As I've expressed several times before (to several people at Ready Mortgage), I am not in charge of paying for the house; Terry and his wife are. They lied to me when I first signed for the house, and told me that they would transfer it to their company's name. They sent me documents transferring "something" to the company's name. I thought it was the house as we originally agreed upon, but then they told me it was just for the liability. It's not until they stopped being able to make the payments that they told me the house was still in my name and I would be responsible for what happens to it.

So, again, it's vital that I know when and if that window of opportunity arises.

Cheryl's doing surprisingly good at her job, and making enough to provide the essentials to her family, plus some cream off the top to help with Adobe, so it seems to stabilizing. A good thing, no matter how temporary or permanent that may be. So I guess I'm feeling a bit bullish, you could say, about the CURRENT situation.

Matthew had the clever idea of using MY VA Loan to buy Adobe at the cost of the loan, which would cap my own loan at 4.5% interest vice whatever's going on with it right now, skimming a few hundred-a-month off the payments, and putting it in my name, which gets me a bit more

involved and takes some of that boulder off your shoulders. Some =p. I'll be checking with my contacts here to see what's entailed and how to set that up, and proceed immediately as if that is the plan, in case it becomes it.

About the $1400: I'd like to make all future transactions smoother, so I agree that establishing a Wells Fargo account on my part would be the wisest choice. I planned on ya'll needing it so I'm doing fine for now, as long as no -$1000-ish problems come my way.

Okay, that joke ran a bit long. I see what you mean, but from what she's told me

it's a bi-weekly paycheck, and commission goes towards the check AFTER the

current pay period, so her sales before the 15th will earn 7-10% of those figures

at the end of the month. She recited the formula matter-of-factly using recent

sales as examples: "This couple bought a $16,000 plan, therefore ~$115-160

commission." etc.

You know I've NOT been a cheerleader for Cheryl in the past, and this is based

on her continual poor financial choices and biting off more than she could expect

herself or family combined to chew. However, in recent conversation she's

spoken with a tone of unfamiliar confidence and joy, with an undercurrent of

yearning independence, so I believe she may have something legit here.

BUT YER RIGHT IN THAT SHE NEEDS TO FLEX THAT NEW MUSCLE before

we can truly believe or count on it.

One thing I picked up, as well, is that she specifically cited that she desperately

wants to make amends with me and Matthew and show she can NOW stand on

Ok, this is my 3rd attempt in sending this e-mail. Hopefully, it'll go through, but

I'm sorry if you end up getting three versions of the same information. I paid the

adobe house today (June 09 payment-- THANK YOU, MICHAEL!!). It was

$1765.84, which included a $62.88 late fee (accrued after the 10th) and a

$75.00 attorney fee (accrued after the 30th). Right now, what is needed to make

the house current is $1587.30 bythis Thu. (the 10th) in order to avoid more

pointless fees. We also need a good amount for hiring contractor(s). Michael

will be able to help out for large chunks of this, but I need to know what

everyone else can contribute to the cause.

Also, Cheryl/Terry: Any new headway with the adobe house, financially or

repair-wise? Have you found any dependable contractors? That way we can

figure out how much money we need to get the ball rolling again. Shanna and

the lender have already agreed to help, so I want to make sure we don't keep

them hanging.

Ok, my brother-in-law was able to get Terry to look at the roof. He said he's going to be able to fix the leak tomorrow, and that it's not very big. Hopefully everything moves along as planned. I'll let you know if we run into any more hang ups, but it looks like this one was a false alarm.

As another exploratory question, what is the process of a "short sale" and is it available to us?

Ok, I jsut made this month's mortgage payment ($2068.11). I asked for

a breakdown, and apparently the normal mortgage is around $1600-

something. They recently (since Aug.) decided to add escrow to our

payments (almost $400) because we are "delinquent in our repairs".

Additionally, Craig decided to raise our interest rate from 10% to 13%.

I'm in the process of trying to figure out why he did that other than just

Ok, so here's the update:

So, I got an email from Shanna yesterday with the draw requested

being rejected (will forward that to you). Apparently, toilets,

countertops, and cabinets are not done. I didn't know the cabinets had

to be painted/stained prior to inspection, which is my bad. Terry said

what Eugene has failed to do is pretty simple to finish and that he'll do

it, but we're both confused as to why Eugene didn't complete his part.

A few hours later, I got an email from Eugene where he gave me an

ultimatum to either give him the money today, or he's going to put a

lein on the house and going to the lawyers. I told him that I wasn't the

one rejecting the draw, that it was his failure to complete the work that

caused him to not get paid. He said that he's done his part, and needs

to get paid because he's now a month behind his rent. He also

suggested that he was getting the "run-around" because there was no

such thing as Ready Mortgage. I told him to take it up with Ready

Mortgage because I did my part with no delays.

Rent is due; should be about $2,068. We have until the 10th to pay it,

so I'm in no hurry right now. :)

Terry mentioned installing pre-made vanities and going out today to

price everything out for the bathrooms.

Ok, so apparently, the draw was approved 11-25-09, but Tu (the lady that

handles the cash at Ready Mortgage) called the phone number they had on file

(Terry's) to figure out where to send the check and could never get a hold of

anyone, so she just kept it in the office. It wasn't until this Sunday that I thought

"Ok, that's been long enough..." so I emailed Shanna for an update. Long story

short: I updated the contact info, picked up the check, deposited it, and paid for

this month's mortgage.

The draw check is for $3,683.50. The month's mortgage was $2,014.48. So, you

currently have $3,837.04 in our account for whatever your heart desires (adobe,

carpet, any self-pleasing wants, etc.). Let me know if you want me to transfer

some to your account, write a check out the the Underwoods, or how you would

like me to proceed from here.

Here's the latest and greatest of 2010, a complete photographic

inventory of the Adobe house, including the very recent collapsing of

some more ceiling drywall (now very "wetwall") that we discovered and

I think sealing the roof once more, and then saving the drywall for last

after the seals been tested, will be the best course of action. Installing

the sinks, oven, washer/dryer(?), and bathtubs and showers are

independent of other factors, so we can work on that in the mean time.

From what I understand, the main bathtub needs to be installed, there's a small electrical issue that I've been probing to get more information about, and cosmetic repairs like baseboards and trim. I'm currently waiting for a more official list.

I am having to reconsider foreclosure because the person helping make payments to the property is missing. I live in Alabama which makes it very difficult to do anything with the house. The process for claiming draw money takes so long and adds to the debt that it makes it pointless to claim it. As I've said before, my name and credit was used to get this loan and then everyone else disappeared once their project failed. So I don't know anything about the loan other than getting a monthly statement for a house in a different state that I've only visited a handful of times. Thanks for any information you can provide about the process of foreclosure. Before I go through with it, I need to make sure my little girl is not going to be affected by it in any way (losing our vehicle, primary residence, or a deficiency that I have no way of paying). I did not have a job when I originally was told of the loan (which again, I was told my name was going to be switched out for the company's name within the first month), and I still don't have a job. I am just a homemaker that was trying to help out some family members with my name/credit and ultimately got really screwed over.

Again, any helpful information is appreciated about the type of loan this is and the possible repercussions of a foreclosure.

Okay, we talked to the realtor and had a contractor inspect the

property. It looks like the cost to repair this property in order to sell it

at market value would be around $30K.

The trustees have reviewed the information and have the following

offer for you and Terry.

1) You and Terry would need to sign a Deed in Lieu of

Foreclosure immediately giving the property back to Ready Mortgage

Corp.

2) You would need to continue the monthly interest payments until

July unless we sell the property sooner. If we sell it later than that, the

get it sold as soon as we can. We probably won't be able to sell for

the amount that we have into this property, but if you comply with the
