Peachtree Mobile Home Park Pump Station Improvements

This addendum is being issued to provide clarification and answer questions received. Clarifications C1. REPLACE the Bid Form with the attached revised Bid Form. C2. base” to “total vertical feet of each size manhole base and riser”. C6 In Specification Section 01 22 15, paragraph 1.5.B.22.b.2. CHANGE the first sentence to “The Unit Price

Bid per vertical foot (VF) of Large Diameter (60”, 72”, 84”, and 96”) manhole shall be the actual number of vertical feet installed of each size – including the reducer slab.

C7 In Specification Section 01 22 15, ADD the following paragraphs to the end of the section.

34. RELOCATION OF EXISTING STORAGE SHED

a. MEASUREMENT: The work under this item is not measured separately for payment. PAYMENT: The item completed and accepted will be paid at the Lump Sum Price Bid. The Lump Sum Price Bid shall be full compensation for providing materials, equipment, and labor to lift and relocate the existing storage shed from its current location to a new location ouside the work area, including preparing, securing, and lifting the shed from its current position, preparing a level location for placement of the shed, moving the shed, setting the shed in palce on a level foundation in the same or better condition than currently exists, removing the wood and wire fence caging adjacent to the shed, and all related work necessary to provide a suitable work area for the pump station and force main improvements.

35. RAILROAD RIGHT-OF-WAY WORK COSTS

a. MEASUREMENT: The work under this item is not measured separately for payment. b. PAYMENT: The item completed and accepted will be paid at the Lump Sum Price Bid. The Lump

Sum Price Bid shall be full compensation for providing materials, equipment, and labor to coordinate with, and obtain any required approvals and permits from the Railroad Company for work within their right-of-way. The Lump Sum Price Bid shall also include the cost for any review fees, permit fees, insurance, flagmen, or other related needs associated with work within the railroad right-of-way.

C8. On Drawing 2, DELETE the last sentence of General Note #30. Questions Q1. Drawing Sheet 2, General Notes, Number 30 states: “…..The Contractor shall not receive any additional

payment or time extension for items not being shown in plans or for field adjustments made due to actual subsurface conditions and utility locations.”

General Conditions, Article 4.04, B.2, page 17 states: “If Engineer concludes that a change in the Contract

Documents is required, a Work Change Directive or a Change Order will be issued to reflect and document such consequences. An equitable adjustment may be made in the Contract Price or Contract Times, or both, to the extent that they are attributable to the existence or location of any Underground Facility that was not shown or indicated or not shown or indicated with reasonable accuracy in the Contract Documents and that the Contractor did not know of and could not reasonably have been expected to be aware of or to have anticipated….”

These two items appear to be contradictory to each other. Please clarify.

A1. See Clarification C8, above. Q2. Is there a geotechnical report available for this project? How will the contractor be compensated for any

rock encountered? A2. See Supplementary Conditions, SC-4.02. See Specification Section 31 23 00, paragraph 3.5.C.1. Q3. Specification 01 00 00-10, section 3.29, paragraph A., it states that the contractor shall provide invoices

to GCDWR for sales tax paid. Will this be required and if so what invoices does GCDWR foresee being requested and does GCDWR have a standard form for this?

A3. Yes. See Specification Section 01 33 23, paragraph 2.8 and Specification Section 01 77 00, paragraph

1.2.B.14. See Attached Sales Tax Forms. Invoices, showing the taxes paid, for materials and equipment shall be submitted with pay requests.

Q4. Section I, Instruction to Bidders, Item 25, Area Office. Please clarify if the office and equipment storage

yard located within Gwinnett County will be required for this project? A4. See Specification Section 01 52 13 – Field Offices Small Projects No Field Office. A field office is not

required. Q5. Please confirm the time the pump station can be out of service while the temporary by-pass tee assembly

is being installed. A5. The pump station can be out of service for four (4) hours. See Clarification C2, above.

service for the proposed wet cut-in. Also, the time/duration the 6” water main at Pine St and East Broad St can be out of service for the wet cut-in.

A6. See Clarifications C3 and C4, above. Q7. Please confirm if the work at East Broad St and Pine St is within the Norfolk Southern Railroad ROW. If so,

how will the contractor be compensated for additional insurance requirements and railroad flagmen? A7. The proposed work at East Broad Street and Pine Street is within the Norfolk Southern Railroad right-of-

way. See Revised Bid Form. Q8. Specification Section 01 22 15 Measurement and Payment, 22.a.2 Page 9, references the measurement

of large diameter (60”, 72”, 84” and 96”) manhole bases. There are large diameter manhole bases shown on the Drawings but there are not pay items in the bid form. Please advise how the contractor will be compensated for the large diameter manhole bases?

A8. See Revised Bid Form Q9. Drawing Sheet 16, shows open cut of Pine Street with the gravity sewer approximately 30 ft. deep. Please

advise the time/duration that Pine Street can be closed to traffic at this intersection. Also, the existing water main is in close proximity to the proposed sanitary sewer. Can the existing water main be taken out of service during the installation of the proposed sewer? How will the Contractor be compensated for any replacement of the existing water main?

A9. Pine Street will be closed during the proposed work. Please see the Traffic Control Plan on Sheet 32 for

the Pine Street Detour. Local traffic may enter from East Broad Street while the work is performed for the gravity sewer installation.

The existing water main cannot be removed from service during the installation of the proposed sewer.

See General Note 29 on Drawing Sheet 2. Q10. Will an office trailer be required for the Peachtree Mobile Home Park Pump Station Improvements

560-12-2-.87 Machinery, Air or Water Pollution. Amended.

(1) Any person making a sale of machinery and equipment which is to be incorporatedinto any facility in this State and used for the primary purpose of reducing or eliminatingair or water pollution shall collect the tax imposed thereon by the Georgia Retailers, andConsumers’ Sales and Use Tax Act, as amended, unless the purchaser furnishes him witha Certificate of Exemption (Form ST-M8), certifying that the purchaser is entitled topurchase such machinery and equipment without paying the tax.(2) Any purchaser of such machinery and equipment to be installed into his facilities,who desires to secure the benefit of the exemption provided for in O.C.G.A. §48-8-3(36)(A) or (B), shall file application for Certificate of Exemption (Form ST-M7)with the State Revenue Department, and furnish other such information as may benecessary in determining the adequacy of such machinery.(3) In order to qualify for such exemption, the property must have the character ofmachinery at the time of purchase, must be installed for the primary purpose ofeliminating or reducing air or water pollution, and the machinery and equipment musthave been certified by the Environmental Protection Division, Georgia Department ofNatural Resources, as necessary and adequate for the purpose intended. The exemption isnot applicable to materials which do not have the character of machinery at the time ofpurchase or materials to be incorporated into real property construction.(4) Application for Certificate of Exemption (Form ST-M7) should be filed by theultimate owner and user of the machinery and equipment prior to or immediatelyfollowing approval of plans by the Environmental Protection Division, Department ofNatural Resources. There must be attached to such application a schedule of machineryand equipment, its function in reducing pollution and the estimated cost of each machineor unit of equipment.(5) Upon approval of an application, the Commissioner will issue a Certificate ofExemption (Form ST-M8) for presentation by the purchaser to his supplier of exemptmachinery and equipment, whereupon the purchaser shall be relieved from payment ofthe tax, and suppliers shall be relieved from collection of the tax.(6) Since O.C.G.A. § 48-8-63(a) provides that any person who contracts to furnishtangible personal property and perform services thereunder within this State shall bedeemed to be the consumer of the tangible personal property and shall pay the tax at thetime of purchase, an exemption certificate is not issued to a contractor.(a) However, where a contractor purchases machinery and equipment which is certifiedby the Environmental Protection Division, Georgia Department of Natural Resources, asbeing necessary and adequate for the purpose intended, the ultimate owner of theproperty may file claim for refund of the tax paid on the approved machinery andequipment. Upon proof of payment that the tax due has been paid to this State, claim forrefund will be processed.(b) Claim for refund must be filed within three (3) years following date of payment to theretailer.(7) In the event a Certificate of Exemption has been delayed by this Department, pendingcertification by the Department of Natural Resources, or for any reason, the purchasershall pay the tax to his supplier and promptly file Claim for Refund (ST-12) with theDepartment of Revenue, Sales and Use Tax Unit, together with Assignment of Vendor's

Right to Refund (Form ST-12A). Upon receipt of the Claim for Waiver of Vendor’sRights, refund of the tax paid on the approved machinery will be made directly to theproperty owner.(8) The purchaser of such machinery and equipment shall maintain records of machinerypurchased under a Certificate of Exemption (Form ST-M8), and in the event propertyother than the approved items has been purchased thereunder, such purchaser shall beliable for the tax, together with penalties and interest provided for in Section 16 of theAct.Authority Ga. L. 1937-38, Extra Sess., p. 77, et seq., as amended (Ga. Code Ann., Secs. 92-8405, 8406,8409, 8427); Ga. L. 1951, pp. 360, 385 (Ga. Code Ann., Sec. 92-3438a); O.C.G.A. Secs. 48-2-.12,43-3-3(36).
