Development Assessment and Compliance Fees 2018-19 This fees and charges brochure will help you to determine which Brisbane City Council assessment and compliance fees are applicable to your development. These fees apply to development assessment services, development applications, requests for compliance assessment and matters under the Planning Act 2016 (PA), Sustainable Planning Act 2009 (SPA), Integrated Planning Act 1997, South Bank Corporation Act 1989 or equivalent replacement legislation.

Getting started If you need help preparing your development application, or are unsure whether your proposal requires an application to be submitted under Brisbane City Plan 2014, you can discuss your proposal with Council using Council’s pre-lodgement services, or by speaking to a Planning Information Officer.

These services will help you to identify relevant issues and make an application that addresses the requirements of Brisbane City Plan 2014. Good applications enable Council to assess your application quickly. Costs for pre-lodgement services are listed on page three.

Fee calculation methodology Council uses a points system to calculate fees for most development-related services. Under this methodology, a point is given a dollar value and a number of points is allocated to a service, to provide the fee dollar value.

For the 2018-19 financial year, the value of a point is $115.

For staged developments, each development stage is to be treated as a separate development application for fee calculation purposes – including Change Applications.

Development fees Pre-application services Council offers various services designed to assist customers seeking advice in relation to development applications. These services include providing assistance with identifying potential issues and collaborating on the design for a development proposal. Under some circumstances, Council may accept a request for consideration that a development proposal be issued an exemption certificate.

Pre-application and exemption request services fees start on page four.

Development assessment fees Paying an assessment fee is necessary before Council can proceed to assess a development application. Payment is also needed where Council is a referral agency to some types of building work. Development assessment fees apply to development applications for material change of use, reconfiguring a lot and building work. This applies whether the application is for a preliminary approval, development permit, or preliminary approval variation request. Applicants are required to pay in full an assessment fee for the development application to be considered ‘properly made’ under the Planning Act 2016.

Operational work and Council compliance assessment fees Following a development application approval, you may be required to submit further operational work or Council compliance assessment applications/requests. The need to submit for further development approvals will be identified by the conditions of an approved development application.

Fees relating to operational work and Council compliance assessment are listed on page 13.

Compliance and inspection fees Where Council is required to undertake an inspection of the development before or during construction, a fee will need to be paid. This fee is calculated according to the size and complexity of the project.

Fees relating to the compliance and inspection of the development are listed on page 14.

Plan sealing fees Where your development involves reconfiguring a lot, a fee is required for Council to endorse the survey plan. Council will seal the plan when the development is finalised and all relevant approval conditions have been met.

Fees relating to plan sealing are listed on page 16.

Discounts RiskSMART Applications lodged by a Council RiskSMART accredited consultant will attract a discount of 20% off the standard relevant assessment fees, providing the application meets all the necessary requirements to be lodged as a Council RiskSMART application.

SealSMART Applications lodged by a Council SealSMART accredited consultant will attract a discount off the standard relevant compliance and inspection fee, providing the application meets all the necessary requirements to be lodged as a Council SealSMART application.

Applications lodged by SealSMART consultants on a Probationary Accreditation Agreement will attract a discount of 30% off compliance fees, and consultants on Full Accreditation will attract a discount of 50% off compliance fees.

Religious, charitable and other organisations Applications by religious, charitable or other organisations as listed in Appendix A of the 2018-19 Brisbane City Council Budget Schedule of Fees and Charges are entitled to a 50% fee discount. If the proposal is primarily for commercial purposes, no discount will be allowed.

Planning and development certificatesPlanning and development certificates provide information about a property. There are three types of planning and development certificates, with each type of certificate providing a different level of information. The three certificates types are: Limited, Standard and Full.

Development assessment fees Development types1

Whether you are doing building work, reconfiguring a lot or making a material change of use, your development should fit into one of the following categories:

• referral agency to building work • minor development• domestic development• demolition development• reconfiguration development• multiple dwellings• development assessment area charge.

Referral agency to building work This category is applicable when a referral of a development application for building work to Council as a referral agency is required, as identified by Schedule 9, Division 2 of the Planning Regulation 2017.

Each referral trigger 5 Points ($575)

Note: Where development is for material change of use or building work for a dwelling house, Council may include an early referral agency response for any further building approval. This would only be applicable where Council would be a referral agency to the development application for the building work, under Schedule 9, Division 2 of the Planning Regulation 2017.

Minor development Minor development includes:

• each instance of small-scale building work requiring a development assessment/approval to a dwelling house

• each instance of small-scale building work requiring a development assessment/approval to a dual occupancy, existing approved single-unit dwelling or modifications to a single unit of a multiple dwelling (e.g. an additional room, garage, swimming pool, deck, carport or shed)

• each instance of small scale demolition work requiring development assessment/approval• any other minor scale development as determined by Council.

Domestic development

Domestic development includes: • a new dwelling house, or extensions to a dwelling house, that are not Minor• a home-based business• any other domestic scale development as determined by Council.

Flat fee 16 Points ( $1840)

Demolition development Demolition development is any demolition, removal or relocation of whole or part of a building (partial demolition). Demolition is broken into two fee types. 1. Demolition type A:

full demolition of a structure whether or not lodged in conjunction with an accompanying aspect of development (e.g. standalone demolition or removal of a building, or demolition of a building to facilitate a development)

partial demolition of a structure where not lodged in conjunction with an accompanying aspect of development; or

demolition on the site of a Heritage Place.

Flat fee 24 Points ( $2760)

2. Demolition type B: demolition where lodged in conjunction with an accompanying aspect of development

(e.g. an extension of a pre-1946 dwelling in the Traditional building character overlay).

Reconfiguration development Reconfiguration development includes:

• reconfiguring a lot to create two or more resulting allotments (includes Common Property, Parks, Balance Lots and Retention Basins)

• rearranging boundaries to resolve encroachments• access easement• subdivision under the Body Corporate and Community Management Act 1997.

Multiple dwellingsMultiple dwellings is the creation of residential accommodation involving self-contained units.For example:

• multiple dwelling, e.g. apartments, flats or units• dual occupancy, e.g. duplex• dwelling unit, e.g. ‘shop-top’ apartment.

Development assessment area chargeThis fee relates to development for uses such as food and drink outlets, industry, offices, shops or warehouses, and is the combination of the below areas, including changes to hours of operation:

• Gross Floor Area (GFA) as defined by Brisbane City Plan 2014• areas not forming part of the definition of GFA, where the area contains activities integral

to the development such as, but not limited to: unenclosed structures decks outdoor storage/stockpiling areas ancillary outdoor areas used by a development (e.g. outdoor play area for a childcare

centre) footpath dining.

For a preliminary approval variation request to override the local planning instrument, where the application is not appropriately reflected by another development type, then the development assessment area charge is to be applied to the site area of the land subject to the preliminary approval variation request.

Refund of feesApplicants may request a fee refund when withdrawing an application.

All requests for a fee refund must be made in writing to the Manager of Development Services. The decision to grant a refund is made on a case-by-case basis.

Operational work and Council compliance assessment feesMinor and self-certified conditionsIf your condition has the phrasing “Submit for the approval of Development Assessment” or “Submit and obtain endorsement from Development Assessment” then you will need to lodge an application for approval that will attract one of the below fees:

Administration fee for fast track self-certified builds where full assessment is not required, including:

• build over or near stormwater, professionally certified road works and other works where full assessment is not required

• minor and self-certified works, where not relating to engineering, in accordance with a condition of a development approval

• any other or self-certified conditions as determined by Council.

Compliance and inspection feesThe number of compliance components that apply to a development will determine the fees at the compliance phase of the development. A compliance and inspection fee must be paid before site works commence. This fee is calculated according to the size and complexity of the project and covers inspections required during construction.

Below is a list of components that may be relevant to a development. All components generally require design plans to be lodged and approved before construction begins.

RoadworkThe development requires construction of roadwork and associated drainage infrastructure which is to be dedicated to Council in the future.

DrainageThe development requires construction of stormwater drainage, where the work does not form part of associated roadworks but will be dedicated to Council in the future.

Stormwater quality A development approval requires construction of a (public) stormwater Quality Bio-Basin or other Water Sensitive Urban Design treatment which is to be dedicated to Council in the future.

Landscaping, parkland and streetscape works The development requires landscape works/streetscape works or works to occur on parkland to be dedicated to Council.

Environmental management A development approval requires work within a waterway corridor and/or where aVegetation Management Plan (VMP) and associated pre-start is required.

Erosion and sediment control A development approval requires an erosion and sediment control plan to be submitted and approved.

A development application fee may consist of several aspects of development and/or development fee types. In these cases the application fee is the sum of fees calculated for the individual components making up the application.
