BEFORE THE BOARD OF APPEALS OF THE CITY AND COUNTY OF SAN FRANCISCO

FINDINGS AND CONCLUSIONS FOR APPEAL NO. 18-002

On March 7, 2018, this Appeal (No. 18-002), filed by Lidia Woytak (“Appellant”), of the issuance of Building Permit Application No. 2016/02/01/8496S (“Site Permit”), came before a duly noticed hearing of the Board of Appeals. The permit is for work at the property located at 1033-1037 Washington Street (the “Subject Property”) in San Francisco. The Board voted 4-1 (Commissioner Lazarus dissented) to grant the appeal and deny the Site Permit. At a duly noticed hearing on April 11, 2018, the Board directed the preparation of these findings to support that decision. Having heard all the public testimony and reviewed all the documents in the record on this matter, the Board of Appeals hereby grants the Appeal and denies the Site Permit based on the following findings and conclusions:

1. On December 15, 2017, the San Francisco Department of Building Inspection issued the Site

Permit to 1033-1037 Washington LLC for the following work to be performed at the Subject

Property: A fourth-floor residential unit addition with a roof deck above to the existing three

story, over the garage, three unit building; renovation of the third-floor unit entry; renovation of

the basement; repair of existing egress stairs at the rear of the property; and seismic and

foundation upgrades.

2. On January 2, 2018, Appellant, one of the owners of 1041 Washington St., filed this Appeal with

the Board of the issuance of the Site Permit.

3. Appellant’s property is located immediately adjacent to the Subject Property. Appellant’s

property shares a wall with the Subject Property for approximately the first 20 feet starting from

the front of the building. Thereafter, Appellant’s property is setback several feet which creates

a very narrow area between the buildings.

4. The residential buildings on Washington Street between Powell Street and Wetmore Street,

including the Subject Property, are nonconforming structures that do not comply with current

Planning Code requirements, because they cover the entire parcels and there is no open space.

5. The Subject Property currently consists of three stories over a garage. The Appellant’s property

is a similar height to the Subject Property. The four buildings to the east between the Subject

Property and Powell Street are three stories. The Site Permit would allow the construction of an

additional story to the Subject Property and a roof deck on top of the addition, making the

Subject Property the tallest building on the block. (See Site Permit plans; photos of block.)

6. Four buildings on this portion of the block, including 1041 Washington St. and 1033-1037

Washington St., are Edwardian in design, very old and have unique, hand-crafted features.

7. The proposed fourth story shown in the plans accompanying the Site Permit is modern in design

and is not in character with the surrounding properties. The plans show that the fourth floor

addition will be visible from the street. The Site Permit also permits the construction of a roof

deck on top of the addition, a feature that does not appear to have been legally constructed in

the other buildings presently on this block. (See Site Permit plans.)

8. The permit would allow expansion of an already nonconforming structure, and the proposed

expansion is out of character with the surrounding properties, because greater side setbacks on

the fourth floor addition were not required by the departments. We therefore conclude that

this project would be detrimental to the surrounding neighborhood within the meaning of

Business and Tax Regulations Code Section 26(a) and the general public interest will be

adversely affected as a result of the permit within the meaning of Business and Tax Regulations

Code Section 30, and exercise our discretion to overturn the Site Permit.

9. The Board recognizes that this project was before the Board on April 5, 2017, when Appellant

appealed the Zoning Administrator’s decision to grant a variance to the rear yard requirement

(Planning Code Sec. 134). At that time, the Board voted 3-2 to grant the appeal and overturn

the variance on the basis that the variance failed to satisfy several of the factors required to

grant a variance under Section 305(c) of the Planning Code. But because 4 votes were necessary

for that motion to carry, the motion failed, and the Board took no action on the case. Thus, the

variance decision was upheld as a matter of law. On May 17, 2017, the Board denied

Appellant’s request that the Board rehear the case. The standards applicable when the Board

reviews a variance decision (Charter § 4.106(c)(2); Planning Code § 308.2(e)) and when the

Board decides a rehearing request (Board Rules, Art. 5, Sec. 9) are different from the standard

applicable to the Board’s review of a permit decision (Charter § 4.106(b); Business & Tax Code

Regulations Code §§ 26(a), 30.)

The Board adopts the above Findings in support of its decision to grant the Appeal and overrule the Department of Building Inspection, with Planning Department approval, and deny the Site Permit.
