[ ANDERSON CITY COUNCIL MINUTES Regular Meeting November 15, 2016 REGULAR SESSION The regular session was called to order at 6:00 p.m. ROLL CALL Councilmembers present: Councilmember Comnick Council member Yarbrough Councilmember Hunt Vice-Mayor Browning Mayor Baugh Councilmembers absent: None. 1331 Also present: City Manager Jeff Kiser, Assistant City Manager Liz Cottrell, Police Lieutenant Rocky Harpham, City Engineer David Durette, and City Clerk Juanita Barnett. INVOCATION Elder Doug Deese, A/C Neighborhood, gave the Invocation. PLEDGE OF ALLEGIANCE Councilmember Melissa Hunt led the Pledge of Allegiance. STUDENT REPORTS Anderson New Tech High School student representative Brandie Lien gave an update on school activities. Anderson Teen Center student representative Christian Counterman gave an update on teen center activities. Anderson Union High School student representative Eden Groval gave an update on school activities. Anderson Middle School Leadership Student representative Jennifer Short gave an update on school activities. PUBLIC COMMENT ON ITEMS NOT ON THE AGENDA Vice-Mayor Baron Browning, together with Youth Violence Prevention Council Peer Court and Youth Fire Prevention Coordinator Jennifer "Jas" Shaw, Anderson Fire Battalion Chief Steve Lowe, and Cal-Fire Cal Fire Investigator J.T. Zulliger, presented a plaque of appreciation to Anderson New Tech High School Principal Carol Germano thanking her and Anderson New Tech High School for their support of the Youth Firesetter Intervention Training Program by allowing the use of the new tech campus for training purposes. Adopted Resolution No.16-53 amending the 2015-2016 Adopted Budget

URGENCY ORDINANCE REGULATING NON-MEDICAL MARIJUANA; ORDINANCE NO. 802

City Manager Jeff Kiser gave a staff report and answered questions from the Council.

Stan Neutze encouraged the Council to approve the urgency ordinance.

By motion made, seconded (Yarbrough/Browning), and carried by a 5· 0 vote, the Council enacted Urgency Ordinance 802 prohibiting the manufacture, processing, laboratory testing, 0 labeling, storing, wholesale or retail distribution of non-medical marijuana and the outdoor cultivation of non-medical marijuana for a period of forty-five ( 45) days.

CITY MANAGER

ORDINANCE AMENDING SMOKING REGULATIONS: ORDINANCE NO. 803

City Manager Jeff Kiser gave a staff report and answered questions from the Council.

Councilmember Hunt made a motion to table the discussion on this subject for two to three weeks. The motion died for lack of a second.

By motion made; seconded (Browning/Comnick), and carried by a 4-1 vote, the Council introduced Ordinance No. 803 (first reading) amending Chapter 9, Section 9.38.250 of the Anderson Municipal Code regulating smoking in pub1ic places and designating Anderson River Park as a "Smoke*free" zone; and set the ordinance for enactment (second reading) at the regular meeting of December 6, 2016.

Vote: AYES: Councilmembers Browning, Comnick, Hunt, and Mayor Baugh. NOES: Councilmember Yarbrough. ABSTAIN: None. ABSENT~ None.

The City Clerk read the motion for clarification and transparency and read the ordinance by title only.

PUBLIC WORKS

ABANDONMENT OF TWO PUBLIC SERVICE EASEMENTS IN SKYVIEW ESTATES; RESOLUTION NO. 16-54

City Engineer David Durette gave a staff report and answered questions from the Council.

By motion made, seconded (Yarbrough/Comnick), and carried by a 5-0 vote, the Council adopted Resolution No. 16-54 relinquishing all public service rights and interest in the emergency access (public service) easements between lots 23 (APN: 086-450-023) and lot 24 (APN: 086-450-024) and, in addition, between lot 30 (APN: 086-450-030) and lot 31 (APN: 086-450-031) in Skyview Estates.

Vote: AYES: Councilmembers Yarbrough, Comnick, Hunt, Browning, and Mayor Baugh. NOES: None. ABSTAIN: None. ABSENT: None.
