an evaluative report for the Council on the merits and feasibility of the project proposed in the petition; and WHEREAS, the City Plan and Zoning Commission has filed with the City Council such evaluative report on the merits and feasi- bility of the project proposed in the petition, all in accordance with the Act; and WHEREAS, subsequent to the filing of the aforementioned report, the Council did set the 18th day of May, 2020, at 7:00 o’clock p.m., in the Community Room at City Hall, in the City, as the time and place for a meeting at which it proposed to take action for the estab- lishment of the Proposed District and did in ac- cordance with the Act publish notice of such meeting as provided in Section 362.3 of the Code of Iowa, and the Clerk did mail written notice of such meeting to each owner of prop- erty within the Proposed District, which notice was mailed to such property owners by certi- fied mail not less than fifteen days before such meeting; and WHEREAS, at the aforementioned time and place, the Council did meet and hear owners of property in the Proposed District or resi- dents of the City desiring to express their views with respect to the establishment of the Proposed District; and WHEREAS, no petition has been filed with the City Clerk containing the signatures of at least 40 percent of all owners of property within the Proposed District or signatures which together represent ownership of prop- erty with an assessed value of 40 percent or more of the assessed value of all property within the Proposed District seeking to have the entire matter of establishing the Proposed District withdrawn from Council considera- tion; and WHEREAS, more than thirty days have passed since the holding of the public hearing referred to above and the Council may now proceed with the establishment of the Pro- posed District in accordance with the Act; NOW, THEREFORE, Be It Ordained and Enacted by the Council of the City of Bel- mond, Iowa, as follows: Section 1. There shall be and there is hereby created in the City a self-supported mu- nicipal improvement district, as defined in the Act, the name of which shall be the “Belmond Downtown Arcade Self-Supported Municipal Improvement District” (sometimes hereinafter referred to as the “District”), the purposes of which District are the undertaking of actions and the design and construction of any and all improvements authorized by the Act and the performance of administration, redevelop- ment, and revitalization of the District, as au- thorized by the Act, any and all of which actions and improvements are intended to ben- efit the property within the District. Section 2. A general description of the property within the District is as follows: All property in lots facing East Main Street in the 100, 200, 300 and 400 Blocks of East Main Street of Belmond, Iowa. Section 3. It is hereby found and deter- mined that the owners of all of the property within the District have a present and potential benefit from the condition, development and maintenance of the District and that all of the property within the District is related by virtue of its location within an area of the City zoned for commercial use. Section 4. Pursuant to the provisions of the Act, there is hereby established and created a self-supported improvement district opera- tion fund, which shall be known as the “Bel- mond Downtown Arcade Self-Supported Municipal Improvement District Operation Fund” for which fund the City may certify taxes against the property as defined in the Act (excluding property assessed as residential property for property tax purposes), within the District each year, in addition to all other taxes, for the purposes of paying part or all of the maintenance expenses of “improvements” or “self-liquidating improvements” as defined in the Act, with respect to the District, for a pe- riod of 50 years, commencing with the levy of taxes for collection in the fiscal year beginning July 1, 2021, and continuing for 49 additional years at a rate not to exceed $3.00 per thou- sand dollars of taxable valuation. The admin- istrative expenses will be paid by the City of Belmond, Iowa. Section 5. The City Clerk shall cause a copy of this ordinance to be filed in the office of the County Recorder of Wright County. Section 6. All ordinances or parts of or- dinances in conflict herewith are hereby re- pealed insofar as the conflicting portions thereof are concerned. Section 7. The invalidity of any section, clause, sentence, or provision of this ordinance shall not affect the validity of any other part of this ordinance, which can be given effect with- out such invalid part or parts. Section 8. This ordinance shall be in full force and effect upon its passage and publica- tion, according to the laws of the State of Iowa.
