PREFACE
The ‘Annual Judicial Statistics, Thailand 2018 (B.E. 2561)’ is a compilation of judicial statistics from the Courts of Justice nationwide, including the Supreme Court, appellate courts, courts of first instance throughout the kingdom and other interesting works for the benefits of administration, study, reference, analyzing and research. This statistics does not only reflect an aspect of the Thai society which is part of information on the Thai justice system, but also can be useful in solving social problems to a certain extent. In addition, it is aimed at benefiting organization including external organizations and those who are interested in regardless of whether they work for the Office of the Judiciary. Finally, the Office of the Judiciary would like to convey our gratitude to every court and Judicial Offices of Regions I – IX for their cooperation resulting in a success as aimed. Statistical Summary of Court of Justice of Thailand 2018 (B.E. 2561)
The Court of Justice is classified into three levels consisting of court of first instance, appellate court, and the Supreme Court (referred to as the Dika). Cases under a power of the court of justice are categorized as follows: Civil Case, Consumer Protection Case, Criminal Case, Bankruptcy Case, Tax Case, Intellectual Property and International Trade Case, Labor Case, Environmental Case, Election case, Juvenile and Family case, Tourist Case, and Corruption and Misconduct Case. The statistical data in this annual report was collected nationwide by 254 courts of first instance, 11 courts of appeal and 1 the Supreme Court or 266 courts in the total amount (the data as at December 31, 2018).
Total cases filed in the court nationwide in 2018 are over 1.9 million cases and these are disposed of at 88.07% (table 1). The number of total caseload increase by 154,439 cases and the number of total case disposed increase by 169,508 cases. As a result, it creates a decrease in the total case during trial at the end of the year since the increase in case disposed is higher than the increase in caseloads (figure 1.1).

From figure 1.2, it shows that, in past five years (2014 - 2018), the number of caseloads in the court of justice of Thailand has been increased persistently and reached apex over 1.9 million cases in 2018.

Caseloads and Cases Disposed in the Court of Justice of Thailand
Thailand has changed appeal system to the Supreme Court for civil cases from the rights-based system to the permission-based system in 2015. Thai law traditionally has allowed parties to appeal any court of first instance decision to the appellate courts and subsequently the latter’s decision to the Supreme Court. The Supreme Court’s judgment (referred to as the Dika) is final. According to the Act (Act No. 27) amending the Civil Procedure Code, the Supreme Court now has the power to grant permission to file a Dika if it deems the question to be a significant matter worthy of a decision.
Therefore, there are major declines in civil case filed to the court (-39.48%) and in case disposed (-20.61%) in the Supreme Court (table 2.1) unlike criminal cases which increase in both caseloads and cases disposed in all level of Thai court of justice (Table 2.2). As a result, in 2018, the number of cases (table 2) in the Supreme Court declined (-22.52% and -10.16%) but the number of cases in the appellate courts and the courts of first instance increase (+8.04, +8.43, +8.90 and +11.13) thus, the total caseloads and the total cases disposed of the court of justice of Thailand in 2018 increase by 8.57% and 10.90% respectively from previous year as can be seen in table 2.

Time to Disposition
Timeliness is an essential aspect of resolving cases and providing the finality which is the length of time it takes the court to process cases.

The above table shows from beginning to end in reporting period in 2018 the court of justice of Thailand mostly resolved the cases less than 3 months which means 81% of cases filed to the court processed within 3 months.
Duration of Cases Pending End of Year Cases filed but not yet disposed make up the court’s pending caseloads. Examining
the age of pending cases make clear, for example, the number and type of cases drawing near or about to surpass the court’s case processing time.

Considering the duration of pending status in 2018, it can be seen that most of the
cases (217,074 cases or 93% of total cases pending) fell into the duration of not over 6 months. The high court of justice in Thailand: The Supreme Court and the courts of appeals had no case pending over 1 year.
The Amount in Dispute For claim computable in terms of money in 2018, the total amount in dispute is 673,891,030,231.61 baht which are civil cases for 380,478,890,284.96 baht, consumer cases for 293,182,399,778.25 baht and environmental cases for 229,740,168.40 baht. As classified cases by the amount in disputes under civil law, in 2018, most of civil
cases (129,115 cases) were the cases of claim cannot be computed in term of money. For example, motion for execution of inheritance, motion for cancellation of fraudulent acts, etc., these are cases where relief applied for cannot be computed in term of money.
However, most of consumer cases and environmental cases are the cases where relief applied for can be computed in term of money as the cases of claim over 50,000 baht to 300,000 baht which are 485,752 cases in consumer cases and 29 cases in environmental cases.
Provisional Release to the Court
Provisional release is a mean whereby a person continues to enjoy freedom, or regains it after having been placed in preventive detention, during the criminal proceedings. Such application is for provisional release without bail, or with bail, or with bail and security submitted to the court to consider for a release of an accused or a defendant for a specified period of time. Overall, in 2018, there were 235,380 applications for provisional release and 91% of them or 214,413 applications granted by Thai court. However, 4,149 persons of the accused or the defendants have absconded after getting the provisional release. Penalties and Defendants
The important purposes of the Criminal Law Enforcement in Thailand are to put people’s living in order to protect innocent people, and to impose the penalties for a person who violates any social rules considered as the criminal offences. The penalties in Thailand consist of death penalty, imprisonment, confinement, fine and forfeiture of property, suspension of punishment respectively.
In 2018, there were 679,625 defendants in criminal cases and the most penalties of defendants in the Thai court are suspension of punishment, next major penalty was fine and the imprisonment came later.
Most of defendants in 2018 were Thai male with suspension punishment (236,566: 37% of total Thai defendants). However, in Thai female defendants, most of them were punished with the fine penalty (54,890: 6% of total Thai defendants).
On the other hand, there were 39,479 foreigners receiving penalty as they violated the law of Thailand. Most of them were given penalty with suspension of punishment which were male: 16,095 persons and female: 2,751 persons.

Regarding to the defendants’ ages, Thai persons who most violated the law are person aging between 25 years old and 40 years old. However, the defendants in table 7 and 7.1 are sentenced by the courts of first instance except Juvenile and Family Courts which applied different penalty for children under juvenile and family law.

Juvenile and Family Law
The act on Juvenile and Family Court and Procedure 2010 was effective on 22 May 2011 aims to provide the rights and welfare protection and the practices for children, youth, women and family members. There is also the improvement in the proceeding of the Juvenile and Family Court in order to be in line with the constitution, the convention on the rights of the child and convention on the elimination of all forms of discrimination against women.
Most criminal cases filed to the Juvenile and Family Courts have been applied special measures for correction, treatment and rehabilitation as showed in table 8. The implementation of special measure of both Section 90 and Section 132 has more successful rate than unsuccessful rate. Table 8. Moreover, to protect children and reduce domestic violence, Thailand established the Child Protection Act, B.E. 2546 (2003) and the Victims of Domestic Violence Victim Protection Act, B.E.2550 (2007).

Human Trafficking Cases Human trafficking is one of a major problem of the world. In Thailand, the Anti-
Trafficking in Person Act B.E.2551 (2008) the Anti-Trafficking in Person Act B.E.2558 (2015) the Anti-Trafficking in Person Act B.E.2560 (2017) and Human Trafficking Criminal Procedure Act, B.E. 2559 [2016] have been established to solve out this problem. It has a significant principle as a consequence of human trafficking problem which is a major problem that affects human rights which is dangerous to the country’ social stability and sustainable development. Therefore, Human Trafficking Criminal Procedure has been specifically established in order to have an efficient prevention and suppression of human trafficking. In addition, it will help any related cases be in the proceedings faster and more fairly.
However, according to the fact that Thailand is a source, transit, and destination country for human trafficking, Thai Government prioritizes this issue as an urgent agenda and should be executed in every dimension to protect and reduce numbers of victims for both sex and labor exploitation. Thus, the Court of Justice of Thailand has followed the policy by making an immediate and effective prosecution in Thai Courts of First Instance. The Office of the Judiciary is well-prepared and has supported to taking evidence in advance and taking in criminal cases via Video Conference Courtroom without having the witness confront with the defendant. At present the Court of Justice has developed the system to support the taking evidence via the Video Conference Courtroom in every court nationwide. Furthermore, the Court of Justice has created the judicial work manual on Human Trafficking Criminal Procedure to guide the judges to have discretion to allow the taking evidence without having the witness confront with the defendant as much as they can.
