Item Title: Jet Brite Sign Variations Staff Contact: Patrick N. Watkins, Community Development Director VILLAGE BOARD ACTION Pass an ordinance granting three (3) sign variations for Jet Brite Car Wash at 900 W. Lake Street. Executive Summary: Attached is an ordinance approving three (3) sign variations for Jet Brite Car Wash at 900 W. Lake Street. At the May 13, 2019 Committee of the Whole Meeting, staff was directed to proceed with an ordinance approving the sign variations. Two sign variations are for wall signs. The third is for the size of directional signs throughout the site. The sign variations have been requested by Jet Brite to accommodate the standard signs they have used at their locations across Chicagoland. Implications: Is this item budgeted? ORDINANCE 2019-
AN ORDINANCE GRANTING THREE SIGN VARIATIONS FOR JET BRITE CAR WASH
(Jet Brite Car Wash – 900 W. Lake Street)
WHEREAS, Miki Properties LLC, (hereinafter “Petitioner”) has petitioned
the Village for sign variations to permit; a.) a wall sign of 47.887 square feet in
lieu of the 43.75 square feet permitted, b.) a wall sign of 130.67 square feet in
lieu of the 43.75 square feet, c) six (6) directional signs of (6) square feet per
face for in lieu of the four (4) square feet, in a B-5 Arterial Business District
located at 900 W. Lake Street; and,
WHEREAS, the Planning and Zoning Commission held public hearing PZ
19-1079 on May 7, 2019, pursuant to a published legal notice and neighborhood
notification as required by the Village of Roselle and Illinois State laws, to
consider the petition for the aforesaid variations; and,
WHEREAS, the Petitioner has demonstrated just cause for the variations
by reason of the topography, exceptional situation, and the surroundings and the
compatibility of the proposed variation with the existing land uses and existing
zoning in the surrounding area; and,
WHEREAS, the President and Board of Trustees of the Village of Roselle
have been advised of the findings and recommendations of the Planning and
Zoning Commission with respect to said Variation; and,
WHEREAS, the Corporate Authorities have decided to grant the
Variations to the Village of Roselle Signs and Advertising Ordinance in a manner
consistent with said public hearing and this ordinance.
WHEREAS, the variations described herein are adopted pursuant to the
authority set forth in the Village of Roselle Sign and Advertising Ordinance,
Chapter 17, Section 17-25 Variations; and,
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Roselle, DuPage and Cook Counties, Illinois, as
follows:
SECTION 1: Variations are hereby granted for:
a.) a wall sign of 47.887 square feet in lieu of the 43.75 square feet; and,
b.) a wall sign of 130.67 square feet in lieu of the 43.75 square feet; and,
c.) six directional signs of (6) square feet per face in lieu of the four (4) square
feet per face
as permitted by the Signs and Advertising Ordinance in the B-5 Arterial Business
District for the property located at 900 W. Lake Street in accordance with Chapter
17, Section 17-25 Variations, of the Village of Roselle Signs and Advertising
Ordinance and legally described as:
THE EAST 214.0 FEET OF OUTLOT 8 (EXCEPT THE NORTH 314.0 FEET
THEREOF) IN THE VILLAGES OF WATERBURY UNIT NINE, BEING A
SUBDIVISION OF PARTS OF THE NORTHWEST QUARTER AND THE
SOUTHWEST QUARTER OF SECTION 9, TOWNSHIP 40 NORTH, RANGE 10
EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT
THEREOF RECORDED SEPTEMBER 13, 1977 AS DOCUMENT R77-082080, IN
DUPAGE COUNTY, ILLINOIS.
AND
LOT 17 IN PLEASANT HILL GARDENS, A SUBDIVISION IN THE WEST HALF
OF SECTION 9, TOWNSHIP 40 NORTH, RANGE 10, EAST OF THE THIRD
PRINCIPAL MERIDIAN ACCORDING TO THE PLAT THEREOF RECORDED ON
AUGUST 20, 1938 AS DOCUMENT 392428, IN DUPAGE COUNTY ILLINOIS.

SECTION 2: The variations for the signs referred to in this Ordinance
shall be installed and maintained in accordance with Exhibit A: “North Wall
Elevation” dated January 25, 2019, Exhibit B: “South Wall Elevation” dated
January 25, 2019, and Exhibit C: “Illuminated Directionals” dated May 21, 2018,
which are attached hereto and incorporated herein by reference as if fully set
forth.
SECTION 3: That this Ordinance shall be in full force and effect from and
after its passage, approval and publication in pamphlet form as provided by law.
This sign is further subject to all applicable ordinances and codes of the Village
of Roselle.
SECTION 4: Provided further, this Ordinance shall automatically become
null and void without further action of the Board of Trustees unless within thirty
(30) days of the approval of this Ordinance is signed by the Petitioner and
Property Owner and returned to the Village Clerk. An extension to this section
may be granted by the Village Board following a written request by the Petitioner.
SECTION 5: This Ordinance shall be binding upon the Petitioners,
Property Owner, their successors, heirs, contract purchasers, and assigns.
SECTION 6: That if any part or portion of this Ordinance is declared
invalid by a court of competent jurisdiction, such partial invalidity shall not affect
the remainder of this Ordinance.
