I. INTRODUCTION
A. Construction Activities and Project Progress during Previous Six Months
1. The Masalli to Astara Motorway is a new 62 km motorway section of the M-3 highway corridor that links the capital city, Baku, to the south of the country and the town of Astara, which straddles the Azeri/Iranian border. The project is split into three sections; A (0 - 22.15 km), B (22.15 - 45.00 km), and C (45.00 – 62.14 km).
2. The Executing Agency for the project is the Azeri Road Service (ARS) Open Joint Stock Company.1
3. Following screening,2 an Environmental Impact Assessment (EIA) was carried out for the project in 2007. The EIA report was approved by ARS and ADB, and has served as a basis for the development of the specification and contract documents, and for the preparation and pricing of the Contractor Environmental Management Plan (EMP).
4. The Engineer appointed by ARS is Nippon Koei UK Ltd. The construction contract for Section A was awarded to Azerinsaatservice LLC, and the Design and Build contract for Lenkaran Bridge was awarded to Ganja Korpu Tikinti-2 OJC.
5. The first bi-annual environmental monitoring report covered the period 1st March to 31st August 2011. The second bi-annual environmental monitoring report covered the period 1st September 2011 to 31st May 2012.3 The third report covered the period 1st June 2011 to 31st December 2012. The fourth report covered the period 1st January 2013 to 30th June 2013. The present report covers the period 1st July to 31st December 2013, and has been split according to loan source into two reports; Part I, covering Section A and Lenkaran Bridge (Loan 2354 AZE), and Part II, covering Sections B & C (Loan 2831 AZE).
6. Key milestones relating to mobilisation are summarised below:
• Overall Contract agreement: 15th Dec 2010.
• The Engineer mobilised on 21st February 2011.
• Construction commenced on Section A on the 28th May 2011, following ADB’s approval.
• Construction commenced on Lenkaran Bridge on the 26th April 2012, following ADB’s approval.
• Earthworks began for Lenkaran Bridge on the 23rd June 2012.

7. Key milestones and construction activities relating to the past six months’ work are summarised below:
Section A
• No major work has taken place since August 2013.
• The Contractor is attempting further reorganization of the project’s management. The Contract period ended as of October 21st 2013 (after extension of time), but the Contractor is still bound by the Contract to complete the permanent Works.
• Bridge No.1’s diversion road is not well maintained, and the Engineer has requested several times that the Contractor carry out maintenance to ensure the safety of the travelling public. The diversion road at Bridge No. 10 is in place and in use by local traffic.
• Certificate No.13 up to 21 October 2013 was the last certificate submitted by the Contractor. Certificates 1 to 12 have all been paid.
• Variation Order No. 1, for AZN 5,061,535.70 and with an extension of time of 242 days has been approved. The Contract end date as extended was 21 October 2013.
Lenkaran Bridge
• Bridge structural works are substantially complete as is the tunnel. The box culvert is also substantially complete.
• Local Road No.1 has been completed to top of sub-base during the present reporting period.
• Local Road No.2 embankment works are ongoing from km 0+000 to km 0+280. From km 0+280 to km 0+498 sub-base is complete.
• On the main road the earthworks are complete from km 31+660 to km 31+760 and from km 31+972 to km 32+350. The first layer of base course has also been placed at these locations. Works are ongoing between km 32+350 to km 32+450.
• An Independent design check is to being carried out on the bridge design by VIC GmbH, a German Consultant. The cost of this will be included in the Variation Order for the weirs and additional protection works to safeguard the bridge pad foundations. The Contractor received the company’s letter of Intent on 26th June 2013.
• Interim Payment Certificates 13 to 15 have been submitted by the Contractor in the reporting period for works executed each month up to the end of September 2013. The Certificates have all been paid.
• Variation Order No 1 (VO1) for AZN 2,278,438/27 has been reviewed by the Engineer and submitted to the Client. VO1 is currently under review by the Asian Development Bank.

B. Project Organization and Environmental Management Team
8. Azerinsaat’s previous Environmental Protection Manager (EPM) left the company at the end of June 2013 and was immediately recruited as the EPM for Section B. A replacement EPM for Section A was recruited, but soon left the company4. A third EPM has not been recruited to date, and Section A is therefore without an EPM at present.
9. Ganja Korpu’s EPM, Muxtar Elesgerov, left the company at the end of November 2013. The Engineer has yet to receive formal notification of the EPM’s departure, and a replacement EPM has not been recruited.
10. The PIU’s Safeguards Specialist, Ms. Ilaha Ilyasova, is no longer responsible for the project. She has not yet been replaced, but the PIU is currently searching for a candidate.
C. Relationships with Contractors, Owner, Lender, etc.
11. The relationships between contractors, Engineer, Owner, and Lender are considered normal working relationships.
12. At the working level, communication with regards to environmental issues remains good.

II. ENVIRONMENTAL MONITORING
A. Status
Section A
13. During the previous reporting period a second letter was sent to the Section A Contractor reminding him that the environmental monitoring is a monthly obligation and not a quarterly obligation. The Engineer has received no response to the letter. Presumably due to the lack of EPM working on the Section A contract, no monthly monitoring has been carried out
14. The Engineer has not received Quarterly Reports 8 (April-June), 9 (July-September), or 10 (October-December) and there are therefore no monitoring results available for the present reporting period.
15. Although the lack of construction progress outlined in Chapter 1 above is not a positive situation in and of itself, it is at least a mitigating factor with respect to the lack of environmental monitoring.
Lenkaran Bridge
16. Due to the departure of the contractor’s EPM, Quarterly Reports 5 (July-September) and 6 (October-December) have not been submitted. There are therefore no monitoring results available for the present reporting period.
17. While no monitoring results are available, very little work has been carried out on Lenkaran Bridge in the latter part of the current reporting period, due to the seasonal closure of the site.
B. Results
Section A
18. No monitoring results are available for the present reporting period for Section A.
Lenkaran Bridge
19. No monitoring results are available for the present reporting period for the Lenkaran Bridge contract.
C. Action
20. Both Section A and Lenkaran Bridge contracts are now considerably out of compliance with the monitoring plans outlined in their respective SSEMPs. Immediate action is required by the contractors to recruit EPMs, carry out monthly monitoring, and catch up on quarterly reporting obligations. The Engineer has sent formal letters to both contractors, reminding them of their obligations and demanding immediate action.

III. ENVIRONMENTAL MANAGEMENT
A. Status
Section A
21. A change in the Contractor’s organisation and the resulting impact on environmental management activities were described in the previous Biannual Report. It was hoped that, following the setbacks outlined, the contractor would act on the recommendations provided by the Engineer, and bring itself back into compliance. The principal area of action was a full update of the SSEMP to reflect the numerous changes in responsibilities and working sites that had occurred.
22. Shortly after the submission of the previous Biannual Report, and as has already been described, the EPM resigned, and has not been satisfactorily replaced since. As a result, a revised SSEMP has not been submitted, Quarterly Reports have been neglected, and, presumably, there are no ongoing site inspections by the contractor for environmental and social issues.
23. During a November 2013 site visit by the Engineer’s Environmental Specialist, an attempt was made to visit the Section A’s Project Manager, to discuss the problems described above; the Project Manager was not on site, and no works were being carried out.
24. The concerns raised in the previous Biannual Report therefore remain entirely unaddressed, and the lack of EPM means the situation is, in fact, worse.
Lenkaran Bridge
25. Environmental management of the Lenkaran Bridge contract is problematic in a similar manner to Section A; the EPM resigned in November, and during a recent site visit by the Engineer’s Environmental Specialist, no staff were present on site with which to discuss environmental issues, as work had stopped for the winter.
26. A cursory inspection of the site indicated that none of the non-compliances identified in the previous reporting period have been addressed. Further details are provided in the relevant sections below.
27. The previous report discussed the possible inclusion of a pair of weirs enclosing the bridge, and voiced some concern over the ability of migratory fish to pass over the structures. Discussion between ARS and ADB closed the issue. A recent site inspection by the Engineer determined that the weirs have been constructed as designed, and that fish passing upriver5 (see Figure 3) would easily negotiate the weirs.

B. Documents
Section A
28. As has already been described, there has been no EPM in the Section A contractor’s team for the majority of the present reporting period. As such, the required documentation is presently out of date. The SSEMP has been in need of overhaul since the previous reporting period, but to the knowledge of ARS and the Engineer, this has not been carried out.
29. The Engineer has not received Quarterly Reports 8 (April-June), 9 (July-September), or 10 (October-December), so it is presumed that site inspection records, monitoring results and the grievance register have also been neglected.
30. The Engineer has issued warnings to the Contractor but to date no response has been received.
Lenkaran Bridge
31. The Engineer’s Environmental Specialist was able to discuss environmental management issues and requirements with the Lenkaran Bridge EPM well in advance of works commencing. As a result, documentation up until the present reporting period had been of reasonably good standard from the start. The EPM’s site audit checklists had been properly completed, with non-compliances swiftly highlighted.
32. With the departure of the Lenkaran Bridge EPM in November 2013, documentation is inevitably suffering; Quarterly Reports 5 (July-September) and 6 (October-December) have not been received by the Engineer.
C. Inspections and Audits
33. No major audits by ADB took place during the reporting period, although the ADB’s project team have visited the site.
34. Both the Section A and the Lenkaran Bridge contractors are without EPMs. It is therefore assumed that no regular inspections are being conducted at present. In terms of environmental issues, it is fortunate that almost no work is being carried out on site on these two contracts.
35. The Engineer’s Environmental Specialist has made visits to all construction sites during the reporting period.
36. The Executing Agency has made a number of ad hoc visits to site as required.

D. Non-Compliance and Corrective Actions
Section A
37. Since the previous reporting period, very little work has been carried out by the Section A Contractor, and no progress has been made on environmental issues. There has been no EPM for the majority of the reporting period, and, despite several requests, no updated SSEMP has been provided. In terms of environment, at least, it is somewhat fortunate that no construction works have been carried out.
38. During a June 2013 site visit by the Engineer’s Environmental Specialist, a number of non-compliances were noted on Section A, as follows:
• A mixture of clay and concrete generated by piling activities was observed to have been discharged into a ditch adjacent to the works;
• Open burning was observed at the new Contractor’s camp;
• None of the vehicles carrying material excavated from the Shovu borrow pit were observed to be covered by a compliant tarpaulin for prevention of dust generation;
• No bowser trucks were carrying out dust suppression at working areas;
• The EPM is not currently provided with a vehicle with which to inspect the various working sites.
39. The above visit by the Engineer’s Environmental Specialist was followed up a week later by an inspection by the Executing Agency’s Safeguards Specialist. The following non-compliances were noted on Section A:
• Hygiene issues and general lack of cleanliness in the kitchen, including unacceptable food storage;
• Lack of appropriate uniforms for site workers;
• Fencing is required at connections with local roads;
• Toilet facilities required servicing;
• General site clean-up is required;
• Signs should be installed at the entrance to site;
• Gas tank arrangements require improvement;
• No tarpaulins were present on trucks transporting fill material.
40. The Contractor’s EPM and Project Manager were made aware of the above issues requiring immediate action during the site visit, followed up with an official letter demanding appropriate corrective action.
41. A site visit towards the end of the present reporting period confirmed that only one of the above issues have been addressed by the contractor; the ditch adjacent to the piling works at the start of Section A had been cleaned up.
42. A further problem area was noted during the November visit by the EPM; the diversion road at the start of Section A, previously reported on as causing dust during the summer,

was heavily rutted and potholed, causing unacceptable levels of disruption to road users. A letter was sent to the contractor requesting that the diversion road be restored to an acceptable quality.

Lenkaran Bridge
43. During a site visit by the Engineer’s Environmental Specialist in June 2013, the previously high standards of environmental management were observed to have slipped considerably. The following non-compliances were noted, all of them bar one at the Contractor’s camp:
• Wheel washing facilities had still not been installed at the entrance of the Contractor’s camp.
• Noise barriers had still not been installed along the perimeter of the Contractor’s camp.
• The Contractor’s camp was generally untidy, with much discarded waste and numerous patches of leaked oil.
• The hazardous waste storage area bunding was ruptured, and the pipe leading to the collection tank was leaking.
• The drainage system at the workshop area was blocked and poorly maintained.
• Fire-fighting equipment was old and safety inspection certifications are expired.
• Accommodation arrangements for workers at the contractor camp had deteriorated considerably.
• No watering trucks were observed to be carrying out dust suppression along access roads.
• Waste materials from the bridge construction were discarded alongside the river bank.
44. The Contractor’s EPM and Project Manager were made aware of the above issues requiring immediate action during the site visit, followed up with an official letter demanding appropriate corrective action.
45. A recent site visit determined that none of the above non-compliances have been addressed. A follow-up letter has been issued to the contractor, who is now without an EPM.

E. Consultations and Complaints
Section A
46. During the present reporting period it is expected that no public consultations took place due to the lack of EPM on site.
47. Likewise, no grievances have been reported to the Engineer, as the usual mechanism for reporting is via the Quarterly Reports, which have not been submitted by the Contractor. A summary of the grievances to date and how they were resolved is provided in Table 2 overleaf.
Lenkaran Bridge
48. It is not known whether any public meetings have been held in the reporting period for the Lenkaran Bridge contract. Although the EPM resigned towards the end of the reporting period, no quarterly reports were submitted during the past six months, so the status is unclear.
49. Likewise, no grievances have been reported, as the usual mechanism for reporting is via the Quarterly Reports, which have not been submitted by the contractor. A summary of the grievances to date and how they were resolved is provided in Table 3 overleaf.

F. Emerging Issues
50. No emerging issues are reported.
G. Conclusions
51. The previous Biannual Report highlighted the urgent work required by both Section A and Lenkaran Bridge contractors to bring their projects back into compliance with respect to environmental issues. For Lenkaran Bridge the requirements were site-based only, whereas for Section A the work needed was both site-based and also a significant SSEMP update.
52. Unfortunately, instead of the present reporting period showing improvements on Section A and Lenkaran Bridge, there has in fact been a further deterioration in environmental management, due principally to the resignations of both contractors’ EPMs. The Engineer has sent letters to the contractors to remind them of their obligations, and it is hoped that the situation on these two contracts will be remedied in the near future.
