THE FORTH PART REFERENCE TERMS I. BASIS OF THE PROJECT 1. In the cooperation framework between Vietnam and Demark Government under the water supply and drainage field, Denmark proposes to support the Ministry of construction to deploy the project “Preventing from loss of fresh water in the small urban centres in Vietnam” in order to contributively implement the objectives of reducing loss of fresh water of the national program about preventing from loss of fresh water which was approved by the Prime Minister at the decision No. 2147/QĐ-TTg dated November 24, 2010. The project is implemented through the consultant unit selected by the Technical Infrastructure Development Project Management (MABUTIP) – Ministry of Construction. 2. The document No. 2138/TTg-QHQT dated December 14, 2012 of the Prime Minister approving the list of project “Preventing from loss of fresh water in the small urban centres in Vietnam” sponsored by Denmark Government. 3. The decision No. 1144/QĐ-BXD dated December 18, 2012 of Ministry of Construction on approving the project documents “Preventing from loss of fresh water in the small urban centres in Vietnam” grant aided by Denmark Government. 4. The project aid agreement was signed between Ministry of Construction and Denish Embassy in Vietnam on December 19, 2012. 5. The project is expectedly deployed in 8-10 small urban centres in Vietnam. These urban centres will be selected based on the criterions unified between MABUTIP and Denish Embassy in the first stage of the project. 6. This project will supply for Ministry of Construction the information about loss of fresh water in the small urban centres through deploying deep survey on the loss situation

THE FORTH PARTREFERENCE TERMSI. BASIS OF THE PROJECT

1. 5. The project is expectedly deployed in 8-10 small urban centres in Vietnam. These urban centres will be selected based on the criterions unified between MABUTIP and Denish Embassy in the first stage of the project.6. This project will supply for Ministry of Construction the information about loss of fresh water in the small urban centres through deploying deep survey on the loss situation of water in the project urban centres. The survey results and recommendations from this research will also help the policy planners of Construction Ministry in specifying solutions of fresh water loss, contributing to improve the stability and effectiveness of Vietnam urban water supply branch.7. The project will be proposed to survey overall the curent state of fresh water loss in the selected urban centres, attaching importance to matters such as public awareness of using fresh water; regulations and ability of orperating of the water companies and local authorities; the current state of the system of water supplying inftastructure. Besides, after the detailed process of surveying, the project will be proposed to organize two national seminars to present the survey report, share experience and propose solutions of reducing the rate of water loss in the urban centres in order to reach the objective of reducing the rate of fresh water loss according to each stage specified in th National program of preventing from loss of fresh water up to 2025.

II. THE PROJECT OBJECTIVES8. The long-term objectives of the project will contribute to implement the national objective program of minimizing loss of fresh water in the urban centres, pushing up developing the green and stable Vietnam urban water supply branch.9. The detailed objectives of the project intend to improve knowledge and understanding about loss of fresh water in Vietnam urban centres, contributing to help Ministry of Construction research, promulgate the legal documents and propose the action related to reducing the rate of fresh water loss.

III. THE PROJECT CONSULTATIVE SERVICE 10. The Technical Infrastructure Development Project Management (Technical Infrastructuren Department Ministry of Construction)IV. WORK SCOPE

The scope of consultative work to implememt will include but not limited following contents:

Deploying the work of field investigation, overall survey on the curent state of fresh water loss in the project urban centres about: the current state, causes and assessment of the current state of of fresh water loss in the project urban centres.12. Making and completing the investigation report, overall assessment of the loss of fresh water in the project urban centres, as well as providing petitions/ solutions in order to reduce the rate of fresh water loss in the project urban centres and propose the corresponding action plans.13. Presenting the results at the two national seminars organized after completing the investigation and fully doing the report of assessment after the seminars. The tasks of consultants at the seminar include: presenting the results, report of survey, assessment, related experience lessons, proposed petition and solutions, sharing the achieved experience lessons. The attendants of the seminars expectedly include the water supply companies of the urban centres in the whole country,related local authorities, national and foreign experts.V. DETAILED TASKS The detailed works of consultative service necessary to deploy include following activities:

14. Taks 1: Invetigating overall the current state of fresh water loss in the project urban centres. (i) Investigating public awareness of using and saving fresh water: Public awareness of using savely water in the activities serving life and production, comparing the difference between the actual amount of used water and the paid money amount. Sense, responsibility of protecting, connecting the system of water supply and informing the problem to the water supply unit. The curent state of using and connecting the system of water supply: the points connected illegally not through management, causes of the state of the used fresh water amount much more than the paid money amount, the activity of using water with business purpose without business register or using not in accordance with the purpose. (ii) Investigating the current state of regulations, ability of operating, activities and management of water supply companies at the local and the related branch management units: Model of organizing and managing the system of water supply of the water supply unit; Ability, qualification of officers, workers and responding ability. Managing customers and making water bills.

Facilities, technology for operating and managing the water supply system.

The system of information and dealing with two-side information between customers and the water supply units in managing, supplying services, developing the water supply system.

Surveying and comparing the current state of operating the water supply pipeline system in accordance with the current regulations such as cleaning the pipeline periodically, checking the devices on the network (air suction and discharge valves, check valve, waste valve), checking and maintaining the water meter. Structuring organization, regulations, schedule of management, checking the water supply pipeline system, material facilities on the network (such as position, dimesion, pipeline equipment,) to repair on time. Long term plan for replacing the old pipeline (if have) and spare accessories for repairing the pipelines. The current state of management and plan of using fresh water from the network of water supply pipe of the city to water the plants, clean the street, prevent and fight fire or other purposes. Regulations related to water supply activity applied at the local, management ability of the unit responsible for this activity.(iii) Surveying the current state of water supply infrastructure system:The content of this activity will focus on definiting the causes of the fresh water loss happening in the water supply pipeline system. Accordingly, the fiels business trips to survey will focus mainly on the connection points in the pipeline system, the divided points in the old pipeline system and the new pipeline system or prepared to construct, details as below: To the old pipeline: Surveying the current state of quantity and quality of the pipeline system, points connecting the pipeline and the running water meter system. To the new pipelines or the pipeline prepared to construct: investigating and checking the quality of executing and assebling the water supply pipeline, compared to the technical design drawings and current technical standards.

Surveying overall the quality and the state of operation of the water meter system in the project urban centres; maintainance schedule, auditing or replacing the water meter. Searching the technical low layer construction plan drawings and detailed implementing plans (if yes) of the urban centres. Providing comments and assessing the suitability of the plan drawings and calculating the water supply pipeline system with the speed of urbanizing of the urban centres; as well as specifying the direct and indirect causes of the pipeline leak. Assessing the comprehensiveness and suitablity of technical low layer construction design with the current state of execution of urban construction works and effects of construction activities to the water supply pipeline system. Accordingly, proposing coresponding solutions.15. Task 2: Investigating, assessing the situation of implementing the work of preventing from water loss of the water supply companies and the branch management units:

(i) Assessing overall the situation of implementing and the care level of water supply companies/branch management units to the work of preventing from fresh water loss in the urban centres.

(ii) Focusing on assessing specific activities of the water supply companies such as:

Structuring the organization of specialized departments: department of specializing in finding out and dealing with leak, replacing the pipeline, water meter on the water supply pipeline system; the department of managing customers and making water bills; Current regulations;

The situation of implementing, the quality and suitability of the Manual of managing water supply system at the companies;

The method of managing the network of water supply pipeline such as the system of technical facilites, applying management software,

(iii) Researching and assessing the projects of preventing from fresh water loss, focusing on stages/matters:

Making projects;

Effectiveness of the projects;

Types of applied contracts;

Model and methods of deploying projects.

(iv) Researching and assessing the situation of operating of central and local branch management units about: Managing the work of preventing from fresh water loss at the local;

Effectiveness of operation of the management authorities, the board of directing the program of preventing from fresh water loss of the province (if yes);

Issued related regulations.16. Taks 3 : Proposing solutions and petitions in order to improve ability of management and reduce the rate of fresh water loss and activity plans.

Coresponding solutions, petitions for each subject/ work type can include:(i) To water supply companies:

Proposing the organization structure and activity such as: establishing specialized departments;

Proposing high effective models and management activity of the pipeline network sich as: the facility system; software of managing the pipeline network and customers; making and implementing the manual of managing the network; Standards of managing the network; Proposing the form and time of organizing training, improving ability of the officers of water supply companies. (ii) To the project of preventing from fresh water loss: proposing models, methods of deploying with main contents:

Method of making projects;

Method of calculating the effectiveness of projects;

Proposing the suitable contract types;

(iii) To officers/ branch management units:

Local level: proposing activities in order to improve effectiveness of the work of preventing from fresh water loss at the local; managing and directing activity og preventing from fresh water loss of the province (such as establishing the borad of directing the program of preventing from fresh water loss of the province; fuctions, duties, activity scope); constructing and issuing regulations on preventing from fresh water loss at the local;

Central level: Proposing technical instructions and instructions of deploying activities of branch management to the locals; proposing research and issuing legal documents and related code.

17. Task 4: making and completing draft report of surveing overall the current state of fresh water loss in the project urban centresAfter finishing the work of field survey and analysing the achieved figures, the consultants will prepare the draft report of surveying, assessing overall the crrent state fresh water loss in the project urban centres. The content of report needs summarizing the results of implementing the above tasks 1,2 and 3. 18. Task 5: organizing the seminars to inform the results

Two national seminars will be organized with attendance of the project urban centres, representatives of related branch units from provinces/cities, water supply companies, national and foreign specialized experts.

The consultants have responsibility of prparing the seminars to present the draft report of surveying, assessing overall the current state of fresh water loss in the implemented project urban centres, as well as presenting discoveries and recommendations, achieved experience lesson.19. Task 6: Completing the final report of survey, overal l assessment of the current state of fresh water loss in the project urban centres. After completing the seminars, the consultants have responsibility of summarizing, analyzing, supplementing all information and collected figures to complete the report of survey, overall assessment of of the current state of fresh water loss in the final project urban centres, meeting the requirement, content and defined objectives. VI. IMPLEMENTING PLAN, OUTPUT RESULTS AND REPORT STATUS20. Duration of implementing the contract is expectedly seven months, starting from May, 2013 and expectedly ending in November, 2013. 21. Expectedly output results:

(i) The head term report:

One month from signing the service contract, the consultants have to submit the head term report. The content of report needs including (but not limited) following matters: (i) Introduction about the project; (ii) Objectives and tasks of the work of survey; (iii) The method of survey; (iv) Plan of mobilizing workforce; (v) Detailed implementing plan, expected results; (vi) Petitions, initial proposals (if yes). (ii) The draft report of survey, overall assessment of of the current state of fresh water loss in the project urban centres:

Five months from signing the service contract, the consultants have to submit the draft report of survey, overall assessment of of the current state of fresh water loss in the project urban centres. (iii) The seminars of informing resultsThe national seminars (two seminars) to inform research results will expectedly organized in October, 2013. (iv) The final report of survey, overal l assessment of the current state of fresh water loss in the project urban centres. Requirement for the final report is regulated at the point 19 of the this reference term.22. To each kind of report, The consultants have to submit with the following quantity: 05 copies in English; 12 copies in Vietnamese; and 01 CD disk (in English and Vietnamese). VII. INPUT RESOURCES23. The consultive company must have suitable ability to implement the contents described in this reference term. Especially, the consultants are required to have experience about at least one in following fields: (i) preparing, implementing the projects relaed to preventing from fresh water loss, (ii) surveying, assessing the situation of operation of water supply companies; (iii) improving ability in the water supply branch. Taking priority for the consultants having good working relationship with water supply companies in order to reach effectiveness of expense and time to collect figures. 24. The total input consultants (key staff, not including administrative officers and other supportive officers) are expectedly seventeen working months. The consultants can actively propose the human staff and necessary mobilizing plan to complete output products with expected high quality. The consultant group need to have a position of foreign expert and 05 positions of national specialized staff and over. One in these staff has role of the head of consultant group. The head of consultant group has responsibility of proposing the method, making the implementing plan, managing the works of the group and specialized quality of each member staff. 25. Required qualification and ability of main staff are summarized as below: (i) Foreign experts of preventing from fresh water loss: Having university qualification (priority for people having postgraduate degree) about water supply and drainage. Having at least 15 years of working experience in which minimum 07 years working in the water branch. Having working experience with role of expert of preventing from fresh water loss in related projects. Taking priority for people having experience working in the projects in Southeast Asia or Vietnam.(ii) The head of delegation / Expert of preventing from fresh water loss:

Having university qualification (priority for people having postgraduate degree) about water supply and drainage. Having at least 15 years of working experience in which minimum 07 years working in the water branch. Having working experience with role of expert of preventing from fresh water loss in related projects and being the head of group in at least one project of of preventing from fresh water loss. Having experience working in at least one ODA project. Having good English skills. (iii) Main regulation expert: Having university qualification (priority for people having postgraduate degree) about technique. Having at least 15 years of working experience in which minimum 07 years working in the water branch. Having at least 5 years working experience in managing the water supply companies or consulting about managing activities of water supply companies. Having experience working in at least one ODA project. Having good English skills. (iv) Main finance expert: Having university qualification (priority for people having postgraduate degree) about finance or related major. Having at least 10 years of working experience. Having at least 3 years of working experience in managing finance of water supply companies or undertaking at least one position of consultant expert about managing activity / finance of water supply companies. Having experience working in at least one ODA project. Having good English skills.

(v) Two main water supply and drainage experts: Having university qualification (priority for people having postgraduate degree) about technique. Having at least 10 years of working experience. Having at least 5 years of working experience in managing water supply companies or consulting about activities of water supply companies. Having experience working in at least one ODA project. Having good English skills.

VIII. SERVICES SUPPLIED BY THE PARTY CALLING FOR TENDERS 26. The party calling for tenders will supply available related reference documents for the consultants to use in order to implement the assigned tasks. In this project, the small urban centre is defined to be the classified urban from the third to fifth type according to Vietnam Laws. In which, the third type urban has the scale of population equal to or more than 4,000 people; the forth type urban has the scale of population equal to or more than 5,000 people; and the fifth type urban has the scale of population equal to or more than 150,000 people.
