Hon. Gale Hickman (Ret.), Marc Tovstein, CFLSWritten discovery is a powerful tool for custody litigators. This panel will demonstrate how to use written discovery tools to bolster or attack a custody evaluator’s report and recommendations with emphasis on the importance of “discovering” the true facts upon which an evaluator should rely and how written discovery can be utilized as a part of the overall “game plan” for securing favorable results in custody litigation.2:45–3:00 PM BREAK (Exhibitors and Coffee/Snack) –

Family Code §3044 Presumption: Get Thee Back to the Fundamentals of Lawyering

Hon. Mark A. Juhas, Andrea Palash, CFLS, AAMLThis panel will focus on addressing the challenges of representing chemically dependent clients, clients facing domestic violence allegations, clients who are victims of domestic violence, and the importance of creating an informed, and informative, narrative for the court in such cases. Panelists will explore obligations as advo-cates for these clients, as well as the attorney’s “human” obligations to them, and perhaps more importantly, to their children. The panel will also touch upon the practical implications of the Sanchez decision and promise to philosophize liberally about the future of child custody litigation.9:45–10:00 AM BREAK (Exhibitors and Coffee/Snack) –

of Relocation and Abduction IssuesHon. Dianna Gould-Saltman, Hon. Erick Larsh

This panel will focus on the formulation and execution of a winning strategy in move-away trials regarding what type of evidence is the most and least persuasive to obtaining and defending against relocation requests as well as steps necessary to gain such evidence. Included in all custody orders, Section 3048 may be the Family Code’s most overlooked statute. This panel will explain both the necessity for including this language in custody orders as well as the nuances related to presenting and defending against allegations related to abduction.11:30–11:45 AM BREAK (Exhibitors and Coffee/Snack) –

Foyer (name badge required)11:45–1:15 PM A Strategic Approach to Direct Examination

Hon. Michael Convey, Glen Schwartz, CFLSDirect examination is an essential part of developing the case narrative in a contested custody matter. Yet, too often, it does not reflect strategic thinking in preparation and execution. This panel will explore all aspects of direct examination of witnesses including researching necessary legal theories, selection of the appropriate witness(es) to present the needed evidence, and the do’s and don’ts of questioning the witnesses on direct examination.
