ORDINANCE NO 01 -14
AN ORDINANCE REQUIRING AND ENFORCING THE REMOVALOF TRASH, LITTER AND RUBBISH
An ordinance requiring and enforcing the removal of trash, litter and rubbish or other unsightly litter fromthe premises of property owners, domestic and commercial. BE IT ORDAINED BY THE CITYCOUNCIL OF THE CITY OF HIGHLAND, ARKANSAS;
SECTION 1. In an effort to keep our city clean, neat and respectable, the City of Highland herebyplaces in motion this ordinance that forbids the accumulation of trash, litter and rubbish on thepremises of property owners whether domestic or commercial, within the boundaries of the City ofHighland.
SECTION 2. Trash, litter and rubbish are described herein as any unsightly or unsanitary litter orcondition, having no useful purpose, old automobiles, trucks, old appliances, or parts of thesedescribed items. thereof, or any other unsightly loose materials or appurtenances thereof, that havebecome a common eyesore.
SECTION 3. All residential and commercial properties are to be kept clean and free of refuse.
SECTION 4. After having been notified by official City of Highland authority, whether by letter orby a personal official notice, the occupant and / or property owner will have thirty (30) days tobegin removal of herein described trash, litter, or rubbish and no more than sixty (60) days tocomplete all removal.
SECTION 5. Failure to comply with this ordinance in part or in whole shall result in finesbeginning at $50.00 and not to exceed $200.00; at which time, if the ordinance has not been followed,will be turned over to the Municipal court. All expenses incurred by the city, to cleanup said property,will be collected from the party the action is against.
SECTION 6. The City of Highland reserves the right by Arkansas State Law 14 -56 -203. " Cities
of the first and second class shall have the power to order the removal or razing of, or to remove orraze. any buildings or houses that in the opinion of the council have become dilapidated, unsightly,unsafe, unsanitary, obnoxious, or detrimental to the public welfare and shall provide, by ordinance.the manner of removing and making these removals." The City may collect charges for removingthrough the proper channels of Sharp County Municipal or Chancery Court.
SECTION 7. All ordinances or parts of ordinances in conflict herewith, are hereby repealed.
