Dear Hr . Rudak:

Thia letter ia to notify you of potential liability that your c011pany aay incur or aay have incurred in connection with the above-referenced hanrdoua vaate treatMnt facility and to re­quest your aaaiatanee in cleanup activities at the dte.

The U.s. EnvironMntal Protection Agency (EPA) baa determined that an actual release or a substantial threat of a release of hazardous aubataneea, aa defined in Section 101 of the Coaprehenaive Environ•ntal Response, Coapenaation, and

~!:b~~~~~r!~ta~ft~!a~bo!:-~~;;~n:~t!~~e ~6o~P~th:qe!~~~;~), public funds in response to iamediate environmental hazards on the aite and is presently involved in planned removal activities to abate these hazar;ds. Upon completion of these activities, planning will be initiated under a Cooperative Agreement between EPA and the State of New Hampshire for the longer term remedial phases of the site cleanup, including remedial design, remedial construction, operation, and main­tenance, as required by site conditions . These response activities are authorized by Section 104ta) t 1) of CERCLA. Under CERCLA, certain responsible parties may be liable for money expended for response activities at the site, including investigation, planning, c leanup measures, and enforcement . Potentially liable responsible parties include the current owner or operator of the site, past owners or operators, and persona who generated the substances or who were involved in transport, treatment, or disposal of them at the site.

EPA believes that your company may be a responsible party with respect to this site and that your company may therefore be liable for public funds expended in response activities at the site. Before EPA undertakes further response activi­

Please notify EPA, in writing, no later than September 10, 1982 of your company's willingness to dis­cuss undertaking the remedial phases of this cleanup activity so that negotiations to effectuate this involvement can con­clude before the end of the remedial planning process. Your letter should indicate the name, address , and telephone number of an appropriate company official for further contact on this matter. It should also include a statement of the type and the extent df the activities your company may be willing to undertake~ . Where your company is already involved in discussions with state or local authorities, or is engaged in voluntary action to clean up the site, these activities should be continued and their statue ahould be reported in your letter.
