EXECUTIVE SUMMARY

LandAmerica Assessment Corporation (“LAC”) was requested by BankAtlantic Commercial Mortgage Capital to conduct a Phase I Environmental Site Assessment (“ESA”) for the Hollywood Video located at 424 E. 13th Street, Muncie, Indiana (the “Property”).

The Property, called Hollywood Video, consists of a 0.24-acre, rectangular-shaped parcel developed with one, single-story retail building specifically for the use by Hollywood Video. The Property is also improved with asphalt driveways, parking areas, and minimal landscaping. According to the Center Township Tax Assessor’s office, the Property was developed with the existing improvements in 1999.

The site is situated within an urban area of Muncie, Indiana. The Property building is bound to the north by a CVS Pharmacy (425 E. Memorial) with paved parking area and building; to the east by S. Madison Road beyond which is a Save-on Liquor Store (1920 S. Madison) and a Rich Gas (a.k.a. Speedway 1900 S. Madison); to the south by 13th Street beyond which is Advanced Auto Parts; and to the west by a spill-over parking lot owned by CVS store, beyond which is a residential area. Based upon topographic map interpretation and site observations, the immediate area of the Property and surrounding appears to slope to the south. As such, local groundwater flow beneath the site is inferred to be in a southerly direction following surficial contours.

Conclusions

LAC has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-00 of 424 E. 13th Street, Muncie, Indiana 47302, the Property. Any exceptions to or deletions from this practice are described in Section 1.4 of this report. This assessment has revealed no evidence of recognized environmental conditions in connection with the Property.

Recommendations

Based on the information available at the time of this assessment, LAC does not recommend further investigation of the Property at this time.

1.0 INTRODUCTION

Per the request of BankAtlantic Commercial Mortgage Capital, LandAmerica Assessment Corporation (“LAC”) has conducted a Phase I Environmental Site Assessment (“ESA”) in general accordance with ASTM E-1527-00 of the Hollywood Video located at 424 E. 13th Street, Muncie, Indiana (the Property).

On May 21, 2005, David F. Keats, CHMM, CEI, a representative of LAC, conducted a site reconnaissance to assess the possible presence of petroleum products and hazardous materials at the Property. LAC’s investigation included review of aerial photographs, reconnaissance of adjacent properties, background research and review of available local, state and Federal regulatory records regarding the presence of petroleum products and/or hazardous materials at the Property.

LAC contracted EDR of Milford, Connecticut to perform a computer database search for local, state and Federal regulatory records pertaining to environmental concerns for the Property and properties in the vicinity of the Property (see Section 3.0).

1.1 Purpose

The purposes of this Phase I Environmental Site Assessment (“ESA”) are: To identify existing or potential Recognized Environmental Conditions (as defined by ASTM Standard E-1527) in connection with the Property. LAC understands that the findings of this study will be used by the Client to evaluate a pending financial transaction in connection with the Property.

1.2 Scope of Services

LAC has performed a Phase I Environmental Site Assessment on the Property in general conformance with the scope and limitations of ASTM Practice E 1527-00 for Phase I Environmental Site Assessments. Any exceptions to or deletions from this practice are described in the body of this report.

In general, the scope of this assessment consisted of reviewing readily available information and environmental data relating to the property; interviewing readily available persons knowledgeable about the site; reviewing readily available maps, aerial photographs and records maintained by federal, state, and local regulatory agencies; and conducting a site visit.

1.3 Assumptions

There is a possibility that even with the proper application of these methodologies there may exist on the Property conditions that could not be identified within the scope of the assessment or which were not reasonably identifiable from the available information. LAC believes that the information obtained from the record review and the interviews concerning the site is reliable. However, LAC cannot and does not warrant or guarantee that the information provided by these other sources is accurate or complete.

1.4 Limitations and Exceptions

The findings and conclusions contain all of the limitations inherent in these methodologies that are referred to in ASTM 1527-00. Specific limitations and exceptions to this ESA are more specifically set forth below:

• Aerial photographs were ordered from the City of Muncie and had not been received at the time of report submittal. Other historical resources were relied upon for this study.

1.5 Special Terms and Conditions

Authorization to perform this work was given by a directive from BankAtlantic Commercial Mortgage Capital.

1.6 Use Reliance

This report may be relied upon by BankAtlantic Commercial Mortgage Capital, its successors and/or Assigns and Affiliates, in determining whether to make a loan evidenced by a note (the “Property Note”) which is further secured by the Property. This report may be relied upon by any purchaser or assignee of the Property Note in determining whether to acquire the Property Note or an interest therein (which may include securities which are secured all or in part by the Property Note). In addition, this report may be relied upon by any rating agency involved in rating securities secured by, or representing an interest in, the Property Note and any investors purchasing securities issued by a trust with an ownership interest, either directly or indirectly, in the property note. “Key Site Manager” consisted of the store manager on duty. There were no individuals available qualified to provide an Environmental Pre-survey Questionnaire to LAC.

2.2 Location and Legal Description

The address of the Property is 424 E. 13th Street, Muncie, Indiana. The Property is located in a dense urban area of Muncie, County of Delaware. According to the Center Township Assessor’s office, the assessor’s parcel number of the Property is 11-22-104-013-000. The legal description is presented below:

2.3 Site and Vicinity General Characteristics

The Property is located in a commercial area that is characterized by numerous small retail businesses. There is significant residential development in the vicinity within 1/8 mile of the Property. According to the City of Muncie Zoning Department Map, The Property is zoned “Commercial.”

The Property, called Hollywood Video, consists of a 0.24-acre, rectangular-shaped parcel developed with one, single-story retail building specifically for the use by Hollywood Video. The Property is also improved with asphalt driveways, parking areas, and minimal landscaping. According to the Center Township Tax Assessor’s office, the Property was developed with the existing improvements in 1999.

Access to the asphalt-surfaced Property parking lot is provided from E. 13th Street and Madison Street. A small paved alley to the north of the Property accepts sheetflow from the parking areas and downspout water from the roof. Manicured landscaping surrounds the Property along the eastern and southern boundaries and includes an automatic irrigation system. No other structures or significant surface features were noted on the Property at the time of the reconnaissance. Landscaping is professionally maintained and irrigated by an automatic system.

2.4 Current Use of the Property

The Property was built in 1999 for the exclusive use by Hollywood Video. No other tenants currently occupy the Property.

According to City of Muncie zoning department map, the Property is zoned “Commercial.” Based on the information reviewed during the preparation of this report and the observations made during the reconnaissance of the Property, the building is occupied solely by Hollywood Video.

2.5 Description of Site Improvements

The building is constructed of concrete masonry block and structural steel on a poured concrete slab-on-grade foundation. Floors are of carpeting and resilient floor tiles. Walls are a combination of painted wallboard and area of painted block. Ceiling is exposed structure and HVAC ductwork. The exterior of the Property building is finished with exterior insulating finishing system (EIFS) materials and painted. The roof is flat and of EPDM single-ply rubber.

The City of Muncie Public Works department supplies drinking water to the Property from the municipal distribution system. Sanitary discharges on the Property are discharged into the municipal sanitary sewer system. The Property area is serviced by the City of Muncie. No wastewater system is onsite. Historical use of the property indicates there were likely no onsite septic system currently or in the past.

The Property building HVAC system is powered by natural gas and electricity. Natural gas is provided by Vectron. Electricity is provided to the Property by American Electric Power (AEP).

2.6 Current Use of Adjoining Properties

During the vicinity reconnaissance, LAC observed the following land use on properties in the immediate vicinity of the Property.

North: The Property building is bound to the north by a CVS Pharmacy (425 E. Memorial) with paved parking area and building. It is a retail pharmacy store.

South: Areas immediately adjacent to the south is 13th Street beyond which is Advanced Auto Parts.

3.0 RECORDS REVIEW

3.1 Standard Environmental Record Sources

3.1.1 State and Federal Regulatory Review

Information from standard Federal and state environmental record sources was provided through Environmental Data Resources, Inc. (EDR). Data from governmental agency lists are updated and integrated into one database, which is updated as these data are released. This integrated database also contains postal service data in order to enhance address matching. Records from one government source are compared to records from another to clarify any address ambiguities. The demographic and geographic information available provides assistance in identifying and managing risk. The accuracy of the geocoded locations is approximately +/-300 feet.

In some cases, location information supplied by the regulatory agencies is insufficient to allow the database companies to geocode facility locations. These facilities are listed under the unmappables section within the EDR report. A review of the unmappable facilities indicated that none of these facilities are within the ASTM minimum search distance from the Property. Regulatory information from the following database sources regarding possible recognized environmental conditions, within the ASTM minimum search distance from the Property, was reviewed. Specific facilities are discussed below if determined likely that a potential recognized environmental condition has resulted at the Property from the listed facilities. Please refer to Appendix C-1 for a complete listing.

Federal NPL

The National Priorities List (NPL) is the Environmental Protection Agency (EPA) database of uncontrolled or abandoned hazardous waste sites identified for priority remedial actions under the Superfund Program.

The Property is not listed as a NPL facility. No NPL sites are located within one mile of the Property.

Federal CERCLIS List

The Comprehensive Environmental Response, Compensation and Liability Information System (CERCLIS) list is a compilation of sites that the EPA has investigated or is currently investigating for a release or threatened release of hazardous substances.

The Property is not listed as a CERCLIS facility. No CERCLIS sites are listed within one-half mile of the Property.

The Property is not listed as a CERCLIS-NFRAP facility. No CERCLIS-NFRAP sites are listed on or adjoining the Property.

Federal Resource Conservation and Recovery Act (RCRA) CORRACTS TSD Facilities List

The EPA Resource Conservation and Recovery Act (RCRA) Program identifies and tracks hazardous waste from the point of generation to the point of disposal. The RCRA Treatment, Storage and Disposal (TSD) database is a compilation by the EPA of reporting facilities that treat, store or dispose of hazardous waste. The CORRACTS database is the EPA’s list of treatment storage or disposal facilities subject to corrective action under RCRA.

The Property is not listed as a RCRA CORRACTS TSD facility. Three RCRA CORRACTS TSD facilities are listed within one mile of the Property. However, all three facilities are more than ½ mile from the Property and either gross-gradient or down-gradient from the Property. As such, none of these sites are considered to pose a concern to the Property.

Federal Resource Conservation and Recovery Act (RCRA) Non-CORRACTS TSD Facilities List

The RCRA TSD database is a compilation by the EPA of reporting facilities that treat, store or dispose of hazardous waste.

The IDEM maintains a State CERCLIS-equivalent list (SCL) of sites under investigation that could be actually or potentially contaminated and presenting a possible threat to human health and the environment.

The Property is not listed as a State CERCLIS facility. No SCL sites are listed within one-half mile of the Property.

Solid Waste/Landfill Facilities (SWLF)

A database of SWLF is prepared by IDEM.

The Property is not listed as a SWLF facility. No SWLF facilities are listed within one-half mile of the Property.

State Leaking Underground Storage Tank List (LUST)

The IDEM compiles lists of all leaks of hazardous substances from underground storage tanks (USTs).

The Property is not listed as a LUST facility. Seven LUST sites are listed within one-half mile of the Property. Of the seven facilities, six appear to be closed, “soil-only” impact, downgradient from the Property, or otherwise addressed to the satisfaction of the IDEM. As such, these six sites are not suspected to be a significant environmental concern.

The single active LUST facility with potential to have impacted the Property is discussed below:

• Rich (Speedway) Gas Station (1900 S. Madison) is located adjacent to the east of the Property and across S. Madison Street. It is identified as an open medium priority LUST case. According to IDEM, active/open LUST facilities are given the following priorities and conditions for each:

IDEM High Priority Sites: Vapors are in buildings with people; Drinking water may be impacted; Tank contents are present in pool; Utility conduits (such as sewer lines) are affected; Environmentally sensitive areas are impacted.

IDEM Medium Priority Sites: No high priority conditions present; and in addition to soil, possible ground water contamination.

IDEM Low Priority Sites: Only soil impacted by the tank contents

The adjacent LUST site, Rickers BP is considered to only have “possible” ground water contamination based on it’s “Medium Priority.” LAC contacted the Indiana Department of Environmental Management (IDEM). According to the IDEM representative, there are currently no studies that document the extent of contamination from this facility. IDEM provided the most recent update of the facility which was a May 18, 2005 letter from IDEM to the LUST facility owners requesting “further study” of the LUST site. This LUST facility is considered hydrogeologically cross to downgradient based on inferred groundwater flow. It should be noted that the “Responsible Party” in this incident appears to be the entities of Speedway, the overall owners of the LUST facility.

In the unlikely event contamination has encroached upon the Property, according to the State’s policy toward owners of property containing contaminated aquifers the State is not likely to take enforcement action against a property owner who owns a property under which is an aquifer contaminated by subsurface migration from an off-site source or sources. Therefore, the Property owner would not likely be liable for any contamination of the underlying aquifer that was attributed to the above listed off-site source. Accordingly, it is our opinion that this condition is de minimis, and no further action is warranted.

State Underground Storage Tank List (UST)

The IDEM compiles a list of UST locations.

The Property is not listed as an UST facility. One registered UST facility is listed adjacent to the Property.

o Rich (Speedway) Gas Station (1900 S. Madison) is located adjacent to the east of the Property and across S. Madison Street. Five of the USTs listed are indicated as “removed.” Four USTs installed in 1989 are listed as “Currently in use.” Potential concerns from this facility are discussed above in the LUST discussion.

3.1.2 Local Regulatory Review

3.1.2.1 County Recorder/Assessor

According the Center Township Assessors office, no environmentally related liens or deed restrictions have been recorded against the Property.

3.1.2.2 Fire Officials

Records from the Muncie Fire Department were reviewed for evidence indicating the presence of underground storage tanks (USTs) and for the use of hazardous materials. No records of such were found for the Property address. LAC interviewed Joe Scott, Chief Inspector for the Muncie Fire Department. According to Mr. Scott there are no compliance issues associated with the Property. Regarding the Speedway Gas Station at 1900 S. Madision, Mr. Scott was not aware of any issues or LUST status.

3.1.2.3 Building Department

Records from the Muncie Building Department were reviewed for evidence indicating the developmental history of the Property, and for the presence of documentation relative to USTs. The records indicate the current site structure was constructed in 1999. Prior land use was not indicated in the files. The files contained miscellaneous building permits issued in 1999. According to desk staff (Barb), no issues regarding the Property are documented since the 1999 date of construction.

3.2 Physical Setting Sources

3.2.1 Topography

The United States Geological Survey (USGS), Muncie West Quadrangle 7.5 minute series topographic map was reviewed for this Phase I Environmental Site Assessment (ESA). This map was published by the USGS in 1992 with no indicated photorevision. According to the contour lines on the topographic map, the Property is located at approximately 960 feet above mean sea level (MSL). The contour lines in the area of the Property indicate the area is sloping gently to the south.

The Property is depicted shaded in red indicating it is situated in a dense urban area. No structure is specifically depicted on the Property. Although not shown on the copy of the Quadrangle included in this report, the White River flows north/south approximately o1.5 miles to the southwest of the Property.

3.2.2 Soils/Geology

The Property and surrounding areas are all classified as silty clay/loam to clay/loam till deposited by the Huron-Erie Lobe of Wisconsinan age. The nearest other surface geology is the undifferentiated outwash following the White River.

The soil series of the Property is classified, “Urban” meaning it is unclassifiable due to disturbance. The estimated depth to bedrock at the Property is approximately 150 feet below the ground surface.

3.2.3 Hydrology

According to inferences from the USGS topographical map and area observations, shallow groundwater in the area of the Property is predicted approximately 20 feet below grade. Based on the topography of the Property and vicinity, shallow groundwater is anticipated to flow to the south. However, overall regional groundwater flow may be influenced by the White River situated approximately 1.5 mile to the southwest of the Property. As such, deep groundwater may trend toward the southwest from the area of the Property. No on-site water wells or springs were observed during the Property reconnaissance.

The nearest surface water in the vicinity of the Property is the White River, located approximately 1.5 mile to the west of the Property. No settling ponds, lagoons, surface impoundments, wetlands or natural catchbasins were observed at the Property during this investigation. The Property does not appear to overly a sole source aquifer.

3.2.4 Flood Zone Information

According to the map image produced at ESRI/Federal Emergency Management Agency (FEMA) Project Impact Hazard Site, the Property is not located in a flood zone. The map was derived from the effective Flood Insurance Rate Map (FIRM) but the base cartographic map information such as roads, rivers, and political boundaries were not. Therefore, information derived from this map image should be considered an advisory tool for general hazard awareness.

3.2.5 Oil and Gas Exploration

No oil and/or gas exploration is evident in the area of the Property.

3.3 Historical Use Information

LAC obtained historical data of the Property’s development via Sanborn Maps, topographical map, and local records. The following briefly summarizes the developmental history of the Property.

The site was developed with two residential structures as early as 1950 and 1954 according to the Sanborn Fire Insurance map for those years. The 1938 aerial photograph of the Property appears to show mostly vacant property. By 1972, the two residences have been replaced by a single small structure labeled on the Sanborn map as a “restaurant.” The 1992 topographical map does not provide any site-specific features. Local records indicate the Property was constructed with the current development in 1999.

According to County building department records and tax assessor records, the Hollywood Video building was constructed at the Property by 1999.

3.3.1 Aerial Photographs

Aerial photographs were ordered from the City of Muncie/Delaware County Planning Department. The photos have not been received at the time of this writing.

3.3.2 Sanborn Fire Insurance Maps

Sanborn Fire Insurance maps dated 1919, 1951, 1963, and 1967 were available for review, and were provided by EDR/Sanborn. Copies of the maps are included in Appendix B-2.

3.3.6 Historical Use Information on Adjoining Properties

North: Prior to the current CVS pharmacy development, the area to the north of the Property has been essentially occupied by residential type structures at least between 1950 and 1972.

South: Prior to the current use as an auto parts store, the area to the south across E. 13th Street was essentially residential in at least 1950 and 1954. By 1972, the area was developed with a gasoline filling station.

East: Prior to the current use as a liquour store, the area to the east of the Property was a gasoline station in 1972. The property to the northeast of the Property has been a gasoline station from as early as 1950 through to the present.

West: In as early as 1950 through to the present, the area to the west has been residential. In recent years a parking lot was constructed to serve the CVS Pharmacy.

4.0 SITE RECONNAISSANCE

4.1 General Site Characteristics

The Property, called Hollywood Video, consists of a 0.24-acre, rectangular-shaped parcel developed with one, single-story retail building specifically for the use by Hollywood Video. The Property is also improved with asphalt driveways, parking areas, and minimal landscaping. According to the Center Township Tax Assessor’s office, the Property was developed with the existing improvements in 1999.

The site is situated within an urban area of Muncie, Indiana. The Property building is bound to the north by a CVS Pharmacy (425 E. Memorial) with paved parking area and building; to the east by S. Madison Road beyond which is a Save-on Liquor Store (1920 S. Madison) and a Rich Gas (a.k.a. Speedway 1900 S. Madison); to the south by 13th Street beyond which is Advanced Auto Parts; and to the west by a spill-over parking lot owned by CVS store, beyond which is a residential area. Based upon topographic map interpretation and site observations, the immediate area of the Property and surrounding appears to slope to the south. As such, local groundwater flow beneath the site is inferred to be in a southerly direction following surficial contours.

4.1.1 Solid Waste Disposal

Solid waste on the Property is collected in one 10-cubic yard dumpster situated in a fenced enclosure at the southwest corner of the Property. The solid waste is collected once a week by a private waste hauler for ultimate disposal at any number of regional waste management facilities. The dumpster was noted to contain miscellaneous cardboard and debris the time of the Property reconnaissance and no indication of potentially hazardous material disposal was noted during LAC’s reconnaissance.

4.1.2 Surface Water Drainage

The property’s paved areas and roof appear to flow to the north end of the property via sheet flow and downspouts to a shallow grassy retention area. A concrete swale opening in the parking lot curbing facilitates flow from the eastern portion of the pavement. The retention area ultimately flows to a storm sewer inlet maintained by the City of Muncie.

4.1.3 Wells and Cisterns

No aboveground evidence of wells or cisterns was observed during the site reconnaissance.

4.1.4 Wastewater

No indications of industrial wastewater disposal or treatment facilities were observed during the onsite reconnaissance.

4.1.5 Additional Site Observations

No additional, relevant general Property characteristics were observed.

4.2 Potential Environmental Conditions

4.2.1 Hazardous Materials and Petroleum Products Used or Stored On-site

No evidence of the use of hazardous materials or wastes was observed on the Property. Typical janitorial supplies were observed.

4.2.1.1 Unlabeled Containers and Drums

No unlabeled containers or drums were observed during the Property reconnaissance.

4.2.1.2 Disposal Locations of Regulated/ Hazardous Waste

No obvious indications of hazardous waste generation, storage or disposal were observed on the Property or were indicated during interviews.

4.2.2 Evidence of Releases

No obvious indications of hazardous material or petroleum product releases, such as stained areas or stressed vegetation, was observed during the site reconnaissance or reported during interviews. Asphalt-paved parking areas exhibited normal surface staining due to use.

4.2.3 Polychlorinated Biphenyls (PCBs)

Older transformers and other electrical equipment could contain polychlorinated biphenyls (PCBs) at a level that subjects them to regulation by the United States Environmental Protection Agency (USEPA). PCBs in electrical equipment are controlled by USEPA regulations 40 CFR, Part 761. Under the regulations, there are three categories into which electrical equipment can be classified:

• Less than 50 parts per million (PPM) of PCBs – “Non-PCB” transformer

• 50 ppm-500 ppm – “PCB-Contaminated” electrical equipment

• Greater than 500 ppm – “PCB” transformer

LAC observed three pole-mounted electrical transformers within the public alley the northwest of the Property. The units are situated outside the northwest corner of the Property building. The units were not labeled as to their PCB status; however, they are owned and operated by American Electric Power (AEP). No indication of staining, leaks or fire damage was observed on or around the three units. Based on the initial development of the Property in 1999, all three units are considered “Non-PCB” transformers. No other electrical equipment expected to contain PCBs was observed on the Property during LAC’s reconnaissance.

4.2.4 Landfills

No evidence of on-site landfilling was observed or reported during the site reconnaissance.

4.2.5 Pits, Ponds, Lagoons, Sumps and Catch Basins

No evidence of on-site pits, ponds, lagoons was observed or reported during the site reconnaissance. No evidence of sumps or catch basins, other than used for stormwater removal, was observed or reported during the site reconnaissance.

4.2.6 Aboveground and Underground Storage Tanks (ASTs and USTs)

No evidence of aboveground storage tanks or underground storage tanks (ASTs or USTs) was observed during the Property reconnaissance or reported during interviews.

4.2.7 Radiological Hazards

No radiological substances or equipment was observed or reported stored on the Property.

4.2.8 Drinking Water

The Property is connected to the city water supply provided by the City of Muncie Public Works Department. According to http://www.epa.gov/safewater/dwinfo.htm, the drinking water supplied to the site is within state and Federal standards, including lead and copper. Water sampling was not conducted at the site to verify water quality.

4.2.9 Additional Hazard Observations

No additional hazards were observed on the Property.

4.2.10 Asbestos-Containing Materials (ACM)

No friable asbestos was identified. Moreover, based upon the age of the building (constructed 1999), no friable materials are suspected to exist, since friable materials were phased-out of use by 1981. Notwithstanding, non-friable materials may contain asbestos, since they were not covered by the phase-out. These materials include floor tile, wallboard and some roofing components. These materials were observed to be in good condition, and represent no hazard unless cut, sawn or broken. Accordingly, no samples were obtained. Notwithstanding, prior to conducting demolition, renovations or building repairs that may damage the suspect materials, it would be prudent to verify the presence or absence of asbestos.

4.2.11 Radon

The USEPA has prepared a map to assist National, State and local organizations to target their resources and to implement radon-resistant building codes. The map divides the country into three Radon Zones, Zone 1 being those areas with the average predicted indoor radon concentration in residential dwellings exceeding the EPA Action limit of 4.0 picoCuries per Liter (pCi/L). It is important to note that the EPA has found homes with elevated levels of radon in all three zones, and the EPA recommends site specific testing in order to determine radon levels at a specific location. However, the map does give a valuable indication of the propensity of radon gas accumulation in structures. Review of the EPA Map of Radon Zones places the Property in Zone 1. However, based on the commercial use of the Property as well as the slab-on-grade foundation, radon concerns are considered minimal.

4.2.12 Lead-Based Paint

Due to the date of construction (1999), lead-based paint is not likely to be present. However, since the current regulations regarding lead-based paint are generally for residential properties, lead-based paint is not considered a significant environmental concern.

4.2.13 Mold

As part of this assessment, LAC performed a limited visual inspection for the significant presence of mold. A class of fungi, molds have been found to cause a variety of health problems in humans, including allergic, toxicological and infectious responses. Molds are decomposers of organic materials, thrive in humid environments and produce tiny spores to reproduce, just as plants produce seeds. When mold spores land on a damp spot indoors, they may begin growing and digesting whatever they are growing on in order to survive. When excessive moisture or water accumulates indoors, mold growth will often occur, particularly if the moisture problem remains undiscovered or unaddressed. As such, interior areas of buildings characterized by poor ventilation and high humidity are the most common locations of mold growth. Building materials including drywall, wallpaper, baseboards, wood framing, insulation and carpeting often play host to such growth.

LAC observed interior areas of the Property structure for the significant presence of mold. LAC did not note obvious visual or olfactory indications of the presence of mold, nor did LAC observe obvious indications of significant water damage. As such, no bulk sampling of suspect surfaces was conducted as part of this assessment.

This activity was not designed to discover all areas, which may be affected by mold growth on the Property. Rather, it is intended to give the client an indication if significant (based on observed areas) mold growth is present at the Property. Additional areas of mold not observed as part of this limited assessment, possibly in pipe chases, HVAC systems and behind enclosed walls and ceilings, may be present on the Property.

6.3 Conclusions

LAC has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-00 of 424 E. 13th Street, Muncie, Indiana 47302, the Property. Any exceptions to or deletions from this practice are described in Section 1.4 of this report. This assessment has revealed no evidence of recognized environmental conditions in connection with the Property.

6.4 Recommendations

Based on the information available at the time of this assessment, LAC does not recommend further investigation of the Property at this time.

6.5 Deviations

This Phase I ESA substantially complies with the scope of services and ASTM 1527-00, as amended, except for exceptions and/or limiting conditions as discussed in Section 1.4.
