2! believe, has spent two nights since March 25 , 1 990 , a t the fam

1 was holding my daughter. on March 25, 1990, Barry grabbed

2 around my thighs, l i f ted me approximately three feet up into t

4 an area rug. I struck my head and was dazed. I got up and r

6 conversation he informed me that i t was his house and that

7 could bring over anyone he wishes to .

8 12 . I informed him that , as a resul t of his prior agreeme

9. and the representation of his lawyer, I would occupy the hou

and that he would not make unauthorized entr ies . I did n

belIeve that any further confrontation was safe for me given h

past history of physical violence towards me.

CHILD AND sFOqSAL SUFPORT

Barry did,

14. In October of 1988, with Barry's approval, I le f t

job as a non-equity partner with Cummins and White, the same fi

in which Barry is a partner. My annual salary was then $75,0

a year, from which health insurance premiums were deducted.

July 2, 1990, I s tarted a job paying $43,200 a year for thr

days work, which would permit me to spend more time a t home w

our child. I t was our agreement when I l e f t work that I wo

not have to resume work unt i l I f e l t i t appropriate in order

ATTORNEYS' FEES AND COSTS

15. I borrowed from my fr iends the in i t i a l $5,000 to re ta

my at torney. Barry is being represented by Arthur Katz,

partner in his law f inn and. therefore, is not incurring a

current l ega l ' fees. Since Barry i s get t ing his leg

representation for free I request an immediate pendente l i

award of at torneys ' fees and costs to repay my borrowing and

permit me to conduct l i t iga t ion on a pari ty with Barry. Barr

recent conduct in direct contradiction to his lawye

representations indicates the prospect of cost ly l i t igat ion.

current ly experiencing f inancial di f f icu l t i es . Since I l e

cummins and White in October of 1.988, I have no f i r s t ha

knowledge of these matters. I had been advised that Barr

lawyer has presented a detailed f inancial statement to my coun

as to the s ta te of the law firm as of December 31, 1989, prepa

by Ernst and Young. However, I wil l need a forensic account

to evaluate the pract ice for purposes of set t lement or, prior

t r i a l in th i s issue. I am informed and believe that a $2,5

retainer is required to hire such an expert . I also request

addit ional $1,500 on account of necessary deposition

photocopying costs , and the cost of business record subpena fe

and copying costs .

INTERNAL REVENUE DEBT

of $10,000. I am s t i l l willing to take out th i s loan to sa t is

the In ternal Revenue Service obligation to prevent the IRS fr

again our home. I would also consent to a portion of borrow

funds being used to reduce our outstanding cred i t card de

since the in te res t ra te on these types of obligations are grea

than the in te res t rate which we would be charged from our ho

equity loan. I am requesting the Court to make an order th

both par t ies cooperate in obtaining th i s equity loan. From th

equity loan, my cost of l i t igat ion can be advanced to me subj

to al locat ion a t the time of t r i a l .

PERSONAL AUTOMOBILE

17. Prior to separation and exclusively thereaf ter , I h

had possession and use of a Nissan 300ZX

automobile, License2FVG765. I request tha t I be awarded temporary exclusive use

possession of th is automobile.

CUSTODY AND VISITATION

IS. At the current time, without prejudice to eith

par ty 's claims I request tha t the Court make an Order of joi

legal custody, with primary physical custody to me subject

Barry's reasonable vis i ta t ion r ights . I t i s my u n d e r s t a n d ithat Respondent wishes to vis i t with our daughter one evenin

week on Wednesday. I consent to a Wednesday vis i ta t ion from 7

to 9:30p.m. However, based upon the Respondent's recent condu

in having "guests over for pizza and beer" while I was

present and while he was supposed to be vis i t ing with o

daughter I reques t t ha t t h i s vis i t a t ion be done outside of t

house. Respondent has also requested a weekly vis i ta t ion

weekends. I consent to a two hour Saturday v i s i t from 3:00

5:00 p.m., on al ternate weekends. Pr ior to our separation, t

Respondent, who is a t r i a l lawyer, was not act ively involved

chi ld rear ing ac t iv i t i e s . He was not act ively involved in o

ch i ld ' s l i f e . I believe the vis i t a t ion se t forth above

consis tent with the Respondent 's own request other than

object ion to him visi t ing in my home.

RESTRAINING ORDERS

19. Prior to the in i t i a t ion of t h i s request , my attorn

has unsuccessfully attempted to have the Respondent s t ipu la te

a res t ra in ing order which I am informed i s customary in fam

law matters with respect to property and the incurr ing of deb

other than in the ordinary course of business or for t

necess i t ies of l i f e . The Respondent has refused to do so. Fr

his refusal , I , therefore, in fe r t ha t he intends to t rans fe r a

hypothecate property in derogation of my r ights . I , therefor
