Let us all bestow our hearty thanks to our Hon'ble Chief Minister of Tamilnadu Selvi.J.Jayalalitha for enabling Best Doctors Award Function by Government of Tamilnadu to happen on 21.02.2014.Our enthusiastic Hon'ble Health Minister, Dr. C. VijayaBaskar and hardworking Health Secretary, Dr. J. Radhakrishnan deserve special appreciation and thanks in materializing IMA's long dream and request. Our beloved Health Minister has assured to enlarge number of recipients' district wise and specialiality wise in the forthcoming years and organize as a bigger event coinciding with Doctors Day.

STATE COUNCIL MEETING

State Council is the guardian of all our association activities and custodian of our hard earned funds. We indulge in introspection on various schemes and wings, analyse suggestions and resolve for sustainable solutions. In our last State Council Meeting on 23.02.2014 at Thiruchirapalli, defaulters of FSS were recommended for deletions, comments about constitution were cleared, indifference of insurance companies were intimated about our unity not to accept meagre payment were main events apart from routine deliberations.

NHB Centenary Meet

Ultimate good selection of beautiful beach resort venue at Mahabalipuram, participation of hospital owners from all zones, visit of IMA National President and Secretary General,honouring of past NHB Office Bearers, release of NHB centenary stamp, face to face discussion with insurance officials, offers to private hospitals from Government and wonderful workshop on patient safety were hall marks of 100th NHB Meet on 9th March 2014.

RNTCP UNIT WORKSHOP

All local branch Presidents and Secretaries will be invited to assemble at leisure resorts at Ooty, Yelagiri and Courtrallam on 15th & 16th, 22nd & 23rd and 29th & 30th March Unit wise and will be appraised about RNTCP and calendar of programmes on CME & DTP finalized. Clinics and Hospitals coming forward to function as Peripheral Health Institution will be certified to exhibit IMA – GFATM – RNCTP – PPM authorized certificates. Kindly remember that TB has become a notifiable disease and defaulters will not be excused.

CHALLENGES ARE BECOMING OPPORTUNITIES

Difference between a successful outcome and a dismal failure is created only by a subtle little shift in perception, strong self-representation and right response. The first step to turn challenges into opportunities is to accept responsibilities and liberate ourselves. Second step is to use leverage which only means to exert the greatest amount of control with the least amount of effort. Finally not to over react but turn it into a game instead.

Let us make positive life changes within us to win the heart of others and then let us reach out to uphold our honour and dignity.

I am extremely happy to say that the Best Performing Doctors Awards have been given to 10 Awardees on 21.02.2014 by our H o n o u r a b l e H e a l t h & Fa m i ly We l f a r e M i n i s t e r – Dr. C. Vijaya Bhaskar in the presence of Health Secretary – Dr.J.Radhakrishnan and Director of Medical & Rural Health Services – Dr. (Thiru) A. Chandranathan, Director of Medical Education, Dr. Suseela and in the presence of IMA State President – Dr.M. Balasubramanian and TNGDA State President – Dr. K. Senthil.

Our Senior Members, Dr. S. Arul Rhaj, Dr. R.M. Krishnan – Past President were honoured in that landmark function.

This was a very good reflection of a favorable gesture from the Government of Tamil Nadu that showered on senior members of our Fraternity. We wholeheartedly thank the Honourable Chief Minister “AMMA” and Honourable Health & Family Welfare Minister for this function. Though this was announced in 2012, when Dr. Prakasam was the State President, and the constant perseverance of Dr. L.P. Thangavelu, Imm. Past President and Dr. J.A. Jayalal, Imm. Past Secretary, it has become a reality this year under the Presidentship of Dr. M. Balasubramanian.

The Honourable Health & Family Welfare Minister, Dr. C. Vijaya Bhaskar assured that this award will be announced every year with larger perspective.

REVISED NATIONAL TUBERCULOSIS CONTROL PROGRAMME (RNTCP)

National Level Workshop is going to be conducted in Chennai on 8th March 2014 to 9th March 2014.

ALL INDIA MEET

President and myself are going to Delhi to attend the Meeting of All States Presidents and Secretaries on 2nd March, 2014, towards further courses of action from the Head Quarters for our future programmes.

PARAMEDICAL WING

Paramedical Wing is going to conduct 9th Zonal Meet & Workshops on 8th March, 2014 at IMA Head Quarters Building, Tambaram, Chennai. All hospitals may utilize this opportunity to strengthen the caliber of their staff.

Medical Council of India

Medical Council of India – the apex regulatory body of doctors and medical practice – has decided to shrink its own jurisdiction. It has reinterpreted its code of ethics regulations as being applicable only to individual doctors and not doctors' associations.

Clause 6.8 of the Code of Medical Ethics Regulation, 2002, states that it pertains to “code of conduct for doctors and professional association of doctors in their relationship with pharmaceutical and allied health sector industry.”

However, MCI's executive committee decided on February 18 that the term “association of doctors” be deleted from the clause. It added that any action it took against any association of doctors by virtue of clause 6.8 shall be nullified and that such proceedings would stand annulled.

We all know that 75% of our stress and burden gets eased if we have well trained quality paramedical team to support us. With this in mind, IMA Paramedical wing will conduct “One Day Practical Workshop”, on

1. “Basic Bed side procedures”.

2. “OT Maintenance”

3. “ICU CARE”

4. “ELECTRONIC RECORD KEEPING”

5. “EMERGENCY CARE”

6 “.BASIC COMMUNICATION SKILLS AND ENGLISH ORIENTATION”

Eligibility:

Workshops can be conducted at any IMA Branch or IMA Registered Paramedical Institutes if minimum, '100' Candidates can be pooled for various Topics together.

Eligibility:

1. Nursing Student / Staffs must be working in IMA NHB Member Hospital or IMA Recognized Nursing Institute.

2. For “Basic Bed Side Procedures” & “Electronic Record Keeping”, any Nursing Student/ Working Nursing Staff.

3. For “OT Maintenance, ICU Care, Emergency Care”, Nursing Students should have completed 1st year/ any working nursing staffs.

Course Fee: Rupees 150 for each student for each course to be paid to IMA TNSB Paramedical Wing. Organizers can charge more if needed. Certificates will be issued at the end of the course. Hospitality and Food to be provided for students and Faculties by the Organizing Branch / Institute.

Our next Zonal Meet is at Chennai at Tambaram IMA Hall on 8th March. It will be a full day program with work shops and lectures. Nursing homes are requested to avail this opportunity and send their para medical staffs in good numbers and train them to

Already along with IMA NHB corporate, we have fixed norms for Nursing Trainees from various private institutes who come for training to our Hospitals. They have to stick on to one hospital for minimum 2 years and stipend structure for them with refundable deposits has been already mailed to all NHB Members. NHB will have tie up with such Institutes and will be able to provide such Trainees to NHB Corporate Members. Already first batch of students have been allotted to 8 of our member hospitals. Dear Colleagues,

Greetings to you. By the time you receive this edition,100th NHB meet at Mahabalipuram would have been over. I hope those of you who attended the meeting would have found it useful. In the souvenir, we have given some useful information and we intend to update in future also. We have been trying to give you topics that

would be useful to your day-to-day practice. Any suggestions from your side are welcome. The next Zonal Meet is in East Zone and by all likelihood Cuddalore Branch will host the event.

The one problem that encounters all hospitals is crisis after a death. People find it difficult to digest the death of a loved one. Unscrupulous elements take advantage of the situation. We shall try to give you a ready reckoner as to how to face a similar situation. First of all, inform your local branch leaders. Next inform police and request protection under ACT48 of2008.Through your manager try to inform as many of your colleagues as possible-numbers count in an emotional situation like this. Do not feel bad to discuss with a senior about what happened. Get your case sheet prepared meticulously with all details. Insist on post mortem through your branch leaders and if they refuse, get it in writing with police as witness. Hire a lawyer to handle negotiations -better for the branch to have one lawyer appointed. Inform state leaders-they can talk to District and State Officials to get you immediate help. Of course you have your NHB always ready to help any time of the day/night.

We have entered in to useful dialogue with insurance officials and our intention is to get all NHB members recognized for insurance. For this purpose we are planning to go for grading of hospitals. We shall soon inform you regarding the modalities. We request you all to become part of the corporate group to gain collective bargain in purchase, service and manpower management.

Thank You All for unanimously electing me as your IMA AMS TNSB CHAIRMAN.

IMA Stalwart, Late Dr. B.R. Ramasubramanian Annan was the one who brought the IMA AMS WING into Lime Light. He revealed that IMA is not just for MBBS Doctors, but also for all Specialists. Noticing my ability to enroll New Members, he inspired and motivated me to start the IMA AMS CHENNAI BRANCH Chapter. Dr. B.R.R. & Dr. A. Selvarajan inaugurated it on Republic Day 2010 and ever since, it has been gaining in numbers as well as honours both at National and State levels.

IMA is my Life and Breath. IMA AMS is perhaps the haemoglobin circulating in my blood. I shall organise one day symposia on various specialities from time to time. I wish as many of you as possible to come and attend. All our CMEs would be accredited by Tamilnadu Medical Council for CME credit hours.

Dear Members,

Greetings to all.

This is the first time I am writing to you all after being elected as Secretary for our college. In this moment, I would like to thank all the National Office Bearers, State Office Bearers, Branch Presidents, Secretaries and Members of all Branches of Tamil Nadu for electing me as Secretary for this prestigious College of our Association.

I would like to specially thank Dr. Muthusamy (Chennai South), Dr. Shyam Sundar (Ashok Nagar) and (Late) Dr. Rabindranath who were in the initial days helped me a lot to become the Branch Secretary. Then, Dr. A. Muruganathan (Tirupur), Our President Dr.M.Balasubramaniam and Past Secretary Dr.T.N. Ravishankar guided me a lot and finally with the help of our Past Secretary, Dr.J.A.Jayalal, Past National President, Dr. K. Vijayakumar, and President CWHPA, Dr. S. Arul Rhaj, I was lifed to this post. All other were also very helpful for me like Dr. T. Sadagopan, Dr.K.Prakasm, Dr.L.P. Thangavelu, Dr. R.V. Surendran, Dr. A.K. Ravikumar, Dr.S. Sridharan etc.

On Febrauary 15th and 16th along with Dr. S. Arul Rhaj Sir and our National Secretary, Dr.K.M.Abul Hasan, I went to Shiridi for the installation function of our National Dean IMA CGP HQrs. There before the installation, I had Lord Sri Saibaba Darshan. With the blessing of Baba, now I have started my CGP activities.

My aim during the tenure as secretary is only a few,

First, in Tamil Nadu CGP membership till date is only 1012. During this two years I am planning to increase the membership over 2500. This I am speaking with all the Branch Secretaries to start a Sub-faculty of CGP in each Branch with a minimum of 20 – 25 members.

Second, to double the number of Candidate taking the courses. This I have planned by giving brouchers to the students who are attending the Speed Coaching Class, those who are preparing for Post Graduation at Dr. MGR MedicalMedical University library and by putting posters in the Medical College notice board. As a first step, the brouchers have been printed and was circulated to members in the State Council Meeting. The same will be distributed to the students.

Finally to fulfill the ambitions of the Past Secretaries of CGP.

For the last year,we have one module to be completed for the Nephrology and Diabetology Course. Examination will be conducted by the end of March (or) First week of April.

We have planned to conduct State CGP Office Bearers meeting along with our State President and Secretary on 8th or 9th March at Mahabalipuram. During this time, we have planned to introduce some new courses for the next Academic Year. Admissions are going on for the year 2014 – 15 for all the courses given below.

IMA CGP is planning for a DUBAI tour on Aril 11th to 14th. I assure you that this tour will be enjoyable and memorable one.

CASES TO BE TREATED AS MEDICO-LEGAL:

The following cases should be considered as medico – legal and a doctor must inform the police about such cases:-

All cases of injuries and burns - which suggest commission of an offence by some

body. [irrespective of suspicion of foul play].

All vehicular, factory or other unnatural accident cases specially when there is a

likelihood of patient's death or grievous hurt.

Cases of suspected or evident sexual assault.

Cases of suspected or evident criminal abortion.

Cases of unconsciousness where its cause is not natural or not clear.

All cases of suspected or evident poisoning or intoxication.

Cases referred from court or otherwise for age estimation.

Cases brought dead with improper history creating suspicion of an offence.

Cases of suspected self – infliction or injuries or attempted suicide.

Any other case not falling under the above categories but has legal implications.

In the eye of the law, irrespective of the facts of case, the law would give supreme importance to the way and method in which a MLC was handled and it would also take into consideration the procedure that was followed in registering a MLC. Hence, understanding the process for registering a MLC can reduce lot of legal hurdles from the point of view of an attending doctor.

Medico – legal cases if handled with due care and precaution by following the institution's guidelines or correct procedures and pose no threat to the attending doctors. MLC require precision in terms of documentation, proper information, details of examination, etc which can help in the easy success of such cases.

Last month we saw how Justice Lahoti analyzed the subject of medical science and exposed the difficulties a doctor faces in his or her practice. He further went on to study the applicability of the Sec.304 A of I.P.C. for doctors in their practice.

A Two-Judge bench in Dr. Suresh Gupta vs. Govt. of NCT of Delhi (2004) case observed “for this act of negligence he may be liable in tort, his carelessness or want of due attention and skill cannot be described to be so reckless or grossly negligent as to make him criminally liable”.

Sec.304 A of I.P.C.:- Whoever causes the death of any person by doing any rash or negligent act not amounting to culpable homicide shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

When the famous Jacob Mathew's case appeal came before another Two-Judge bench, it was not willing to go by the order in Dr. Suresh Gupta's case. Their contention was

1) Negligence or recklessness being 'gross' is not a requirement of Sec.304 A of I.P.C. So if Dr. Suresh Gupta's case is to be followed, the word 'gross' shall have to be read into Sec.304 A of I.P.C. Such an approach cannot be countenanced (tolerated).

2.) Different standards cannot be applied to doctors and others. In all cases it has to be seen whether the action of the accused was rash or negligent and punish if there is negligence. Separate treatment for doctors by introducing degree of negligence is a violation of the language of Sec.304 A of I.P.C. A doctor cannot be placed at a different pedestal for finding out whether rashness or negligence was involved.

But this Two-Judge bench cannot over rule another Two-Judge bench court decision and so it referred the case to Three-Judge bench and luckily for us, Judge Lahoti's Three-Judge bench took up the case to deal with the issues in the interests of setting the law. And again, they analyzed this issue in depth.

Lord Atkin in Andrews vs. Director of Public Prosecutions (1937) stated “for purposes of criminal law very high degree of negligence is required to be proved before felony is established (than is sufficient to create civil liability).”

In Syed Akbar vs. State of Karnataka(1980) “Where negligence is an essential ingredient of offence under Sec.304 A of I.P.C., the negligence to be established by the prosecution must be culpable or gross and not the negligence merely based upon an error of judgment”.

In Bhaichandra Waman Pathe vs. State of Maharashtra 1968 “Criminal negligence is the gross and culpable neglect of failure to exercise that reasonable care and precaution to guard against injury to….”

Discussing the above judgments in detail, Judge Lahoti's Three-Judge bench set the law as “in our opinion, the factor of grossness or degree does assume significance while drawing distinction in negligence actionable in tort and negligence punishable as a crime. To be latter (criminal), the negligence has to be gross or a very high degree”.

So by introducing 'gross', he saved the doctors from being booked under I.P.C on minor negligence.

He further pronounced a clear cut method of arrest under 304 A, which really safeguards the doctor from police and vengeful litigant patients' harassments. We are immensely indebted to him for his just considerations for doctors. The courts have placed us in higher platform for the noble service we render. But we fail to be of worthy of that consideration at times; how? Let us see it in the analysis of famous Kunal Saha vs. Dr. Mukerjee case, in the following months.

Although Surgical Aortic Valve replacement remains the definitive therapy for calcified aortic valve stenosis, only 30% of patients undergo valve replacement, because of the extensive co morbidity and other high risk factors.

TAVR as its name goes is aortic valve implantation done as percutaneous based catheter implantable valves as opposed to an open surgical implant. Major advantage of TAVR is that owing to its minimum invasive nature it can be done on patients who are moribund to undergo open surgery. By comparison of results, TAVR has shown to have similar 30days and 1 year mortality and a similar 30 days stroke rate.

Indications for TAVR

- Senile degenerative valvular aortic stenosis with an echo derived mean gradient >40mmhg and valve area of <0.8cm. Aortic annular diameter of 18-24 mm. A very high surgical morbidity as assessed by EURO SCORE of >20 and STS score of >10.

The commonest site of implant is through the femoral route and less frequently transapical. The newer valves because of its smaller delivery system (14-18F) it can be inserted through the subclavian or carotid route.

Complications are arterial dissection, myocardial ischemia, cardiogenic shock, stroke, bradyarrythmias and paravalvular leak.

The only major evidence base is the PARTNER TRIAL which is the randomized trial evaluating TAVR with the Sapien Valve versus medical therapy or surgery. In cohort A, 700 patients were randomized 1:1to TAVR versus surgical AVR. The results of which showed non inferiority for mortality between the two, there was a higher incidence of stroke in the TAVR arm while a higher incidence of bleeding was observed in the surgical AVR. These results led to the FDA approval of the Sapien valve for those patients deemed inoperable.

Are all aortic stenosis patients eligible for TAVR?

Patients having severe symptomatic, calcific valvular aortic stenosis and who are at high surgical risk are the candidates for TAVR. The promising results of TAVR have prompted to expand its purview to moderate risk candidates as well.

Since the initial TAVR in 2002, over 50,000 procedures have been performed worldwide. Few centers in New Delhi and Bangalore have performed few cases and at present it is in its infancy in our country.

Till date at least 10 different valves with improved design and delivery system are in the pipeline awaiting approval which aims to reduce the degree of PVL which is a major issue in the current valves. Newer indications are being explored notable amongst which is bicuspid aortic valve stenosis and primary aortic regurgitation.
