    7. I Andre Murray have received correspondence (as recently April 2009) by mail from thedefendant BETTY ROSE DANIELSKl with a return address written on the said letter.Because of this Ihave reason to believe this is her current address.

    D. Each allegation of a material fact relied upon 10 substantiate the claim.

    5. On June 2005 the plaintiff (Lessee) and Betty Rose Danielski (Lessor) entered into a fouryear lease agreement July 2005 to July 2009 with a n o ptio n to purchase 29 - 31 MarshallStreet, F re de ric to n, N e w Brunswick, on the fourth year only.

    6. Renovations prior to occupancy of 29 -31 Marshall Street, commenced July 2005 at theplaintiff's expense.

    7. Plaintiff did faithfu1ly begin tenancy of 29 - 31 Marshall Street, Sept 2005.8. Plaintiff did faithfully and according to the terms of th e lease pay all costs for the

    repairing, improving and maintenance of 29 -3 1 M arsha ll S tree t staring July 2005 andcontinues to this date.9. Plaintiff did faithfully and according to the terms of the lease pay all utility bills of 29 -31

    Marshall Street staring July 2005 and continues to this date.10. The plaintiff did at the expense of the plaintiff and according to the terms of the lease, atall reasonable times during the said term did permit guests of the lessor to temporarily

    occupy a portion of the house.11. The plaintiff did not at any time of the lease term break a condition of the lease.12. And consequently has performed honourably.

    13. The plaintiff did faithfully and according to the terms of the lease on the fourth yearrequested of the Lesser: transfer of title / ownership for 29 - 31 Marshall Street.

    14. The defendant has not made an y effort to transfer the title.15. The defendant according to the terms of the lease must on the fourth year of the lease at

    the request of the Lesse (Plaintiff) commence action to register a transfer the title.16. The terms of the lease state specifically that on the fourth year of the lease: the 1esse may

    request th e lessor transfer the title.17. Failure to perform or transfer the title requires a refund of all costs according to the

    lease schedule.18. The plaintiff has made a appropriate and timely request according to the terms of the

    lease.19. The plaintiff has requested of the defendant the transfer of title to the plaintiffs name
