The agreement was valid till 31 S ! December 2006. Consequent to the expiry of the existing settlement and pending revision of wages, adhoc advance was paid. Further in 2008, based on the directions of the Hon'ble High Court, Chennai bargaining agents were identified through Secret Ballot Election. In order to finalise the Wage Revision, a Bipartite Committee was constituted initially on 22110/2007 and modified on 10/02/2009. The following members constituted the Bipartite Committee. S. The Wage Structure for unionised category of Workmen I Non-executives of Neyveli

Lignite Corporation was determined hrough a 12(3) settlement dated 29062001 between

the Management and Workmen J Non-executives of the Neyveli Lignite Corporation

represented by the NLC Workers Progressive Union (LPF) The agreement was valid till 31 S

December 2006

Consequent to the expiry of the existing settlement and pending revision of wages

adhoc advance was paid Further in 2008 based on the directions of the Honble High

Court Chennai bargaining agents were identified through Secret Ballot Election In order to

finalise the Wage Revision a Bipartite Committee was constituted initially on 221102007 and

The Recognised Union viz NLG Workers Progressive Union (LPF) had submitted its

charter of demands on 29122006 Subsequently the two Recognised Unions viz NLC

Workers Progressive Union (LPF) and NLC Pattali Thozhir Sangam (PTS) had submitted

their revised charter of demands on 04012010 The Bipartite Committee commenced its

negotiations on the charter of demands from 1610312009 and held 65 sittings and a broad

understanding was reached on almost all the issues during the final rounds of discussions at

Chennai on 27052010

However the Unions cjemanded that the proposal of the Management to give effect

to i) one Additional Increment weJ from 01091009 ii) Service Weightage (Amount

equivalent to one annual increment) weJ 0109201l~ and iii) Allowances weJ 01012010

to be revised Thereafter the Recognised Unions had seIYed strike notice on 31052010

and Bilateral Discussions wpre held on various dates fcilloveurod b~i conciliation proceedings

conducted by the Regional Labour Commissic i~ Certra) C~e~nai for~ear (middotIement

Despite the above the Recognised Unions resorted toindefinite strike from3 rd shift of

301062010

The Regional Labour Commissioner (Central) Chennal conducted conciliation

proceedings from 01072010 to 05072010 After protracted negotiations and conciliation

meeting by the Regional Labour Commissioner (Central) an understanding was reached on

i) Additional Increment ii) Service Weightage (Amount equivalent to one annual increment)

and iii) payment of Allowances and to arrive an MoU pn all other aspects on which a broad

understanding had already been arrived The Unions called off the strike on 051072010 midnight Accordingly a Memorandum of Understanding (MOU) was reached between the

representatives of Management and Recognised Unions on 06072010 as set out below

TERMS OF AGREEMENT

10 Scope and Coverage The MOU shal1 cover and be applicable to all unionised category of Workmen 1 Non-executives of NLC ltd and its subsidiaries herein after called as Corporation including Trainees drawing pay in regular scales of pay

20 Duration of Agreement Save as otherwise specifically mentioned hereinafter this agreement will be effective from 01012007 and shall remain in force for a period of 5 (five) years (ie) upto 31 sl December 2011

30 Minimum Wage The minimum wage 151 on 01012007 with AICPI 12633 (2001=100) shall be Rs98001- pm comprising of basic pay only while the existing

- While the above pay scales upto W8 were agreed as such by the Recognised Unions the pay scales beyond W8 were not agreed to However in order to ensure that those employees in scales beyond W8 get benefited out of the Wage Settlement it was agreed to tentatively implement the pay scale as indicated above It was agreed to subsequently discuss and finalise the pay scales designation beyond W8 and the modalities of operating the new pay scales separately

70 Annual Increment The annual-increment shall be at a uniform rate of 3 of basic I

pay and the period of unauthorized absence will postpone the increment

With a vie~~~tandrdi55the d~te~~f grant of annuai increment and thereby ensure

pay anomalies do not arise the eltisting twelve crucial dates of sanctioning annual

l increments will be restricted to xiy two crucial dates (Le) 15t January and 151 July

every year In case of annual increments falling due from February to June the

crucial date will be pre-paned to 1st JanlJry and that falling due from August to

December the crucial date will be 1st July Separate instructions shall be issued in

this regard ~

Stagnation Increment The Stagnation Increment will be 3 of the revised basic

pay and un ionised category of Workmen I Non-executives will be allowed to draw maximum three stagnation increments one after every two years upon reaching the

maximum of the revised pay scale

Pay fixation on promotion

91 Promotion from one revised pay scale to the next revised higher pay

scale One notiqrial increment equal to the increment being drawn by the

unionised category of Workmen 1Non-executives in the pay scale before such

promotion would be granted and pay fixed in the promoted pay scale and

rounded off to the next multiple of Rs1 01-

92 After pay fixation on promotion as above annual increments falling due on the

date of promotion or after the date of promotion will be granted on the due

dates (111 January or 1S July as the case may be) subject to fulfillment of the

prescribed conditions

Additional Increment The unionised category of Workmen I Non-executives who

Family Planning Increment The Family Planning increment(s) granted prior to

01J0112007 will continue to be palO on the same rate(s) Eligible acceptors of small

family norms on and after 01012007 will be covered under the existing scheme of

Incentives for Family Planning

Golden Jubilee Increment Theltwo special increments granted on the eve of

Golden Jubilee Celebrations as per Cir NoCORPPampAMlR8282006 dated

18052006 will continue to be paid at the same rates as granted

Dearness Allowance 100 Dearness Allowance for AICPI 12633(2001=100) will

get merged in the basic pay fully as on 011012007 Thus DAas on 01012007 will

become nil Beyond AICPI 12633 (2001 = 100) Dearness Allowance shall be

increased J decreased according to the raisrffall of the quarterly average of AICPI

House Rent Allowance HRA will be paid to those employees not provided

minimum take home salary is over Rs10000middot for a period of 3 months immediately

a maximum of Rupees one lakh The rate of interest for the Multipurpose Loan shall

be 9 The amount shall be recovered through salary of the employee in 24 equal

informed by the Management separately

200 Consequential Adjustments As a result of increase in pay the existing pay limits

prescribed for Eligibility for allotment of quarters TA DA Medical and other Benefits

shall be intimated by the Management separately

260 Gratuity The payment of gratuity will be regulated in terms of the Payment of

Gratuity Act 1972 ~s amended from time to time The gratuity of WorkmenI Nonshy

executives payable will be calculated at the rate of 15 days wages (Basic Pay + DA)

for every compfeted year of service rendered up to 30 years and one month pay

(Basic + DA) for every completed year of service rendered beyond 30 years

270 Revision of rates of services extended There is a need to revise the rates of food

and beverages being supplied by the Industrial Canteens proportionately in line with

the enhancement of pay and allowances to meet the price rise of all commodities

Similarly there is a need to revise the tariff on House Rent Water and Electricity

Charges Commercial bus fare etc A Bipartite Committee will be constituted to

study and recommend for revision of rates and accordingly the same shall be

revised

280 It has been agreed by the Unions that no fresh demands involving financial

implication shall be raised in any form during the currency of this settlement

290 It has been agreed that the Unions will extend their full cooperation by putting in all

out efforts to ensure production proauctivity and diSCipline and also to enhance the

The Recognised Union viz NLG Workers Progressive Union (LPF) had submitted its

charter of demands on 29122006 Subsequently the two Recognised Unions viz NLC

Workers Progressive Union (LPF) and NLC Pattali Thozhir Sangam (PTS) had submitted

their revised charter of demands on 04012010 The Bipartite Committee commenced its

negotiations on the charter of demands from 1610312009 and held 65 sittings and a broad

understanding was reached on almost all the issues during the final rounds of discussions at

Chennai on 27052010

However the Unions cjemanded that the proposal of the Management to give effect

to i) one Additional Increment weJ from 01091009 ii) Service Weightage (Amount

equivalent to one annual increment) weJ 0109201l~ and iii) Allowances weJ 01012010

to be revised Thereafter the Recognised Unions had seIYed strike notice on 31052010

and Bilateral Discussions wpre held on various dates fcilloveurod b~i conciliation proceedings

conducted by the Regional Labour Commissic i~ Certra) C~e~nai for~ear (middotIement

Despite the above the Recognised Unions resorted toindefinite strike from3 rd shift of

The Regional Labour Commissioner (Central) Chennal conducted conciliation

proceedings from 01072010 to 05072010 After protracted negotiations and conciliation

meeting by the Regional Labour Commissioner (Central) an understanding was reached on

i) Additional Increment ii) Service Weightage (Amount equivalent to one annual increment)

and iii) payment of Allowances and to arrive an MoU pn all other aspects on which a broad

understanding had already been arrived The Unions called off the strike on 051072010 midnight Accordingly a Memorandum of Understanding (MOU) was reached between the

representatives of Management and Recognised Unions on 06072010 as set out below

TERMS OF AGREEMENT

10 Scope and Coverage The MOU shal1 cover and be applicable to all unionised category of Workmen 1 Non-executives of NLC ltd and its subsidiaries herein after called as Corporation including Trainees drawing pay in regular scales of pay

70 Annual Increment The annual-increment shall be at a uniform rate of 3 of basic I

Stagnation Increment The Stagnation Increment will be 3 of the revised basic

pay and un ionised category of Workmen I Non-executives will be allowed to draw maximum three stagnation increments one after every two years upon reaching the

- While the above pay scales upto W8 were agreed as such by the Recognised Unions the pay scales beyond W8 were not agreed to However in order to ensure that those employees in scales beyond W8 get benefited out of the Wage Settlement it was agreed to tentatively implement the pay scale as indicated above It was agreed to subsequently discuss and finalise the pay scales designation beyond W8 and the modalities of operating the new pay scales separately

70 Annual Increment The annual-increment shall be at a uniform rate of 3 of basic I

pay and the period of unauthorized absence will postpone the increment

pay anomalies do not arise the eltisting twelve crucial dates of sanctioning annual

Stagnation Increment The Stagnation Increment will be 3 of the revised basic
