quite frankly, fun. We hope this will be a fun and innovative way to present the grant applications so others can stick around and pick up some new ideas. Let us know your thoughts!

6. Community Service Project. Last year's "Suits for Soldiers" clothing drive was

incredibly successful. This year, we will host another community service-related event to be decided by the committee. Stay tuned!

7. Health and Wellness Component. Health and wellness is very important to the YLD’s overall message for AOC. To this end, we will be hosting a fun run similar to the last couple of years. Governors Margaret Rowell Good and John Miller have done an incredible job heading this up in the past and we are excited to continue the tradition. There may be tank tops. You never know, so you should definitely participate.

8. Keynote Speaker. Having a keynote speaker in years past has been a big success

and we will be including one again this year. We are currently considering options as a committee and will make a selection soon. Stay tuned!

9. President Elect Boot Camp. Last year, we implemented a presentation to help educate our affiliates about what the YLD does and all of the incredible YLD resources available to them. We will continue this boot camp and seque it into a roundtable for the Presidents and President-Elects of local affiliates, to educate them on the YLD’s programing and resources to help their affiliates and allow them to take full advantage of all the YLD has to offer during their presidencies.

American Bar Association Young Lawyers Division Committee Report SPONSORING A PROPOSAL TO THE ABA YLD TO ADOPT THE PARENTAL LEAVE RULE AS AN ABA MODEL RULE

Background

Our YLD Board unanimously supported the Parental Leave Rule, as did the “big” Board. The Miami-Dade Chapter of the Florida Association for Women Lawyers also adopted a resolution encouraging the Florida Bar Board of Governors to adopt the Rule.

Ingrid P. Benson-Villegas (11th Circuit, Miami-Dade) recently reached out to Zack, Lara Bach, and others, explaining that she had attended an ABA YLD Conference and discussed putting forth a resolution to add a Parental Leave Rule, modelled after Florida’s, to the ABA Model Rules. Ingrid stated that those she spoke with were very interested in the idea of adopting the Rule at the national level. She asked us if we would sponsor a proposal for a resolution to the ABA YLD.

Ingrid copied Craig Leen (11th Circuit, Coral Gables; City Attorney), Deborah Baker-Egozi (11th Circuit, Miami-Dade; Greenspoon Marder), and Miriam Ramos (11th Circuit, Coral Gables; Deputy City Attorney/City Prosecutor), whom she credited with spearheading the Rule. Leen and Ramos were on The Florida Bar Special Committee on Parental Leave in Court Actions, and Baker-Egozi is on the Board of Governors. Leen emailed us to note his support of an ABA Model Rule, and offered his assistance going forward.1 Baker-Egozi also expressed support and explained that a male friend of hers is filing a motion for continuance due to his wife’s due date and that he would be citing the proposed rule and its unanimous support by both Boards, while noting that it is now before the Florida Supreme Court.

Austin Thacker has also previously discussed the Rule with Casey Kannenberg, who heads up resolutions for the ABA YLD as the ABA YLD Assembly Speaker. Casey is personally supportive. I reached out to Cabell Clay, the ABA YLD Administrative Director, for additional input on next steps. She is also supportive. Based upon their input, we have identified the next steps listed below should our Board desire to submit an ABA YLD resolution to seek an ABA Model Rule.

This is exactly something that the ABA should be supporting as the logic and principles behind it apply nationwide. This will allow attorneys, both women and men, the dignity and joy of being able to spend time with their newborns or newly adopted children without having to give up their cases in the process. In addition, and this is a key point to emphasize, it is also supportive of clients, who will be able to continue with their attorneys of choice and not lose them because of a failure to be granted a continuance. The rule is also a fair one as it allows for judicial discretion to deny or reduce a continuance where there would be substantial prejudice such as a need for time sensitive relief.

Next Steps for Submitting an ABA YLD Resolution (deadlines below assume submission at Midyear Meeting on Feb. 1-3)

Florida Bar YLD BOG to discuss whether to put forth a resolution2 (July 20)

o If we elect to do so, we should begin broaching the issue with the “big” Board to start garnering their support.

Expand the scope of The Florida Bar Special Committee on Parental Leave in Court Actions’ Committee Analysis and Action Report to cover other states

o Out-of-state members will be needed to coordinate with their respective states’ YLDs to try to get them on board and to include an analysis of their state.

Re: ABA Board of Governors Election (Young Lawyer At-Large)

Dear President Zuroweste and Members of The Florida Bar YLD Board of Governors:

I hope this letter finds each of you well. It has been a pleasure to get to know many of you over the past several years, both at ABA meetings as well as the Florida and Virgin Islands regional summit in St. Thomas last year. As you may know, I am currently seeking the ABA Young Lawyers Division’s nomination to the ABA Board of Governors. This is a contested election, and another young lawyer, Sheena Hamilton, is also seeking the nomination. I write to you in the hope that the Florida Bar YLD will consider supporting me in this campaign.

The Board of Governors oversees the general operations and strategic direction of the ABA. This includes setting the annual budget for the ABA and its divisions, such as the ABA YLD. Because only two young lawyers serve on the 44-member Board at any given time, it is critically important that the candidate has the experience necessary to work with senior ABA leadership to ensure that the interests of young lawyers are not just presented, but adopted.

Like many of you, I began my bar involvement with my local affiliate, eventually becoming Chair of the Virgin Islands Bar Association Young Lawyers Committee in 2013. Since then, I ran for election to senior bar leadership, and just last year was elected President-Elect of the Virgin Islands Bar Association. In addition, I have worn many hats in the ABA YLD, including serving as Assembly Parliamentarian and a member of the Resolutions Team, National Conferences Team, the Membership Board, and as a Diversity Scholar. I have also held several senior leadership positions in the ABA, including as a member of the ABA House of Delegates and as a State Captain for ABA Day in Washington.

It is this unique experience—a young lawyer leader who has also ascended to the highest levels of senior bar leadership—that makes me particularly suited to serve on the ABA Board of Governors. Since I declared my candidacy, I have reached out to young lawyer and senior bar leaders across the country, and spoken with them about what they would like to see from the ABA. Simply put, I believe that the ABA must (1) adequately fund the ABA YLD; (2) provide young lawyers with greater representation in senior ABA leadership, including at the officer level; and (3) improve the quality of services the ABA provides to its members, so that the ABA provides real value to its members that attorneys of all levels of experience and areas of practice will have no qualms paying for. As both a young lawyer Chair and senior bar President, I have dealt with these issues locally, and know that we can accomplish these goals through relationship-building, planning, and hard work.

As of this writing, I am proud to have earned the personal support of more than 160 young lawyer and senior bar leaders nationwide—including many from Florida—as well as the endorsement of diverse senior bar and young lawyer groups, including the Connecticut Bar Association Young Lawyers Section, the Denver Bar Association Young Lawyers Division, and the State Bar of Hawai’i Young Lawyers Division. Dear Fellow Young Lawyers: Welcome to Montreal! The ABA YLD Spring Conference is my favorite meeting of the year because it focuses on one of the most important services our Division has to offer: affiliate leadership training and networking.

Like many of you, I got involved in the ABA after becoming a leader in my local affiliate. The training provided at prior ABA YLD Spring Conferences was truly invaluable in preparing me to serve as Chair of the Virgin Islands Bar Association Young Lawyers. In fact, I continue to use many of those lessons

in my senior bar leadership positions in both the ABA and the Virgin Islands Bar, where I currently serve as its President-Elect.

I chose to seek election to the ABA Board of Governors for the same reason I ran for President of the Virgin Islands Bar: to ensure that the same opportunities that benefited me do not become the victim of impending budget cuts, but remain available to future young lawyers. I am confident that - with your help – we can get the job done!

I believe young lawyer dues should stay with the YLD, and not be sent elsewhere. A professional organization's budget should be equitable and reasonable. This means that dues-paying members should get value from the organization that is roughly equal to the money they pay in dues. If that does not happen, then membership drops, and the whole ABA suffers.

Young lawyer members brought in between $10,103,240.00 and $15,589,004.00 in ABA membership dues in FY2013. Young lawyers’ dues thus accounted for 14% to 21% of the $72,700,000.00 in dues revenue the ABA collected in FY 2013. But the ABA YLD only got about $1,762,489.00 back in FY2014. This is unsustainable, and has to change.

I believe young lawyers should be heard, from the ABA House to the State House. From testifying before the Connecticut General Assembly in favor of Civil Gideon to amending the ABA Constitution, I have never hesitated to ensure that young lawyers make an impact.

I believe the ABA needs to provide real, tangible value to all its members. As the Executive Director stated in a recent report, “the ABA's membership pressures are significant,” with “[a] key reason former ABA members leave” being that “[m]ore than 60 percent say they did not find value for their dues payments.” The ABA must focus on improving the quality of its member services, so that all attorneys will have no qualms paying for an ABA membership.

I believe that while the ABA has made great strides to meet Goal III of its mission statement, more can be done. Although ABA leadership is diverse, the rank-and-file membership does not look like the legal profession. I believe we should increase collaboration with affinity bars, such as joint membership discounts, so that young lawyers need not choose between the ABA and other bars for financial reasons.

Let’s roll out the red carpet for second-career lawyers, and lawyers returning from family leave by extending ABA YLD eligibility and waiving CLE registration and other fees.

Awards Committee

Past chair Lara Bach has given the committee a great foundation and we hope to build upon the successes of last year. Currently, we are developing a calendar for all the awards. Please look out for our calendar before the next meeting. We will be communicating to our affiliates and seeking nominations through our Local Affiliates Committee. We are currently brainstorming ways to keep the awards (especially the ones that received few applications in past years) fresh in the minds of affiliates and encourage applications. In addition, we hope to get more involvement from YLD board members to encourage nominations. We are asking that you personally reach out to your local affiliates to inform them about awards as deadlines approach. The first award on our calendar will be the YLD Pro Bono Service award. Applications will be due on August 31, 2017. Please encourage your affiliates to nominate a recipient. We hope to get our form letter out to affiliates next week, so please be on the lookout for those.

The Florida Bar YLD Pro Bono Service Award The completed application is due by Thursday, August 31, 2017 at 11:59 p.m. All completed application packets should be emailed to Joe Joyce ([email protected]) and Annika Ashton ([email protected]) with copy to Tom Miller ([email protected]) This award recognizes the public service or legal aid performed by a young lawyer (under the age of 36 or one who has not practiced for more than five years in any jurisdiction) who provides outstanding contributions to those in need of legal services. A nominee must be admitted to practice in Florida.

The term Pro Bono is derived from the phrase pro bono publico meaning “for the good of the public.” The purpose of this award is to encourage more Florida young lawyers to freely contribute their time and expertise in providing legal services to people in their community who cannot otherwise afford those services. In some instances, this will include legal services to charitable organizations which serve the poor. The emphasis of this award is on legal service to the poor.

Communications Committee

2017-2018 Communication Committee Goals/Priorities

• Re-design of E-Newsletter • Promotion of Inclusion and Equality initiatives • Welcome letter to all new YLD members • YLD articles in local bar association publications • Collaboration with BOG Communications Committee

E-Newsletter

• One of our main priorities this year is redesigning the YLD E-Newsletter. We have hired Holly Clark to assist with this project. Holly has already provided us with a couple of samples. A key component of the re-design is making sure that the Newsletter promotes the YLD’s key resources and initiatives (i.e. online resources, basic CLE’s, PWP, AOC, inclusion and equality, etc.). Other features might include links to our online resources, a substantive section such as civil/criminal law updates, a “top story”, a member benefit highlight, upcoming events, and a “did you know” section.

• Our goal is to complete the re-design and first edition of the new E-Newsletter by the end of July.

Promotion of Inclusion and Equality

• One of the YLD’s main initiatives this year is inclusion and equality. We will be working closely with the I&E committee to promote their various initiatives/projects. Our major focus will be educating our members and the profession on the benefits of inclusion.

Welcome Letter

• We will be creating a welcome letter from Zack that will be sent to all new YLD members. The letter will welcome new members to the YLD and promote all of our resources. The letters will be mailed to new members after the July and February bar exams. Our goal is to complete the letter and have all of the logistics worked out by the end of August 2017. Michael Lockamy will be leading this project.

Local Bar Articles

• We would like governors to write bar articles for local bar association publications that promote the YLD (i.e. explains who we are and what we do). We will be creating a template for governors to use and asking that they submit articles in their local bar publications. Our goal is to have the template completed by September 2017.

Collaboration with BOG Communications Committee

• This year we will be working closely with the BOG Communications Committee to promote joint BOG and YLD projects. The main areas of collaboration include: YLD webinars for the CRC BOG Committee, Health and Wellness initiatives, and implementation of recommendations from the gender bias survey.

CLE Committee Report

The CLE Committee is gearing up for a successful 2016-2017. As you know, we are now offering Basic CLEs as a bundle and as individual segments. This is a great opportunity to let the viewer know what the YLD does, so we are planning to produce a short YLD commercial that we can attach to each segment. We are also going to revise the script so there is an introduction before each hour. That way, when someone buys it as a segment, it will feel more like a stand-alone CLE.

We are working with Adam White to develop a promotional plan to increase in-person

and online attendance. We are going to increase social media marketing, begin marketing father out, and streamline the marketing process. We are also going to look into outsourcing our CLE marketing. Since these CLEs are the way the YLD funds itself, we want to ensure our efforts are maximizing our revenue stream.

• Brand around a Mind, Body, Spirit holistic approach to health and wellness. • Launch a year-round Health & Wellness Initiative as opposed to just one month.

(May will continue to be Health & Wellness Month). • Integrate Health & Wellness message and programming into law student division • Partner with Board of Governors to promote awareness with mental health and

substance abuse. • Create a one-stop, resource center for health & wellness resources.

Committee Activities

• “Good stuff” at beginning of every meeting (e.g. video of Benjamin Irving, Law Student Pro Bono Award)

o At the start of each meeting, the Health & Wellness Committee will do a one- to three-minute “Good Stuff” presentation to orient the board to our purpose and goals for the YLD. These segments will focus on things our board has recently accomplished, and if possible, include a testimonial showing how our actions have personally impacted a young lawyer.

• Health & Wellness activity or exercise at every meeting (e.g. gratitude

exercise) o For each meeting, we will develop a creative wellness exercise focused

on the mind, body, or spirit such as stretching, eating a peppermint, for attention, meditating, etc. These exercises should be supported by science so we can educate the group with a quick presentation prior to partaking in them. We plan to practice gratitude for the first meeting by having the BOGs each think of three things they are grateful for during the meeting, then share one during the Good of the Order at the end of the meeting. Studies support this practice as increasing positivity,

• Law Student Health & Wellness Day

o We are partnering with the YLD Law Student Division to launch a Law Student Health & Wellness Day. This would help the YLD to expand its Health & Wellness Initiative further into the law schools where it is likely to have a large impact.

• Year-long Health & Wellness Initiative o We want to expand the YLD’s health & wellness month to a year-long

initiative. We believe now is the right time to do this. o This will involve a year-long focus on Health & Wellness and

programming to support. o Monthly Health & Wellness CLEs o Regular content going out on social media.

• Resources & Benefits

o We will create a QOL website for the YLD where we host things like our wellness tips, CLE programs, wellness profiles, wellness-related member benefits and discounts.

• Strategic Partnerships o We will partner with the Board of Governors in their focus on mental

health. o We will work with the Florida Lawyers Assistance Program to present to

our board, possibly at AOC. Two ideas for presentations are 5 Myths About FLA or 5 Tips For Helping Your Lawyer Friend In Need Who Doesn’t Know They Need Help. These could also be CLEs.

Sub-Committees will work closely with Ben & Natasha to achieve their objectives.

• Meetings Subcommittee o Responsible for putting a health & wellness emphasis and focus into

every meeting o Responsible for organizing “Good stuff” message o Responsible for planning one health and wellness activity at every

meeting o Responsible for disseminating information to Board on health & wellness

opportunities at each resort (e.g. gym hours, fitness classes, local healthy eating options, etc.).

• Health & Wellness Month Subcommittee

o Responsible for organizing all events- CLEs, daily social media challenges, Affiliate involvement, promotional articles, etc.

o We will continue hosting YLD Health and Wellness Month in May and will assign committee members to work on collecting law firm, attorney and judge profiles at the Joint Meeting. We also need a volunteer or

Wellness Day. o Works directly with the Law Student Division Health & Wellness liaison. o Responsible for organizing events at law schools for health & wellness

presentations by Committee members. o Responsible for assisting in promotion of health & wellness materials and

resources to law student division and Deans of law schools.

• Benefits Subcommittee o Responsible for arranging a health & wellness benefit package for YLD

members and possibly all Florida Bar members. o We are seeking fitness, nutrition, and other companies that offer wellness

related items (masseuses, acupuncturists, etc.) who would like to provide Florida Bar member discounts and/or sponsor our law student event or another wellness event we might host.

o Possibly something to work with the Board of Governors on.

• Promotion/Resource Subcommittee o Responsible for organizing health & wellness resources in a one-stop

online presence. o Work with Transition to Practice Committee o Responsible for funneling resources, tips, articles, and challenges to

Danny Aller to post on Bar social media platforms o Responsible for getting articles published in the Florida Bar News focused

on lawyer well-being o We will develop, in partnership with the Local Bar Affiliates Committee, a

list of Quality of Life team builders for young lawyer affiliates, push it out to affiliates, and promote grants for those activities.

• CLE Subcommittee o Responsible for helping to plan one hour-long lunchtime health &

wellness CLE per month for Florida Bar members.

Law Student Division Committee Report

1. Elections/Appointments: Calling all liaisons!! We will be asking the students to contact their liaisons to coordinate interviews for new 1L governors. Each class gets 2 governors so some schools may be interviewing 2Ls and/or 3Ls as well if students have chosen not return, graduated early, or some schools provide accelerated tracks that have made things a little more difficult with how we count our governors. We are asking that our liaisons do their best to attend the interviews in person and engage with the students. Sometimes they don’t know what questions to ask and you can really help shape the incoming crop of Governors. This process was a HUGE success last year so we really want to keep that going!

2. New Programming: The LSD is doing a lot to reshape its relationship with the Center for Professionalism and update its programming this year. The LSD President, Amanda Decker, has done an awesome job getting the ball rolling on our new “Workshop Series.” We are working to design programming to give students tangible training for their transition to the work force. Our liaisons will play a huge part in this process. If you can attend no other program this year, please try to attend the new Workshop and get other lawyers and judges to attend as well!! If any YLD Board members have materials, ideas or are willing to assist in this undertaking, please reach out to Paige Gillman or Iris Elijah for more information.

3. Pro Bono Award: The LSD just awarded its first ever Pro Bono Award! Barbri

was kind enough to donate a free bar study course to the recipient with the most pro bono hours. This year the award went to Benjamin Irving, an amazing and very deserving FAMU graduate and hopefully a new lawyer come this fall! Look for his photo and an article in the upcoming Florida Bar News. We would like to start publicizing this award MUCH earlier (like at the membership drives on campus this fall) so that we can get more students to apply. Please let us know if you have any ideas about how we can further publicize this opportunity.

4. Proposed Bylaws Revisions: Proposed changes to the Law Student Division Bylaws can be found in the business agenda. The LSD Bylaws require the YLD to vote on any changes to the LSD bylaws. The most notable proposed changes are the following:

a. Section 1- This clarifies how the appointment and election process of the law student governors will work. One is elected by the students, the other is appointed by the school/LSD President and both seats always have the final approval of the YLD President

b. Section 4- Board Member Retention- Because these Governors are chosen within the first month of their 1L year some get too busy and others just fail to engage, although that’s happening less and less. This provision allows the liaison for that school to recommend the student continue on as a governor

c. Article XV- Removal- The LSD Chair can remove any governor at any time for cause (which is outlined in the bylaws and includes a substantial failure to participate)- that removal may be appealed in writing to the YLD President within 14 days

Legislative Affairs Committee Report Florida’s Constitution Revision Commission meets every twenty years. It is now in full swing, for the third time in history. Among other initiatives, the YLD will be supporting the CRC this year, producing a series of 16 one-hour seminars about the Florida Constitution. Initially, the target audience is the commission itself, but we will eventually repurpose the seminars for our own members, law students, and the general public. The other exciting project on the horizon is an optional Tallahassee board meeting for anyone interested in state government, on January 25-26, 2018. We are hoping to build on the success of our 2016 meeting. We are planning to do it in connection with the big board’s meeting, to leverage some of their resources and programming. We will have meetings with legislators, a few tours, a reception with legislators and judges, and a dinner for our people. It will be open to our board, of course, but also affiliate members who are interested in the process. And this year, we hope to host a government Boot Camp (training young lawyers how to get involved in politics and government). Local Bar Affiliates The Local Bar Affiliates Committee’s goals for the year essentially fall into three categories:

1. Develop an FAQ/Tips page for the YLD website 2. Communicate regularly and effectively with LBAs 3. Create new LBAs

Below are some of the tasks we think we will need to work on to accomplish those goals: Develop and FAQ/Tips page for the YLD website

- Consult with successful/active LBAs and gather best practices/tips to share (these can go on the website and can be part of a regular (maybe bi-monthly) email update to LBAs)

o Potential topics include fund raising, increasing attendance/participation, programming, networking, etc…

o We should have a mix of tips from both small and large LBAs - Assemble the information/documentation regarding the various resources the YLD

provides to LBAs (grants, using the new tech roadshows as CLE fundraisers, etc…) - Assemble the documentation needed for an LBA to register/start (most of this is already

there, but having some sample bylaws would be helpful) Communicate regularly and effectively with LBAs

- Gather updated email addresses for LBA leadership (this process has already started) - Gather email addresses for executive directors/leaders of main bar associations for LBAs

as a backup means of communication Create new LBAs

- Put together a letter to bar associations without a YLD explaining the ease and benefits of creating a YLD

We are fortunate in that our committee members cover nearly the entire state, but we may periodically reach out to our entire Board for help in reaching local bar leaders for input on some of these initiatives.

Moot Court Committee The 2017 Robert Orseck Memorial Moot Court Competition was a huge success. All twelve of Florida’s law schools participated in the competition. All seven Justices of the Florida Supreme Court, the first for Justice Alan Lawson, judged the final round and declared the Stetson University College of Law’s moot court team the victors. Stetson’s Kris Galloway won best oralist in the final round. Florida State University College of Law’s moot court team finished as the runner-up, with FSU’s Mallory Neumann winning best oralist in the preliminary rounds. The St. Thomas University School of Law’s moot court team received the best brief distinction. This year’s competition problem was based on a criminal-law fact pattern, regarding the admissibility of a partial iPhone video recording of a surveillance tape and the constitutionality of a shaming sentence. In addition to the Florida Supreme Court, judges from all five District Courts of Appeal as well as numerous judges from Florida’s circuit and county courts judged the preliminary, quarterfinal, and semi-final rounds. On behalf of the 2016-2017 Chair and Co-Chair of the Moot Court Committee, Andrew Manko and Jason Lambert, we wanted to send a special thanks to the YLD Board of Governors and the Moot Court Committee for their support and countless volunteer hours drafting the problem, preparing the bench brief, securing judges, as well as judging and facilitating the competition, among other things. We extend a special thanks to Kristina Feher, Sarah Young, Anthony Constantini, and Kyle Sill for drafting this year’s problem and to Caitlein Jammo for drafting the bench brief. This year’s problem featured a iPhone video of an actual burglary as well as an expanded written record on appeal containing transcripts from a suppression and a sentencing hearing. This year, we incorporated the expanded record following a request from Florida Supreme Court justices at the conclusion of last year’s competition. It was a brilliant idea that we intend to carry forward for future competitions. This year, we were able to purchase lunch for all competitors during the first day of the competition. Our preliminary plans are to do the same next year for competitors and possibly the judges, although the previous cost estimates at Bonnet Creek in Orlando were prohibitive. The Moot Court Committee is already planning for next year’s competition, which will be a civil law problem. Please share with us any ideas you may have from your practices or otherwise.

ONLINE PWP UPDATE

The online PWP program rolled out and the committee is in the process of reviewing the attendees’ responses to the surveys along with evaluation summaries of the surveys. Many of the early evaluations mention technical issues which were resolved. After our review, we will propose recommendations to the Board. We will also be reviewing the PWP video footage and create a list/log of sections that will likely require updates.

Pro Bono Committee

We have two separate pro bono events that we are promoting for the Joint BOG meeting. The first event is an “Ask a Lawyer” pro bono project that we will be participating in

with the OLD. On the Friday of Joint (7/21), we will have the ability to log into a system through the ABA and answer questions on specific topics. We are currently working on a way to log the questions so that we can tell how many were completed through the YLD and through the OLD and compete to have the most participation and questions answered. We would then award an additional point during “Battle of the Boards” for whoever had the most participation. We will provide additional information on this project in the next few weeks.

The second event is supporting Lotus House, a woman’s shelter in Miami. They are

hosting an event in Miami on July 22nd. We would like to encourage members to participate in the event, but we will also be collecting items to donate to Lotus House for those who do not wish to attend in person. I will be collecting the items during our meeting and will then drop off the items during the event on July 22nd. We will be reaching out the OLD to dominate items as well.

Pro Bono Website. We are reaching out to Erica Garcia to determine the best way to promote the website. It is a new tool to connect attorneys throughout Florida with pro bono cases. We will be creating a short (1 minute) video to explain how to use the website and encourage others to use the website to take on pro bono cases. We will then promote the website through the video on all social media outlets. We need to have the video finalized before pro bono month in October. Please let me know if you are interested in working with this project.

This year we will also revamp the pro bono webpage on the YLD website. We want to

combine the page with the community service page. We would like to feature pro bono and community service projects from the AOC grants. We would also like to change the webpage format to make it more user friendly.

We would like to reach out to JALA (Jacksonville Area Legal Aid) to have a project during our meeting in Amelia Island in August. Please let me know if you would like to take the lead to reach out to JALA and get ideas for a pro bono project during that meeting. We could also do a drive like we are doing for Lotus House.

During the JW board meeting in September, we are going to have either Paige or Jewel

speak to the board about becoming a Florida Bar Foundation Fellow. Our goal is to have every board member become a Fellow by the end of that meeting. It is important that our board lead by example and support the Foundation and then we can promote the Foundation to our local constituents and encourage them to become Fellows as well. We could try to do a social media competition and have our affiliates compete to see who can get the most young lawyer members to commit to be Fellows. I am open to any ideas you may have for how we can make this work.

For our project in January for AOC in St. Pete, I would like to find a way to get the

affiliates to join in a project. Maybe we could have the affiliates report their results for the Fl Bar Foundation pro bono cases during AOC and we can announce the winner during AOC.

In May we have our meeting in Hawks Kay. We can try to find a local organization in the

keys to support. We are open to any suggestions on a collection/project for this meeting. Please let me know if any of you are interested in taking the lead on this.

• Significant dates of YLD events have been placed on the calendar on the YLD Website. If there is a significant date that you know of that is not on there, please let me know. The current version of the calendar is not the best, so we are currently working on a better version.

• If you are a committee chair and you have events that we need to promote, please get with me so that we can develop a schedule/strategy.

• I have begun the process of drafting a 3 minute speech for our Board to give to their local affiliates. The speech has been passed on to various committees for comment and we are now ready to share it with you. Below is the current version. If you have any suggests/comments, please let me know.

YLD – Elevator Speech 2017-2018

My name is [_________] and represent the [______]Judicial Circuit on the Florida Bar Young Lawyers Division Board of Governors. I am one of approximately 60 representatives of the Florida Bar YLD. You are automatically a member of the YLD if you have practiced for less than 5 years or are under the age of 36. I am often asked, what does the YLD do? Simply put, we are the “work horse” of The Florida Bar, and we work hardest for you, our members. We do this by advocating for, educating, and serving Florida young lawyers. Some examples include:

• Producing all of the Basic CLEs that young lawyers are required to take in their first 3 years of practice including Practicing with Professionalism. Through our efforts, those are now offered online, without the mandatory in-person attendance requirement. We also create and host webinars with free CLEs.

• We have created a website, startmyfloridalawfirm.com to help young lawyers learn the tools they need to start their own law firm. This website includes information on everything from choosing a corporate structure to how to comply with trust accounting rules. This website also has how-to videos on topics such as handling an initial client meeting, initiating a personal injury suit, and preparing for mediation.

• We host a yearly Affiliate Outreach Conference where our affiliates, which are local young lawyer bar associations and sections (like yourselves [if applicable]) and other volunteer bar associations (like yourselves [if

applicable]), share ideas on community outreach programs and we award approximately $50,000.00 in grants to those affiliates to continue their important programs. This year’s conference will take place January 12-13, 2018 at the beautiful Vinoy in St. Petersburg, Florida.

That is only a small fraction of the work that we do for you. Some of the most important work that we do is to advocate for young lawyers. Just recently, we impressed upon the The Florida Bar Board of Governors the importance of the proposed Parental Leave Continuance Rule for all young lawyers. With our assistance, that groundbreaking rule was passed by the Board of Governors with unanimous support. We are your voice within The Florida Bar, so please make sure to share your ideas and opinions on topics important to you with your local YLD representative. Technology Committee Report

The Technology Committee is looking forward to a great year, and will work on accomplishing the following initiatives.

1. Assembling and Hosting “Technology Roadshows” with Adriana Linares, The Florida Bar’s legal technology consultant. We have actively reached out to start the initial engagement for the Technology Roadshows; at this time we are exploring details around the CLE approval status and to confirm the site of the first event. These course will be offered in conjunction with local bar associations, and focus on practical, relevant technology issues. Local bars will keep the money generated from registrations and the local YLD governor will handle introductions to the CLE and use the first few minutes to play our Who We Are Video and pre-packaged elevator pitch on benefits offered by the YLD, helping brand the YLD and promoting the connection between the YLD and local affiliates.

2. Tech Tips. We will work with the Communications Team to include in the YLD eNewsletter a “Trending in Tech” section where the we will share a few recent developments from new practice resources to developments in technology related case law.

3. Digital Accessibility Handbook. The Tech Team is also starting the initial research for the development of a Digital Accessibility handbook that is to include AG WG (Accessibility Guidelines Working Group) best practices for ensuring websites meet ADA online accessibility standards. This is intended to be a handbook of best practices that will provide guidance for those with public facing websites such as affiliate bars or even law offices. Additional work is being aligned to support the technology initiatives of The Big Board.

4. Updating the Technology Page on the YLD Website. We will be reviewing the content of our current Technology Page to review content for relevancy and accuracy and to give suggestions for improving the Technology Page.

5. Research the Viability of an Online Forum/Messaging Board. We will be reviewing whether the YLD should develop a website or messaging board to connect young lawyers to communicate on topics like sharing of office space, staff, etc.

Transition to Practice (T2P) Committee Report – July 2017 YLD BOG Meeting Santo DiGangi Andrew Pickett The Transition to Practice Committee’s main objective this year is to create a website which we are currently calling a “Legal Accelerator.” This website will serve as a one stop hub for Florida’s young lawyers to get answers to common questions they may have as they transition to the practice of law. The YLD currently has a large number of resources available to young lawyers including how-to videos, webinars, basic CLEs, blogs, and much more, but they are scattered across multiple websites making them hard to find. This website, which is housed behind The Florida Bar’s member portal and is only accessible by Florida Bar members, will serve as a repository for these resources. Similar to Google, the site will be easily searchable and will be organized in a way to make it as user friendly as possible to find answers to common young lawyer questions. Our goal is to create hundreds, and one-day thousands, of 3-minute videos by experienced practitioners that will answer questions regarding professional development, ethics, The Florida Bar, and even substantive legal matters. We want to make this website, the only of its kind in the country, the first stop for Florida young lawyers on their search for a solution to whatever issue they are facing. Our committee has already been hard at work coming up with close to 200 hundred questions for experienced practitioners to record video answers. Our pilot program for recording answers is occurring at this joint meeting with the Board of Governors (we even made the attached flyer). We have provided the approximately 200 questions to the BOG members in advance of this meeting and will have a room set up all day Thursday near the BOG meeting room for BOG members to come by and record answers to a few of the questions of their choosing. We will have multiple iPads to record their answers so feel free to stop by the room and thank the BOG members for their time. We are hoping to get at least 100-125 videos recorded on Thursday! The committee will be working closely with Holly Clark on creating the website. We are in the final stages of finalizing a site map for the website and once that is done, Holly will begin designing the site. We will need the entire Board’s assistance in coming up with questions and utilizing the Board’s contacts for experienced practitioners who are willing to record answers to our questions for the website. Additionally, the T2P committee will continue to create how-to videos, and our goal is to record videos for a family law case and a commercial case. We are excited to premiere this new website at AOC. If you have any ideas or suggestions, please feel free to contact Santo or Andrew.

DIVISION BYLAWS

BYLAWS OF THE LAW STUDENT DIVISION OF THE FLORIDA BAR YOUNG LAWYERS DIVISION

ARTICLE I

GENERAL PROVISIONS Section 1. Name. The name of this organization shall be the “Law Student Division,” a division of The Florida Bar Young Lawyers Division. Section 2. Purpose. The purpose of the Law Student Division (the “Division”) is to: (1) assist The Florida Bar and The Florida Bar Young Lawyers Division (the “YLD”) in their purposes; (2) encourage interest in and participation by Division members in the purposes of The Florida Bar and the YLD; (3) provide a program of activities and projects designed to be of interest and assistance to Division members and which further the best interests of the legal profession; (4) coordinate the activities of the Division members and to serve as a medium for fostering discussion and free interchange of ideas relative to the duties, responsibilities, and problems of Division members; (5) promote professionalism, mentoring, and the image and reputation of the legal profession, The Florida Bar and the YLD; (6) serve the public, particularly those persons outside the legal profession, through statewide and local service projects and activities; (7) encourage and promote diversity in all areas of the study and practice of law; and, (8) act as liaison between Florida law schools, the YLD, and The Florida Bar. Section 3. Status. The Division is a division of the YLD. The YLD’s constitution and bylaws and action taken under its authority supersedes and controls the Division and these Bylaws. Section 4. Authority. These Bylaws and action taken under their authority that is not inconsistent with the YLD’s constitution and bylaws are the basis for the conduct of all business in the Division.

ARTICLE II

DIVISION MEMBERSHIP Section 1. All law students enrolled in Florida law schools and in good standing with their respective schools (“members in good standing”) may join the Division. Section 2. All law students enrolled in any ABA accredited law school and in good standing with their respective schools (“members in good standing”) may join the Division.

ARTICLE III

PRESIDENT OF THE DIVISION Section 1. President - Generally. There will be a President of the Division who at the time of taking office must be about to begin his or her second or third year of law school and is not graduating early. Early graduation will create a vacancy. Section 2. President Duties and Responsibilities. The President shall preside over all regular meetings of the Division and shall be responsible for maintaining communication between the YLD and the Division. The President shall also perform such other duties as the YLD or The Florida Bar may from time to time prescribe. Unless a secretary is appointed by the President, the President shall keep the records of the proceedings of the Division and of the Board, keep a roll of the board members in attendance, attend to correspondence, and issue notices of meetings.

ARTICLE IV APPOINTMENT OF PRESIDENT OF THE DIVISION

Section 1. Appointment. The Division Board of Governors shall vote on the position of President and propose up to three nominees for the position of President to the YLD. The YLD President shall then appoint the Division President, but. The YLD President’s selection of President is not limited to the proposed nominees from the Division Board of Governors. The YLD President may also appoint one or more Law Student Division Chairs (“LSD Chairs”) to facilitate and further the mission of the Law Student Division. In the event LSD Chair(s) are appointed, they shall be members of the YLD Board of Governors. Section 2. Installment of President. The candidate appointed by the YLD President shall be installed in the office of President at the Annual Meeting of The Florida Bar. The President shall serve until a successor is appointed and installed. The same person shall not serve as president for two (2) successive years. Section 3. Vacancy of President’s Office. If the Division President’s office becomes vacant, the YLD President shall appoint a successor. The appointed successor mayshall be in his or her third year of law school.

ARTICLE V BOARD OF GOVERNORS

Section 1. Board Composition. There shall be a board of the Division, to be composed of the President and additional representatives from each and every law school in the State of Florida (“Board,” infra and supra). Each Florida law school shall adopt procedures to fill the Board seats. Each law school shall elect a 3L Board Member, a 2L Board Member and 1L Board Member. The 1L Board Member shall be elected at each law school during their first semester of first year and shall attend the Affiliate Outreach Conference or other such meeting as designated by the President of the Division as their first official meeting. being appointed President, the law school the President represents shall also conduct an election to fill that representative board member vacancy. In addition to the elected Board Members at each law school, the YLD President shall appoint a 3L Appointed Member, 2L Appointed Member, and 1L Appointed Member for each law school. Each law school is appointed a YLD Liaison to provide guidance to the law school chapter of the Division. Every law school shall have two Governor representatives per class. For each class there shall be a Governor appointed by the YLD President, and a Governor elected by his or her respective class. The appointments and elections will be conducted as soon as practicable during the first semester of law school. The Executive Board of the Law Student Division shall recommend procedures for the selection of all LSD Governors at the Annual Meeting of The Florida Bar for review and these procedures shall be approved by the YLD President. Revisions to the Governor election and appointment procedures may also occur as needed at the discretion of the YLD President. Section 2. Purpose. The Board shall provide an opportunity for networking and growth of the law schools in the State of Florida. The Board shall also assist the YLD in its endeavors, including the YLD's aim to provide a more seamless transition between law school and the practice of law. Section 3. Board Member Eligibility. To be eligible to serve on the Board, a member must be enrolled in at least six credit hours per fall and spring semester in a law school in the State of Florida, and be a member in good standing of the Division. Section 4. Board Member Retention. Each Board member in good standing may serve until the end of their 3L year. At the conclusion of each academic year the YLD liaison for each law school shall make a recommendation of retention for the 1L and 2L Governors at his or her assigned law school.

Section 5. Board Vacancies. A Board Vacancy is the result of created by the absence of a boardBoard member of the Division. An absence is defined as any time a boardBoard member is not enrolled in at least six credit hours per semesterfall and spring semesters or is not on campus for more than 4 consecutive weeks during the fall or spring semesters, including but not limited to transfers, study-abroad programs, medical or personal leave, etc. If procedures have not been adopted, the President shall consult with the board members from the subject law school and shall be responsible for filling any and all board vacancies resulting from the absence of any member from his or her law school. The individual appointed to fill the vacancy must be a member in good standing of the Division. If a board member transfers to another Florida law school, the YLD President, LSD Chair(s), and YLD Law School Liaison shall have the ability to determine whether that Board member can continue his or her duties at the new Florida law school. Vacancies created by the election of the LSD President, transferring Governors that are not retained, resignations, or other causes, shall be filled through publication during the 1L application period encouraging any eligible students interested in filling the vacancy to

apply in accordance with the Board member election and appointment procedures. Vacancies will only be filled by appointment. The YLD President has the sole discretion to call for applications outside the 1L application period and fill any vacancy in the event the YLD President deems it necessary. Section 56. Board Member Duties and Responsibilities. In addition to the other duties and responsibilities of the board members set forth in these bylaws, boardBoard members shall be responsible for: (1) attending all meetings of the Division; (2) establishing or attempting to establish involvement in The Florida Bar throughout the law schools of the State of Florida; (3) keeping each of the law schools of the State of Florida and their administration advised of the rights, benefits, privileges, opportunities, programs and status of the YLD and The Florida Bar; (4) working with the Law School Liaisons appointed by the YLD to keep the members of the Division involved; (5) assisting the YLD in establishing and administering on campus programming to promote the purposes of the Division, the YLD and The Florida Bar; (6) planning and attending Raising the Bar events; (7) planning, promoting, and attending professionalism events with the Henry Latimer Center for Professionalism, (8) working with the Law School Liaisons and YLD to promote and administer the statewide Mentoring Program, and, (9) representing the Division at law school orientation events. Section 67. General Duty of Professionalism. A boardBoard member shall act with professionalism regarding all activities and responsibilities associated with the Division. A boardBoard member shall also uphold the image and reputation of the legal profession, The Florida Bar, and the YLD. Professionalism includes, but is not limited to, communicating with all boardBoard members and Division affiliates in a respectful manner at all times. Determination of whether an act or conduct fails to adhere to the Division’s standard of professionalism shall be the responsibility of the LSD Chair(s) and/or the YLD President and the Chair of the Law Schools Committee of the YLD.. Section 78. Official Communications. Any and all official communications, as defined by the Chair(s) of the Law SchoolsSchool Divisions Committee of the YLD, sent by or published by the Division shall be subject to approval by the LSD Chair of the Law Schools Committee of(s) and/or the YLD President.

ARTICLE VI MEETINGS

Section 1. Number of Meetings. The Board shall meet not less than four (4) times during each bar year. One (1) such meeting shall be held in conjunction with the Affiliate Outreach Conference of the YLD (or other such meeting designated by the President of the Division)

and one (1) such meeting shall be held in conjunction with the Annual Meeting of The Florida Bar. The other two (2) meetings may be held via teleconference pursuant to Section 2 of this Article. Section 2. Teleconference. The Board may satisfy two (2) of the required meetings each year through teleconferencing. Unless the Division is otherwise able, the YLD shall provide the Board the means and opportunity to meet via teleconference. Section 3. Robert’s Rules of Order. Except as provided in these bylaws, the current version of Robert’s Rules of Order shall be the rules that govern the conduct of all meetings of the Division. Section 4. Quorum. A majority of the members of the Board shall constitute a quorum for the transaction of business at all meetings.

ARTICLE VII COMMITTEES

Section 1. Executive. The President, with the approval and consent of the Board, may appoint an executive committee consisting of the President and at least four (4) and not more than six (6) other members of the Board. The executive committee by two-thirds (2/3) vote may exercise the powers of the Board during any period when the Board is not meeting, subject to such limitations as may be imposed by the Board or the YLD. Section 2. Bylaws Committee. There will be a bylaws committee to be composed of the President, and at least two (2) members of the Board to be named by the President. These members may suggest and submit amendments to these Bylaws to the Board of the Division for approval. The Board by two-third (2/3) vote may approve suggested bylaw amendments. Upon proper approval by the Board, the President or histheir appointee shall present said bylaw amendments to the YLD for approval. The YLD shall have sole and final authority to amend these bylaws. Section 3. Standing and Special Committees. The Board or the President may create such standing committees and such special committees as they may deem advisable and shall define the duties, functions, and scope of such committees thereof. Standing committees shall continue in existence until terminated by the Board; and special committees shall be terminated at the end of each President's term of office.

ARTICLE VIII AMENDMENTS

Section 1. Manner of Amendment. These bylaws may be amended only by approval of the YLD and a vote of the YLD's Board of Governors. A bylaws amendment can be made at any regularly scheduled YLD Board of Governors meeting. The Division may suggest and submit amendments to these bylaws from time to time as provided in Article VII, Section 2.

Section 2. Vote Necessary for Adoption. A two-thirds (2/3) vote of the YLD Board members present and voting shall be necessary to adopt the proposed bylaw change.

ARTICLE IX BYLAWS INTERPRETATION

If any Board Member requests an interpretation of these Bylaws, or the President, or Chair of the Bylaws Committee deems confusion to exist regarding the Bylaws, then the YLD shall make the final determination as to the disputed interpretation. The determination of the Board of Governors, including the YLD President and YLD President-Elect, shall be deemed final.

ARTICLE X RECORDS

Section 1. Copies to President. It shall be the responsibility of every Board member to, upon request, furnish the President and Chair(s) of the Law Schools CommitteeSchool Division of the YLD a copy of all correspondence or other documents relating to the business of the Division. It shall be the responsibility of every Board member to, upon request, carbon copy the President and LSD Chair of the Law Schools Committee of the YLD(s) on all correspondence relating to the business of the Division. Section 2. Transfer of Files. Immediately following the installation of the President, the retiring president and all committee chairs shall deliver to the succeeding president their complete files relating to the Division activity. Section 3. Transfer of Records of the Division. Within a period of 30 days preceding the installation of a new presidentPresident, the new presidentPresident shall review the records of the Division and transfer to the YLD for storage those records of the Division that are more than 1 year old, and that, in the opinion of the presidentPresident are no longer active. The President shall report to the Board the records thus transferred.

ARTICLE XI GENDER CLAUSE

Unless the context otherwise requires, the singular shall include the plural and consistent with the policies of The Florida Bar, gender specific language shall not be employed.

ARTICLE XII FUNDING

The YLD may fund the Division each year with a portion of its budget or through sponsorships, which is subject to be changed in accordance with decision of the YLD. Each law school and its Division boardBoard members must comply with the provisions of these

Bylaws and with the directives of the YLD with regard to programming in order to receive said funding.

ARTICLE XIII DIVISION ACTIONS

All acts of The Florida Bar Law Student Division shall be subject to the approval of The Florida Bar Young Lawyers Division Board of Governors.

ARTICLE XIV

LAW SCHOOL REGISTRATION Each Division chapter may become a registered student organization of its law school at the sole discretion of, and approval by, the YLD President.

ARTICLE XV REMOVAL

Section 1. Removal of Board Members. The Division shall provide for the removal of any boardBoard member for cause as deemed appropriate by the LSD Chair of the Law Schools Committee of the YLD. Removal shall require a two-thirds (2/3) vote of the YLD Board after at least two (2) weeks' notice to the YLD Board and Chair of the Law Schools Committee of the YLD, and an opportunity for the board member to challenge any evidence against him or her.(s). The YLD Board may also provide for the suspension of any board member against whom a removal proceeding is pending. A removed boardBoard member may appeal his or her removal at the next official YLD Board meetingto the YLD President within fourteen (14) days of receiving notice of the removal. That appeal must be made in writing. Cause for removal may include, but is not limited to:

1. Missing two (2) consecutive mandatory meetings with or without prior approval by the Board Secretary;

2. Consistent failure to respond to communications dealing with Board business; 3. Consistent failure to adhere to Board directives; or 4. Failure to adhere to the general duty of professionalism provided above in Article V

Section 6.; or 5. Failure to substantially participate in Division events at the Board member’s law

school, as determined by the YLD President and/or the LSD Chair(s). Section 2. Removal of the President. The President may be removed by the process provided above in Article XV Section 1, or, at the collective discretion of the Chair of the Law Schools Committee of the YLD, YLD President and YLD President-Elect.

Division Policies & Procedures

Electronic and Print Communications The Law Student Division requires approval by the YLD for all electronic and printed communications. Please follow the procedures set forth in this manual in order to get approval for said items prior to sending them out. Facebook The Law Student Division is proud to now have its own Facebook Fan Page. This page has been approved by the YLD. Please do not create other Law Student Division pages, groups, events, etc. on Facebook without approval by the YLD. Your Law Student Division President is happy to post any items you would like on our Facebook Page, and from there you may “share” it. Alcohol Law Student Division funds may not be used to purchase alcohol. Division events may have alcohol; however, Division funds cannot be used to pay for alcohol. In addition, please refrain from mentioning alcohol in event advertisements. For example, instead of using the term “Happy Hour” use “Networking Event.” Intellectual Property Please do not use or modify the Law Student Division logo without approval. E-mail your president with questions. Fundraising While the Law Student Division may participate in pre-existing fundraising events (such as Light the Night), the Law Student Division may not hold its own fundraising events, nor can the Law Student Division collect or hold any money. Further, Law Student Division members may not set up bank accounts in the name of the Law Student Division or any of its local affiliates. Finances The YLD provides the financial resources necessary to run the Law Student Division. The YLD plans a per-semester budget for each law school. Governors will be reimbursed for the approved expenses they incur in organizing events for the benefit of the Law Student Division as long as such reimbursement requests are submitted, along with receipts, within 30 days of purchase. Conference Expenses The cost of Law Student Division governors’ attendance at YLD conferences is subsidized by the YLD. Law Student Division governors receive this subsidy in the form of a reimbursement after the conference. No alcohol purchases will be reimbursed. The reimbursement form must be

filled out properly for each school, and submitted no later than 2 weeks after the date of the conference. Again, receipts must be attached to the reimbursement request, or the reimbursement will not be processed.

EVENT /COMMUNICATION APPROVAL PROCEDURE All events hosted, co-hosted, or involving The Law Student Division must be pre-approved by the YLD prior to the event taking place. This includes all electronic and printed communications pertaining to the event or leading up to the event. Approval is still required even if LSD funds are not being utilized for the event. Steps to Receive Event/Communication Approval: 1. Fill out the Event Request Form and/or& Communication Request Form located on Google Drive. 2. Email the completed form to [email protected] at least fourteen (14) days prior to the date of the event or date that the communication is intended to be sent out. 3. Wait to receive approval back from the Events/Logistics Committee Chair. 4. If errors exist, the Event/Logistics Committee Chair will communicate these errors to the governor who submitted the Event and/or Communication Request for revision and then the governor will need to correct and resubmit the form for approval. 5. If no errors exist, the Event/Logistics Committee Chair will let the governor who submitted the Event/Communication request form know that the event has been approved by the YLD. 6. If LSD funds were requested and approved prior to the event-taking place, the governor needs to fill out the Reimbursement Request Form located on Google Drive. 7. The completed Reimbursement Request Form and copies of all receipts must be sent to the Events/Logistics committee Chair no later than (7) days after the date of the event. The completed form can be sent by U.S. mail or may be scanned and e-mailed to [email protected]. Scanned copies will be accepted only if they are completely legible. 8. The Events/Logistics Committee Chair will submit the reimbursement request, which will be processed by YLD Program Administrator Tom Miller. 9. The Governor that requested the reimbursement will receive the reimbursement in the form of a check mailed to the address indicated on the Reimbursement Request Form.
