1.1 Purpose The Authorized Contractor Program provides a process for recognizing Ontario Electrical Safety Code compliant work, performed by a Contractor – based on current practices and previous work.

1.2 Scope An Authorized Contractor Program that meets the needs of the qualified Contractor. The Program will include most electrical installations with exceptions listed in the introduction to Section 4.0. ACP provides for safe electrical installations, and allows ESA to focus and further improve safety in other sectors of the electrical industry.

1.3 Audit Process The ACP Program works on an audit-based process. Contractor performance is closely monitored; hence, full inspections may not be required. The audit ratio takes into account the associated risk and is different for each ACP Vertical. See Section 4.0 Program Verticals for specific information relating to this item.

Additional inspections may be required during the probationary period or if the level of “safety” of the work diminishes over the contract period.

Electrical safety will not be compromised. Code compliant installations will be the standard. Defects that may present a life or property hazard will be cause for suspension. See Section 2.0 Program Eligibility, sub-section 2.2.4 Defect Monitoring.

PLUS: Whenever ESA New Code is offered it is mandatory for all ACP participants. This is in accordance with Section 2.0, Program Eligibility, sub-section 2.2.2.1 Training – For Ongoing Membership Status.

PLUS: Whenever the OESC Code Book is updated, ESA recommends that sufficient copies be purchased – This is mandatory for all ACP participants in accordance with Section 2.0, Program Eligibility, sub-section 2.2.11 Contractor Accountability.

PLUS: Contractors wishing to participate in Co-Advertising may do so for a one-time administrative charge of $25 (plus GST) and 50 cents per sticker (plus GST) per order. For more information regarding co-advertising, please see Section 3.0 Program Benefits, sub-section 3.6 Co-Advertising.

REFUNDS: For those Contractors who have been on the Program for less than three months, a refund of 75% of membership fee, excluding bulletin costs, will be paid to those who voluntarily withdraw from the Program (25% will be held by ESA to cover administration), except under the following conditions:

Refunds will not be given to those who are suspended/deregistered as a result of receiving a Warning or Suspension letter;

Refunds will not be given to those who have been suspended/deregistered due to leaving imminent fire and/or shock hazard

2.1 What is Required to Become a Member of the ACP?

2.1.1 Orientation Package

All individuals interested in joining the ACP Program must contact the ACP Office at 1-800-249-4583. Provided all program eligibility requirements are met, the prospective ACP Contractor may opt to receive an Orientation Package or go to ESA’s website at www.esasafe.com and go through this process on-line. The Orientation Package consists of:

The purpose of the Orientation Package is to make certain the Contractor understands what is required to get onto the Program and what is required, on an ongoing basis, to remain on the Program. The Package contains sufficient information so that the Contractor can make an informed decision as to whether or not they want to join. All information provided to the prospective Contractor in the Orientation Package must be signed, dated and returned, as stipulated in the Orientation Letter.

2.1.2 Application Form The Application Form is included in the Orientation Package. Contractors are required to fill out the form in its entirety and return it to the ACP Office. HVAC APPLICANTS ONLY are required to also submit a copy of their applicable trade licence and commercial liability insurance. Should any information on the application form change, it is the responsibility of the ACP Contractor to notify the ACP Office and have all information pertaining to their business updated. Failure to do this may result in suspension from ACP, until such time as Contractor and/or qualified installer information is updated accordingly. The following rules apply to Contractors wishing to change any information regarding their ACP Company: The company who retains the original Company Owner will hold onto

orientation history, account history The company who retains the licensed installer will hold onto

notification activity, defect history, new code training history

2.1.3 Renewal Form – HVAC Contractors only On each anniversary date, a Renewal Form is issued to all HVAC ACP Contractors which must be signed and returned, along with copies of the contractor’s current commercial liability insurance and applicable trade licence for the work being performed as an ACP Contractor.

2.1.4 Licensing

Contractors on the Authorized Contractor Program must hold a valid ECRA/ESA Electrical Contractor's Licence as required under Ontario Regulation 570/05 made under the Electricity Act, 1998, and the appropriate Certificates of Qualification as required under the Trades Qualification and Apprenticeship Act or under the Apprenticeship and Certification Act for the work to be performed. Specific Certificates of Qualification requirements are noted in Section 4.0 Verticals, within each individual vertical section. The principal or employee of the company may hold the current valid Certificate of Qualification, as required by the Trades Qualification and Apprenticeship Act. It is the expectation of ESA that the company’s certified electrician(s) or certified HVAC installer(s) is responsible to oversee and ensure that all electrical/HVAC installations are code compliant. The owner of the company has a vested interest in ensuring that all work is code compliant, as his/her company may be removed from the Program as a result of repetitive non-code compliant work. In very specific circumstances and only where there is no requirement for an appropriate certificate of qualification in accordance with the Trades Qualification and Apprenticeship Act and/or where there is no requirement for an ECRA/ESA Electrical Contractor's Licence, a Contractor (in accordance with rule 2-004 (8)(c)) may be admitted to the Program if the Contractor has demonstrated competency through appropriate training and examination, who holds the appropriate liability insurance and has demonstrated knowledge of the OESC and the installations. A formal request must be made to the Chief Engineer or the Provincial Code Engineer, who has complete authority to approve/disapprove in accordance with the requirements set out in the OESC. Program integrity and risk will be the two underlying principles considered at all times.

2.1.5 Sub-Contracting Sub-Contracting is allowed under the ACP Program, providing the individual who is licensed under the ACP Program takes full responsibility: To oversee the work done by others - both full-time employees of the

company and those who work on a part-time or contract basis, and

For ensuring that all sub-contractors hold the necessary ECRA/ESA Electrical Contractor's Licence(s) as required under Ontario Regulation 570/05.

The ACP Contractor is responsible for ensuring all individuals doing work under this Program receives ESA New Code Training whenever it is offered or when required by ESA, and

The ACP Contractor recognizes and understands that his/her company may be removed from the Program should it be determined that sub-standard or non code compliant work is being done – regardless of who has done the work, on behalf of the company.

2.1.6 # of Notifications Required To Get Onto The ACP Program Contractors wishing to participate in ACP must have filed a minimum of 20 applications for inspection in the previous one-year period, while a member of ESA’s charge account system, to be considered for the ACP Program. Contractors participating in the Pole Line Maintenance vertical who hold a 309A electrician’s certificate only, must have filed a minimum of 20 applications specific to that Line of Business, while a member of ESA’s charge account system (See Section 4.0 Program Verticals, sub-section 4.5 Pole Line Maintenance for more information).

2.1.7 Training – For Initial Program Membership Mandatory Training:

ESA offers Ontario Electrical Safety Code (OESC) Training upon the

release of the updated Code Book – when offered, this training is mandatory for all ACP participants.

ACP Contractors must ensure all staff are trained on New Code The Contractor shall ensure that a current issue of the OESC and

Electrical Safety Authority Bulletins are readily accessible to field staff.

2.1.8 Account History Contractors requesting entrance to the ACP Program must have a current account balance and their account history must indicate no overdue or past due notices. ACP Program Supervisor may deny access to the Program should a clear account history not be present.

2.1.9 Performance Management

2.1.9.1 Defect Ratio Methodology

The defect ratio methodology applies to all verticals under ACP, except HVAC. Contractors are measured by their “defect ratio”. There are a number of elements with regard to how the “defect ratio” works: The defect ratio is calculated by dividing the number of notifications

with at least one technical defect with the number of notifications with at least one site visit

A Contractor’s defect ratio cannot exceed 4% Defect information is based on a 6-month rolling window Only ACP notifications and defects issued on ACP notifications are

considered in the defect calculation once a contractor is accepted onto the ACP program.

Only Technical defects are considered in the defect calculation (note that 2-022 and 2-034, from the administrative portion of the Code Book are considered Technical for the purposes of ACP and therefore count in the defect ratio)

Contractors may receive a “WARNING Defect” first before a defect is issued. A “WARNING Defect” is intended to advise the Contractor that a minor code infraction exists so that it is corrected and done correctly, going forward

The Inspector may at any time select to issue a defect, rather than a “WARNING Defect”

Failure to make application is considered a hazard All fire and/or shock hazards will result in suspension from the ACP

Program for a minimum period of three months In addition, Contractors are “defected” should they fail to follow ACP administrative practices. While these defects do not count in the defect calculation, Contractors need to understand that this information is tracked and Contractors can be warned/suspended if they do not implement processes that eliminate Administrative defects.

Example: # of Notifications with at least 1 technical defect = 5 # of Notifications with at least 1 site visit = 132 Defect Ratio: 3.78% Acceptable Defect Ratio: <=4%

2.1.9.2 “60Day/100%” Process Should a Contractor’s defect ratio exceed 4%, the ACP Program Supervisor will proceed to suspend the Contractor or may select to Warn the Contractor and place his Contracting business on the ACP “60Day/100%” process. What is the “60Day/100%” process? Safe electrical installations done in accordance with the Ontario Electrical Safety Code is a requirement of all ACP Contractors. Once a Contractor has been >4% for an extended period of time or if the Contractor’s performance under ACP deteriorates quickly, the ACP Program Supervisor will suspend or will move the Contractor to 100% inspections. ESA wants to give the Electrical Contracting Business every opportunity to remain a member of the ACP Program, but must ensure code compliant installations are being done. “60Day/100%” Process - the following rules apply to this process

Timeframe: The Electrical Contracting Company is placed on 100% inspections for a period of 60 days Identification: The suffix “100%” appears behind the Company’s ACP # on all ESA correspondence sent to the Contractor Access: All access arrangements during this period are the responsibility of the Contractor to arrange Fees:

Fee discounts will continue to be applied during the 100% phase If the Inspector attends a New Residential site three times – once for

each stage of construction, the Contractor will be charged an additional call of $125. To avoid this cost, the Contractor may select to combine his inspections so only two visits are done, thereby eliminating the third visit charge.

24-Hour Benefit: The 24-hour benefit will be removed for the 60-day timeframe. Inspections will be scheduled on the day the Inspector is in the area. This may mean work will need to be held open until the Inspector is there to inspect it. Other trades need to be advised they are not to cover up any wiring until it has been inspected.

Contractors who on-line with ESA, are not allowed to schedule on-line during the 60-day timeframe.

Pre-Authorized Connections: The pre-authorized connection benefit will be removed for the 60-day timeframe. Inspectors need to inspect 100% of all services; therefore, this work will be entered as a “Disconnect and Hold”, and inspection must occur before reconnection takes place. Defect Ratio:

A separate calculation will be done during the 60 days that will only take into account work done during this period – oftentimes it is difficult for a Contractor to bring his overall rating down below 4%, because it is based on a six-month rolling window. The separate calculation will assist the Contractor in that only work done during this timeframe will count, so code compliant work will ensure positive results

At the end of 60 days, if the Contractor is not below 4% in his 60-day separate calculation, he will be suspended from ACP for a minimum period of three months

To return to full status: At the end of the 60 days, four months of defect information collected from the four months leading up to the 100% being applied, will be blended with the 60 days at 100% defect information . If the blended total is below 4%, the Contractor will be returned to full status. If the blended total is above 4%, the Contractor’s 60-day timeframe will continue to be extended on a monthly basis, until the blended total is below 4%.

2.1.9.3 Quality Assurance System (QAS) for HVAC Contractors only:

HVAC Contractor performance under ACP is measured by way of the Quality Assurance System, or QAS. QAS works as follows: Code infractions discovered on your work today will require another

inspection at another of your work sites already filed for or on your next filed notification

Inspections will continue to occur until no code infractions are found and until ESA feels confident none exist

To assist us in gaining access to all sites, it is imperative that you

include the site contact name and their phone # on the Application Form at the time of filing. Failure to provide this information will result in ESA requesting that your Company make access arrangements on behalf of ESA.

2.2 What is Required to Remain a Member of the ACP?

2.2.1 Probationary Period (excluding HVAC) A three month probationary period will commence when a Contractor first joins ACP and when a Contractor selects to include another vertical in his/her membership. The probationary period will be considered a training and evaluation period. During this time, additional inspections may be required based on the performance of the Contractor. All defects are to be written and sent to the Contractor. Any hazardous condition or documented Contractor practice not followed may be grounds for suspension. If the Contractor does not successfully complete the probationary period he will be removed from the Program and will be unable to re-apply for a period of one year. The Contractor may use the appeal process should he/she wish to challenge the suspension. (See Section 2.0 Program Eligibility, sub-section 2.2.9 Appeal Process). At the ACP Program Supervisor’s discretion, the probationary period may be extended once due to failure to meet Program criteria. Note1: HVAC Contractors operate under the Quality Assurance System (QAS) and are not subject to the rules of probationary status

2.2.2 Training

2.2.2.1 For Ongoing Membership Status All ACP members must take New Code Training, when offered by ESA. Those required to take training includes all individuals performing electrical/HVAC work under the Authorized Contractor Program. This training is mandatory for all Contractors on ACP.

2.2.2.2 Due to Poor Performance Should a Contractor be removed from the ACP Program due to poor performance, the ACP Program Supervisor may insist that an ESA technical training course, appropriate to the poor performance, be taken prior to reinstatement to the ACP Program. This training will occur at the expense and travel time of the Contractor.

2.2.3 Account – Current Contractors on the ACP Program must maintain a current account balance and will be warned first and then suspended/ deregistered if the account is not immediately made current. Should a warned or suspended Contractor’s account fall into an overdue status again, the ACP Program Supervisor may immediately deregister the Contractor.

2.2.4 Performance The ACP Program Supervisor, General Manager and Field Facilitator will continually monitor a Contractor’s performance as it relates to code compliant work. Contractors who continually do non-code compliant work will be warned first, suspended/deregistered if Contractor response is not adequate, or moved to the “60Day/100%” process. Note1: HVAC Contractors operate under the Quality Assurance System (QAS) and are not subject to the rules of the defect ratio Note2: A defect deemed as “hazardous” by the Inspector and agreed to by the Territory Technical Advisor, will be cause for immediate suspension for a minimum period of three months Note3: Failing to file is considered a hazard Note4: If a defect is deemed as “hazardous”, the penalty includes:

Automatic suspension for minimum three months All active ACP notifications will be changed to non-ACP status $71 fee per active ACP notification, changed to non-ACP, will apply

2.2.5 Corrective Action Plan A “Corrective Action Plan” may be requested when a Warning Letter is issued to a Contractor and will be requested when a Suspension/ Deregistration Letter is issued to a Contractor. The purpose of the Corrective Action Plan is for the Contractor to advise – in writing – what processes have been implemented so that ESA is assured this situation will not arise again.

2.2.6 Warning Letter The Program Supervisor will issue a Warning Letter:

If a Contractor has a defect ratio >4% (does not apply to HVAC members)

If a Contractor has an overdue account balance If pre-existing hazards were present and the Contractor neglected

to advise ESA (see Section 2.0 Program Eligibility, sub-section 2.2.10.3 Shared Responsibility)

If a Contractor drops below the required number of 20 permits annually to remain a member

If a Contractor doing Substation or Pole Line maintenance work, does work outside of the pre-defined Scope of Work (See Section 4.0 Program Verticals, sub-section 4.5 Pole Line Maintenance and 4.6 Substation Maintenance)

If a Contractor fails to follow ACP Processes, i.e. frequent “no access” defects, failing to call at each stage of construction, failing to notify if connection date changes, failing to correct defects within specified timeframe, etc. (See Section 2.0 Program Eligibility, sub-section 2.2.11 Contractor Accountability)

Warning Letters will state the reason for the warning, request in writing a “Corrective Action Plan” and stipulate a reply date. Contractors are required to reply in writing, within the stipulated timeframe, what processes they have put into place to ensure the same concern is not flagged again. Failure to adequately respond to the Warning Letter is sufficient reason for the ACP Program Supervisor to consider suspension.

2.2.7 Suspensions/Deregistration Letter

The Program Supervisor will issue a Suspension/Deregistration Letter:

If after an investigation has been done, it is confirmed a Contractor was doing work without filing – suspend, min 3 mths – max 2 year; Note1: Failing to file is considered a hazard (see Section 2.0 Program Eligibility, sub-section 2.2.4 Performance).

If Contractor has left life and/or property hazards behind – suspend, min 3 mths – max. 2 year;

If a Contractor connects prior to the pre-authorized connection date – connections must take place on the date the pre-authorized connection is issued for – suspend, min 3 mths – max. 2 year;

If Contractor sub-contracts to a non-licensed Contractor – suspend, min 3 mths – max 2 year;

If Contractor fails to meet the conditions laid out in the Warning Letter – suspend min 3 months – max 2 year;

If Contractor fails to meet the conditions laid out in the Suspension Letter – deregister up to 2 years;

If Contractor fails to successfully complete the probationary period – suspend, contractor may re-apply once eligibility requirements are met;

If Contractor has a >4% defect ratio and he was warned when he reached >4% - suspend min 3 months – up to 2 years;

If Contractor was convicted of an offense under the Electricity Act – deregister – 2 years.

Note2: Responsibility rests with the Contractor to contact ESA if he/she desires to rejoin the Program - if a Contractor was suspended and makes no attempt within 12 months to reinstate his Company to the Program, deregister. Suspension/Deregistration Letter will state the reason for the suspension/deregistration, advise that all ACP privileges are immediately removed, advise that an appeal process is available, and stipulate a date in which the Contractor is eligible to reapply for Program membership. During the suspension period, normal inspection procedures and fees will apply to all installations filed after the suspension date.

Voluntary deregistrations must be submitted in writing to the ACP Program Supervisor.

2.2.8 Appeal Process

To ensure a fair and just system, Contractors may make a formal appeal if their application for Program membership has been denied or when suspended/deregistered from the Authorized Contractor Program. An appeal, in writing, must be faxed to the ACP Office at 1-800-249-7667 within 15 working days from receiving the refused application, or notice of suspension/ deregistration. A decision will be forthcoming within three weeks.

2.2.9 Reinstatements It is the responsibility of the Contractor to request reinstatement to the Authorized Contractor Program. Upon receiving the request, the ACP Program Supervisor may issue a Reinstatement Letter, if:

the stipulated time-period in Suspension/Deregistration Letter has been fulfilled and the ACP Program Supervisor is satisfied with Contractor performance; or

the Contractor formally submits a Stage I Appeal, requesting that the suspension/deregistration decision be reconsidered, (in writing to the Program Supervisor) and is successful, reinstatement will be immediate, effective the date of the decision (see Section 2.0 Program Eligibility, sub-section 2.2.8 Appeals)

If the ACP Program Supervisor agrees to reinstate a Contractor, a Reinstatement Letter will be issued, advising agreement to reinstate, date reinstatement is effective, and the reinstatement conditions. Reinstatement conditions may include retraining for particular aspects of concern, i.e. Ontario Electrical Safety Code, ACP Procedures, Residential Wiring, HVAC training. If the ACP Program Supervisor does not agree to reinstate a Contractor, a letter will be issued, advising the Contractor of the reason reinstatement has been denied. If a Stage I Appeal does not result in successful reinstatement, the Contractor may advance the appeals process to Stage II (See Section 2.0 Program Eligibility, sub-section 2.2.8 Appeals)

2.2.10 Following Program Administrative Processes It is important that Program administrative processes are followed. Each of the below-noted items could result in a written defect – Contractors can be warned/suspended for failing to follow administrative processes.

2.2.10.1 Available Access (excludes New Residential) The Contractor must arrange access when requested by the Electrical Safety Authority. Failure to do so may result in a Warning Letter and a

written defect.

2.2.10.2 Safe Access Contractor shall ensure safe access to installations is always available for the Electrical Safety Authority. Failure to do so may result in a Warning Letter and a

written defect.

2.2.10.3 Shared Responsibility The Authorized Contractor Program has a shared responsibility. Should a Contractor discover existing hazards while on a work site, he/she must advise the Electrical Safety Authority. Failure to do so will result in a Warning Letter and a

written defect.

2.2.10.4 Rescheduling Pre-Authorized Connection Dates It is the responsibility of the Contractor to advise the Electrical Safety Authority when connection dates are changed or re-scheduled – connections can only take place on the date the pre-authorized connection is issued for. Failure to do so may result in a Warning Letter and a

written defect.

2.2.10.5 Calling at Each Stage of Construction It is a requirement of the Authorized Contractor Program, that Contractors notify the Customer Service Centre when each stage of construction is ready for inspection, i.e. rough wiring, service, and final. Failure to do so may result in a Warning Letter and a

written defect.

2.2.10.6 Calling to Reschedule It is a requirement of the Authorized Contractor Program, that Contractors notify the Customer Service Centre should a scheduled inspection not be required. Failure to do so may result in a Warning Letter and a

written defect.

2.2.10.7 Failing to Correct Defects Within A Specified Timeframe It is the responsibility of the Contractor to correct defects within 30 days from the time of issuance. Failure to do so may result in a Warning Letter and a

written defect.

2.2.10.8 Working Outside Scope Of Work – Pole Line It is the responsibility of the Contractor doing Pole Line work, to work within the pre-defined Scope of Work, as outlined in Section 4.0 Program Verticals, sub-section 4.5 Pole Line. Failure to do so will result in a Warning Letter and a

written defect.

2.2.10.9 Working Outside Scope Of Work – Substation It is the responsibility of the Contractor doing Substation work, to work within the pre-defined Scope of Work, as outlined in Section 4.0 Program Verticals, sub-section 4.6 Substation Failure to do so will result in a Warning Letter and a

written defect.

2.2.11 Contractor Accountability

The following Contractor Accountabilities must be adhered to. Failure to do so, may result in a Warning Letter/Suspension from the ACP Program: 2.2.11.1 Basic Program Accountability Requirements:

o Notifications must be filed for ALL electrical work, as per the Ontario Electrical Safety Code, Rule 2-004

o When filing, the Contractor must disclose all information relating to that particular electrical installation, to ensure ACP/non-ACP rules are appropriately applied

o When serious code violations are detected by the Electrical Safety Authority on an installation, the Contractor must verify in writing to the General Manager and the ACP Supervisor, that similar defects in the work performed are NOT present in any previous installation

o Contractors are responsible to advise ESA when a scheduled inspection is not ready, or cancelled

o Contractors must work within the parameters of ACP and any work that falls outside the scope of a particular Vertical, must be filed on a separate Application for Inspection

o The owner or an employee of the owner must hold the appropriate Certificate of Qualification

2.2.11.2 Administration

o All information must be provided on the application form, including specific directions to the site requiring inspection, or it will be returned to the Contractor requesting that it be completed prior to inputting

o Staff must be skilled and qualified according to the particular type of work being performed

o All those doing work under the Authorized Contractor Program, have participated in an Electrical Safety Authority New Code whenever such training is offered

o Copies of the Ontario Electrical Safety Code and the Electrical Safety Authority Bulletins must be readily available to all staff

o The Contractor’s business is equipped with a telephone answering machine or voice mail

o The Contractor has a dedicated fax machine or has supplied ESA with a current email address, in order to receive ACP related communications, i.e. ACP Newsletter

o Substation contractors must have email capability in order to submit via email the substation maintenance condition report to the applicable ESA Inspector

o Contractor shall pay an annual Program registration fee o Contractor shall be on the charge system and shall maintain

a current account balance

2.2.11.3 Processes: o A process is in place that ensures all staff are familiar with

the requirements of the Authorized Contractor Program o A process is in place that ensures ALL applications for

inspection are filed o A process is in place to ensure scheduling, rescheduling and

cancellations, for inspections is made o A process is in place that ensures all non-conformances,

defects and code violations are corrected immediately o ACP processes must be followed, i.e. Arrange access,

ensure safe access, calling at each stage of construction, notifying ESA if connection date changes, etc

2.2.12 # of Notifications Required to Remain a Member Contractors participating in ACP must have filed a minimum of 20 applications for inspection in the previous one-year period, while a member of ESA’s charge account system. Contractors participating in the Pole Line Maintenance vertical who hold a 309A electrician’s certificate only, must have filed a minimum of 20 applications in the previous one-year period specific to that Line of Business, while a member of ESA’s charge account system to retain status (See Section 4.0 Program Verticals, sub-section 4.5 Pole Line Maintenance for more information). Application monitoring will occur quarterly. Contractors with <20 applications in the previous one-year period will be warned and should their company again have <20 applications in the previous one-year period when the information is again reviewed at the beginning of the next quarter, the Contractor will be suspended.

Members of the Authorized Contractor Program are advantaged by the many benefits offered by the Program; however, all benefits will be immediately withdrawn should a Contractor fail to meet the criteria as outlined in “Program Eligibility” and is subsequently suspended or deregistered from the Program. Note1: ACP benefits apply to ACP work only and only where exceptions are not noted.

3.1 24-Hour Benefit ACP Contractors, who file their application with the Electrical Safety Authority as per Code Rule 2-004 and pay the fee as set out under the fee schedule, are entitled to a 24-hour turnaround on their applications. The process is as follows,

The Contractor notifies the Electrical Safety Authority Customer Service Centre, when an electrical inspection is ready for inspection. (Only work that is “ready” qualifies for this benefit).

All requests for inspection must be received in the Customer Service Centre by 2:00pm, for next business day service.

After 2:00pm of the next business day following the particular request for inspection, an inspection shall be deemed to have taken place by the Electrical Safety Authority.

Notwithstanding the aforementioned, an Inspector may notify the corporation, partnership or sole proprietor (Contractor) by 2:00pm on the day the inspection is scheduled, and advise that a physical inspection is going to take place on this installation.

The 24-Hour Benefit applies to ACP Contractors only and only to those items covered under the ACP Program.

This benefit applies to all three stages of construction – Rough-In/ Service/ Final

This benefit covers New Residential, Renovation Residential, Service Upgrades, 1:3 & 1:5 Commercial/Industrial Small Jobs. (1:10 Small Jobs are not included).

This benefit is in effect during regular business hours and does not apply to emergency work.

3.2 Pre-Authorized Connections See Section 4.0, Program Verticals, for explanation of when pre-authorized connections apply to individual verticals. The process to follow to request a pre-authorized connection is as follows:

The Contractor files an “Application for Inspection” for a pre-authorized connection

The Contractor contacts the Supply Authority and makes arrangements for the Power Outage

The Contractor provides ESA with 24 hours advanced notice of the power outage date

The Contractor is responsible for notifying ESA of any cancellations or postponements

Note1: Pre-authorized connections can only be used on the date they are issued for; connections occurring prior to the scheduled date, will be viewed as working without a permit.

3.3 Same Day Emergency Connections

Under ACP, Contractors are entitled to a same day emergency connection if the following conditions are present:

Due to weather conditions, ie. Ice storms, wind storms Due to an accident, ie. Vehicle hitting a pole, tree or limb falling on line Due to meter replacements Due to an existing underground cable being damaged

Type of work that would be included:

damaged stack/meterbase, pole damage replacement of main breaker, or replacement of a main disconnect in a residential setting, or replacement of a burnt or broken jaw in a meterbase

3.4 After Hours Emergency Status Under ACP, Contractors belonging to the substation and/or pole line verticals require a connection authorization in an after hour emergency situation will contact ESA after hours by calling 1-877-ESA-SAFE and review with the on-call Inspector the work that was done. The on-call Inspector will determine if an inspection is required prior to reconnection and if not, he will arrange a connection providing the Contractor has ACP status in the applicable vertical.

3.5 Fee Discounts ACP Contractors receive reduced fees on filed applications, as follows:

3.6 Co-Advertising ACP Contractors who have been on the ACP Program for at least one year, who are not on probation, may display the ESA logo by way of vehicle stickers and/or an electronic file for letterhead/business card purposes. To participate, the following criteria must be met,

The cost to participate in Co-Advertising is a one-time $25 administrative charge plus 50¢ per sticker (+GST) per order. There is no charge for the electronic files. Certain restrictions apply and Contractors must agree to adhere to all restrictions, prior to the issuance of stickers and/or an electronic file. Contractors who wish to participate in Co-Advertising should contact the ACP Office at 1-800-249-4583.

Scope of Work The ACP Program will include all electrical installations normally done within a “single family dwelling” as defined in the current Electrical Inspection Fees.

Vertical Residential - HVAC

Scope of Work

Heating, Ventilation, Air Conditioning Contractors on the ACP Program must understand they are limited in scope to work that is unique to this business and for which their staff are qualified under the Trades Qualification and Apprenticeship Act. Therefore, HVAC Contractors on the ACP Program must ensure they work within the scope of their licence and are qualified to install and/or do work within the unit only. An HVAC “small job” is identified as follows: An HVAC installation valued at five hundred dollars ($500) or less invoiced

to the customer for labour and miscellaneous materials only HVAC job value does not include the price of the appliance and associated

non-electrical equipment Applications are to be filed:

4.4 Commercial/Industrial

The ACP Program will include electrical installations and maintenance work with a Contractor invoice to the customer value of $5000 or less (including the cost of parts/ equipment/machinery). This Program will not apply to maintenance work in any facility, building, business or other location where a Continuous Safety Services contract is in effect. There are three small job tiers included in Commercial/Industrial in ACP – scope of work for each follows: 1:10 - An audit ratio of 1:10 is applied to this work and the following criteria is applied: An electrical installation valued at five hundred dollars ($500) or less invoiced

to the customer for labour AND materials Applications are to be filed:

o When the Small Jobs Application Form is filled, or o On the 1st and on the 15th of each month

Note1: A Contractor may file more frequently but in no case should an application be filed more than two weeks after the job

4.5 Pole Line Maintenance

Vertical POLE LINE MAINTENANCE

Scope of Work

Under ACP, Contractors will receive a one in five inspection ratio and will be advantaged by pre-authorized connections for pole line maintenance work <50kV, on both temporary and permanent pole lines. Allowable maintenance work is as follows: Like for Like Replacements:

Note1: Performing work other than that work as noted above is not covered under this ACP vertical and will require a separate non-ACP notification. Failure to do so will result in a Warning Letter and a written defect. Note2: New Contractors to the Program come on as “Probationary” Contractors for three months; failure to successfully complete the probationary period, can result in automatic suspension (see Section 2.0 Program Eligibility, sub-section 2.2.1 Probationary Period) Note3: Gang-operated switches and other replacement installations not covered under the maintenance list of like for like above (and not including new installations) will be subject to preauthorized connections and emergency connections. After Hours Emergency Work

Requiring a Connection Authorization Under ACP, Contractors requiring a connection authorization in an after hour emergency situation will contact ESA after hours by calling 1-877-ESA-SAFE and review with the on-call Inspector the work that was done. The on-call Inspector will determine if an inspection is required prior to reconnection and if not, he will arrange a connection providing the Contractor has ACP status.

4.6 Substation Maintenance

Vertical SUBSTATION MAINTENANCE

Scope of Work

Clean out foliage (weeds, shrubs etc.) from inside the substation. Wash down the insulators, check the operation of the switches and breaker or fuses, check oil for contaminants, review and perform minor repairs. Over all, a general clean up is allowed. Make recommendations to the substation owner as to required repairs. In addition, under ACP, Contractors will receive a one in five inspection ratio and will be advantaged by pre-authorized connections on substation maintenance work up to and including 115kV/230kV, defined as “minor” or “Like for Like” replacements. Vertical SUBSTATION MAINTENANCE Exclusions: If major repairs are required in order to re-energize the substation, the Contractor is obligated to contact an ESA Electrical Inspector for approval to reconnect. Failure to do so will result in a Warning Letter and a written defect. Note1: the pre-authorized connection issued on the above “minor” work or “Like for Like” replacements does not apply if “major” work is required.

Note2: New Contractors to the Program come on as “Probationary” Contractors for three months; failure to successfully complete the probationary period, can result in automatic suspension (see Section 2.0 Program Eligibility, sub-section 2.2.1 Probationary Period) Note3: 1:5-inspection audit ratios will not apply to TLO, Metal Clad Switch Gear and Indoor Substations. Inspections on this work will be determined by the Inspector, after his review of the Substation Maintenance Report and as per the internal Best Business Practice (ESA BBP Version Date January 24/02) Note4: Five days notice required on all substation maintenance work for open air stations. Failure to do this may result in a mandatory site visit with applicable fees. Note5: Gang-operated switches and other replacement installations not covered under the maintenance list of like for like (and not including “major” work) will be subject to preauthorized connections and emergency connections. Full inspections will occur on this work the next time the Inspector is in the area.

After Hours Emergency Work Requiring a Connection Authorization

Under ACP, Contractors requiring a connection authorization in an after hour emergency situation will contact ESA after hours by calling 1-877-ESA-SAFE and review with the on-call Inspector the work that was done. The on-call Inspector will determine if an inspection is required prior to reconnection and if not, he will arrange a connection providing the Contractor has ACP status.

Vertical SUBSTATION MAINTENANCE

Required Qualifications

A valid ECRA/ESA Electrical Contractor's Licence as required under Ontario Regulation 570/05 made under the Electricity Act, 1998, and the appropriate Certificates of Qualification as required under the Trades Qualification and Apprenticeship Act or under the Apprenticeship and Certification Act for the work to be performed. Electrician’s Certificate 309A or D, or 434A or B, or CET* + Experience** or Professional Electrical Engineer*** + Experience** *CET must be recognized by Ontario Association of Certified Engineering Technicians and Technologists (OACETT) ***Professional Electrical Engineer must be recognized by the Professional Engineers of Ontario (PEO) **Experience = 20 notifications specific to this line of business, to get onto ACP and to remain on ACP. Notification information is continually reviewed, on a one year rolling window (see Section 2.0 Program Eligibility, sub-section 2.1.7 # of Notifications Required to Get Onto the ACP Program and 2.2.12 # of Notifications Required to Remain a Member)

5.0 Glossary Audit Ratios The ACP Program works on an audit-based process. Contractor performance is closely monitored; hence, full inspections may not be required. The audit ratio takes into account the associated risk and is different for each ACP Vertical Automated Batching Process The Automated Batching Process (aka ABP), batches all small job notifications on a per Contractor basis, ensuring 1 in 10 notification is inspected ACP Authorized Contractor Program. A process for recognizing Ontario Electrical Safety Code compliant work, performed by a Contractor, based on current practices and previous work Action Letter Action letters, ie Warning, Suspension, are sent to a Contractor whose behaviour under the Program is not within Program standards, ie. A Warning Letter is issued due to a high defect ratio Account Status Every Contractor on ACP must maintain a current account balance to remain eligible for Program status Co-Advertising Contractors who meet certain criteria may be eligible to co-advertise with ESA. Defect - Ratio The ACP defect ratio is calculated by dividing the # of defective sites into the # of site visits. Contractors must maintain a defect ratio of 4% or below to remain eligible for Program status Deregistration Contractors can be deregistered from the Program if they fail to meet on-going eligibility requirements HVAC HVAC Contractors must work within the scope of their licence. Pre-Authorized Connections Contractors on the Program are allowed a pre-authorized connection on Residential, Commercial/ Industrial, Pole Line and Substation Maintenance work, providing the work done is within the pre-authorized scope. Probation Contractors come onto ACP in a probationary capacity. They must fulfill three months while on probation prior to consideration being given for full time membership status. Full Program benefits apply while Contractor has a status of probationary and Inspectors may do additional inspections during the probationary period. Quality Assurance System (QAS) QAS measures performance under ACP. Contractors who consistently do code compliant work will see no change, but those who are issued defects will receive increased inspections.

Reinstatement ACP Contractors can be considered for Program reinstatement, providing they have fulfilled the time requirement stipulated in the Suspension letter and the ACP Program Supervisor is satisfied with performance, or they have successfully appealed the suspension decision. Suspension Letter ACP Contractors are suspended from the Program if they fail to meet the requirements laid out in the Warning Letter, if they have left a Life and/or Property hazard, or if they do not meet Program requirements during the probationary period. Vertical The term “vertical” defines the work included in ACP, ie. HVAC, Residential, etc. for which Contractors may elect to include in their membership. Certain criteria apply to each Vertical; see Section 4.0 Program Verticals, for a detailed description of each. Warning Letter Warning letters are issued to Contractors who fail to meet the requirements of the ACP Program. A Contractor can be warned for an overdue account balance, a high defect ratio, failing to reschedule a pre-authorized connection date, etc.
