RE: PEBBLE BEACH AGGREGATE – APPLICATION FOR STORAGE EXPANSION (KIRKPATRICK TWP)

The following letter was received from Pebble Beach Aggregate in response to our initial comments submitted to the MNRF Aggregate Resources Inspector regarding application for an expansion permit at their site located in the Township of Kirkpatrick (Deer Lake Road). A copy of our comments (letter dated Nov-5th) is attached for reference purposes.

In order for the Proponent to proceed, the MNR requires written confirmation from the municipality of West Nipissing that the mitigation measures proposed are satisfactory.

RE: APPLICATION FOR AGGREGATE PERMIT, KIRKPATRICK TOWNSHIP, DISTRICT OF NIPISSING – Municipality’s comments Dear Melanie: I would like to offer these comments in order to address the concerns raised in your letter dated November 5, 2015.

1. Adequate noise buffers will be maintained. Both the noise assessment for the permit issued to the north and the Addendum for this application will ensure that MOECC guidelines are met. The berm proposed in the original permit will be now located south of the stockpile area.

2. The hours of operation at this site will be 7 a.m. to 11 p.m., Monday to Sunday which are the same as for the permit to the north. I gather these were acceptable to the Municipality at the time of that application, but please let me know if you feel they should be modified.

3. As outlined in the information submitted with the application, the surrounding environment will not be negatively impacted as indicated in the reports that accompanied the application. This area will be used only until sufficient flat open space is available for stockpiling on the permit to the north.

4. There will be no increase in heavy traffic as a result of the permit expansion since it is the original permit that will control how much material will be exported from the site. There will no increase in tonnage extracted as a result of the prosed permit.

PROJET DE MURALE AU COMPLEXE SPORTIF DE STURGEON FALLS MISE À JOUR – JANVIER 2016

1. La première murale a été complétée en décembre 2015. Le travail a exigé 210 heures de bénévolat de la part de cinq artistes, tous membres de la Galerie Expressions. Le slogan « Joie de vivre » sera apposé le vendredi 8 janvier en haut de la murale. Un fixatif de vernis sera appliqué une fois la peinture complètement séchée.

2. Les villages représentés dans cette première murale sont : Monetville Nord, Lavigne, Kipling, Verner et Cache Bay.

3. Les commentaires des gens sont très positifs et la communauté semble apprécier le travail. Les gens identifient facilement les éléments de chaque village.

4. La deuxième murale sera complétée d’ici la fin mai 2016 et représentera les villages de Desaulniers, Crystal Falls, Field, River-Valley et la ville de Sturgeon Falls. Quelques nouveaux artistes s’ajouteront à l’équipe.

MURAL AT THE SPORTS COMPLEX IN STURGEON FALLS UPDATE – JANUARY 2016

1. The first mural was completed in December 2015. A total of 210 hours of voluntary work was invested in the project by five artists, all members of Expressions Gallery. The slogan “Joie de vivre” will be installed on Friday January 8th at the top of the mural. A varnish will be added to protect the mural once the paint has cured.

2. The villages represented in the first mural are: North Monetville, Lavigne, Kipling, Verner and Cache Bay.

3. Comments are very positive and the community seems to appreciate the work. People can easily relate to the elements represented for each village.

4. The second mural will be completed by May 2016 and will represent the villages of Desaulniers, Crystal Falls, Field, River-Valley and the town of Sturgeon Falls. A few new artists will be joining the team.

RE: TAX COLLECTION EXTENSION AGREEMENTS

As part of the tax collection process, once a tax arrears certificate has been registered against a property, there is a one year time period in which the full amount of the cancellation price must be paid. It must be paid in one sum and not as a part of a payment plan. At the end of that year, the Municipality may proceed with a tax sale. Prior to that time, a tax payer may ask for an extension agreement with the Municipality. The extension agreement can extend the one year period for up to an additional year and allows the tax payer to enter into a payment plan with the Municipality. These can become time sensitive issues, as property owners reach the final days of the year. There are 4 properties that will have the one year window expire in 2016 and the properties would then be eligible for tax sale. I am requesting council’s permission to enter into extension agreements, if requested, with property owners who have not previously had an extension agreement. The extension agreements would be for 1 year and are conditional on the current taxes also remaining paid within that time frame.

RE: EXTENSION OF NOISE BY-LAW EXEMPTION - MTO

The Municipality has received a request from the Ontario Ministry of Transportation for extensions of the noise by-law exemptions for ongoing Highway 17 improvements between Warren and Sturgeon Falls.

The construction projects include the following:

#C2015-5101 .......... construction at Bear Creek and Deer Creek

#C2015-5111 .......... construction at Big Cache Creek

Please note that the construction for Project C2015-5111 will include 24 HR operation for one week only (Monday night up to and including Friday night – Jan-18th through Jan-23rd) for the removal of concrete using hydraulic hammers during the night.

WHEREAS Council has previously approved noise by-law exemptions for the Ontario Ministry of Transportation (MTO) for Highway 17 improvements; for the period of May 2015 through November 2015; AND WHEREAS the Municipality has received a request from the Ontario Ministry of Transportation (MTO) to extend the noise by-law exemptions for the continued Highway 17 improvements for which construction work may extend beyond the permitted weekday work hours; BE IT RESOLVED THAT Council authorizes an exemption of the Municipality of West Nipissing Noise by-law 1999/75 to the Ontario Ministry of Transportation (MTO) from January 13, 2016 through August 31, 2016 for continued Highway 17 Improvements between Warren and Sturgeon Falls for Project No. C2015-5101 (Bear Creek and Deer Creek) and Project No. C2015-5111 (Big Cache Creek), which exemption shall not include quarry operations.
