3. ELECTION OF MAYOR
The CEO advised that he had received nominations for the office of Mayor from Cr Kevin Bailey, Cr Ian Johnson and Cr David Lucas.
Cr David Lucas withdrew his nomination.
Ballot papers were printed and circulated to Councillors for their votes.
The CEO counted the ballot papers in the Chamber and the result was as follows:
Cr Kevin Bailey 9 votes
Cr Ian Johnson 6 votes
The CEO declared Cr Kevin Bailey as being elected as the Mayor for the next two years. The Mayor made a Declaration of Office before the CEO.
Cr Bailey took on the role of Presiding Member.

4. ELECTION OF DEPUTY MAYOR
The CEO advised that he had received nominations for the office of Deputy Mayor from Cr Ian Johnson and Cr David Lucas.
Ballot papers were printed and circulated to Councillors for their votes.

1. APPOINTMENT AND NOMINATION OF COUNCILLORS TO COMMITTEES

KEY ISSUES
• Council is required to give consideration to the appointment of representatives
to various committees.
• Membership of Council committees is for a two year term in line with local government ordinary elections.
• Membership of other committees is determined by the relevant legislation or governing organisation/agency.
This report is submitted to Council for determining membership of relevant committees.
BACKGROUND
Following the local government elections held on 19 October 2019, consideration is required to be given to the appointment of representatives to various Council-created and external committees/boards.
In accordance with section 5.11 of the Local Government Act 1995 (the Act), all positions on Council Committees become vacant. Membership of Committees Required Under Other Legislation, Committees Required Under Legal Agreements and Other Committees are also reappointed.
In regard to Statutory Bodies Requiring Councillor Representation tenure and nomination of members is dependent upon the provisions of the relevant establishing legislation.
DETAILS
Provided below is the current list of Committees and their current membership. Council is to determine membership or nominations for membership as identified, in accordance with the Terms or Reference or other instrument specifying membership.

Section 5.10 provides for the appointment of committee members. A decision to appoint committee members requires an Absolute Majority decision of Council.
At any given time each Council member is entitled to be a member of at least one committee that comprises Council members only, or Council members and employees. If a Council member wishes to be a member of such committee, the Council is to appoint that Council member to at least one committee as the Council determines.
If the Council is to make an appointment to a committee that has or could have a Council member as a member and the Mayor informs Council of his/her wish to be a member of the committee, the Council is to appoint the Mayor to be a member of the committee.

AUDIT COMMITTEE
Function: Provide advice and assistance to Council in relation to financial reporting, external audit, internal control framework, internal audit and risk management.
Training and Development:
An introduction presentation will be provided to all members of the Audit Committee at its first meeting.
Meeting Date: Quarterly (approximately) on a Tuesday at 5.30pm
The first meeting of the Audit Committee is scheduled for 5pm on Tuesday, 29 October. The agenda for this meeting will be distributed to appointed members during the week.

Function: Conduct the CEO's annual performance review, determine the CEO's Key Performance Indicators and provide a report and recommendation to Council on these matters.

STATUTORY BODIES REQUIRING COUNCILLOR REPRESENTATION
EASTERN METROPOLITAN REGIONAL COUNCIL (EMRC)
Function: Comprises the Cities of Bayswater, Belmont, Kalamunda, Swan, Town of Bassendean and Shire of Mundaring. The EMRC provides services in waste management, environmental management and regional development.
Meeting Fees and Allowances
Each Councillor, other than the Chairman, is entitled to an annual attendance fee of $10,560 from the EMRC.
The Chairman is entitled to an annual attendance fee of $15,839 as well as an annual allowance of $20,063 from the EMRC.
The Deputy Chairman is entitled to an annual allowance of $5,015 in addition to annual attendance fee of a Councillor from the EMRC.
Meeting Date: Ordinary Meetings are held on the third Thursday of the month at 6pm
Venue: EMRC Offices, Great Eastern Highway, Belmont
Membership: Two Councillors plus one Councillor as deputy from each member Council.

SWAN VALLEY PLANNING COMMITTEE (SVPC)
Function: This is a statutory planning committee established under the Swan Valley Planning Act 1995. The main function of the committee is to make recommendations to the City of Swan and WAPC on land use and development matters in the Swan Valley. Most members of the committee are appointed by the Minister for Planning from nominations made by various industry and community groups.
Meeting Date: First Monday of the month at 5.30pm.
Venue: City of Swan Administration Centre
Membership: Section 11 of the Swan Valley Planning Act 1995 details membership which includes representatives of a number of bodies. The City's representative shall be the Mayor or his/her nominee and a Councillor for a ward representing the Swan Valley.
Nomination Process
The Mayor or his/her nominee is automatically a member and approval is not required by the Minister.
A Councillor for a ward representing the Swan Valley is to be nominated by Council and appointed by the Minister.

The City's long term practice has been to make arrangements regarding the membership of the Committee such that both Swan Valley/Gidgegannup Ward Councillors are members of the Swan Valley Planning Committee. Therefore Scenarios 2 or 3 are the recommended outcomes.
It is recommended that the membership be determined as follows:
1. The Mayor advises if he/she shall be the Member or wishes to nominate a representative.
2. Dependent upon the Mayor's advice the following three scenarios could occur:
Scenario 1
The Mayor is not a Swan Valley/Gidgegannup Ward Councillor and advises he/she wishes to be the member.
Council may nominate one or both of the Swan Valley/Gidgegannup Ward Councillors to be appointed by the Minister.

Scenario 2
The Mayor is not a Swan Valley/Gidgegannup Ward Councillor and advises he/she wishes for one of the Swan Valley Ward Councillors to be his/her nominee.
Council nominates the second Swan Valley/Gidgegannup Ward Councillor to be appointed by the Minister.
Scenario 3
The Mayor is a Swan Valley/Gidgegannup Ward Councillor and advises he will be the member on the Committee.

MIDLAND LAND REDEVELOPMENT COMMITTEE (MLRC)
Function: The Metropolitan Redevelopment Authority (MRA) was established with the Metropolitan Redevelopment Authority Act 2011 to undertake redevelopment projects in suitable areas within the Perth metropolitan area.
Each redevelopment area has a Land Redevelopment Committee enabling community and local government involvement in the development and delivery of redevelopment projects.
Meeting Fees and Allowances
Members are remunerated according to Public Sector Commission guidelines.
Meeting Date: First Monday of every month at 9.00am.
Venue: MRA Midland Office
Membership: The Committee consists of five members. One member of the Committee is to be appointed from nominations provided by a local government.

DEVELOPMENT ASSESSMENT PANELS (DAP'S)
Function: Determine development applications that meet set type and value thresholds as if it were the responsible authority under the relevant planning instrument.
Training and Development
It is a mandatory requirement that all DAP members attend training before they can sit on a DAP and determine applications.
Meeting Fees and Allowances
Fees for Local Government Members are as follows:
Determine development applications - $425
Determine applications to amend or cancel determination - $100
Attending proceeding in State Administrative Tribunal - $425
Training - $400 and Re-Training - $200
Meeting Date: As required and will be determined by the Department of Planning in consultation with the City.
Venue: Determined by the Department of Planning. Held at either the Department of Planning, City of Swan Administration Centre or another local government.
Membership: Each DAP comprises five members: three specialist members, one of which is the presiding member, and two local government members.
Two alternate (deputy) local government members are also appointed.
Nomination process:
The Minister for Planning considers nominations and appoints members.

Function: Land conservation district committees are statutory committees appointed by the Commissioner of Soil and Land Conservation to administer Land Conservation Districts. Their main function is to promote land management and undertake projects.

Meeting Date: Bimonthly, on Thursday evenings
Venue: Bullsbrook
Membership: Membership includes a City representative and representatives from the Western Australian Farmers Federation and/or the Pastoralists and Graziers Association and members of the local community.

Function: Membership includes representatives from Bassendean, Bayswater, Belmont, Kalamunda, Mundaring and Swan and meets to consider regional issues and policy matters to present to the WALGA State Council.
Each Zone nominates members to the WALGA State Council. Sitting fees for State Councillors are $3,500 per annum and $405 per meeting for Deputy State Councillors attending as a delegate.
Meeting Fees and Allowances
There are no sitting fees for being on the WALGA East Metropolitan Zone however representatives from each of the zones are elected to serve on the WALGA State Council. WALGA State Councillors do receive sitting fees for their appointment.
Meeting Date: Bimonthly, generally the last Thursday of the month at 6.00pm.
Venue: Rotates through the relevant local government authorities.
Membership: Three Councillor delegates from each local government within the East Metropolitan Zone.

METROPOLITAN REGIONAL ROAD GROUP - EASTERN SUBGROUP
Function: Assessment of road funding needs, the annual distribution of State funds to local government roads and monitoring and reporting on the effectiveness of the application of the State funds for local government roads in its region.

Membership: One elected member and one technical member from each participating local government.
Mr Jim Coten is the current technical member.

PERTH AIRPORTS MUNICIPALITIES GROUP
Function: Forum for local government representatives and stakeholders to discuss and resolve issues relating to airports which either directly or indirectly impact the community.
Meeting Date: Every three months, first Thursday of the month.
Venue: Rotates through the relevant local government authorities.
Membership: One delegate (Councillor), the CEO and a technical officer (optional) from each of the participating local governments.
Up to two deputy members may be appointed. These may be Councillors or Officers.

PARKS OF THE DARLING RANGE - COMMUNITY ADVISORY COMMITTEE
Function: A regular forum to hear public opinion and exchange advice on management issues affecting the parks of the Darling Range.
Meeting Date: Every three months, on a Thursday.
Venue: Rotates through relevant local government authorities.
Membership: One Councillor delegate from each of the participating local governments.

SWAN COMMUNITY CARE ADVISORY COMMITTEE
Function: Swan Community Care Services provides services to assist frail aged or at risk aged persons and younger people with disabilities to remain in their homes. More recently the Committee has taken on an active role in advocating for increased Residential Aged Care Facilities in the City of Swan.
Meeting Date: Fourth Friday of the month at 9.30am
Venue: 2 Templeman Place, Midland
Membership: The Committee consists of volunteer members as well as a Councillor.
