I. Call to Order The meeting was called to order at 8:02 a.m., Thursday, July 25, 2013. The following Board members were present: Quinn, McCormies, Berrigan, Dalton, Harrell, Johnson Snider, Gutierrez, Post and Busby. Quinn presided. Quinn welcomed members of the audience, explained the procedure for addressing the Board, and stated the mission of the Board. VI.B.10. Jose Alberto Sanchez RN Exam; LP043142; (Richter) CNA1000004080 Attorney Robert Chelle was present and addressed the Board. Sanchez was present and available for questions. Gutierrez moved, Dalton seconded, and it was unanimously carried, upon a determination of reasonable cause, based on the facts alleged in the investigative report, and material presented at this Board meeting, issue an Interim Order for a substance abuse evaluation, at no expense to the Board, to be completed by a Board approved PhD level licensed psychologist, and to include any additional testing deemed necessary by the evaluator, to be completed within 45 days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, deny licensure and issue Notice of Charges for LP043142 and CNA1000004080, and include the factual allegations and alleged violations of statute and rule for failure to comply with the Interim Order.

Hunter addressed the Board with additional information. .Busby moved, Post seconded, and it was unanimously carried, on a determination of reasonable cause based on the facts alleged in the investigative report and material presented at this Board meeting, and at no cost to the Board, issue an Interim Order for: Substance use disorder and psychiatric evaluation to be completed by a Board approved psychiatric addictionologist, and any additional testing deemed necessary by the evaluator, to be completed within 45 days and Hair Follicle Testing for controlled substances (Health Professional Panel), to include Fentanyl, both to be completed with 14 days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, issue Notice of Charges and include the factual allegations and alleged violations for failure to comply with the Interim Order.

Johnson returned to the meeting at 8:25 am. VI.A.5. Evan Kyle DiGiovanni RN Exam; (Monas) CNA1000021559 Attorney Robert Chelle was present and available for questions. Gutierrez moved, Dalton seconded, and it was unanimously carried, upon a determination of reasonable cause, based on the facts alleged in the investigative report, and material presented at this Board meeting, issue an Interim Order for a substance abuse evaluation by a Board approved PhD level licensed psychologist, and to include any additional testing deemed necessary by the evaluator, to be completed within 45 days and then return to the Board. VI.A.13 Michael Rawlins RN Exam (Monas) Attorney Robert Chelle was present and addressed the Board. Rawlins was present and available for questions. Busby moved, Harrell seconded, and it was unanimously carried to grant licensure upon meeting all requirements, and issue a Letter of Concern for Applicant’s April 7, 1999, conviction in the City Court of Syracuse (NY), docket number 99-00106, Driving Under the Influence of Alcohol, a misdemeanor, with a blood alcohol concentration of .13%, committed on January 10, 1999; his July 11, 2001, conviction the City Court of Sullivan (NY), docket number 99-090133, of Driving While Impaired, committed on August 19, 1999; his December 2000, citation with drug possession resulting from his possession of ecstasy pills in his pockets, for which the charges were dismissed after completion of Drug Court; his June 9, 2000, citation for possession of drug paraphernalia, for which the charges were dismissed after completion of Drug Court. McCormies moved, Gutierrez seconded, and it was unanimously carried to issue a Letter of Concern for inaccurately disclosing on the Board's Investigative Questionnaire dated 03/01/2013, by answering "No" to whether you were terminated f rom Maravilla Care Center in Phoenix, AZ when you were terminated from the facility n 07/19/2010; inaccurately disclosing on an employment application to Hacienda Healthcare dated 01/19/2012 by answering that your reason for leaving Maravilla Care enter was to volunteer in Africa; and for self-administering an Ambien on or around 1/23/2013 and then driving a vehicle and resulting in an arrest in Scottsdale, Arizona; admitting that you either took an expired Ambien from an old prescription that belonged to you or you took one of your mother's Ambien. Quinn moved, Berrigan seconded, and it was unanimously carried to issue a Letter of Concern for providing inaccurate, misleading or false information in a written statement to the Board and on numerous employment applications, while seeking employment from or about 2011 and 2012 and for failure to notify the Board of her change of address within 30 days. VI.D.15. Iris Day Mears RN102454 (Greabell) Greabell confirmed receipt of additional information. Attorney Kelly McDonald was present and addressed the Board. Mears was present and available for questions. Snider moved, Busby seconded, and it was unanimously carried to dismiss the complaint. Motion failed with five in favor and five opposed. After discussion, Quinn moved, McCormies seconded and it was unanimously carried to issue a Letter of Concern for disclosing to your then husband on or around November 2011 that you provided nursing to a high ranking employee while employed as a RN at Banner Good Samaritan Medical Center in Phoenix, AZ The motion carried with six in favor and four opposed. VI.D.2. Morgan K Cambern RN098896 (Greabell) Attorney Michael Kielsky was present and addressed the Board. Cambern was present and available for questions. Quinn moved, Gutierrez seconded, and it was unanimously carried, on a determination of reasonable cause based on the facts in the investigative report and material presented at this Board

VI.D.3. Patricia Isabel Descalzi RN117019 (Greabell) Greabell addressed the Board and confirmed receipt of additional information. Attorney Melanie Balastra was present telephonically and addressed the Board. Descalzi was present and addressed the Board. Quinn moved, McCormies seconded, and it was unanimously carried to issue a Letter of Concern for failing to document a verbal order in a patient’s medical record which reschedules the patient’s Insulin Glargine Pen 20 units from a morning administration time to an evening administration violation of the standard of care which requires that licensed nurses will maintain accurate patient medical records and on or around May 28, 2013 while Respondent was employed as a RN at Mountain Vista Medical Center in Mesa, AZ, Respondent failed to follow the facility’s Heparin Protocol by sending a patient’s blood for Prothrombin Time testing (“PT”) instead of for Partial Thromboplastin Time (“PTT”) during the 12-hour day shift that Respondent was working. VI.D.7. Jennifer Anne Lopshire RN098560 (Greabell) (AKA: Miller, Kline) Greabell addressed the Board with additional information. Attorney Lisa Gervase was present telephonically, and addressed the Board. Busby moved, Berrigan seconded, and it was unanimously carried to go into Executive Session pursuant to A.R.S. §38-431.03(A)(2) and (3), on Agenda Item VI.D.7. for the purpose of obtaining legal advice. Executive session convened at 10:00 am and adjourned at 10:10 am. Busby moved, Quinn seconded, to lift the suspension ordered in the September 19, 2012 Consent Agreement Order No. 1204100 and on a determination of reasonable cause based on the facts alleged in the investigative report and material presented at this Board meeting, at no cost to the Board, issue an Interim Order for a psychological evaluation with an emphasis on boundaries, to be completed by a Board approved evaluator who is at minimum Ph.D. prepared, and to include any additional testing deemed necessary by the evaluator, to be completed within 20 business days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, issue Complaint/Notice of Hearing and include the factual allegations and alleged violations for failure to comply with the Interim Order. After discussion Busby amended the motion to include: If Respondent has difficulty in scheduling and completing the Interim Order, and that difficulty is communicated to Board staff, Board staff may extend Respondent’s time to comply with the Interim Order up to an additional 10 business days. Quinn concurred. The motion carried unanimously.

VI.D.16. Annalisa Machado RN158948 (Greabell) Greabell was present and confirmed the receipt of additional information. Attorney Amanda Damianakos was present and addressed the Board. Quinn moved, Dalton seconded, based on the finding of fact and statute/rule violations identified in the investigative report, offer a Consent Agreement for a (12) month stayed suspension to be followed by a minimum (24) month probation, to include the attached stipulations, amended to delete AA/NA 3x per week option. If not signed within (30) days, issue Notice of Charges. After discussion, Quinn amended the motion to remove fact #1, rule #2, and statute #18 (h). Dalton concurred. The motion carried with eight in favor and one abstained.

I. Call to Order The meeting was called to order at 8:00, a.m., Friday, July 26, 2013. Quinn welcomed members of the audience, explained the procedure for addressing the Board, and stated the mission of the Board. II.A. Administrative Law Judge (ALJ) Recommendations II.A.1. was unanimously carried to grant certification upon meeting all requirements, and issue a Letter of Concern for his October 11th, 2007 conviction in Scottsdale City Court for extreme driving under the influence, his October 18th, 2004 conviction for open alcohol container violation in Scottsdale City Court, and his January 18th, 2001 conviction for driving while intoxicated in El Paso County Court, Quinn amended motion to include which was later dismissed in 2001. McCormies concurred.
