VeranstaltungszielAls Leitmesse der chemischen Prozessindustrie ist die ACHEMA die internationale Plattform für den Dialog zwischen Herstellern und Anwendern, zwischen Wissenschaft und Technik, zwischen Academia und Industrie. Hierdurch wird die Weiterentwicklung der Chemischen Technik und Biotechnologie im weitesten Sinne gefördert.

3. TeilnehmerkreisAlle Firmen und Institutionen, die Produkte oder Dienstleistungen (Apparate, Anlagen, Komponenten, Verfahren, Dienstleistungen) im Bereich der stoffum-wandelnden Industrien anbieten. Die ausgestellten Erzeugnisse müssen im weitesten Sinne in diesem Bereich Verwendung finden. Im Zweifelsfall entschei-det die DECHEMA über die Zulassung.

4. Definition der Ausstellungsgruppen und HallenzuordnungDie Hallen und Freigeländeflächen, die für jede Aus-stellungsgruppe vorgesehen sind, entnehmen Sie bit-te der nachfolgenden Auflistung. Die Aufteilung kann modifiziert werden, wenn der endgültige Platzbedarf dies erfordert. Das Freigelände ist nicht streng nach Ausstellungsgruppen unterteilt. 5. Anmeldung, Zulassung, Standvergabe

Mit Rücksendung des ausgefüllten und unterschrie-benen Formulars „Anmeldung“ oder der Absendung des Online-Formulars (www.achema.de/anmeldung-aussteller) meldet sich der Aussteller verbindlich zur Teilnahme an der ACHEMA 2021 an.

Mit der Anmeldung werden die Allgemeinen Teilnah-mebedingungen, die Technischen Richtlinien und alle übrigen Bestimmungen, die dem Aussteller vor Messebeginn zugehen, anerkannt.

In der Anmeldung enthaltene Vorbehalte und Bedin-gungen sind nicht rechtsverbindlich.

Der Anmeldetermin ist der 15. November 2019.

Aussteller der ACHEMA 2018, deren Anmeldung bis zum 15. November 2019 bei der DECHEMA einge-gangen ist, werden bei der Standvergabe bevorzugt berücksichtigt. Später eingehende Anmeldungen werden dem Eingangsdatum und der zur Verfügung stehenden Fläche entsprechend bearbeitet. Beson-dere Platzierungswünsche oder ein Konkurrenzaus-schluss werden nach Möglichkeit berücksichtigt, stellen aber keine Bedingung für eine Teilnahme dar.

Die Annahme der Anmeldung des Ausstellers erfolgt durch die Anforderung des 1. Teilbetrags der Standmie-te. Mit der Ausstellung dieser Rechnung ist der Vertrag zwischen der DECHEMA und dem Aussteller rechtsver-bindlich zustande gekommen. Die Annahme der Anmel-dung setzt voraus, dass die Aktivitäten des Ausstellers dem Ausstellungsprofil gemäß Punkt 3 zuzuordnen sind. Die DECHEMA entscheidet hierüber nach pflicht-

5. Application, Approval, Stand AllocationOn returning the completed and signed “Application” form or by submitting the online form (www.achema.de/application-exhibitors), the exhibitor is legally committed to participate at ACHEMA 2021.

With the application, the General Conditions of Participation, the Technical Regulations and all other provisions received by the exhibitor prior to the event are recognised.

Any and all reservations and conditions contained in the application shall not be legally binding.

Application date is 15 November 2019.

Exhibitors at ACHEMA 2018, whose applications are received at DECHEMA by 15 November 2019, will be given preferential consideration when stands are allocated. Applications received after this date will be processed according to the date of receipt and the area available. Special placement requests or an exclusion of competition will be considered as far as possible, but do not constitute a condition for participation.

Approval of the exhibitor’s application by DECHEMA takes the form of the request for payment of the first instalment of the stand rent. The contract between DECHEMA and the exhibitor becomes legally binding when the first instalment is invoiced. A prerequisite for approval is that the activities of the exhibitor conform to the profile of the exhibition, as specified in item 3. DECHEMA reserves the right, at its sole

gemäßem Ermessen. Ein Rechtsanspruch des Ausstel-lers auf Zulassung zur ACHEMA 2021 besteht nicht. Die Bereitstellung der Stände erfolgt nach ausstel-lungstechnischen Gesichtspunkten. Ein Anspruch des Ausstellers auf eine bestimmte Lage, Größe oder herausgehobene Sichtbarkeit besteht nicht. Die Standvergabe setzt voraus, dass alle offenen und fälligen Forderungen der DECHEMA gegenüber dem Aussteller vollständig erfüllt sind. Eine trotz offener fälliger Forderungen erfolgte Standvergabe steht unter der Bedingung, dass diese Forderungen unver-züglich erfüllt werden. Im Falle der nicht sofortigen Erfüllung der offenen Forderungen ist die DECHEMA jederzeit zum Rücktritt vom Vertrag berechtigt. Die Nutzung der Standfläche durch mehrere Unterneh-men ist nur zulässig, wenn alle dort vertretenen Unternehmen neben dem Hauptaussteller, mit dem der Vertrag abgeschlossen wird, zusätzlich als Mitaussteller der DECHEMA gemeldet und von ihr zugelassen worden sind (s. Punkt 7). Die DECHEMA behält sich in begründeten Ausnah-mefällen vor, auch nach erfolgter Standvergabe dem Aussteller einen anderen Stand zuzuweisen, die Größe oder Art der Standfläche zu ändern, Ein- und Ausgänge zu verlegen oder zu schließen oder sonsti-ge bauliche Veränderungen vorzunehmen. Auch bei erheblichen Abweichungen der Standvergabe gegen-über den in der Anmeldung geäußerten Wünschen wird diese entsprechend den Teilnahmebedingungen verbindlich, wenn zwei Wochen nach dem Datum der Standvergabe kein schriftlicher Einspruch des Ausstellers bei der DECHEMA vorliegt. Der Einspruch muss darlegen, warum durch die Standvergabe die Belange des Ausstellers unzumutbar beeinträchtigt werden. Abweichungen in der Standbereitstellung oder Standänderungen begründen - unbeschadet des Rücktrittsrechts des Ausstellers gemäß Punkt 13 - keine Schadensersatzansprüche oder sonstigen Ansprüche gegen die DECHEMA.

discretion, to approve exhibitors. The exhibitor has no legal claim to acceptance for ACHEMA 2021.Stands will be allocated on the basis of the techni-cal requirements of the exhibition. The exhibitor has no right to a certain size, location or to prominent visibility. The prerequisite for stand allocation is that all due accounts receivable of DECHEMA have been met in full by the exhibitor. When a stand is allocated although accounts receivable have not been met, it is on condition that these be fulfilled without delay. If the accounts receivable are not met immediately, DECHEMA is entitled to cancel the contract at any time. Use of the stand space by several companies is only permissible if, besides the main exhibitor with whom the contract is concluded, all companies rep-resented have been registered as co-exhibitors and have been approved by DECHEMA (see item 7).

In justified exceptional cases, DECHEMA reserves the right, even after the stand has been allocated, to assign another stand to the exhibitor, to change the size or type of stand area, to relocate or close entrances and exits or to undertake other structural changes. Even if the stand allocation considerably deviates from the wishes expressed by the exhibi-tor in the application, the stand allocation shall be binding, commensurate with the General Conditions of Participation, if DECHEMA receives no written objection from the exhibitor within two weeks of the date of stand allocation. The objection must explain why the interests of the exhibitor are unreasonably impaired by the stand allocation. Notwithstanding the exhibitor’s right to cancellation, as specified in item 13, changes in stand allocation or changes to the stands themselves do not represent a basis for claims for compensation or other claims against DECHEMA.

6. Stand Rent, Conditions of Payment, Research Contribution

Bruchteile von Quadratmetern werden ab 0,5 m² auf-gerundet, unter 0,5 m² abgerundet. Säulen werden bei der Flächenberechnung abgezogen. Die Mindeststand-größe beträgt 12 m².

Nebenkosten und Standbau sind nicht in der Stand-miete enthalten. Die für die Veranstaltung gültigen Preise der Nebenkosten und Zusatzleistungen werden zu einem späteren Zeitpunkt im Ausstellerportal der ACHEMA aufgeführt und können dort bestellt werden.

Ab Oktober 2020 finden Sie in unserem Online- Bestellportal diverse Standbauoptionen vom All- inclusive-Paket bis zu individuellen Varianten.

Die Standmiete und alle sonstigen Entgelte werden in Euro berechnet und sind Nettopreise, d.h. ohne Umsatzsteuer und/oder andere Verbrauchs- bzw. Dienstleistungssteuern (s. hierzu auch Punkt 10).

Als Zahlungsziel werden 14 Tage nach Rechnungs-stellung vereinbart. Die Rechnungsstellung erfolgt auf elektronischem Weg in Form einer PDF-Datei. Der Aussteller erkennt dieses Prozedere an und benennt im Zusammenhang mit der Anmeldung eine für die elektronische Rechnungsstellung geeignete E-Mail-Adresse.

Alle Beträge sind auf eines der Konten der DECHEMA einzuzahlen, die auf der Rechnung aufgeführt sind. Bei Fremdwährungszahlungen gehen eventuell ent-stehende Kursdifferenzen und Kosten zu Lasten des Ausstellers. Gerät der Aussteller mit der Zahlung in Verzug, so ist die DECHEMA berechtigt, als pauscha-lierten Verzugsschaden Verzugszinsen in Höhe von 2 % über dem jeweiligen Basiszinssatz der Europä-ischen Zentralbank in Rechnung zu stellen. Befindet sich der Aussteller mit der Zahlung länger als 14 Tage im Rückstand, so ist die DECHEMA berechtigt, über die vom Aussteller angemietete Standfläche zu verfügen,

Fractions of square metres from 0.5 m² upwards will be rounded up, if below 0.5 m² they will be rounded down. Pillars are deducted from the area calculation. The minimum stand size is 12 m².

Service costs and stand construction are not included in the stand rent. Effective rates for additional costs and extra services will be listed and can be ordered in the ACHEMA exhibitor portal at a later point in time.

From October 2020 you will find various stand con-struction options in our online ordering portal, rang-ing from all-inclusive-packages to individual variants.

The stand rent and all other charges are calculated in Euro and are net prices, i.e. without value added tax and/or other consumption or service taxes (see also item 10).

Term of payment is within 14 days after receipt of invoice. The invoice will be dispatched electronically as PDF file. The exhibitor accepts this procedure and indicates an appropriate e-mail address for the elec-tronic invoicing in his application.

All amounts are to be paid into one of DECHEMA’s accounts listed on the invoice. In the case of foreign currency payments, any arising exchange rate differ-ences or costs shall be borne by the exhibitor. If the exhibitor is in default with payment, DECHEMA shall be entitled to request default interests as a lump sum compensation for damages caused by delayed pay-ment. Default interests are 2 % above the respective base rate of the European Central Bank. If the exhibi-tor is more than 14 days in default with payment, DECHEMA shall be entitled to dispose of the stand space rented by the exhibitor without any need for

ohne dass es einer weiteren Mahnung bedarf. Ersatz-ansprüche des Ausstellers sind in diesem Fall ausge-schlossen. Die Geltendmachung weiterer Schadenser-satzansprüche der DECHEMA bleibt vorbehalten.

Ausstellungsobjekte und die sonstigen auf dem Stand befindlichen Gegenstände dienen als Pfand für alle Ansprüche der DECHEMA aus der Mietvereinbarung gegenüber dem Aussteller/Mitaussteller. Die DECHEMA kann, wenn die Bezahlung nicht innerhalb der gesetz-ten Frist erfolgt, die zurückgehaltenen Gegenstände nach schriftlicher Ankündigung freihändig verkaufen. Bei der Verwahrung von Pfandgegenständen haftet die DECHEMA nur für grobe Fahrlässigkeit und Vorsatz. Etwaige Kosten für die Aufbewahrung trägt der Ausstel-ler/Mitaussteller.

Mit der Anmeldung verpflichtet sich der Aussteller zur Zahlung der Standmiete in folgenden Teilbeträ-gen:

6.1 Mit der Anmeldung wird der 1. Teilbetrag fällig in Höhe von:

Nach der Standvergabe wird der verbleibende Rest-betrag in zwei weiteren Teilbeträgen fällig. Dieser Restbetrag ergibt sich aus der tatsächlich vermiete-ten Fläche einschließlich des zutreffenden Zuschla-ges abzüglich des 1. Teilbetrages.

6.2 Zum 15. September 2020 wird der 2. Teilbetrag in Höhe von 65 % des Restbetrages fällig.

6.3 Zum 15. Februar 2021 wird der 3. Teilbetrag in Höhe von 35 % des Restbetrages fällig.

6.4 In Anlehnung an die Standfläche wird für die Max-Buchner-Forschungsstiftung, die von der DECHEMA e.V. ehrenamtlich verwaltet wird, ein freiwilliger Forschungsbeitrag von € 6,50/m² erbeten, der nach der ACHEMA 2021 ohne jeden Abzug an die Stiftung abgeführt wird. Über den tatsächlich gespendeten Betrag erhält der Aussteller eine Spendenbescheini-gung.

Die Max-Buchner-Forschungsstiftung vergibt Stipen-dien zur Förderung von Forschungsvorhaben auf den satzungsgemäßen Arbeitsgebieten der DECHEMA Gesellschaft für Chemische Technik und Biotech-nologie e. V.. Sie ergänzt damit wirkungsvoll die

Exhibits and other items on the stand shall serve as security for all claims arising from the rental contract that DECHEMA asserts against the exhibitor or co-exhibitor. If payment is not made within the stipu-lated period DECHEMA is entitled, after written notifi-cation, to sell the retained items at its discretion.DECHEMA shall be liable only for gross negligence and intent in the safekeeping of pledged items. Any costs incurred for the storage shall be borne by the exhibitor or co-exhibitor.

The application commits the exhibitor to paying the following instalments of stand rent:

6.1 The first instalment is due with application in the amount of:

6.2 The second instalment, constituting 65 % of the balance, will be due on 15 September 2020.

6.3 The third instalment, constituting 35 % of the balance, will be due on 15 February 2021.

6.4 A voluntary research contribution of € 6.50/m², based on the size of the stand area, is requested on behalf of the Max Buchner Research Foundation (Max-Buchner-Forschungsstiftung), which is admin-istered in an honorary capacity by DECHEMA e.V.; after ACHEMA 2021 it will be paid into the Founda-tion without deductions of any kind. The exhibitor will receive a certificate of charitable donation of the exact amount he has contributed.

7. MitausstellerUnternehmen, die auf der vom Hauptaussteller ge-mieteten Fläche neben diesem mit eigenem Personal und/oder Ausstellungsgut vertreten sind, sind als Mitaussteller anzumelden. Die Zulassung von Mit-ausstellern richtet sich ebenfalls nach den Kriterien dieser Teilnahmebedingungen. Eine andere – auch nur teilweise – Gebrauchsüberlassung der Standflä-che an Dritte ist unzulässig. (s. Formular „Anmeldung für Mitaussteller“).

Die Teilnahmegebühr für jeden Mitaussteller beträgt € 975,00.

Aussteller und Mitaussteller haften für die Gebühr gemeinsam und gesamtschuldnerisch. Neben zwei kostenfreien Ausstellerausweisen erhält der Mitaus-steller die gleichen Leistungen wie der Hauptausstel-ler, mit Ausnahme des Punktes 12 a). Zur Zulassung eines Mitausstellers ist die schriftliche Zustimmung der DECHEMA erforderlich (Mitausstellerbestäti-gung). Im Übrigen gelten auch für die Mitaussteller diese Teilnahmebedingungen, soweit sie Anwendung finden können.

8. BesucherwerbungJeder Aussteller erhält Zugang zu beliebig vielen Tages-Gastkarten, wofür eine nach Standgröße gestaf-felte obligatorische Pauschale gemäß nachfolgender Tabelle zu entrichten ist.

7. Co-exhibitorsAn application as a co-exhibitor is to be made by companies who are represented with their own staff and/or exhibits on the stand space rented by the main exhibitor. The approval of co-exhibitors is also based on the criteria of these General Conditions of Participation. Any other – even if only partial – transfer of use of the stand space to third parties is prohibited (see form “Application for Co-exhibitors”).

The admission fee for each co-exhibitor is € 975.00.

Exhibitors and co-exhibitors shall be jointly and severally liable for the fee. In addition to two free exhibitor passes, the co-exhibitor shall, with the exception of item 12 a), benefit from the same services as the main exhibitor. The written authorisa-tion of DECHEMA is required for a co-exhibitor (co-exhibitor confirmation). Moreover, where applicable, these General Conditions of Participation shall apply equally to co-exhibitors.

8. Visitor AcquisitionEach exhibitor has access to an optional number of day tickets for guests calculated according to a graduated, mandatory flat-rate charge by stand size according to the following scale.

Dazu wird jedem Aussteller ein obligatorisches Me-dienpaket zur Verfügung gestellt, das eine ziel- und plattformgerechte Darstellung des Unternehmens und seiner Produkte ermöglicht. Das Medienpaket umfasst:

• die Kontaktdaten des Ausstellers (einschl. Halle/Stand-Angabe)

• ein Kurzprofil zum Unternehmen (200 Zeichen, Deutsch/Englisch)

• Firmenlogo und Hyperlink zur Firmenhomepage • einen ausführlichen Produkteintrag

(500 Zeichen, Englisch mit 1 Produktabbildung)• die Eintragung unter einer Ausstellungsgruppe

Der Katalog enthält die Kontaktdaten des Ausstellers, das Firmenlogo und das Kurzprofil zum Unternehmen. Die ACHEMA App bietet mit Angaben zu Ausstellungs-gruppe und Produkt-/Themenkategorien zusätzliche Selektionskriterien. Firmenlogo und ausführliche Produktpräsentationen können gegen Aufpreis hinzugebucht werden. Das Compass-Besucherinfor-mationssystem gibt Auskunft über die Kontaktdaten des Ausstellers, die Ausstellungsgruppe und die Produkt-/Themenkategorien, um die Besucher gezielt zu den gewünschten Anbietern und Ihren Ausstel-lungsständen zu führen. Auf ACHEMA Online werden alle Inhalte des Medienpakets publiziert.

Die Berechnung des Medienpakets erfolgt pauschal. Danach wird für alle Aussteller eine Medienpauschale in Höhe von € 355,00 berechnet. Für Mitaussteller beträgt die Medienpauschale € 180,00. Das Fällig-keitsdatum ist der 15. Februar 2021. Aussteller, deren

Every exhibitor is provided with a mandatory media package, enabling a targeted and platform oriented presentation of the company and products.The media package includes:

• contact details of the exhibitor (including hall/stand number)

• a short company profile (200 text characters, English/German)

• a company logo and hyperlink to the company homepage

• a detailed product information (500 text characters in English with 1 illustration)

• the listing under one exhibition group and up to 5 product-/topic categories from the ACHEMA keyword index

The catalogue lists the contact details of the exhibitor, the company logo and the short company profile. The ACHEMA App offers additional selection criteria with information on the exhibition groups and product-/topic categories. For the app, a com-pany logo and detailed product presentation can be purchased against surcharge. The COMPASS visitor information system provides information on the contact details of the exhibitor, the exhibition group and product-/topic categories, guiding visitors directly to the required exhibitors and stands. In ACHEMA online, the complete content of the media package is published.

The media package is charged at a flat-rate of € 355.00 for every exhibitor. The co-exhibitor rate for the media package is € 180.00. The due date is 15 February 2021. Exhibitors that have not submit-ted their publication orders until the deadline will

Über den mit der Medienpauschale abgedeckten Ausstellereintrag hinaus können zusätzliche Einträge und individuelle Präsentationen gegen Berechnung bestellt werden. Details und Preise sind dem ACHEMA-Ausstellerportal (www.achema.de/ausstellerportal) zu entnehmen, über das alle Publikationseinträge einzureichen sind.

Die DECHEMA hat das Recht, die vom Aussteller erhobenen personen- und unternehmensbezogenen Daten zum Zweck der Eintragungen in die ACHEMA-Publikationen an die mit ihr verbundenen Unterneh-men und ihre bzw. deren Dienstleister weiterzugeben. Ferner dürfen die Daten gespeichert und ggf. bei einer erneuten Ausstellung weiter genutzt werden. Der Aussteller erklärt sich damit einverstanden, dass er aufgrund eines Eintrags in den genannten Publika-tionen und digitalen Medien über diese Systeme oder via E-Mail Anfragen von Dritten erhalten kann.

Die vom Aussteller übermittelten Inhalte dürfen nicht gegen geltendes Recht verstoßen und die Rechte Dritter nicht verletzen. In diesem Zusammenhang ist insbesondere zu beachten, dass dem Aussteller für alle übermittelten Texte, Bilder, Marken- und Kennzeichen die entsprechenden Nutzungsrechte vorliegen. Die Einhaltung von Marken-, Nutzungs- und Persönlichkeitsrechten obliegt dem Aussteller. Der Aussteller stellt die DECHEMA und mit ihr verbundene Unternehmen von sämtlichen Ansprüchen Dritter frei, die im Zusammenhang mit der Rechtswidrigkeit seiner Angaben und/oder Materialien erhoben werden. Die DECHEMA prüft die vom Aussteller bereitgestell-ten Inhalte nicht auf ihre Rechtmäßigkeit. Wird die DECHEMA von einer möglichen Rechtsverletzung des Ausstellers im Rahmen seines Auftritts in den Medien der DECHEMA in Kenntnis gesetzt, kommt sie ihren entsprechenden Prüfpflichten nach. Wenn die DECHEMA nach juristischer Prüfung der Sach- und Rechtslage zu dem Ergebnis gelangt, dass eine Rechts-verletzung vorliegt, ist sie berechtigt, einzelne Inhalte oder den gesamten Eintrag des Ausstellers in den betroffenen Medien zu sperren. Eine Preisreduzierung oder Kostenerstattung wird dadurch nicht begründet, Schadensersatzansprüche sind ausgeschlossen. Die Kosten für die Prüfung hat der Aussteller zu tragen. Gleiches gilt, wenn die DECHEMA durch eine gericht-liche Entscheidung von einer Rechtsverletzung in den Angaben oder Materialien des Ausstellers in Kenntnis gesetzt wird. Kommt ein Gericht nachfolgend zu einem

DECHEMA is entitled to forward personal and company data collected from the exhibitor for the purpose of entries in the ACHEMA-publications to its affiliated companies and its or their service provid-ers. Furthermore, this data may be stored and, if necessary, further used for a new event.The exhibitor hereby consents to receiving requests from third parties on the basis of an entry in the mentioned publications and digital media via these systems or by e-mail.

The information and materials submitted by the exhibitor must not breach applicable law and must not infringe upon third party rights. In this con-text, special care must be taken to ensure that the exhibitor holds the corresponding usage rights for all texts, pictures, brand and trademarks. The observance of trademark rights, rights of use and privacy/personal rights lay with the exhibitor. The exhibitor shall indemnify DECHEMA and its affiliated companies against all third party claims that may be asserted against these in connection with the illegality of his information and/or materials.

DECHEMA does not verify the exhibitor’s informa-tion and materials in regard to their legality. If DECHEMA is informed of a possible rights infringe-ment of an exhibitor within his appearance in the DECHEMA media it will fulfil its verification obligations. If, following legal examination of the factual and legal situation, DECHEMA comes to the conclusion that a rights infringement does exist, it is entitled to block parts or the whole entry of the exhibitor in the respective media. This shall not provide grounds for a price reduction or reimburse-ment of costs; claims for damages are excluded. Costs for verification will be charged to the exhibi-tor. The same shall apply if DECHEMA is informed through a court decision of a rights infringement in the exhibitor’s information or materials. If a court subsequently comes to a different conclusion than that of DECHEMA within the context of its verifica-tion obligations, or if a court decision regarding a rights infringement by the exhibitor is overturned by

anderen Ergebnis als die DECHEMA im Rahmen ihrer Prüfpflicht oder wird eine gerichtliche Entscheidung bezüglich einer Rechtsverletzung des Ausstellers durch eine spätere gerichtliche Entscheidung aufge-hoben, so steht dem Aussteller gegenüber der DECHEMA ebenfalls kein Anspruch auf Preisreduzie-rung, Kostenerstattung oder Schadensersatz zu.

10. Steuerliche BelangeDie Standmiete und alle sonstigen Entgelte werden in Euro berechnet und sind Nettopreise, d.h. ohne Umsatzsteuer und/oder andere Verbrauchs- bzw. Dienstleistungssteuern. Sofern solche Steuern durch die Leistungen ausgelöst werden, sind diese zusätz-lich zum vereinbarten Preis fällig. Der Aussteller ist nicht berechtigt, Zahlungen an die DECHEMA um gegenwärtige oder künftige Steuern (inkl. möglicher Quellensteuer), Abgaben und/oder Gebühren zu kür-zen. Wenn und soweit der Aussteller gesetzlich zum Einbehalt und zur Abführung solcher Abgaben im Namen der DECHEMA verpflichtet ist, so geht dieser Einbehalt zu Lasten des Ausstellers. Der Aussteller stellt die zum Fälligkeitstag vertraglich vereinbarte Zahlung der Standmiete und sonstiger Preise sicher und führt die ggf. geforderten Abgaben auf eigene Rechnung im Namen der DECHEMA in der gesetzlich vorgeschriebenen Frist an die anfordernde Behörde ab.

In der Regel liefert die DECHEMA Ausstellern eine einheitliche, sogenannte Veranstalterleistung gemäß Art 3a 4 Absatz 2 des UStAE. Der steuerlich relevante Ort dieser Leistungen entspricht dann der Adresse des Leistungsempfängers. DECHEMA Ausstellungs-GmbH wird daher ausländischen Ausstellern gemäß dem Reverse-Charge-Mechanismus keine USt be-rechnen. Um als Unternehmer angesehen zu werden, haben Aussteller der EU ihre gültige USt-ID-Nr. im Anmeldeformular anzugeben. Jede Änderung der USt-ID-Nr. hat der Aussteller der DECHEMA unverzüg-lich mitzuteilen.

Gemäß Artikel 3a 2, Absatz 11 des UStAE haben Leistungsempfänger aus Drittstaaten (nicht EU) mit einem Dokument einer Behörde zu bescheinigen, dass das Unternehmen dort als Unternehmen erfasst und umsatzsteuerlich registriert ist.

Die vom Aussteller anzugebene USt-ID-Nr. (für An-melder aus der EU) bzw. der Nachweis der Unterneh-merbescheinigung (für Aussteller aus Nicht-EU-Län-dern) dient der umsatzsteuerlichen Zuordnung des Ausstellers. Der Aussteller versichert die Richtigkeit bzw. Gültigkeit der USt-ID-Nr. bzw. der Unterneh-merbescheinigung und die Zuordnung zu seinem unternehmerischen Bereich. Er ist verpflichtet, evtl. Änderungen diesbezüglich der DECHEMA unverzüg-

10. Tax IssuesThe stand rent and all other charges are invoiced in Euro and are net prices, i.e. without value added tax and/or other consumption or service taxes. Insofar as such taxes are triggered by the services, they shall be payable in addition to the agreed price. The exhibitor shall not be entitled to reduce payments to DECHEMA by current or future taxes (including any withholding tax), levies and/or fees. If and to the extent that the exhibitor is legally obliged to withhold and pay such taxes on behalf of DECHEMA, such withholding shall be borne by the exhibitor. The exhibitor shall ensure the contractually agreed payment of the stand rent and other charges on the due date and shall pay to the requesting authority, on DECHEMA’s behalf and within the period prescribed by law, any fees charged on his own account.

Generally, DECHEMA provides exhibitors with a uni-form service – a so-called event-service – in accord-ance with Art. 3a 4, Par.(2) of the German ordinance on the application of the VAT (UStAE). The tax-rele-vant location of these services then corresponds to the address of the service recipient. DECHEMA will therefore invoice foreign exhibitors according to the reverse charge accounting mechanism without charg-ing any German VAT. Exhibitors from the European Union need to enter their valid VAT identification number in the application form in order to be con-sidered entrepreneurs. Exhibitors must immediately notify DECHEMA of any changes to their VAT identifi-cation numbers.

In accordance with Art. 3a.2, Par. (11) of the Ger-man ordinance on the application of the VAT (UStAE) foreign exhibitors from third countries (not EU) have to present a certificate of entrepreneurial status which confirms the VAT registration in their country of residence.

The VAT ID number to be stated by the exhibitor (for exhibitors applying from the EU) or verification of the entrepreneur certificate (for exhibitors from non-EU-countries) is necessary for purposes of VAT classification of the exhibitor. The exhibitor provides assurance that the VAT ID number or the entrepre-neur certificate along with the classification for his corporate sector is correct and valid. He is obliged to immediately inform DECHEMA of any changes

lich mitzuteilen. Die USt-ID-Nr. bzw. Unternehmer-bescheinigung verwendet der Aussteller für seine Teilnahme an der ACHEMA; sie kommt auch für alle weiteren Geschäfte zwischen dem Aussteller und der DECHEMA zu Anwendung.

Im Falle einer Umfirmierung oder einer Änderung der Unternehmensform tritt der Rechtsnachfolger für alle Verbindlichkeiten gegenüber der DECHEMA rechtskräftig ein und wird somit Vertragspartner und Leistungsempfänger. Der Rechtsnachfolger ist verpflichtet, der DECHEMA die neue Steuernummer bzw. USt-ID-Nr. unverzüglich mitzuteilen.

11. Annahmeverpflichtung/ BetriebspflichtDer Aussteller ist verpflichtet, den Stand während der Vertragsdauer entsprechend den Teilnahmebe-dingungen zu nutzen und während der Öffnungszei-ten der Veranstaltung ständig personell ausreichend besetzt zu halten.

Der Abtransport von Ausstellungsgütern und der Abbau von Ständen vor Schluss der Veranstaltung sind nicht gestattet. Bei Zuwiderhandlung ist die DECHEMA berechtigt, eine Vertragsstrafe von bis zu € 5.000,00 zu fordern. Ggf. entstehen zusätzliche Kosten für die Instandsetzung der Standfläche, um umliegenden Ausstellern eine störungslose Veran-staltungsteilnahme zu ermöglichen.

12. Leistungen der DECHEMADie Standmiete beinhaltet folgende Leistungen der DECHEMA:a) Überlassung der angemieteten Fläche

13. Rücktritt vom VertragsverhältnisEin Rücktritt vom Vertrag ist bis zum 31. Januar 2020 ohne Angabe von Gründen möglich, wobei der bereits gezahlte 1. Teilbetrag der Standmiete rückerstattet wird. Tritt ein Aussteller zu einem späteren Zeitpunkt von dem Vertrag zurück, so ist die DECHEMA berechtigt, von dem Aussteller einen pau-schalierten Schadensersatz zu fordern. Die Höhe des Schadensersatzes richtet sich nach dem Zeitpunkt

in this respect. The VAT ID number or entrepreneur certificate is used by the exhibitor for participation at ACHEMA and for all other businesses and transac-tions between the exhibitor and DECHEMA.

In case of a change of name or of the legal form of the company, the legal successor shall legally bear all liabilities existing against DECHEMA and shall thus become the contractual partner and the beneficiary of the services. The legal successor is obliged to inform DECHEMA of the new tax number or VAT ID number.

11. Obligations of Acceptance and OperationFor the duration of the contract, the exhibitor is obliged to use the stand in accordance with the General Conditions of Participation and to ensure that sufficient personnel is on the stand during the opening hours of the event.

The dismantling of stands or exhibits before the end of the exhibition is prohibited. In case of a violation DECHEMA is authorised to inflict a contract penalty up to € 5,000.00. Additional costs may arise for maintenance of the stand space to guarantee an undisturbed event participation for the surrounding exhibitors.

12. Services to be provided by DECHEMAThe stand rent comprises the following services by DECHEMA:a) Provision of the rented area for exhibition

13. Cancellation of ContractThe contract may be cancelled without specifying the reason prior to 31 January 2020; in this case payment already made of the first instalment of the stand rent will be refunded. If an exhibitor cancels the contract at a later date, DECHEMA shall be entitled to demand a lump sum compensation from the exhibitor. The amount of damages claimed shall be determined by the date of the cancellation and amounts to:

Dem Aussteller bleibt die Möglichkeit nachzu-weisen, dass der DECHEMA kein Schaden oder nur ein Schaden entstanden ist, der niedriger ist als die Pauschalen.

Tritt ein angemeldeter Mitaussteller zurück, verfällt die Teilnahmegebühr.

The same applies to a reduction in stand space and to cases where DECHEMA cancels the contract as a result of a default of payment by the exhibitor. The decisive criterion is the date of receipt at DECHEMA of the declaration of cancellation or the date on which the exhibitor falls into arrears, respec-tively. It is the responsibility of the exhibitor to prove that DECHEMA has incurred either no loss or only a loss which is less than the liquidated damages.

Should a co-exhibitor cancel his participation, the admission fee shall be forfeited.

15. Standgestaltung Die Gesamtgestaltung des Ausstellungsgeländes erfolgt durch die DECHEMA.

Die Gestaltung der einzelnen Ausstellungsstände liegt in der Verantwortung der Aussteller. Bei der Gestaltung und dem Aufbau des Standes sind die technischen Richtlinien, die geltenden Gesetze, Sicherheitsvorschriften und behördlichen Bestim-mungen zu beachten.

Die maximale Standbauhöhe beträgt 8,00 m. Für Stände bis zu einer Standfläche von 30 m² beträgt die maximal mögliche Standbauhöhe 4,00 m. Bedingt durch die Hallenhöhe kann die maximal mögliche Standbauhöhe verringert sein (vgl. Anga-ben in den Hallenplänen in diesem Heft und in den Technischen Richtlinien). Zweigeschossige Bauweise ist nur in Hallen mit einer erlaubten Standbauhöhe ab 6,00 m möglich.Nähere Informationen sind in den Technischen Richt-linien enthalten, die unter www.achema.de/technischerichtlinien als Download zur Verfügung stehen und Bestandteil der Allgemeinen Teilnahmebedingungen sind.

16. ACHEMA-AusstellerportalAussteller haben die Möglichkeit, über das ACHEMA-Ausstellerportal Serviceleistungen online zu bestellen.

Der Zugang zum Online-Portal erfolgt mittels einer von der DECHEMA ausgegebenen Online-Benutzer-kennung, welche dem Aussteller mit der Standbestä-tigung zugesandt wird. Die DECHEMA haftet nicht für Schäden, die auf eine missbräuchliche Verwendung dieser Benutzerkennung oder des vom Ausstel-ler bzw. Mitaussteller zu wählenden Passwortes zurückzuführen sind. Die auf elektronischem Wege übermittelte Bestellung gilt dann als zugegangen, wenn sie auf dem Server der DECHEMA eintrifft. Der Aussteller erhält dann eine Bestätigung seiner Bestellung per E-Mail. Die DECHEMA haftet ebenfalls nicht für Schäden, die durch technische Störungen und durch höhere Gewalt entstehen.

17. Benutzung des ACHEMA-ZeichensDas Bildzeichen „Erlenmeyerkolben mit Zahnrad“ und das Wortzeichen „ACHEMA“ sind der DECHEMA im In- und Ausland geschützte Zeichen, die nur mit deren Genehmigung benutzt werden dürfen.

18. Haftung und VersicherungDie DECHEMA hat eine Haftpflichtversicherung mit angemessenen Deckungssummen für ihre gesetz-liche Haftung. Es gelten die Allgemeinen Versiche-rungsbedingungen für Haftpflichtversicherungen

15. Stand DesignDECHEMA is responsible for the overall design of the exhibition grounds.

The design of the individual exhibition stands is the responsibility of the exhibitors. Stand design and construction are subject to the Technical Regula-tions, applicable laws, safety provisions and official regulations.

The maximum stand construction height is 8.00 m. For stands with a stand space of up to 30 m² the maximum stand construction height is 4.00 m. Due to the ceiling height in some halls the maximum possible stand construction height can be reduced (cf. details given on the floor plans in this brochure and in the Technical Regulations). Two-storey stands are only possible in halls with a permissible stand construction height of at least 6.00 m.Detailed information is contained in the Technical Regulations which are part of the General Conditions of Participation and can be downloaded at www.achema.de/technicalregulations.

16. ACHEMA Exhibitor PortalExhibitors have the option of placing orders for services online via the ACHEMA exhibitor portal.

Access to the online portal is provided by means of a user ID issued by DECHEMA which will be sent to the exhibitor with the stand confirmation. DECHEMA shall not be liable for damages attributable to mis-use of this user ID or of the password to be selected by the exhibitor or co-exhibitor, respectively. Orders transmitted by electronic means shall be deemed to have been received when arriving on the server of DECHEMA. The exhibitor will receive an electronic acknowledgement of the order. DECHEMA is not liable for damages caused by technical errors or force majeure.

17. Use of the ACHEMA SymbolThe “conical flask with cogwheel” logo, and the “ACHEMA” logotype have been legally registered worldwide for DECHEMA and may only be used with DECHEMA’s authorisation.

18. Liability and InsuranceDECHEMA has adequate insurance cover for its statu-tory liability. The General Insurance Conditions for Liability Insurances (AHB) shall apply. The liability insurance covers only those damages and injuries

(AHB). Die Haftpflichtversicherung deckt ausschließ-lich Schäden Dritten gegenüber. Ferner erstreckt sich der Versicherungsschutz nicht auf Messegaststätten und Sonderveranstaltungen, die nicht von der DE-CHEMA durchgeführt werden.

Der Aussteller hat wegen seiner eigenen Haftung für einen ausreichenden Versicherungsschutz zu sorgen. Wenn der Aussteller im Rahmen seiner be-trieblichen Versicherung keinen Versicherungsschutz für diese Ausstellungsbeteiligung besitzt, kann er auf seine Kosten über das Online-Bestell-Portal das entsprechende Formular herunterladen.

Der Aussteller haftet für alle Schäden, die er, seine Mitarbeiter, seine Beauftragten oder seine Hilfskräf-te im Rahmen der ACHEMA 2021 der DECHEMA oder anderen zufügen, einschließlich der Schäden an Gebäuden und Ausstellungseinrichtungen.

Wird die DECHEMA von Dritten wegen vom Aussteller verursachter Schäden in Anspruch genommen, so wird der Aussteller die DECHEMA von diesen Ansprü-chen freistellen. Dies gilt insbesondere im Falle der behaupteten Verletzung von gewerblichen Schutz-rechten (vgl. Punkt 19).

Die DECHEMA haftet gegenüber dem Aussteller nur für Schäden, die infolge grober Fahrlässigkeit oder Vorsatz ihrer Organe oder Mitarbeiter entstanden sind. Ausgeschlossen ist insbesondere eine Haftung für Schäden, die durch Feuer, Wasser, Explosion, Unwetter oder andere Formen höherer Gewalt oder durch Gewaltanschläge, Diebstahl, Einbruch, Versa-gen der Versorgungsanlagen (wie Strom, Gas, Was-ser) und ähnliche Ursachen eintreten, sofern sie nicht auf grobe Fahrlässigkeit oder Vorsatz der DECHEMA, ihrer Organe oder Mitarbeiter zurückzuführen sind. Dies gilt auch für Schäden, die durch Publikumsver-kehr (insbesondere durch Veranstaltungsbesucher, andere Aussteller, deren Beauftragte usw.) verursacht werden.

Soweit die Haftung der DECHEMA dem Grunde nach gegeben ist, beschränkt sich die Haftung der Höhe nach gegenüber Ausstellern, die Kaufleute sind, auf typischerweise im Messe- und Ausstellungsgeschäft eintretende Schäden. Schadensersatzansprüche ge-genüber der DECHEMA wegen fehlerhafter oder nicht erfolgter Eintragungen in die ACHEMA-Publikationen sind grundsätzlich ausgeschlossen. Die DECHEMA haftet nicht für die inhaltliche Richtigkeit von Einträ-gen und Übersetzungen. Soweit die DECHEMA dem Grunde nach auf Schadensersatz haftet, ist diese Haftung auf Schäden begrenzt, die die DECHEMA bei Vertragsschluss als mögliche Folge einer Vertrags-verletzung vorausgesehen hat oder unter Berück-

The exhibitor is responsible for providing sufficient insurance cover for his own liability. If the exhibitor has no insurance cover for exhibition participation via his company insurance, the exhibitor may at his own cost obtain cover for liability insurance by down-loading the corresponding form through the ACHEMA exhibitor portal.

The exhibitor shall be liable for any and all damages that he, his employees, his agents or his helpers cause to DECHEMA or to others during ACHEMA 2021; this includes damage to buildings and exhibition facilities.

If a claim is made by a third party against DECHEMA as a result of damage caused by the exhibitor, the exhibitor shall indemnify DECHEMA against these claims. This especially applies in the case of a claimed violation of commercial property rights (cf. item 19).

DECHEMA shall be liable to the exhibitor solely for damages that arise from gross negligence or intent on the part of its agencies or employees. One particular exclusion from liability is that of dam-age resulting from fire, water, explosions, storms or other acts of God, or from violent assault, theft, breaking and entering, failure of supply systems (such as electricity, gas, water) and similar causes, provided they are not attributable to the gross negligence or intent of DECHEMA, its agencies or employees. This also applies to damage caused by the public (in particular by visitors to the event, other exhibitors, their agents, etc.).

Insofar as there is liability on the merits on the part of DECHEMA, the liability in terms of the amount towards exhibitors who are engaged in commerce shall be limited to types of damage that are typical of the trade fair and exhibition business. Claims for damages against DECHEMA for inaccurate entries or for failure to include an entry in the ACHEMA publica-tions shall, on principle, be excluded. DECHEMA shall not be liable for the accuracy of entries and translations. Insofar that DECHEMA is liable for dam-ages on the merits, this liability shall be limited to damages which DECHEMA has foreseen at the time of concluding the contract as a possible conse-quence of a breach of contract or, having regard to the circumstances that were known to DECHEMA or should have been known to DECHEMA, with all due diligence should have foreseen. sichtigung der Umstände, die ihr bekannt waren oder die sie hätte kennen müssen, bei Anwendung verkehrsüblicher Sorgfalt hätte voraussehen müs-sen. Mittelbare Schäden und Folgeschäden, die Fol-ge von Vertragsverletzungen seitens der DECHEMA sind, sind außerdem nur ersatzfähig, soweit solche Schäden typischerweise zu erwarten sind.

19. Patente, Urheber- und sonstige Schutzrechte Gegenüber Ausstellern haftet die DECHEMA nicht für die Verletzung von Patenten, Urheberrechten und anderen gewerblichen Schutzrechten durch Dritte im Zusammenhang mit der Durchführung der ACHEMA 2021. Der Aussteller wird die DECHEMA von allen An-sprüchen freistellen, die Dritte wegen einer angeb-lichen Patent-, Urheber- oder sonstigen Rechtsver-letzung des Ausstellers gegen die DECHEMA geltend machen. Die DECHEMA wird einen Patentanwalt benennen, der während der Veranstaltung bei et-waigen Rechtsverletzungen auf Wunsch eines jeden Ausstellers – und zu dessen Lasten – verfügbar sein wird.

Der Aussteller gesteht der DECHEMA das Recht zu, im Rahmen der ACHEMA 2021 Fotos, Film- und Videoauf-nahmen zu machen und zu Informationszwecken zu verwenden.

20. LeistungsvorbehalteDie DECHEMA ist berechtigt, die Veranstaltung aus wichtigem Grund (z. B. Arbeitskampf, höhere Gewalt, Gefährdung der öffentlichen Sicherheit) zu verlegen, zu kürzen, zeitweise ganz oder teilweise zu schlie-ßen oder abzusagen.

Sofern die DECHEMA wegen unvorhergesehener Ereignisse die Veranstaltung nicht durchführen kann, werden die Aussteller unverzüglich benachrichtigt. Die DECHEMA wird dem Aussteller die bis zu diesem Zeitpunkt erbrachten Leistungen sowie bei ihr in Auftrag gegebene Sonderleistungen in Höhe der entstandenen Aufwendungen in Rechnung stellen. Der Anspruch der DECHEMA auf die vereinbarte Standmiete entfällt.

Falls die DECHEMA aufgrund von Ereignissen, die außerhalb der Verfügungsmacht der DECHEMA liegen die begonnene Veranstaltung abbrechen oder verkürzen muss, hat der Aussteller keinen Anspruch auf Rückzahlung oder Erlass der Standmiete. Das Gleiche gilt, wenn die DECHEMA aus oben genannten Gründen einen oder mehrere Veranstaltungsbereiche schließen oder räumen muss.

19. Patents, Copyrights and other Property RightsDECHEMA shall not be liable to exhibitors for third-party violation of patents, copyrights and other commercial property rights in connection with the implementation of ACHEMA 2021. The exhibi-tor shall indemnify DECHEMA against all claims asserted by third parties against DECHEMA as a result of the alleged violation by the exhibitor of a patent, copyright or other rights. DECHEMA will appoint a patent lawyer for the duration of the event who, at the request of an exhibitor and at the exhib-itor’s cost, will be available in cases of violations.

The exhibitor accepts that DECHEMA has the right to take photographs and make film and video record-ings during ACHEMA 2021, and that DECHEMA may use them for information purposes.

20. ReservationsDECHEMA reserves the right to postpone, cur-tail, close temporarily or completely, or to cancel the event for cause (e.g. industrial dispute, force majeure; threat to public security).

Should DECHEMA not be able to hold the event as a result of unforeseen circumstances, the exhibitors shall be informed immediately. DECHEMA will charge the exhibitor for services provided up to this time, as well as for special services that have been ordered, in the amount of the costs incurred. DECHEMA’s claim to the agreed stand rent shall not apply.

Should DECHEMA be forced to cancel or curtail the commenced event as a result of circumstances that are outside of the control of DECHEMA, the exhibitor shall have no claim to a refund or waiver of the stand rent. The same applies if DECHEMA is forced to close or vacate one or more areas of the event.

22. Bild- und TonaufnahmenVertreter der Medien wie Rundfunk, Fernsehen, Film, Tages- und Fachpresse sowie sonstige gewerbetrei-bende Fotografen und Filmteams müssen im Besitz eines von der DECHEMA ausgestellten Ausweises sein. Der Aussteller hat das Recht, von seinem eigenen Stand oder seinen Exponaten während der Öffnungszeiten der Veranstaltung Bild- und Tonauf-nahmen anzufertigen. Die DECHEMA hat besondere Ausstellungsfotografen zugelassen, die sich durch einen offiziellen Ausweis legitimieren und berechtigt sind, Standaufnahmen im Auftrag des Ausstellers anzufertigen. Sofern der Aussteller die Aufnahmen durch einen eigenen Fotografen außerhalb der offiziellen Öffnungszeiten für Besucher anfertigen lassen will, ist die Genehmigung spätestens drei Wochen vor Veranstaltungsbeginn formlos bei der DECHEMA einzuholen unter Angabe des Termins und des beauftragten Unternehmens. Die DECHEMA hat das Recht, Bild- und Tonaufnahmen sowie Zeich-nungen von Ausstellungsständen oder einzelnen Exponaten zum Zwecke der Dokumentation oder für Eigenveröffentlichungen anzufertigen oder anferti-gen zu lassen. Dies gilt auch für dabei aufgenomme-ne Personen.

23. Betreten fremder StändeEs ist nicht gestattet, außerhalb der offiziellen tägli-chen Besuchszeit fremde Stände zu betreten. Nicht-einhaltung dieser Bestimmung zieht den Ausschluss von der ACHEMA nach sich.

24. Besucherinformation während der ACHEMADie Durchführung von Informationsmaßnahmen (z. B. das Verteilen von Prospekten oder sonsti-gen Informationen, Anbringen von Werbematerial, Einsatz von Personen als Werbeträger) außerhalb des gemieteten Standes ist nicht gestattet. Das gilt auch für Besucherbefragungen. Werbe- und Informa-tionsträger auf dem Gelände oder in unmittelbarer Umgebung werden dem Aussteller kostenpflichtig

21. Data ProtectionFor the purpose of fulfilling the contract, DECHEMA shall • record, store, process and use the necessary

personal data of the exhibitor.• transfer these data to third parties commis-

sioned with the implementation of this contract.

All details on the processing of data by DECHEMA can be found in the privacy policy at www.achema.de/privacy. By submitting the applica-tion form, the exhibitor declares that he has taken note of the above note on data processing.

22. Visual and Sound RecordingsRepresentatives of the media, such as radio, televi-sion, film, and the press as well as other commer-cial photographers and camera teams, must be in possession of DECHEMA’s official pass. The exhibitor is entitled to make visual and sound recordings of his own stand or his exhibits during the opening hours of the event. DECHEMA has authorised specific exhibition photographers, who will be identifiable by their official DECHEMA passes and who are permitted to take photographs of stands for exhibitors. If the exhibitor wishes to have photographs taken by his own photographer outside the official opening hours for visitors, a permit to do so must be applied for to DECHEMA, indicating the date and the name of the firm commissioned, at least three weeks prior to the event. DECHEMA is entitled to make or to have made on its behalf photographic and sound recordings, as well as sketches of exhibition stands or individual exhibits, for documentation purposes or for its own publications. This also applies to any persons photo-graphed under such circumstances.

23. Entering other Exhibitors’ StandsExhibitors are not permitted to enter other exhibi-tors’ stands outside the official daily visitors’ hours. Infringement of this regulation shall incur exclusion from ACHEMA.

24. Visitor Information during ACHEMA

Promotional activities (e.g. the distribution of leaflets or other information, posting of advertising material, use of persons for advertising purposes) outside the rented stand area is prohibited. The same applies to visitor surveys. Marketing measures on the exhibition grounds or in the direct surround-ing of the exhibition can be ordered at costs through the online ordering portal. Verkauf und Auslieferung von Waren, auch von Messemustern sowie von Speisen und Getränken sind auf der Veranstaltung nicht gestattet.Informations- oder Werbemaßnahmen müssen dem Zweck einer fachbezogenen Information dienen. Werbemaßnahmen, die gegen die einschlägigen gesetzlichen und Verwaltungsvorschriften, gegen be-hördliche Auflagen und Anordnungen, insbesondere der Branddirektion, gegen die Regeln der Technik oder die guten Sitten verstoßen oder weltanschauli-chen, religiösen oder politischen Charakter haben, sowie Maßnahmen, die zur Störung anderer Aus-steller führen (z. B. durch akustische oder optische Belästigungen, Staubentwicklung, Verschmutzun-gen, Besucherstauungen auf den Gängen) sind nicht zulässig. Ebenfalls nicht zulässig sind Fremdwerbung sowie Hinweise auf andere Firmen. Die DECHEMA ist berechtigt, die Ausgabe von Informationsmaterial, das zur Beanstandung Anlass geben kann oder ge-geben hat, zu untersagen und vorhandene Bestände dieses Informationsmaterials für die Dauer der Ver-anstaltung sicherzustellen. In schwerwiegenden Fäl-len von Pflichtverletzung ist die DECHEMA berechtigt, unbeschadet der Weiterhaftung des Ausstellers für die volle Standmiete, den Stand sofort zu schließen und den Aussteller von künftigen Veranstaltungen auszuschließen. Ein Schadensersatzanspruch des Ausstellers besteht nicht.

Die Aussteller können in Zusammenarbeit mit der DECHEMA-Pressestelle Pressekonferenzen nach Verfügbarkeit der vorhandenen Räumlichkeiten vereinbaren.

25. Sonstige RechtsfragenDie DECHEMA ist zur fristlosen Kündigung des Ver-tragsverhältnisses berechtigt, wenn durch Vorlage einer gerichtlichen Entscheidung nachgewiesen wird, dass der Aussteller mit der Art der Ausstel-lung, mit den Exponaten oder seinem Auftritt in den Medien der ACHEMA gegen Vorschriften des Patent-, Wettbewerbs- oder sonstigen Rechts verstößt; wenn der Aussteller trotz Aufforderung durch die DECHEMA Verstöße gegen die Teilnahmebedingun-gen nicht unverzüglich beseitigt; wenn der Aussteller nachhaltig den geordneten Ausstellungsablauf oder den Hausfrieden stört. Nach der Kündigung kann die DECHEMA den Stand des Ausstellers schließen und auf dessen Kosten abbauen lassen. Ein Anspruch des Ausstellers auf Erstattung der von ihm geleisteten Zahlungen besteht nicht.

Bestandteil des Vertrages sind die Hausordnung sowie die Technischen Richtlinien und übrigen Be-stimmungen, die dem Aussteller vor Veranstaltungs-beginn zugehen.

Market-ing measures that constitute a breach of the law, of regulatory requirements and arrangements, in par-ticular those of the fire department, of engineering rules or morality, or are of an ideological, religious or political nature as well as activities that lead to a disturbance of other exhibitors (e.g. acoustic or opti-cal disturbance, dust generation, dirt, congestion in the aisles) are not permitted within the exhibi-tion grounds. Furthermore, advertising on behalf of and attention drawn to other firms are prohibited. DECHEMA is entitled to prohibit the distribution of material which can, or has given, rise to complaint, and may confiscate stocks of such material for the duration of the exhibition. In serious violations of obligations DECHEMA is entitled to close the stand immediately, while the exhibitor is liable for payment of the full stand rent and will be excluded from fur-ther events. There is no claim for damages on behalf of the exhibitor.

In cooperation with the DECHEMA Press Centre exhibitors can hold press conferences according to availability of rooms.

25. Other Legal MattersDECHEMA is entitled to give immediate notice of termination of the contract, if presentation of a judicial decision proves that the exhibitor violates the provisions of patent, free trade or other rights as a result of the nature of his display, the exhibits or its presence in the ACHEMA media; if, despite DECHEMA’s demand, the exhibitor fails to redress violations of the General Conditions of Participation immediately; or if the exhibitor persistently disrupts the smooth running of the exhibition or the keeping of the peace. After giving notice of termination, DECHEMA may close the exhibitor’s stand and have it dismantled at the exhibitor’s cost. The exhibitor has no entitlement to a refund of any payments he has made.

The House Rules and the Technical Regulations and other provisions that the exhibitor receives before the event commences are an integral part of the contract.

Mit Anerkennung der vorliegenden Teilnahmebedin-gungen nimmt der Aussteller davon Kenntnis, dass die DECHEMA sämtliche gesetzlichen Bestimmungen hinsichtlich Arbeitszeitgesetz, Mindestlohn, Daten-schutz, Kartellrecht u.ä. einhält und verzichtet auf die Anforderung diesbezüglicher Einzelerklärungen.

26. SchlussbestimmungenAbreden, die von diesen Teilnahmebedingungen abweichen oder sie ergänzen, bedürfen zu ihrer Wirksamkeit der Schriftform. Dies gilt auch für die Aufhebung des Schriftformerfordernisses. Der Aussteller unterwirft sich während der Veranstaltung einschließlich der Auf- und Abbauzeiten auf dem gesamten Gelände dem Hausrecht der DECHEMA. Sollten eine oder mehrere Bestimmungen dieser Teilnahmebedingungen unwirksam oder nicht durchführbar sein, so wird dadurch die Gültigkeit der übrigen Bestimmungen nicht berührt. Anstelle der unwirksamen oder undurchführbaren Bestimmungen oder in Ergänzung einer lückenhaften Bestimmung soll eine angemessene, dem Sinn und Zweck dieses Vertrages entsprechende Regelung gelten.

27. GerichtsstandIm Verhältnis zu Kaufleuten, die nicht zu den in § 4 des HGB bezeichneten Gewerbetreibenden gehören, juristischen Personen des öffentlichen Rechts oder öffentlich-rechtlichen Sondervermögen oder Aus-stellern, die keinen allgemeinen Gerichtsstand im Inland haben, gilt als Erfüllungsort der Zahlung der Standmiete für alle sich aus dem Vertrag ergebenden Ansprüche Frankfurt am Main als vereinbart. Es gilt ausschließlich deutsches Recht und der deutsche Text dieser Allgemeinen Teilnahmebedingungen ACHEMA 2021 ist maßgebend.

Alle Ansprüche des Ausstellers gegen die DECHEMA sind schriftlich geltend zu machen. Sie verjähren, beginnend mit dem Ablauf des Jahres, in dem sie entstanden sind, innerhalb von 12 Monaten. Verein-barungen, die von diesen Bedingungen oder den sie ergänzenden Bestimmungen abweichen, bedürfen der Schriftform; faksimilierte Unterschriften sind ausreichend.

Gerichtsstand ist Frankfurt am Main. Der DECHEMA bleibt es jedoch vorbehalten, ihre Ansprüche bei dem Gericht des Ortes geltend zu machen, an dem der Aussteller seinen Sitz hat.

By agreeing to these Conditions of Participation the exhibitor recognises that DECHEMA meets all relevant legal provisions and regulations of the working hour act, minimum wages, data protection, anti-trust-law, and such and waives the require-ments of individual declarations.

26. Concluding ProvisionsAny and all arrangements differing from or supple-menting these General Conditions of Participation must be submitted in writing to become effective. This also applies to the rescinding of the require-ment to put them in writing. During the event, includ-ing the set-up and dismantling periods, the exhibitor is subject to DECHEMA’s domiciliary rights on the entire site. Should one or more provisions of these Conditions of Participation be invalid or impractica-ble, the validity of the other provisions shall not be affected. In lieu of invalid or impracticable provisions or to supplement an incomplete provision, a suitable ruling appropriate to the meaning and purpose of this contract shall apply.

27. Place of JurisdictionIn relation to persons engaged in commerce, who are not listed under those specified in Section 4 of the HGB (German Federal Commercial Code), legal entities under public law or a special fund under public law, or exhibitors who have no general place of jurisdiction in Germany, Frankfurt am Main shall be deemed as the place of fulfilment for payment of the stand rent for all claims arising from the contract. German law shall apply exclusively and the German text of these General Conditions of Participation, “Allgemeine Teilnahmebedingungen ACHEMA 2021”, shall prevail.

Any and all claims of the exhibitor against DECHEMA shall be lodged in writing. They shall be time-barred within one year from the end of the year in which they became material. Any and all agreements which deviate from these terms and conditions or from the supplementary provisions shall be in writing. Facsimile signatures shall suffice.

The place of jurisdiction is Frankfurt am Main. Not-withstanding, DECHEMA reserves the right to lodge its claims in the courts where the exhibitor’s busi-ness is domiciled.

Maßgebend für diese Einteilung ist die Beschaffen-heit des endgültig zugeteilten Standes.

€ 135,00/m² für alle Stände im Freigelände

€ 216,00/m² Sondertarif für junge Unter- nehmen oder universitäre Forschungseinrichtungen

€ 135,00/m² für die Fläche des Obergeschos-ses bei Ausstellungsständen mit zweigeschossigem Standbau, zusätzlich zur Standmiete der Grundfläche einschließlich des gültigen Zuschlags (zuzüglich aller Zusatzkosten: Standbau, Prüfung, Brandschutz, etc., s. Technische Richtlinien)

Bruchteile von Quadratmetern werden ab 0,5 m2 aufgerundet, unter 0,5 m2 abgerundet. Säulen werden bei der Flächenberechnung abgezogen. Die Mindest-standgröße beträgt 12 m².

Nebenkosten und Standbau sind nicht in der Stand-miete enthalten. Die für die Veranstaltung gültigen Preise der Nebenkosten und Zusatzleistungen werden zu einem späteren Zeitpunkt im Ausstellerportal der ACHEMA aufgeführt und können dort bestellt werden.

Ab Oktober 2020 finden Sie in unserem Online- Bestellportal diverse Standbauoptionen vom All-inclusive-Paket bis zu individuellen Varianten.

Die Standmiete und alle sonstigen Entgelte werden in Euro berechnet und sind Nettopreise, d. h. ohne Umsatzsteuer und/oder andere Verbrauchs- bzw. Dienstleistungssteuern (s. hierzu auch Punkt C 10).

2. Details of Rental Charges

€ 341.00/m² for all stands along hall walls and for aisle stands (only 1 side open) along the outer gangways of halls

20 % surcharge for all other aisle stands (only 1 side open) in halls

40 % surcharge for all stands with at least 2 sides open, not located along hall walls

The basis for these categories is the position and type of the finally allocated stand.

€ 135.00/m² for all stands in the outdoor area

€ 216.00/m² special rate for start-ups or academic research institutions

€ 135.00/m² for the upper floor area of two-storey exhibition stands, in addition to the stand rent of the ground area, including the effec-tive surcharge (plus all addi-tional costs: stand construction, inspections, fire prevention, etc., see Technical Regulations)

Fractions of square metres from 0.5 m2 upwards will be rounded up, if below 0.5 m2 they will be rounded down. Pillars are deducted from the area calculation. The minimum stand size is 12 m².

Service costs and stand construction are not included in the stand rent. Effective rates for addi-tional costs and extra services will be listed and can be ordered in the ACHEMA online ordering portal at a later point in time.

From October 2020 you will find various stand construction options in our online ordering portal, ranging from all-inclusive-packages to individual variants.

The stand rent and all other charges are calculated in Euro and are net prices, i.e. without value added tax and/or other consumption or service taxes (see also item C 10).
