The Legal Process after the Death of a Loved One
When a loved one passes away, families can become overwhelmed with the legalities of administering their estate.
Some common questions asked by family members are included below. What do the family need to do? An application is made to the Court by the Personal Representatives (PR's) of the deceased. The application will be for a “Grant of Probate” if the deceased left a Will or for “Letters of Administration” if the deceased did not leave a Will.
Why does an application have to be made? An application has to be made so that the PR's can gain control of the assets/liabilities of the deceased. The PR's can then pay any debts and distribute any assets to the beneficiaries.
Who are the Personal Representatives? If the deceased left a Will s/he will have appointed Executors to manage the administration of their estate. If the deceased did not leave a Will, Administrators are appointed. Administrators are the next of kin of the deceased. If a PR does not want to take on the responsibility of administering the estate they can renounce the role.
Who are the beneficiaries? If the deceased left a Will it will state who they want their estate left to. If the deceased did not leave a Will the law outlines the beneficiaries in order of priority. Generally speaking the spouse and children take the estate.
What are the responsibilities of PR's? The PR's have a duty to contact HMRC to inform them of the death, value any assets and debts of the deceased at the date of death by contacting all of the institutions involved such as banks, pension funds etc. They also have a duty to value any property owned by the deceased such as a house and personal items. Once the estate has been valued the HMRC are notified and inheritance tax (if any) is dealt with.
How long does the process take? The process can take anywhere from a couple of months to more than a year. It depends on how complicated the estate is. It can be painstaking work as each company has individual procedures for dealing with probate.
How much does it cost? This depends on whether the PR's employ a solicitor to undertake the work or whether they choose to complete it themselves In addition there are court fees to extract Probate.

AT THE CINEMA: Hitchcock 12A, (98 mins) Psycho is a masterpiece of modern cinema. So, have you ever wondered about the story behind the scenes? No? Me neither, but here we are.
At the centre of this picture is Anthony Hopkins. Hard as it is to believe, he won his Oscar 22 years ago for his portrayal of Dr Hannibal Lector in the truly chilling The Silence of the Lambs. Now he plays the director of a horror picture. But this movie is actually a study of Hitchcock’s sometimes strained but always sympathetic relationship with his wife Alma, deftly played here by Helen Mirren (The Queen). Performance-wise, Hopkins gives a precise and calculated impersonation of ol’ Alfred and, though obviously well-rehearsed, is never quite natural. Mirren plays the downtrodden woman well. Her emotional, yet platonic affair with fellow writer Whitfield Cook (Danny Huston) is tender and bittersweet, with Mirren showing real vulnerability.
Scarlett Johansson (The Other Boleyn Girl) is surprisingly plain as Janet Leigh. This does not detract however, from her overall performance. Johansson’s depiction of Leigh is that of a sensible ’50’s wife and mother who happens to be an actress and this builds an effective rapport with her audience.
The main problem with this movie is its oversimplification. Gervasi has sculpted a fine drama, but he deals with complex emotional issues which are not fully developed. Instead issues are hinted at or dealt with in one scene. For example, Alma’s creative frustration at never getting ample credit for the work she does on Hitchcock’s movies is intermittently tempered and
similarly resolved; this should surely be a bigger issue. So near and yet so far Gervasi. 3 / 5
On DVD: Skyfall 12A (143 mins) Much has changed in the Bond universe since Ursula Andress emerged from the sea in her bikini in Dr No exactly 50 years ago. But as they say, the more things change, the more they stay the same. This saying could be the mantra for Skyfall which contains many changes to Bond’s clique but everything ends up back where it started. This is done deliberately as writers Neal Purvis and Robert Wade create a coherent plot while touching on every Bond cliché (the cars, the gadgets, the girls…) for the series’ 50th anniversary.
Daniel Craig’s outings as Bond have been inconsistent: Casino Royale was brilliant, but Quantum of Solace was a huge let-down. In Skyfall, Craig’s Bond must retrace his steps, returning to old ground, as he tells M, ‘We’re going back in time.’ He is dependable and stolid as the suave secret agent, even becoming emotional and tender at the bittersweet climax. Surprisingly, Judi Dench is the main Bond girl, as M becomes so haunted by her logical, past decisions that only 007 can save her. Dench proves believable and hard-hearted as the head of MI6, but creates sympathy for her character and situation that the audience can believe and support.
Javier Bardem proves intelligent and creepy as the villain, always two steps ahead of his captors. A word must be given to Ralph Fiennes as M’s political rival who could be very dull, but Fiennes imbues him with a charisma and succinct air which is difficult to ignore. Ben Whishaw shines as Q; it is such a relief R (John Cleese) was not brought back from Die Another Day. Director Sam Mendes shows he can handle action sequences as well as the
next director but where are his directorial idiosyncrasies in an otherwise great movie? 4 / 5

St Joseph’s Nursery School celebrates Chinese New Year
“I’m like a Chinese girl. There’s Papa’s dolls. They’re from China ‘cos Papa was in China, he was working in China. That’s Papa’s Chinese hat and he brought me Chinese slippers with panda bears on them and they’re all the way from China. We ate the Mandarin oranges with chopsticks and I could do that, and I could kick the Chinese game with the feathers. It’s the Year of the Snake this year. There was a red envelope in my book bag to give us good luck. There was a big, big dragon and Chinese clothes. China’s far away. Kim’s granny and granda live in China, Hong Kong.” Evie

Millennium Primary School P2 marked the end of their ‘Pirate’ topic with a Pirate party. All the children (and P2 staff) dressed up in Pirate costumes (right). They took part in games and activities and ended the day with a Pirate feast. This is always a very popular day in the P2 calendar!
Congratulations to our girls Netball team for their recent success in the Netball League. Star players for the team this week were Laura Shaw, Holly Cunningham and Rebecca Scott.
The Nursery children were thrilled to have a visit from Ignatius McGreevy in his 1939 Fire Engine (right). The engine, called Betsy, served during World War II in Scotland as well in London during the Blitz. Mr McGreevy has travelled around Ireland, England, Wales and Scotland in Betsy going to vintage car shows.
Many of our classes made pancakes for pancake Tuesday (left). There were all types of crepes and pancakes with lemon, jam, sugar and butter. We were able to incorporate weight and measure into the pancake making – a delicious way to do numeracy!!
Rehearsals are well under way for our school production of ‘Annie’ taking place in March. Further information is available from the school office.
St Joseph’s Primary School qualified for
the All County finals of the Cumann na mBunscol Indoor Hurling competition. The team played in the qualifying tournament held at St Malachy's High School in Castlewellan on Monday 11th February.
