Overview of the Court’s statistics in 2013

A. Number of new applications In 2013 65,900 applications were allocated to a judicial formation, an overall increase of 2% compared with 2012 (64,900). 45,750 of these were identified as Single-Judge cases likely to be declared inadmissible (a decrease of 7% in relation to 2012). 20,150 were identified as probable Chamber or Committee1 cases (an increase of 27%).

B. Applications disposed of judicially and pending applications 93,396 applications were disposed of judicially, an increase of 6% in relation to 2012 (87,879). The number of cases disposed of therefore exceeded those allocated by approximately 27,500 (i.e. a monthly surplus of almost 2,300). As a result, the stock of allocated applications pending before the Court decreased over the year, by 22% from 128,100 to 99,900.

C. Processing of applications

1. Pre-allocation

Before a case is allocated to a judicial formation applicants are required to complete the application form and submit the necessary supporting documents on pain of administrative disposal. As at 31 December 2013 the number of applications pending at this pre-judicial stage stood at 21,950, an increase of 8% in relation to the same date the previous year (20,300). The number of applications disposed of administratively in 2013 was 13,600, a decrease of 27%.

2. Inadmissibility or strike out decisions

In 2013 89,737 applications were declared inadmissible or struck out of the list of cases by a Single Judge, a Committee or a Chamber, a 4% increase compared with 2012 (86,201). The Single-Judge formation decided 80,583 cases in 2013, a decrease of 1% compared with 2012 (81,764). The number of applications struck out, in a decision or a judgment, following a friendly settlement or a unilateral declaration, decreased by 1% in 2013 (1,890 compared to 1,909 in 2012). Friendly settlements (1,481) increased by 14% (1,303 in 2012), but there were 33% fewer unilateral declarations (409 compared to 606 in 2012).

3. Communicated applications

Where an application is not on its face inadmissible, it is communicated to the respondent Government. In 2013 7,931 applications were communicated (an increase of 51% in relation to 2012 when 5,236 applications were communicated). This increase is due to the introduction of new working methods for well-established case-law cases in particular for Ukrainian or Serbian non-enforcement cases.

4. Judgments

Judgments were delivered in respect of 3,659 applications (compared with 1,678 in 2012 – an increase of 118%). A significant proportion of these applications were joined with the result that the number of judgments actually delivered was 916, a decrease of 16%. 219 judgments were adopted by a three-judge Committee formation under the procedure

5. Requests for interim measures (Rule 39 of the Rules of Court)

The total number of decisions on interim measures (1,591) decreased by 20% compared with 2012 (1,979). The Court granted requests for interim measures in 108 cases (an increase of 5% compared with 103 in 2012) and dismissed them in 817 cases (32% less than the 1,203 in 2012). The remainder fell outside the scope of Rule 39 of the Rules of Court.

D. Priority policy2 In June 2009 the Court adopted a priority policy establishing seven different categories. The essence of this policy is to concentrate more resources on the most important cases, namely the cases falling within the top three categories (“priority applications”). At 31 December 2013 there were 7,368 applications in these categories. The number of priority applications dealt with in 2013 decreased by 14% compared to 2012. 17% less priority applications were communicated to the respondent Governments in comparison with 2012. The number of priority applications declared inadmissible or struck out of the list of cases by a Chamber or Committee decreased by 31%. A number of priority cases are awaiting leading decisions or judgments (in particular for expulsion cases) or the outcome of a pilot judgment (for example in conditions of detention cases). Another factor explaining the decrease compared to 2012 is that in that year a large number of cases concerning expulsion to Somalia were struck out. The number of priority applications struck out following a friendly settlement or a unilateral declaration rose from 158 in 2012 to 247 in 2013. The number of priority applications giving rise to a judgment decreased by 5% in 2013.
