NOTICE INVITING BIDS

The Inyo County Information Services Division is soliciting bids for:

NETWORK WIRING FORMER COUNTY SCHOOLS FACILITY

Bid Packages, which include the Notice Inviting Bids, Bid Proposal Forms, Contract and

Bond Forms, Special Provisions, and Plans, may only be obtained from the Inyo County

Information Services Division, 168 North Edwards, P. O. Box 477, Independence, CA

93526, telephone (760) 878-0398. Bid Packages are available for inspection at the

Department offices during regular business hours.

Bids must be submitted in a sealed envelope clearly marked with the bidder's name

and address, the word "BID", and the Project Title -


To be considered, bids must be received by the Inyo County Clerk of the Board of

Supervisors, 224 North Edwards Street (mailing address: P.O. Box N),

Independence, California 93526 at or before 3:30p.m. on April 21, 2008 at which

time they will be publicly opened and read. No oral, telegraphic, telephonic, or fax

proposals or modifications will be accepted.

General Work Description: The work to be done generally consists of installing,

terminating and certifying Category 5e Ethernet cabling in an existing County of Inyo

occupied facility in Independence, California. In addition the project may include core

drilling, installation of conduit/cable raceway, equipment racks and light finishing

carpentry as necessary to maintain the aesthetics of the facility relative to the installation.

Work to be performed as required by, and in accordance with, the Contract Documents

and to be completed within 21 calendar days of the date specified in the Notice to

Proceed, subject to adjustments provided for in the Contract Documents. All work shall

be in accordance with all applicable Federal, State, and Local laws, codes, and

regulations.

Plans and specifications have been prepared for the facility impacted by the project.

Each bid is required to include an individual Bid Sheet for the facility in accordance with

the Bid Proposal forms and the other Contract Documents.

The County reserves the right to, and shall, award the contract for the facility based on

the Bid Proposal which the County, in its sole discretion, determines at the time of the

award to be in the County’s best interest.

Bids shall conform to and be responsive to the Contract Documents. Each Bid must be

submitted on the Bid Proposal Forms furnished as part of the Bid Package.

A mandatory pre-bid job walk through is scheduled for April 14, 2008 8:30 AM.

Each Bid must be submitted on the Bid Proposal Forms furnished as a part of the Bid

Package. Each Bid must be accompanied by a Proposal Guarantee in the amount and

form described in the Bid Package, in an amount not less than 10% of the amount of the

bid, made payable to the order of the County of Inyo. The check or bond shall be given

as security that the bidder will enter into the Contract with the County and furnish the

required Labor and Materials Payment Bond, Faithful Performance Bond, certificates

and/or original endorsements of insurance, or other required documents. The check or

bond may be retained by the County for one hundred eighty (180) days or until the

Contract is fully executed by the successful bidder and the County, whichever first

occurs.

The successful bidder shall be required to furnish a Labor and Materials Payment Bond

and a Faithful Performance Bond on the forms provided in the Bid Package and in the

amount of 100% of the Contract amount.

The successful bidder must be licensed as required by law, and consistent with the

Contract Documents, at the time the contract is awarded, which license shall be a current

California Class C-7 Contractor's license or a combination of all specialty classifications

that will be required for the complete performance of all of the work in accordance with

the Contract Documents, and, if applicable, a joint venture license as defined in the

Business and Professions Code Section 7029. Failure of the bidder to obtain proper and

adequate licensing for an award of a contract shall constitute failure to execute the

contract and shall result in the forfeiture of the security of the bidder.

In addition to the requirements set forth in this Notice Inviting Bids, all bids shall be

subject to the requirements set forth in the Special Provisions, Standard Specifications of

the Inyo County Public Works Department, March, 1997 (Standard Specifications),

Contract Documents and other applicable law.

The Contract is subject to the State Contract nondiscrimination and compliance

requirements pursuant to Government Code Section 12990 and other applicable law.

The Contract is also subject to and incorporates by reference the provisions of Public

Contract Code section 22300, pursuant to which, the Contractor is permitted to

substitute securities for earned retention or have them placed in escrow at the Contractor's

expense, as also set forth in Section 1150.15 of the Standard Specifications.

Pursuant to Section 1773 of the Labor Code, to which this Contract is subject, the

prevailing wage per diem rates in Inyo County have been determined by the Director of

the State Department of Industrial Relations. These wage rates appear in the Department

of Transportation publication entitled "General Prevailing Wage Rates," in effect at the

time the project is advertised. Future effective wage rates which have been predetermined

and are on file with the State Department of Industrial Relations are referenced but not

printed in said publication. Such rates of wages are also on file with the State Department

of Industrial Relations and the offices of the Public Works Department of the County of

Inyo and are available to any interested party upon request.

Inyo County reserves the right at any stage of these proceedings to reject any or all Bids

or to waive any immaterial defect in any Bid if it is deemed to be in the best interest of

the County.

The definition and meanings of the words used in this Notice Inviting Bids are the same

as set forth in Section 1070 "Abbreviations, Symbols, and Definitions "of the Standard

Specifications of the Inyo County Public Works Department, March, 1997.

This Bid includes all costs for all labor, materials, tools, taxes, insurance, transportation, and other related functions to perform all work as required by, and in accordance with, the Contract Documents for the NETWORK WIRING FORMER COUNTY SCHOOLS FACILITY project. This Bid includes, but separately identifies and sets forth, all such costs for each facility: In submitting this Bid, it is understood that: 1. The Notice Inviting Bids; these Bid Proposal Forms; the Contract and Bond Forms; the

Special Provisions; the Standard Specifications of the Inyo County Public Works Department, dated March 1997; and the Plans, including any documents incorporated therein, are to be considered complementary and are incorporated herein by reference and made a part hereof with like force and effect as if all of said documents were set forth in full herein. All of said documents, which include these Bid Proposal Forms, are referred to collectively as the Contract Documents and shall constitute the Contract between the parties which will come into full force and effect upon acceptance, approval and execution by the Inyo County Board of Supervisors.

Insurance and the required documents as described in the Contract Documents.

In submitting this Bid, the Contractor has familiarized itself with the Bid Package, which includes the Notice Inviting Bids, the Bid Proposal Forms, the Contract and Bond Forms, the Special Provisions, the Standard Specifications of the Inyo County Department of Public Works, dated March 1997, and the Plans. Contractor further agrees in this Bid to perform all the work in accordance with the Contract Documents within 21 calendar days as required in Section 1017.071, "Time of Completion," of the Special Provisions. The undersigned has/have checked carefully the following figures and understand(s) that the County of Inyo will not be responsible for any errors or omissions on the part of the undersigned in making this Bid. Attached as a part of this Bid is a Bid Bond from an admitted corporate surety on the form provided in the Bid Package, or cashier's or certified check, in the amount of at least 10% of the Bid, concerning which it is agreed, pursuant to the Notice Inviting Bids and the Bid Proposal Forms, the Bid Bond or other bidder’s security shall be retained by the County if the undersigned fails to execute the Contract or furnish the required bonds, Certificates of Insurance, or other required documents within fifteen (15) calendar days after written notice of the Award of Contract. If the Notice Inviting Bids and the Bid Proposal Forms require or permit each bid to include two or more alternates, the amount of the Bid Bond or check must be not less than 10% of the amount of the bid submitted for the alternate having the highest total bid amount. Further, if alternates are so included, County reserves the right to, and shall, award the contract for that alternate or alternates which the County, in its sole discretion, determines at the time of award to be in the County's best interest. Also attached as a part of this Bid are the Bid Proposal Form, Bid Schedule, Bid Bond, Cashier’s or Certified Check Form, Designation of Subcontractors, Certification Regarding Equal Employment Opportunity, Contractor’s Labor Code Certification, Noncollusion Affidavit, Public Contract Code Section 10162 Questionnaire, and Public Contract Code Statement (Section 10232). These documents have been completed and signed as required on the forms provided in the Bid Package. The Bidder’s signature on this proposal constitutes an endorsement and execution of each and every certification and declaration, which is obtained in these documents. The meanings of words used in these Bid Proposal Forms are the same as set forth in Section 1070, “Abbreviations, Symbols, and Definitions,” of the Standard Specifications of the Inyo County Public Works Department, dated March 1997.

ACCEPTANCE: The County reserves the right to reject this Bid. However, this Bid shall remain open and shall not be withdrawn for a period of forty-five (45) calendar days from the date set for its opening. If written notice of the acceptance of this Bid is mailed, or delivered to the undersigned within forty-five (45) calendar days after the date set for its opening, or at any other time thereafter before it is withdrawn, the undersigned will execute and deliver the Contract, bonds, Certificates of Insurance, and other required documents to the Owner within fifteen (15) calendar days after receipt of the Notification of Acceptance of this Bid (Notification of Award of Contract). The Bidder shall set forth, for each unit basis item of work, an item price and a total for the item; and, for each lump sum item, a total for the item; all in clearly legible figures in the respective spaces provided for this purpose. In the case of unit basis items, the amount set forth under the "Total" column shall be the extension of the item price bid on the basis of the estimated quantity for the item. The amount of the bid, for comparison purposes, will be the total of all items. In case of discrepancy between the item price and the total set forth for a unit basis item, the item price shall prevail, provided, however, if the amount set forth as an item price is omitted, or is the same amount as the entry in the “Total” column and it is apparent that the amount is not

an item price, then the amount set forth in the “Total” column for the item shall prevail and shall be divided by the estimated quantity for the item and the price thus obtained shall be the item price. The undersigned, as bidder, declares that the only persons or parties interested in this proposal as principals are those named herein; that this proposal is made without collusion with any other person, firm, or corporation; that he/she has carefully examined the location of the proposed work, the Contract and bond forms, and the Plans therein referred to; and he/she proposes, and agrees if this proposal is accepted, that he/she will contract with the County of Inyo, on the Contract form provided in the Bid Package, to provide all necessary machinery, tools, apparatus, and other means of construction, and to do all the work and furnish all the materials specified in the Contract, in the manner and time therein prescribed, and according to the requirements as therein set forth, and that he will take in full payment therefore the following item prices:

INYO COUNTY INFORMATION SERVICES NETWORK WIRING FORMER COUNTY SCHOOLS FACILITY

SPECIAL PROVISIONS

INTRODUCTION / GENERAL:

The Network Wiring Former County Schools Facility (Project), a public works project of Inyo County, is to be constructed and completed in accordance with these Special Provisions, the Project Plans, and, insofar as they are referenced herein, the Standard Specifications of the Inyo County Public Works Department dated March, 1997 (Standard Specifications). The Special Provisions, the Project Plans, and the sections of the Standard Specifications referenced herein, constitute a portion of the “Contract Documents” (as that term is defined in Section 1070.04 of the Standard Specifications) governing the project and shall therefore be binding upon and observed by the person/entity with whom the County of Inyo enters into a contract for construction of the Project. Copies of the Project Plans and the Standard Specifications may be obtained from the Inyo County Information Services Division in Independence, California. Unless indicated otherwise, all references in this document to sections are to those in the Standard Specifications (designated by “SS” following the section number) or to other sections in these Special Provisions. In case of any irreconcilable conflict between the requirements of the Standard Specifications referenced herein and these Special Provisions, the latter shall prevail and be observed.

PROJECT DESCRIPTION:

The work to be done generally consists of installing, terminating and certifying Category 5e Ethernet cabling in an existing County of Inyo occupied facility in Independence, California. In addition the project may include core drilling, installation of conduit/cable raceway, equipment racks and light finishing carpentry as necessary to maintain the aesthetics of the facility relative to the installation. Work to be performed as required by, and in accordance with, the Contract Documents and to be completed within 30 calendar days of the date specified in the Notice to Proceed, subject to adjustments provided for in the Contract Documents. All work shall be in accordance with all applicable Federal, State, and Local laws, codes, and regulations.

SECTION 2008.001 – True/Level of installed conduit All installed conduit must be true and/or level as measured by a standard, appropriately sized carpenter’s level. SECTION 2008.002 – Conduit Fixture Joins All conduit joins, raceway-to-raceway and raceway-to-surface mount housing shall be sealed with clear silicone sealant or appropriate coupler. SECTION 2008.003 – Surface Mount Housing Location The surface mount CAT5e jack housings are to be mounted such that the top of the housing is 15” from the floor.

SECTION 1017.07 - TIME FOR COMPLETION AND PAYMENTS TO COUNTY

FOR DELAY.

SECTION 1017.071 - TIME FOR COMPLETION

The Contractor shall complete all designated portions of the work required under the Contract no later than thirty (30) calendar days from and including the Starting Date, plus such additional days, if any, which are expressly granted as extensions of time by Contract Change Orders signed and issued by the County. Such total number of days shall be referred to herein as the “Time For Completion.” Failure of the Contractor to perform any covenant or condition contained in the Contract Documents within the time period specified shall constitute a material breach of this Contract entitling the Owner to terminate the Contract unless the Contractor applies for, and receives, an extension of time in accordance with the procedures set forth in Section 1017.09 SS, “EXTENSION OF TIME.”

SECTION 1017.073 - LIQUIDATED DAMAGES

In accordance with Government Code, Section 53069.85, the Contractor shall pay to the County of Inyo liquidated damages in the amount of: $100.00 per day for each and every calendar day delay in finishing work in excess of the Time for Completion specified herein. The County shall be entitled to deduct the amounts of liquidated damages from any payment otherwise due to the Contractor.

AMENDMENT TO COUNTY OF INYO STANDARD SPECIFICATION, MARCH

1997

The County of Inyo Standard Specification, March 1997 is amended for the NETWORK WIRING FORMER COUNTY SCHOOLS FACILITY as follows: Section 1070.04 DEFINITIONS The definition of Engineer is amended to read: Officers or employees of the County of Inyo, Information Services Division, 168 N. Edwards Street, Independence, California 93526, 760-878-0245, expressly designated in writing by the county to act as such with regard to the contract. Section 1010.09 PLANS AND SPECIFICATIONS FURNISHED BY THE COUNTY Section 1010.09 is amended in its entirety to read: The County will furnish to the Contractor free of charge all copies of Plans and Specifications reasonably necessary up to ten (10) sets for the execution of the Work. The Contractor shall keep one set of Plans and Specifications in good order available to the Engineer at the site of the Work. Section 1015.9 RECORD DOCUMENTS Paragraph 1 of Section 1015.9 is amended to read: The County shall provide the Contractor with one complete set of the Contract Bid Package to be used as reference in preparing "Record Documents." Paragraph 2 of Section 1015.9 is ameded to read: No later than the fifteenth (15th) day of each month, the Contractor shall annotate the documents comprising the Contract Bid Package, and shall legibly and accurately show on them any and all changes, deletions, and additional information incorporated into the Work during the preceding month. When so annotated these documents and plans become the "Record Documents." Copies of the "Record Documents" showing such changes and additions in the Work and additional information from the previous month shall be submitted to the Engineer no later than said fifteenth (15th) day of each month, or as otherwise agreed upon by the County in writing. Section 1017.14 COUNTY ACCEPTANCE AND NOTICE OF COMPLETION; COMPLETION DATE AND ACCEPTANCE DATE Paragraph 1 of Section 1017.14 is amended to read: Upon the completion of Engineer's Final Inspection report and submission of the Contractor's unconditional Certification of Completion, together with required supporting

documents, the Information Services Manager shall promptly make a written recommendation to the County for acceptance of the Project as being complete and authorizing the County’s agent to verify, sign, and cause to be recorded, a Notice of Completion, in accordance with applicable law, including, without limitation, Civil Code

Sections 3086 and 3093.

SECTION 700 - INSURANCE, DEFENSE AND INDEMNIFICATION.

Bidders’ attention is directed to the insurance requirements designated below. It is

highly recommended that bidders confer with their respective insurance carriers or

brokers to determine in advance of bid submission the availability of insurance

certificates and endorsements as prescribed and provided herein. If an apparent low

bidder fails to comply strictly with the insurance requirements, that bidder may be

disqualified from award of the Contract and the bidder's bid security may be

forfeited.

Contractor shall procure and maintain, for the duration of the Contract, insurance against claims for injuries to persons or damages to property which may arise from or in connection with the performance of the work hereunder by the Contractor, its agents, representatives, employees or subcontractors. The cost of such insurance shall be included in the Contractor's bid.

702 MINIMUM SCOPE OF INSURANCE:

A. Commercial General Liability. Contractor shall procure and maintain during the entire term of this Agreement a policy of Commercial General Liability Insurance which includes blanket contractual liability, broad form property damage, products/completed operations, and personal injury coverages. Coverages shall be at least as broad as: 1. Insurance Services Office Commercial General Liability coverages (occurrence

Form CG 0001).

2. Insurance Services Office Form (G0009 11 88 Owners and Contractors Protective Liability Coverage Form – Coverages for Operations of Designated Contractor).

3. Insurance Services Office Form Number CA 0001 covering Automobile Liability,

code 1 (any auto).

4. Workers’ Compensation insurance as required by the State of California and Employer’s Liability Insurance.

5. Course of Construction insurance covering all risks of loss.

703 MINIMUM LIMITS OF INSURANCE:

Contractor shall maintain limits of no less than:

1. General Liability (including operations, products and completed operations): $1,000,000 per occurrence for bodily injury, personal injury and property damage. If Commercial General Liability insurance or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to this project/location or the general aggregate limit shall be twice the required occurrence limit.

2. Automobile Liability: $1,000,000 per accident for bodily injury and property

damage.

3. Employer’s Liability: $1,000,000 per accident for bodily injury or disease. 4. Course of Construction: Completed value of the project with no coinsurance

penalty provisions.

704 DEDUCTIBLES AND SELF-INSURED RETENTION:

Any deductibles or self-insured retention must be declared to and approved by the County. At the option of the County, either the insurer shall reduce or eliminate such deductibles or self-insured retention as respects the County, its officers, officials, employees and volunteers; or the Contractor shall provide a financial guarantee satisfactory to the County guaranteeing payment of losses and related investigations, claims administration, and defense expenses.

705 OTHER INSURANCE PROVISIONS:

The general liability and automobile liability policies are to contain, or be endorsed to contain the following provisions:

1. The County, its officers, officials, employees and volunteers are to be covered as insureds with respect to liability arising out of automobiles owned, leased, hired or borrowed by or on behalf of the contractor; and with respect to liability arising out of work or operations performed by or on behalf of the Contractor including materials, parts or equipment furnished in connection with such work or operations. General liability coverage can be provided in the form of an endorsement to the Contractor’s insurance, or as a separate owner’s policy (CB 20 10 11 85).

2. For any claims related to this project, the Contractor’s insurance coverage shall be

primary insurance as respects the County, its officers, officials, employees, and volunteers. Any insurance or self-insurance maintained by the County, its officers, officials, employees or volunteers shall be in excess of the Contractor’s insurance and shall not contribute with it.

3. Each insurance policy required by this clause shall be endorsed to state that

coverage shall not be canceled by either party, except after thirty (30) days prior written notice by certified mail, return receipt requested, has been given to the County.

4. Coverages shall not extend to any indemnity coverage for the active negligence of

the additional insured in any case where an agreement to indemnify the additional insured would be invalid under Subdivision (b) of Section 2782 of the Civil Code.

Course of construction policies shall contain the following provisions:

1. The entity shall be named as loss payee. 2. The insurer shall waive all rights of subrogation against the County.

706 ACCEPTABILITY OF INSURERS:

Insurance shall be placed with insurers with a current A.M. Best's rating of no less than A.

707 VERIFICATION OF COVERAGES:

Contractor shall furnish the County with original Certificates and amendatory endorsements effecting coverages required by this clause. The endorsements should be on forms provided by the County or on other than the County’s forms, provided those endorsements or policies conform to the requirements. All Certificates and endorsements are to be received and approved by the County before work commences by mailing or delivering the same to the County of Inyo, Attention: Risk Manager, P. O. Drawer “N”, Independence, California 93526. The County reserves the right to require complete, certified copies of all required insurance policies, including endorsements effecting the coverage required by the specifications at any time.

708 SUBCONTRACTORS:

Contractor shall include all subcontractors as insureds under its policies or shall furnish separate Certificates and endorsements for each subcontractor to the County for review and approval. All coverage for subcontractors shall be subject to all of the requirements stated herein.

709 DEFENSE AND INDEMNIFICATION:

Contractor shall defend, indemnify and hold harmless the County, its agents, officers, and employees from and against all claims, damages, losses, judgments, liabilities, expenses and any other costs, including litigation costs and attorney’s fees, arising out of, resulting from, or in connection with the performance of this Contract by Contractor, or Contractor’s agents, officers, employees or subcontractors. Contractor’s obligation to defend, indemnify and hold the County, its agents, officers, and employees harmless applies to any actual or alleged personal injury, death, or damage or destruction to tangible or intangible property, including the loss of use. Excepting only those liabilities, claims, and damages caused solely and exclusively by the active fault or negligence of the County, the Engineer, or their officers, agents, or employees, Contractor’s obligation under this paragraph extends to any claim, damage, loss, liability, expense or any other cost which is caused in whole or in part by any act or omission of the Contractor, its agents, employees, subcontractors, suppliers, or anyone directly or indirectly employed by any of them, or anyone for whose acts or omissions any of them may be liable. Contractor’s obligation to defend, indemnify and hold the County, its agents, officers, and employees harmless under the provisions of this paragraph is not limited to or restricted by any requirement in this Contract for Contractor to procure and maintain a policy of insurance.

710 CONTRACTOR’S LIABILITY NOT LIMITED BY INSURANCE:

Nothing contained in the insurance requirements is to be construed as limiting the liability of the Contractor or the Contractor’s sureties.

1] Install fifty-five (55) 4-port Side Exit CAT5e Surface Mount Housings (NW05A-

04) including CAT5e Jacks (NW05A-05) and four (4) CAT5e cable runs

(NW05A-99) from each housing to the Dmarc (refer to drop location map for

locations).

2] Terminate the cable runs to the appropriate locations on the newly installed patch

panels.

3] Certify (NW05A-70) all CAT5e cable runs.

4] Install appropriate Surface Raceway and Fittings for each Surface Mount Housing

installation.

5] Install three (1) Telco Splice Blocks (NW05A-80) on wall at Telco Dmarc (see

drop location map).

6] Install/terminate Telco trunk cable (NW05A-85) between Telco Splice Blocks

and newly installed patch panels (single pair per jack). Label phone patch panel

PH01 thru PH48.

7] Verify (NW05A-81) all Telco cable runs.

8] Request and secure facility work sign-off from County of Inyo Information

Services.
