A) Report on the observance of World Consumer Rights Day 2011 by CA & FBP, South 24 Parganas Regional office. On account of mandatory participation of this R.O. in the World Consumer Rights Day celebration centrally organized by CA Department, West Bengal at Rabindra Sadan auditorium on 15 th March’2011, this Regional observed World Consumer Rights on 18 th March’2011 at the auditorium of the SDO, Diamond Harbour at Diamond Harbour at 1:00 P.M. as per resolution of the DCPC, South 24 Parganas. Though the Chairman of DCPC as well as District Magistrate, South 24 Parganas, ADM(D), South 24 Parganas, SDO Diamond Harbour consented to remain present in the observance ceremony, none of them could manage to attend the programme due to their preoccupation. However, the programme started at 1:00 P.M. Sri Manas Kumar Chottopadhyay, Assistant Director, CA & FBP, Presidency D.O. presided over the programme. Sri A. Kar, Assistant Director, South 24 Parganas R.O. in his welcome address briefly narrated the genesis and significance of World Consumer Rights Day. He also stressed upon the need to assert rights and pursue remedies whenever a consumer is duped. Dr. Jagadbandhu Chakraborty, Ex-Director of National Test House, Kolkata presented a unique deliberation on food adulteration. He also demonstrated some chemical tests for identification of adulteration on some food items which created a commendable impact on the audience, especially on the teachers and students who took part in the programme. Sri T.K. Ray, Ex-Assistant Director and guest faculty member of ATI, Kolkata took part in the interaction session with the audience. Renowned magician Tarun Kumar presented some magic items carrying messages of consumer protection which were cheered and applauded by the audience who were approximately 200 in number. In the conclusion, Sri M.K. Chatterjee, A.D. Presidency D.O. appreciated the audience for their lively and disciplined participation. He also narrated the role of “Consumer International” in formulation of UN gruideline on consumer protection and outcome of the enactment of CP Act 1986 in India. The whole programme was co-ordinated by Sri Subrata Mandal, DAD, South 24 Parganas. Bagaria Relief Welfare Ambulance Society, a VCO of this District extended co-operation in organizing the programme. The programme was concluded at 5:00 P.M. with thanks to and from the chair. B) DCPC Action Taken Report (ATR) on the resolution of DCPC meeting held on 11.07.11. At first, the Member Secretary welcomes all members of DCPC, South 24 Parganas and submitted the action taken report as follows:- 1. Regarding Resolution 1: a) The Assistant Director, CA & FBP, South 24 Parganas as well as the Member Secretary, DCPC, South 24 Parganas wrote letter to the Senior Area Manager, Indian Oil Corporation (IOC) with the request to inform.

A) Report on the observance of World Consumer Rights Day 2011 by CA & FBP, South 24 Parganas Regional office. Action Taken Report (ATR) on the resolution of DCPC meeting held on 11.07.11. At first, the Member Secretary welcomes all members of DCPC, South 24 Parganas and submitted the action taken report as follows:- 1. Regarding Resolution 1: a) The Assistant Director, CA & FBP, South 24 Parganas as well as the Member Secretary, DCPC, South 24 Parganas wrote letter to the Senior Area Manager, Indian Oil Corporation (IOC) with the request to inform.

i) the norms of getting new LPG connection ii) pre-condition for buying oven etc. for new connection. iii) reservation to supply second cylinder iv) punitive measures taken by IOC against fraudulent gas dealers. v) publishing in newspapers for conditions of getting new LPG vide this office memo No.1141/CASR dated 20.12.10, but no reply has come so far. Later, on the date of next meeting of DCPC on 11.07.11, Smt. Chandrani Dam assured to submit a detailed report in this regard. However, no such report has come as yet. b) All members of DCPC were requested in the last meeting dt.11.07.11 to submit their up to date report on the actions to DCPC resolutions at least seven days prior to next DCPC meeting. But no such report was received till date. 2. Regarding Resolution -2 ACLM would submit a copy of the letter w.r.t. his approach to higher authority for deployment of staff in this respect. 3. Regarding Resolution-3 The Chairman of DCPC wrote letters to all i) SDOs under memo No.1109(5)/CASR dt.03.11.11, ii) BDOs under memo No.1118(29)/CASR dt.04.11.11, iii) Executive officers of Municipalities under memo No.1110(7)/CASR dt.03.11.11 for nomination of two or three employees for undergoing training on Consumer Protection Act, 1986 to enable them to act as resource persons to convey messages on consumer rights and protection thereof. By this time 31 nominations have come to this office. 4. Regarding Resolution-4 The Member Secretary talked over telephone on 13.07.11 and wrote a letter to SDO Kakdwip under this office memo No.963/CASR dt.19.09.11 w.r.t. organizing consumer awareness cum orientation programme at his office premises, but with no reply till date. 5. Regarding Resolution-5 The Chairman, DCPC, South 24 Parganas wrote letters to all absentee members to present in all forthcoming DCPC meetings without fail, under memo No.1098(24)/CASR dt.02.11.11. 6. Regarding Resolution-6 It is time for NGOs, VCOs and consumer activists what they have done so far to find complaint on behalf of the consumers in general. 7. Regarding Resolution-7 a) The DM and Chairman of DCPC, South 24 Parganas wrote letter to CMOH, South 24 Parganas instructing all pathological laboratories, private hospitals and nursing homes for display of rate chart for pathological tests/ package treatments under memo No.1108/CASR dt.03.11.11, with a request to send an action taken report in this regard. However, no such report was received so far.

b) The Member Secretary wrote a letter to Senior Area Manager (LPG), IOC for non-issuance of cash-memo outside the Diamond Harbour Municipal area for LP gas cylinder. But no response has come so far. 8. Regarding Resolution-8 It is time for Lead Bank Manager to highlight over the issuance of general circular instructing all banks under his territorial jurisdiction w.r.t. issuance of acknowledgement by banks at the time of deposition of cheque to be displayed in front of drop box. 9. Regarding Resolution-9 It is again time for Lead Bank Manager to highlight his approach towards BSNL regarding poor net connectivity/link failure. 10. Regarding Resolution-10 The Chairman drew attention of the Superintendent of Posts, South 24 Parganas regarding the non-availability of new format of money order forms at different post offices under memo No.1107/CASR dt.03.11.11 11. Regarding Resolution-11 It is time for representative of IOC w.r.t. provision for more than one white phone to each LPG distributor. 12. Regarding Resolution-12 Now it is time for members present in this DCPC meeting to express their valuable views w.r.t. inclusion of the name of Sri Bijon Biswas, Secretary of Gas Dealers’ Association as new member. C) Minutes and Resolution of DCPC meeting held on 12.12.2011 at 1:00 P.M. at the conference hall of South 24 Parganas Zilla Parishad Bhawan, 3rd floor, Alipore. Sri Narayan Swaroop Nigam, IAS, DM, South 24 Parganas presided over the meeting. At first, Sri Arun Kar, Member-Secretary, DCPC, South 24 Parganas as well as AD, CA & FBP, South 24 Parganas R.O. welcomed all the members. Thereafter, he briefly discussed the following agenda: (i) Observance of National Consumer Day, 2011 to be organised in the conference hall of New Administrative Building, 3rd floor, Alipore on 27th December, 2011. Resolution: The Chairman and members of DCPC confirmed the same. (ii) Nomination for Netaji Award, 2011. The Member Secretary as well as AD, CA & FBP, South 24 Parganas proposed the name of Sabari Sarkar of Saradanagar Human Health Education & Environment Development Society for the Netaji Award, 2011. Resolution: The same was accepted by all the members.

(iii) Recommendation for setting up of New Consumer Clubs in schools. Member Secretary pointed out that till date 27 consent letters have been received from different schools of South 24 Parganas. Also, Member Secretary read out all the names of 27 schools to all the members present. Resolution: The same was accepted by all. (iv) Co-option of new members/exclusion of inactive members of DCPC. Member Secretary proposed the name of Kollol Ghosh of Samaj Unnayan Kendra and Bijon Biswas, Secretary, LPG Distributors Association for co-opting as new member. Resolution: The same was accepted by all. 1. Sri Gopal Mondal of Bagaria Relief Welfare Ambulance Society stated that Kerosene dealers of Baruipur and Diamond Harbour area are not issuing cash memo to customers. The Chairman opined that mobile electronic weighing machine may be arranged at different market places so that consumers can verify the weight of their purchase. Resolution: (i) A written complaint in this respect be made by Sri Mondal. (ii) Initiatives will be taken as per advice of Chairman. 2. Sri Gopal Mondal of Bagaria Relief Welfare Ambulance Society stated that an extra amount is being charged by the delivery man for delivering the gas cylinder. Resolution: Sri Mondal shall give a written complaint. Also, the member secretary shall invite all the heads of IOC and HP separately to discuss the issue. 3. Representative of Federation of West Bengal Trade Association stated that booking of gas cylinder via mobile creates much problem. Also, he expressed his views that restriction of 4-6 cylinders in a year would create black marketing. Resolution: The Member Secretary shall discuss the issue with IOC and HP officials. 4. Member Secretary discussed the issue of medical negligence and displaying the rates of all packages of treatment and pathological tests with the CMOH present in the meeting. Resolution: CMOH confirmed that the notice displaying the rate chart of different pathological tests has been already circulated to all nursing home/ hospitals. She also assured her initiative for implementation and future presence in all DCPC meeting. 5. Representatives of FTA opined that regular inspection should be conducted al all nursing home/hospitals to cross check all the emergency services. Resolution: CMOH assured to take up the matter seriously with their higher authorities. 6. Representatives of FTA stated the importance of non-availability of money order forms in Post Offices. Member Secretary told that this office already wrote to the Superintendant of Post vide this offices Memo No. 1107/CASR dt.03.11.2011 for the same.

Resolution: The matter shall be taken up once again. 7. Representative of FTA demanded a list of names and contact nos. of all service providers and requested this office to fix the timing of next DCPC meeting after 3 p.m. to 4 p.m. Resolution: Both the proposals shall be taken care of. 8. Representative of Haltu-Kasba-Garfa-Kreta Suraksha-O-Kalyan Samity enquired about the implementation of circular issued by the Department of Consumer Affairs stating that “Goods once sold cannot be taken back”. The Member Secretary informed that the circular has already been issued by this office to the traders associations. Sri M.K. Singhania of FTA confirmed the receipt of the same. 9. Sri Gopal Mondal of Bagaria Relief Welfare Ambulance Society stated the non-availability of RMO in different nursing homes of Diamond Harbour region and non-issuance of cash memo by pharmacists. Resolution: CMOH assured to take up the matter seriously. The meeting lasted for nearly two hours and a half and ended after vote of thanks. D) Minutes of Seminar on LPG distribution vis-a-vis Consumer Protection.

Date: 14-06-2011 (Tuesday) Time: 2:00 P.M.

The ADM(D) of South 24 Parganas took the chair. Sri A. Kar, AD, CA & FBP narrated the

mission and vision of the seminar in brief and invited valued opinions from the representatives of the

three petroleum companies.

1) Smt. Chandrani Dam, DM(LPG-Sales) Kolkata AO, IOCL emphasized customer to book their

cylinders through newly instroduced IVR system and described it to be more transparent and

customer friendly.

2) For taking new connections, Smt. Chandrani Dam clarified that valid ID proof and ration card

are required. In case of non-availability of ration card, an affidavit of declaring that the

consumer does not posses any LPG connection is mandatory.

3) Smt. Chandrani Dam also cleared that purchasing any gadgets / accessories like hot place etc.

at the time of getting new connection is not mandatory.

4) Representative of BP told that across India all oil companies have the same procedure for

taking new connection. Though, some value added services are being provided by some oil

companies, but those are not mandatory.

5) Gopal Halder, Secretary of Bagaria Relief and Ambulance Society, an NGO pointed out that

outside municipality area of Diamond Harbour, some customers are refused to be given new

connections by the distributor.

6) Smt. Sabari Sarkar, Saradanagar Human Health Education & Environment Dev. Society, an

NGO raised the question that delivery man charges extra amount for delivery of the cylinder

and there is no arrangement for weighing the cylinder before delivery at home.

7) K. M. Sarkar, Representative of Haltu-Kasba-Garfa Kreta Suraksha-O-Kalyan Samity, an

NGO raised the question of charging extra amount by the delivery man and categorically

wanted justification on “Lead upto what and lift upto what”?

8) Representative of Bhubannagar Rural Development Society, Kakdwip, an NGO pointed out

that small eateries like road side tea stall restaurants are using domestic cylinders on

commercial basis.

9) Bijon Biswas, proprietor of Gas & Gadgets and Secretary of LPG Distributors’ Association,

W.B. clarified the following points:-

i) He clarified that Green Label ovens manufactured by public sector oil companies are

more efficient, safe and customer friendly. Also, low price gas ovens of different brands are

available at the distribution centre.

ii) He also proposed that frequent raids are needed to be conducted at big establishments

e.g. hotels, restaurants etc. to check the rampant use of domestic cylinders on commercial

basis.

iii) He also clarified that there is provision for measuring the cylinder with a spring balance

if the customer desired so.

iv) He also pointed out that due to the middlemen between the distributor and the customer

there is a delay in regular refilling of cylinder.

10) Frequent safety checking of gas cylinders and ovens by oil companies is mandatory and for

which a nominal sum of Rs.70/- is charged from the customers.

11) ADM, (Dev.), South 24 Parganas opined that proper awareness to customers regarding

necessary guidelines would help in resolving the issues to great extent. Also, administrative

support related to seizure / raid is also assured as and when prayed for.

12) ADM asked for a concrete and complete feedback from IOC over delay in refilling of the

cylinder within 15-20 days.

Sri Pain, Dy. Manager, IOCL, assured that he would look into the matter and give a feed back

on the present status of delivery system within 15 days. However, he also assured to expedite the pace

of the delivery system which was seconded by Smt. Chandrani Dam, DM(LPG-Sales) Kolkata AO,

IOCL.

ADM (D) thanked the participants and stressed on the need of organizing buyer-seller meet on

various issues.

E) PARTICIPATION OF STUDENTS FROM NSB MANAGEMENT INSTITUTE FOR THEIR LIVE PROJECT ON CONSUMER PROTECTION UNDER CONSUMER AFFAIRS & FAIR BUSINESS PRACTICES, SOUTH 24-PARGANAS REGIONAL OFFICE. This office organized a 5 day project work on the consumer protection with the students of NIILM School of Business, 47/h/1, Ballygunge Terrace, Behind South City College, Gole Park, Kolkata – 700029. Students have participated in the project oriented camp on Consumer Protection & Consumer Rights under the aegis of South 24 Parganas Regional Office of the Directorate of Consumer Affairs & Fair Business Practices, Government of West Bengal for the period from 16.05.2011 to 20.05.2011. Students actively taken part in the consumer awareness campaign, �ounseling of consumers and consumer grievance redressal through the process of mediation during this period and also visited West Bengal State Consumer Dispute Redressal Commission to overview the adjudication procedure and various schools to overview the functioning of consumer clubs. K) Awareness programme through Tableau from 22.11.11 to 11.12.11 In order to disseminate consumer awareness up to the grass root level in the District of South 24 Parganas, a tableau was arranged which roamed through 4 (four) Sub-divisions, 7 (seven) Municipalities, 23 (twenty three) Blocks and various Gram Panchayats. The tableau was flagged off by Sri Nilanjan Sandilya, Additional District Magistrate (D), South 24 Parganas on 22.11.11 at 11:00 A.M. from the yard in front of the Annex Building, Bhabani Bhaban. Awareness programmes had also been organized at different market places, Gram Panchayets, Blocks, Municipalities etc. during this 20 days programme. Distribution of leaflets, announcement through audio system and instant consumer counseling by the officials of this office were also be arranged during the period. To make the tableau more attractive and effective professional artists were engaged. Shri Biswajit Adhikary presented Baul Songs. Shri Anil Sardar and Shri Tarun Kumar presented magic show and ventriloquism. All these programmes were specially designed for consumer protection. The tableau was flagged off by Sri Nilanjan Sandilya, Additional District Magistrate (D), South 24 Parganas on 22.11.11 at 11:00 A.M. from the yard in front of the Annex Building, Bhabani Bhaban.

Shri Biswajit Adhikary presented Baul Songs in a seminar during the Tableau.

National Consumer Day 2011 was observed on 27.12.11 at the auditorium of PWD (Roads), 6th floor, Annex Building, Bhabani Bhawan, South 24 Parganas. Smt. Shilpi Majumdar, Member-in-Charge, State Commission, Sri Jagadbandhu Chakraborty, Ex-Director, Food Testing Lab, Sri Abdur Rauf, Karmadhaksha, Khadya-O-Sarbaraho, Zilla Parishad, South 24 Parganas, Sri T. K. Ray, guest faculty member, ATI, WB, Sri Subal Ch. Saha, AD, Kolkata Port R.O., Sri Asim Kumar Dey, Assistant Engineer, PWD and Smt. Papiya Sultana, DSP, DEB, South 24 Parganas participated in the observance ceremony. Approximately 200 persons took part in programme. Among them, Members of NGOs/VCOs, the prize winners in different categories of competition organized in this District and general consumer participated in the interaction. Dr. Jagadbandhu Chakraborty presented an excellent deliberation on identification of food adulterants in common foods with practical experiments which created much enthusiasm among the audience. A magic show on consumer protection and consumer rights was staged by Tarun Kumar which created much enthusiasm. The prize winners of the District level Essay, Slogan and Poster illustration competition were felicited with prizes and certificates by the AD, CA & FBP, South 24 Parganas R.O. and guest faculty present. No. of recorded attendance : 277. N) Awareness programme at Sanjua Baimela, 2012. This office has already participated at the “Sanjua Bai-Mela’2012” at Bakhrahat, South 24 Parganas which started w.e.f. 01.01.2012 and shall continue upto 10.01.2012 with a mission to spread consumer awareness among common people. No. of recorded attendance : 703. O) Awareness programme at Narendrapur Ramakrishna Mission Mela & exhibition on the 175th birth anniversary of Thakur Sri Ramakrishna from 17.01.2012 to 22.01.2012. This office participated at Ramakrishna Mission Ashram, Narendrapur, Kol – 700 030 from 17.01.2012 to 22.01.2012 wherefrom officials of this office will distribute leaflets and conduct consumer counselling. Magic show, Ventriloquism by professional artists and Baul songs will also be arranged from this stall with a view to promote consumer awareness among common people. Q) Report on the observance of World Consumer Rights Day 2012 by CA & FBP, South 24 Parganas Regional office.

On account of mandatory participation of this R.O. in the World Consumer Rights Day celebration centrally organized by CA Department, West Bengal at Star Theatre on 15th March’2012, this Regional observed World Consumer Rights Day on 16th March’2011 at Ray’s House, Ukilpara, Baruipur at 1:00 P.M. which is approved by District Magistrate & Chairman of District Consumer Protection Council (DCPC), South 24 Parganas as per resolution of the DCPC, South 24 Parganas. Sri Arshad Hussan Warshi, SDO Baruipur presided over the programme, Sri Shaktipada Choudhury, Chairman, Baruipur Municipality, Dr. Jagadbandhu Chakraborty, Ex-Director of Food Testing Lab, Sri T.K. Ray, guest faculty member, ATI, WB, Sri Manik Lal Sarkar, Samity Accounts & Audit officer, Canning, Sri Tamal Das, Assistant Agriculture Marketing officer, Sri Arunava Mitra, SDICO, Sri Keshab Roy Choudhury, Sub-divisional Land & Land Reforms officer, Md. Abu Zahir, Youth officer of Baruipur Municipality and Sri Swapan Mondal, Local Member of Baruipur Municipality were present in the observance ceremony as guests of honour. Sri A. Kar, Assistant Director, CA & FBP, South 24 Parganas R.O. in his welcome address briefly narrated the genesis and significance of World Consumer Rights Day. He also stressed upon the need to assert rights and pursue remedies whenever a consumer is duped. Dr. Jagadbandhu Chakraborty, Ex-Director of National Test House, Kolkata presented a unique deliberation on food adulteration. He also demonstrated some chemical tests for identification of adulteration on some food items which created a commendable impact on the audience. Sri T.K. Ray, Ex-Assistant Director and guest faculty member of ATI, Kolkata took part in the interaction session with the audience and narrated the formulation of UN guideline on consumer protection and outcome of the enactment of CP Act 1986 in India. Audio-visual presentation carrying messages of consumer protection were displayed by Sub-divisional Information & Cultureal officer which were cheered and applauded by the audience who were approximately 200 in number. Sri Arshad Hussan Warshi, SDO Baruipur appreciated the audience for their lively and disciplined participation. Also, he stressed upon the need for conducting such consumer protection programmes in Baruipur Sub-division to benefit the general consumers. The whole programme was co-ordinated by Sri Subrata Mandal, DAD, South 24 Parganas. Subudhipur Relief and Welfare Society for Backward Community, Baruipur, a VCO of this District extended co-operation in organizing the programme. (February 2012) 4) This office organise a street drama on consumer protection and consumer rights in association with “ JHUMKI SAHA”, Radio and T.V. artist and “ Bagaria Relief Ambulance Welfare Society”, a voluntary consumer organisation as co-ordinating agency at Diamond Harbour near the junction point of railway station and bus stand on 09.07.11 between 2 P.M. to 4P.M. 5) As per the Member Secretary, W.B. commission for women, a committee headed by a woman as set up for the implementation of Vishakha guidelines on sexual harassment at workplaces in West Bengal, a committee is hereby constituted with the following members for the office of the undersigned which will take immediate effect and arrange sending reports in this regard once in year to the W.B. commission for women through proper channel:
