REGULATIONS made by the Minister responsible for theEnvironment ill exercise ofthe powers conferred UpOIlItim by sections 7, 26, 44 and 45 ofthe EnvironmentalProtection Act, Cltapter 328 ofthe Substantive Laws ofBelize, Revised Edition 2000 - 2003, and all otherpowers thereunto him enabling.

1. These Regulations may be cited as the

HAZARDOUS WASTE REGULATIONS, 2009

Short title.

2. Inthese Regulations, unless the context otherwise lnterpretnio n

requires.-

"Act" means the Environmental Protection Act; CAP. 328

"carrier" means aperson accepting for transportation ortransporting wastes for storage, treatment or disposal;

"container" means any portable device in which a waste isstored, including but not limited to drums, barrels, and pails;

"Chief Environmental Officer" means the Chief CAP. 328

Environmental Officer appointed under the Act;

"Department" means the Department ofthe Environment CAl'. 328

established under Section 3 ofthe Act;

CAP. 328 "Designated Officer" means a designated officeras defmedin section 2 ofthe Act;

"disposal" means the intentional release of untreatedhazardous wastes into, or onto land, air or water;

"emptycontainer" means a containerthat contains less than2.5 centimeters of residue remaining at the bottom of thecontaineror less than 3% ofthe original contents, whichever isthe lesser amount;

"farmer"means a person engaged in the primary productionofan agricultural, horticultural, or arboricultural operation forfinancialgain;

"generator" means any person whose activity produceshazardous wastes or other wastes, or if that person is notknown, the person who is in possession and/or control ofthosewastes;

"hazardous wastes" means any material or substancecharacterized as being toxic, corrosive, flammable, reactive,explosive, infectious, or pathogenic that may pose a threat tothe environmentand human health, and includes waste that are:

(c) listedinAnnex 1ofthe Basel Conventionon theTransboundary Movement ofHazardousWaste;

"hazardous waste management facility" means afacilityforthe collection, storage, treatment, or disposal ofhazardouswastes which is authorized or permitted to operate for thispurpose by the Department;

"incompatible waste" means a hazardous waste tbat isunsuitablefor placement in a particular device, machine orfacilitybecauseitmaycause corrosion or decay ofcontainmentmaterials, or for comminglingwith another wasteor material under uncontrolled conditions because thecomminglingmight produce heat or pressure, fire or explosion,violent reaction, toxic dusts, mists, fumes orgases, or flammablefumes or gases;

"treatment" includes, in relation to waste, any thermal,physical, chemical or biological processes that change thecharacteristics of waste in order to reduce its volnme orhazardous nature orfacilitates its handling, disposal or recovery;

"waste" has the same meaning as in section 2 ofthe Act.

3. These Regulations apply to all hazardous wastesunless specifically exempted.

CAP. 328

Application

4. These Regulations do not apply to -

(a) househo ld wastes while in the possessionofthehouseholder or while un-segregated in amunicipal waste management system;

(b) wastes,otherthanpesticidesandemptypesticidecontainers,generatedbyfarmersin:

(i) the growing and harvesting ofcrops, or

(ii) the raising ofanimals, including manures returned to the soil as fertilizers;

Exemptions

(c) any hazardous waste, exceptingthose chemicalslisted in Table 3 ofthe Schedule, produced by agenerator in an amount less than 5 kilograms ifasolid,or5litersifaliquid,permonth, butonlyifthetotal quantity accumulated does not exceed 5kilogramsor5litersatanyonetime;

(d) domesticsewage;

Generalrecords

(e) wastes resulting from emergency spill clean­ups during emergency clean-up operations,provided the Department has authorized theclean-up activity and has made properarrangement for the safe disposal ofanyhazardous waste.

PART II

HAZARDOUS WASTE MANAGEMENT FACILITY

5. Every operator of a hazardous wastemanagement facility shall keep an operating record, in a formacceptable to the ChiefEnvircnmental Officer, ofthe followinginformation:

(a) adescription ofeach waste received, generatedorstored including:

(i) the name ofthe waste;(if) a description ofthe wastes including the

physical, chemical and biologicalcharacteristics ofthe waste;

(iii) the physical state ofthe waste;(iv} the quantity in kilograros or in liters ofthe

waste;

(b) records ofall waste obtained from a generator;

(c) all results ofplant inspections, tank inspectionsand the comments and data resulting from theinspections;

(d) all personnel trainingprograro documentation;

(e) a record of all events which resulted incontingencyplanimplementation;

(f) all monitoring data collectedas requiredby anyapprovals, includingoriginal strip chart record­ingsandrecordings fromcontinuousmonitoringequipment, where applicable;

(g) calibration and maintenance records ofmoni­toring equipment;

(h] copies ofall approvals issued by the Depart­ment;

(i) copies ofall applications for approvals filedwith the Department;

(j) copies ofall reports and records required bythe Department;

(k) the results ofall physical inventories ofwaste atthe facility.

6. No person shall establish, construct or operateanyhazardous waste management facility:

(a) in a 100 year floodplain unless the hazardouswaste management facility is designed, con­structed, operated and maintained to preventwashout ofany hazardous waste by a 100 yearflood;

(b) within 100 meters ofany land whichis subjectto slope failure;

(c) within a wetland area or an area immediatelyadj acent to a wetland so that natural drainagefrom the secure landfill would flow directly intothe wetland area;

(d) in a recharge area ofan unconfined area;

(e) within a minimum ofone and ahalf(l V,)rnileradius of any human settlement including avillage, town, city, farm, resort or hotel;

(j) within 300 meters of any non-intermittentwatercourse or any other permanent waterbody.

7. (l) A person who operates a hazardous wastemanagement facility shall provide to the ChiefEnvironmentalOfficer, ifthe ChiefEnvironmental Officer so requires, financialassurance in a form and amount that the ChiefEnvironmentalOfficerconsiders appropriate to coverthe cost ofreclamation,inventory removal, closure and 20 years ofpost closure care forthe facility.

(2) The amountofsecurity provided shall be basedupon the total oflthe most current cost estimate for closuretogether with the most current cost estimate for post closurecare and shall be annually adjusted for inflation.

(3) The estimates shall be based on reclamationconducted by a third party.

(4) In determining whether to require financialassurance, the ChiefEnvironmental Officer shall have regard tothe volume ofhazardous waste at the facility or accepted, thecharacteristics ofthe waste, and the nature ofthe treatment anddisposal ofsuch waste.

(5) Within 30 days ofany changes to the closureplan or post closure care plan, the operator shall recalculate theclosure and post closure care cost estimates and provide theseto the ChiefEnvironmental Officer.

8. TheChiefEnvironmental Officerrnaydeclareforfeitedthe financial assurance instrument provided by the operator if:

(a) the operator fails to commence closure in atimely fashion;

(b) the operatorfails to complete closure in a timelyfashion;

(c) the operator fails to meet closure or post clo­sure care standards specified in an approval;

(d) the operator fails to renew an existing financialassurance instrument in a timely fashion;

(e) the operator fails to adjust the amountoffinan­cial assurance for inflation or to account forchanges in the closure orpost closure care plan;

(f) the operatorhas not complied with an environ­mental protection order issued by the ChiefEnvironmental Officer;

(g) bankruptcyproceedings arecommenced againstthe operator.

9. The forms ofthe financial assurance include bondsand guarantees.

PART III

STORAGE

10. (I) A person who stores a hazardous waste shall storeitin a manner satisfactory to the ChiefEnvironmental Officer,and in an amount and in a manner such that it will not cause anadverse effect to the environment so that:

(a) any leakage is contained and prevented fromentering into the remainder ofthe storage siteand places beyond, including sewers and thegroundunderneaththe site;

(b) asecondary containment system is provided asa minimumfor liquid hazardous waste;

(c) the hazardous waste is adequately labeled,stating the identity ofthe containedhazardouswaste;

(d) incompatible hazardous wastes are stored insuch amanner that there will be no contact evenin the event ofarelease;

(e) routine inspections ofthe facilityareperformed;

(f) the place where the hazardous waste is stored:

(i) is secured from public entry,

(ii) is prominently identified as a hazardouswaste storage site,

(iii) is equipped with suitable equipment tohandle emergency situations,

(iv)is provided with operators trained torespond to emergency situations specific tothe waste and other substances stored;

(v) has noopeninginthe secondarycontainmentsystem that provides a direct connection toany place beyond the containment system,

(vi) provides no access for surface water toenterthe secondary contaimnent system.

(2) Forthe purposes ofthis Regulation, adequatelabelinginc1udesthe identity, quantity, data generated andwarning placard indicating the hazard associated with thewaste.

11. (l) All hazardous waste storage facilities shall besited, designed, operated, and constructed as approved by theChiefEnvironmental Officer.

(2) No person shall store hazardous waste on siteunless such storage is approved ofby the ChiefEnvironmentalOfficer.

(3) This Regulationshall not apply to storage facili­ties constructed and operated before the commencement oftheseRegulations.

PART IV

TRANSPORTATION

12. (1) A transporterofhazardous waste shall:

(a) provide a certificate of collection to thegenerator ofthe hazardous waste;

(b) transport hazardous waste to a facilityauthorized by the Department for storage,treatmentor final disposal, and shall obtainthe necessary certificate ofreceipt ofsuchwaste;

(c) obtain from the generator ofthe hazardouswaste a manifest, whichshall be signed forby both of them (transporter andgenerator), and which shall accompany allcollection, transport and deliveryprocesses;

(d) keep up to date collection and destinationrecords ofhazardous waste for inspectionpurposes, for a period ofup to ten years;

(e) guarantee that all activities (collection,

transportation and delivery) shall be car­ried out without any harm to the publichealth or the enviroumeut;

(f) adopt all possible measures in order toavoid diluting or mixing ofincompatiblehazardous wastes;

(g) provide, every three months, to the De­partment a report with all information onwaste collection, transportation and deliv­ery;

(h) identify allvehicles with a clear and visibleinscription (on both sides and behind) bywriting the words "HAZARDOUSWASTE TRANSPORT" in large letters,or by having posted thereon such words;

(i) present, when collecting wastes, a certifi­cate ofauthorization given by the Depart­ment;

(j) develop and maintain a contingency planfor spill prevention with control and coun­termeasure descriptions to designed mini­mize hazards to public health and the envi­ronment;

(k) have a written emergency procedure forspills including a notificationsystem; iden­tifiable characteristics, source, extent,amount ofspills, and access numbers ofappropriate authorities;

(/) provide adequate and continuous trainingto all his personnel;

(m) have an insurance to cover anyh=com­ingfrom the development ofhis activities;

(n} carry inthe vehicle all the adequate equip­mentandmaterials to reduce andminimizethe hazards ofan eventualwaste spill;

(0) keep arecord,inthevehicle, ofanyaccidentwhich may have occurred during thetransportation ofhazardons wastes;

(p) have,whentransportinghazardonswastebywater, a special floatable container, evenwhen it is full of-wastes, which shall beindependentofthetransportunit.

13. No transporter shall:

(a) store hazardous waste for a period ex­ceeding ten days before or after transpor­tation;

(b) collect, transport or deliver hazardouswaste stored in deficient containers;

(c) accept hazardous waste without havingprevious acceptance ofthe treatment orfinal disposal plant where it will be re­ceived;

(d) transportsimultaneonslyincompatiblehaz­ardous waste in the same vehicle.

TREATMENT

14. .(I) All facilitiesforthe treatment orfinal disposal ofhazardouswaste shall be sited, designed, constructed andoperated as approved bythe ChiefEnvironmental Officer.

LAND DISPOSAL

Solidhazardouswastes

15. No liquid hazardous waste shall be disposed ofin alandfill.

16. (I) The Chief Environmental Officer shall notapprove the disposal of solidhazardous wastes, not otherwiseprohibited from disposal in a landfill, unless the landfill isprovided with at least:

(a) two linersofwhichat leastone isasyntheticliner; "

(b) a leachate collection and removal system;

(c) a groundwater monitoring system; and

(d) a leak detection system between the twoliners.

(2) The Chief Environmental Officer shall notapprove the disposal of'liquid hazardous wastes by means ofdeep well injection unless the following are met:

(a) the fluids will be injected deep into theearth into brine saturated formation ornon-fresh water zones ofmore than I0,000mg/l TDS;

(b) the depth ofthe well shall be no less thantwo thousand (2,000) feet;

(c) assurances areprovided to showthatfluidsinjected into the deep sub-surface arelikely to remain confined for a very longtime;

(d) the operator ofthe well cao demonstratethatthere are no traosmissive fractures orfaults in the confining rock layers throughwhich injectedfluids could travel towardsdrinking water sources;

(e) the well casings preventthe borehole fromcaving in, aod are constructed of acorrosion-resistantmaterial such as steelor fiberglass-reinforced plastics;

(f) in the instaoce ofpetroleumwater, thesemust first receive pre-treatmentso that thedischarge ofoil in water does not exceed30 mg/l or ppm;

(g) a comprehensive monitoring anddocumentation programme is developedwhich has been approved by theDepartment;

(Iz) proper monitoring aoddocumentation ofinjection pressure aod flow rate to ensurepeakefficiency ofthe facility is conducted;

(/) continuous monitoring ofthe pressurizedaonulus fluid around casings is conductedto detect possible leaks.

17. All hazardous waste maoagement facilities shall be Guidelines

sited, designed, operated, constructedaod closed in accordaocewith such guidelines as may be approved by the ChiefEnvironmental Officer.

PART VII

LANDFILL DISPOSAL PROHIBITIONS

18. (I) The generator of a hazardous waste shall beresponsible for determining ifhis hazardous waste is restrictedfrom laodfill disposal pursuantto these Regulations.

Prohibitions

(2) The generator shall use a reasonable knowl­edge ofthe hazardous waste composition inmaking the deter­mination under subregulation(1) above.

19. Landfill disposal ofthe following hazardous wastes isprohibited:

(a) solid hazardous wastes containing I ormore halogenated organic compounds in atotal combined concentration greaterthan1000 milligrams per kilogram;

(b) solid hazardous wastes containing I ormore ofthe following non-halogenatedorganic compounds in a total combinedconcentrationgreaterthan I 000 milligramsper kilogram:

(i) acetone;(ii) benzene;(i) nebutyl alcohol;(ii) carbondisulfide;(iii) cresols and cresylic acid;(iv) cyc1ohexanone;(v) ethyl acetate;(vi) ethyl benzene;

(vii) ethylether;

(viii) isobutanol;(ix} methanol;(x) methyl ethyl ketone;(xi) methyl isobutylketone;(xii) nitrobenzene;(xiii} 2-nitropropanone;(xiv) pyridin;(xv) toluene;{xvi) xylene;

(c) flammable gasses that exert a measurablepressure on the cylinder, tube, tank or containerin which they are held;

(d) hydrocarbon contaminated solids exhibiting aflash point less than or equal to 61 degreesCentigrade as determined by the closed cuptest method;

(e) flammable substances that are liable tospontaneous combustion under the conditionsof disposal or are liable to emit flammablegasses under the conditions ofdisposal;

(f) wastes which produce a waste extract thatcontains one ormoresubstances listed inColumnI ofTable 2 ofthe Schedule in concentrationsequal or greaterthanthe concentrationspecifiedfor each contaminant in Column II ofthe saidTable, ifthose wastes are to be disposed withmunicipalgarbage;

(g) earthen materials including gravel, sand clayand soil, that contain more than 100 parts permillionby weight ofpolychlorinatedbiphenyls;

(lz)hazardous wastes with a pH less than 2.0 ormore than 12.5;

(i) solid hazardous wastes producing a wasteextract which contains any substance in aconcentration greater than the value for thatsubstance shown in subregulations (f) to (h).

(a} the hazardous waste will be used as a rawmaterial for an industry in Belize; and

(2) No person shall import hazardous waste intoBelize for the purpose ofdisposal.

21. No person shall mix hazardous waste with any solidor liquid for the sole purpose of dilution or to avoid therequirements ofthese Regulations.

22. Nopersonshall divide ahazardous waste in order toavoid the requirements ofthese Regulations orin order to meetthe exemptions provided for in Regulation 4.

PART VIII

REQUIREMENT FOR WASTE CLASSIFICATION

23. (I) Any person generating hazardous waste is re­sponsible for classifying each hazardous waste in a mannerapproved in writing by the Chief Environmental Officer.

(2) Waste streams shall be individually classified attheir source and shall not be analyzed following mixing ordilution with other waste streams.

(3) Any person generating a hazardous waste shallkeep adequate records of the dates, types and amounts ofhazardous waste generated and the date and location wheresuch waste are shipped for disposal.

INVESTIGATIONS, OFFENCES AND PENALTIES

24. Any designated officermay enter and inspectanyhazardouswaste managementfacility,andmayinspectandtake copies ofthe records of such facility.

25. Everypersonwho contravenes orfailsto complywith any ofthe provisions ofthese Regulations commits anoffence and shall be liable on summary convictionto afine ofnotless tban twenty five tbousand dollars orto imprisonment for aterm not exceeding two years, orto both suchfine and periodofimprisonment.
