For the first time, beginning January 1, 2018, truck drivers subject to pre-employment and post-accident drug tests will be screened for four additional synthetic opioids. This will require medical experts to consider prescribing medications that balance pain mitigation with safety performance.

Indications are that most of the private, drug-testing labs are ready to conduct the four additional Department of Transportation mandated tests. According to Barry Sample, senior director of science and technology for Quest Diagnostics, Inc., the new requirement will likely slow down the process for medical review officers.

The primary responsibility of a medical review officer is to verify if an employee has an alternative medical explanation for a lab-confirmed positive test result.

Abigail Potter, manager, safety and occupational health policy at American Trucking Associations, said “If someone gets dinged as positive, an MRO reviews it, and if the MRO finds that the person had a legitimate prescription under the Controlled Substance Act, then it will most likely be marked negative.”

But someone who has a valid prescription for one of these drugs may not be considered medically qualified by the medical review officer. He might be able to pass a DOT test, but he may not be medically certified to drive.”

She added, “These are very potent drugs, and some of them have addiction qualities similar to heroin. They are very, very dangerous. We as an industry are focused on preventing these drugs being used by drivers.”

The DOT final rule, announced November 9th, would continue to make medical review officers the ultimate decision-makers of whether a driver, with or without a legal opioid prescription, is fit to drive. If the driver with a prescription for an opioid passes the drug test but still is not deemed fit to drive, the medical review officer can still forward a “safety concern” letter to the driver’s employer, but only after a five-day waiting period, Sample said. The waiting period would allow the driver’s physician to further discuss the matter with the officer.

During the comment period for the proposed rule earlier this year, several commenters expressed concerns that adding the opioid tests will increase circumstances in which drivers innocently using opioids would be unfairly treated as drug abusers, with consequent positive tests harming their careers.

In response, DOT said it added language in the final rule to prohibit an MRO from denying a legitimate explanation based on whether the officer thinks the prescribing physician should not have prescribed the medication to the driver.

Yet, the agency said in its final rule that it’s important

to note that when there is a valid concern about whether the employee can continue performing safely, the prescribing physician still may be asked to reconsider the employee’s use of the prescription. And, even when a prescription is legitimate, the MRO can forward a safety concern letter to the driver’s employer.

Sample said the odds of failing an opioid test with a valid prescription are “very dependent” on the pattern of use, dosage, frequency of use and an individual’s metabolism.

The detection window for the new opioid tests is shorter than for many other drugs, Sample said.

We generally say the [opioid] urine screen will be able to detect use within the last 72 hours,” he added.

Sample said opioids may cause decreased reaction time and increase sleepiness.

But, for some individuals, they may be actually be more effective in carrying out their duties if they are not debilitated by pain,” he said. “So it’s somewhat of a balancing act in trying to ensure that the individual is being treated for their pain, but might impact their ability to work.

Members step up to fund Public Education Program for 2017-18November marked the beginning of the The Kansas Motor Carriers Association’s Public Education Program (PEP) fundraising drive. PEP is an important tool to deliver positive public information on the Kansas trucking industry. Members are asked to donate an amount equal to one-third of their member dues to fund the educational efforts which include the Kansas Road Team, purchashing infant and toddler seats for the Child Passenger Safety Week, KMCA Day at the Capitol and KMCA Foundation scholarships.

NOMINATION FOR PARTICIPATION 2018-2020

ABOUT THE KANSAS ROAD TEAM The Kansas Road Team program is sponsored by the Kansas Safety Management Council of the Kansas Motor Carriers Association. Its purpose is to promote highway safety and inform the public about the “real” world of trucking, and the impact the trucking industry has on the Kansas economy. Kansas Road Team captains have been making appearances on behalf of the industry and KMCA and assisting with community service projects since 1993. KMCA is soliciting nominations of professional truck drivers, both men and women, who can deliver the industry’s message from the unique perspective of a truck driver. Selected candidates must be willing to spend one to two days per month during a 24-month period to meet with the news media, speak before civic groups, school students and other audiences as well as appear at trucking industry events. KMCA provides training, uniforms and support materials including videotapes and literature.

ELIGIBILITY 1. Nominees must have been continuously employed as a full-time truck driver for the past 12 months and

currently employed by a KMCA member as a full-time truck driver. 2. Nominees must possess an outstanding safety record and must maintain an accident-free record and have no

convictions for any moving violation in both the truck and personal vehicle for the previous three years. 3. Nominees must be able to clearly and convincingly communicate their commitment to safety and courtesy. They

must be able to represent a positive image of professionalism. 4. If selected, the nominee must be willing to spend one to two days each month traveling and speaking on behalf

of the Kansas trucking industry. 5. The nominating company shall continue to pay the salary and provide benefits and insurance to the driver while

he/she is traveling for the Road Team. In selecting the representatives, emphasis will be placed on driver’s safety record and ability to speak knowledgably about the trucking industry.

The nominator must be a motor carrier executive with the authority to commit his/her company’s support for the program. The nominator also should confirm before submitting the nomination that the candidate is willing to participate in the program. After the individual has been nominated, it is the nominator’s responsibility to immediately notify the Kansas Road Team office at KMCA if the candidate becomes ineligible at any time during the selection process. Once nominations are closed, the Kansas Safety Management Council will announce a group of finalists who will come to Topeka for two days in March where a panel of judges representing industry-related business, communication and public relations will select the 2018-2020 Kansas Road Team captains. The new captains of the Kansas Road Team will be formally introduced at the Kansas Safety Awards Banquet.

ELDs topic of December Safety Council meetingMichael Christopher with the Federal Motor Carriers Safety Administration was the featured speaker at the Safety Council Meeting on December 12th. Nearly 70 members packed into the KMCA conference room to hear Mr. Christopher discuss the ELD mandate and answered questions regarding compliance and exemptions.

This meeting also marked the first webinar safety council meeting. Nearly 40 individuals tuned in for the meeting making this the most well-attended meeting in recent history.
