Motion 1.It is proposed that the category of Junior License be discontinued. That discontinuance will require changes to the Cosmetology Act and by-laws.

Rationale:

There have been many problems with regard to junior license holders (“juniors”) trying to work in the industry and with labour mobility across Canada. This year alone, the Association received more than six written complaints and numerous calls about the issue of juniors having difficulty finding work and/or getting their hours signed off. Further, the Government advised us that they have received complaints about the issue as well.

With regard to labour mobility, there have been calls from Alberta from our members who cannot become licensed there because they are juniors. The Alberta Government believes that juniors are still apprenticing. We need to move to a system that addresses that misunderstanding.

Agenda

(i) Problems trying to work in the industry

A junior must now find a Master Cosmetologist to work under and this is leading to several types of problems.

First, some juniors cannot find Master Cosmetologists in their communities, especially in rural Nova Scotia.

Second, there have been problems as some juniors have not been able to get their hours signed off by a Master. As you all know in this industry, staff sometimes leave unexpectedly. However a departure can leave a junior dealing with someone who will not sign for hours.

(ii) Labour Mobility

In 2009 the new labour mobility protocol became effective to allow greater mobility of cosmetologists (and other professions) across Canada. The Nova Scotia category of junior is unique and that is creating issues. Across Canada, we are the only province to have tiered licensing. Other provinces provide a Hairstyling License or Esthetics License upon Graduating. The Nova Scotia junior category is confusing. In Alberta, for instance, the system perceives a junior to still be apprenticing.

To address these concerns, the following changes are proposed to be made to the Cosmetology Act:

Section 4 of the Act currently reads:

4. A person may be licensed to practice cosmetology in one or more of the following capacities:

a. a Specific Cosmetologist;b. a Junior Cosmetologist;c. a General Cosmetologist;d. a Master Cosmetologist;e. a Master Cosmetologist Instructor.

To delete the category of Junior we propose deleting subsection 4(b). Section 4 would then read:

4. A person may be licensed to practice cosmetology in one or more of the following capacities:

a. a Specific Cosmetologist;b. a General Cosmetologist;c. a Master Cosmetologist;d. a Master Cosmetologist Instructor.

Section 18(2) of the Act currently reads:

Students and Junior Cosmetologists

18(2) No person who is licensed to practice cosmetology in the capacity of a junior cosmetology shall practice cosmetology except under the direct supervision of a person who is licensed to practice cosmetology in eh capacity of a master cosmetologist or master cosmetologist instructor and in a recognized school or in a place of business that mat be operated as a place of business where cosmetology is practiced.

Proposed change:

Delete reference “and Junior Cosmetologists” in title so that it reads only “Students” and delete subsection 2 entirely.

The following changes would have to be made to the by-laws

Section 3(2)(c) will have to be deleted. Section 3(2) currently reads:

3(2) Associate – associate members shall be entitled to attend meetings of the Association as observers only. Any person may become an associate member if that person:

a. is an owner/part-owner of a salon or school where cosmetologists work or train;

b. is a student in training at an approved school of cosmetology;c. is a junior cosmetologist license holder;d. was a licensed cosmetologist when ceasing to work at the

profession; ande. pays prescribed membership fees.

In 2009, the membership approved a resolution addressing membership of salon owners. That change reads:

3(2) Associate - associate members shall be entitled to attend meetings of the Association as observers only. Any person may become an associate member if that person:

a. is an owner/part-owner of less than 50% of a salon or school where cosmetologists work or train;

b. is a student in training at an approved school of cosmetology;c. is a junior cosmetologist license holder;d. was a licensed cosmetologist when ceasing to work at the

profession; ande. pays prescribed membership fees.

Section 3(2)(c) would be deleted, and (d) and (e) would be renumbered. This section would then read:

(2) Associate – associate members shall be entitled to attend meetings of the Association as observers only. Any person may become an associate member if that person:

a. is an owner/part owner of less than 50% of a salon or school where cosmetologists work or train;

b. is a student in training at an approved school of cosmetology;c. was a licensed cosmetologist when ceasing to work at the

profession; andd. pays prescribed membership fees.

Also we propose deleting sections 5(3)(b) and 5(3)(c) from the by laws. These sections currently read:

5(3)(b) Junior Cosmetologist in Hairdressing License

Upon the applicant successfully completing the training as prescribed in section 13(1) and (2) of the Act and upon successfully completing the examination as prescribed by the Provincial Examining and Licensing Committee in Cosmetology with an average mark of at least 65% in all phases, and upon paying to the Association the fees prescribed in these by-laws, the applicant shall be issued a Junior Cosmetologist in Hairdressing license, permitted to carry on the functions listed in section 2(1)(d)(I) of the Cosmetology Act while under the direct supervision of a Master Cosmetologist in Hairdressing or a Master Cosmetologist Instructor in Hairdressing.

5(3)(c) Junior Cosmetologist in Esthetics License

Upon the applicant successfully completing the training as prescribed in Section 13(1) and (2) of the Act and upon successfully completing the examinations as prescribed by the Provincial Examining and Licensing Committee in Cosmetology with an average mark of at least 70% in all phases, and upon paying to the Association the fees prescribed in these by-laws, the applicant shall be issued a Junior Cosmetologist in Esthetics license, and shall be permitted to carry on the functions listed in Section 2(1)(d)(ii) of the Cosmetology Act while under the direct supervision of a Master Cosmetologist in Esthetics or a Master cosmetologist Instructor in Esthetics.

The sections following those in the by-laws would have to be renumbered.

Next, section 5(3)(d) of the Bylaws refers to a Junior. That reference would have to be deleted. Section 5(3)(d) currently states:

5(3)(d) General Cosmetologist in Hairdressing License

Following 960 hours of practical experience under the direct supervision of a Master Cosmetologist in Hairdressing or Master Cosmetologist Instructor in Hairdressing in a registered salon/school, and being able to verify the following specified applications: haircuts - 100 applications, permanent waving/chemical relaxer - 25 applications; haircolouring/lightening /highlights - 25 applications and successfully completing one pre-approved course in the subject of either perming, colouring, or cutting, the Junior Cosmetologist in Hairdressing licensee shall qualify for a General Cosmetologist in Hairdressing license. Upon application to the Provincial Examining and Licensing Committee in Cosmetology, providing evidence of such experience, and upon paying to the Association the fees prescribed in these by-laws, the licensee shall be issued a General Cosmetologist in Hairdressing license.

We propose that it read:

5(3)(d) General Cosmetologist in Hairdressing License

Upon the applicant successfully completing the training as prescribed in Section 13(1) and (2) of the Act and upon successfully completing the examinations as prescribed by the Provincial Examining and Licensing Committee in Cosmetology with an average mark of at least 70% in all phases, and upon paying to the Association the fees prescribed in these by-laws, the applicant shall be issued a General Cosmetologist in Esthetics License.

Section 5(3)(e) will require the same change. Section 5(3)(e) currently reads:

5(3)(e) General Cosmetologist in Esthetics License

Following 960 hours of practical experience under the direct supervision of a Master Cosmetologist in Esthetics or a Master Cosmetologist Instructor in Esthetics in a registered salon/school, and being able to verify the following specified applications: 40 facials, 25 facial waxings, 25 body waxings, 15 makeup applications, 15 lash tints, 40 manicures, 40 pedicures, and successfully completing one pre-approved course in

the subject of esthetics, the Junior Cosmetologist in Esthetics licensee shall qualify for a General Cosmetologist in Esthetics License. Upon application to the Provincial Examining and Licensing Committee in Cosmetology, providing evidence of such experience, and upon paying the Association the fees prescribed in these by-laws, the licensee shall be issued a General Cosmetologist in Esthetics license.

With the change the section would read:

5(3)(e) General Cosmetologist in Esthetics License

Upon the applicant successfully completing the training as prescribed in Section 13(1) and (2) of the Act and upon successfully completing the examinations as prescribed by the Provincial Examining and Licensing Committee in Cosmetology with an average mark of at least 70% in all phases, and upon paying to the Association the fees prescribed in these by-laws, the applicant shall be issued a General Cosmetologist in Esthetics License.

Section 5(3)(m) refers to a Junior. It currently reads:

5(3)(m) Specific License: Body Sugaring Services

Upon the applicant successfully completing the examinations as prescribed by the Provincial Examining and Licensing Committee in Cosmetology and upon paying the fee as prescribed in these by-laws to the Association, the applicant shall be granted a specific license permitting the holder to provide body sugaring services. The Specific License: Body Sugaring Services shall only be granted to those qualified applicants who apply within one year from the date of approval of this provision by the Governor in Council, following which body sugaring may only be provided by holders of a Junior Cosmetologist in Esthetics, General Cosmetologist in Esthetics, Master Cosmetologist in Esthetics, or Master Cosmetologist Instructor in Esthetics license.

With the deletion of the junior category, the language would read:

5(3)(m) Specific License: Body Sugaring Services

Upon the applicant successfully completing the examinations as prescribed by the Provincial Examining and Licensing Committee in Cosmetology and upon paying the fee as prescribed in these by-laws to the Association, the applicant shall be granted a specific license permitting the holder to provide body sugaring services. The Specific License: Body Sugaring Services shall only be granted to those qualified applicants holders of a General Cosmetologist in Esthetics, Master Cosmetologist in Esthetics, or Master Cosmetologist Instructor in Esthetics license.

Next, at a previous AGM, the membership ratified the following resolution.

5(3)(o) Supervision of Junior Cosmetologists

It is an offence for a Master Cosmetologist or a Master Cosmetologist Instructor, having supervision of a Junior Cosmetologist to:

i. fail to maintain a current license;ii. leave a junior cosmetologist to deliver services alone in the salon;

oriii. refuse to sign for proven hours worked and practical applications

obtained by the junior cosmetologist.

We propose that this proposed amendment not proceed or, if it is implemented before the AGM convene, that section 5(3)(o) be deleted from the by-laws.

Also, at a previous AGM the membership proposed a change to section 24(1) of the by-laws. The proposed changes to that section would read:

24(1) Only those persons lawfully in possession of a current certificate as a specific cosmetologist, junior cosmetologist, general cosmetologist, master cosmetologist or master cosmetologist instructor or who own at least 50% of a salon or school where cosmetologists work or training and are active members of the Association shall be entitled to vote at any meeting.

We propose deleting the reference to a “junior cosmetologist”. With that change, the language would read:

24(1) Only those persons lawfully in possession of a current certificate as a specific cosmetologist, general cosmetologist, master cosmetologist or master cosmetologist instructor or who own at least 50% of a salon or school where cosmetologists work or training and are active members of the Association shall be entitled to vote at any meeting.

Nick Pascetta has been in the industry for over twenty years. During his time he has traveled across Canada, the United States and Europe. On his travels Nick has attended numerous

For his inspiration he looks to both the fashion and music industries. Krista began her career with the beauty industry in 2001 in Newfoundland, Canada. After graduating top of her class, she was more than eager to immerse herself in the hair and fashion

Throughout her career, she has been featured on local television shows, as well as the national television program “Hair Wars”. Stella Livoti made her entrance into the industry of hair design 27 years ago in New York City. She instantly fell in love with how gratifying it is to make people feel and look beautiful. Today

she not only performs techniques on stage but she also works on photo shoots for Joico. At Joico’s Artistic Institute in Darien, Connecticut, Stella facilitates work shops with her fellow guest artists. She has been noted as being “direct and precise.” Stella has the artistic ability to infuse classic styles with bold trends.
